Sub.: Legal Notice – Deficiency of Service – Partial Treatment of


Customer – Humiliation – Reg.

I, --------, S/o Mr. -------, residing at No. -------- do hereby issue this
following legal notice to you;

1. I state that on 13 th May, 2022, were travelling toward Chennai, my four


friends and I had visited the Perundurai Branch of Hotel Junior
Kuppanna (hereinafter, “Perundurai Branch”) around 3.30 PM to have
our lunch in your hotel.

2. I state that at the time of entering your Perundurai Branch, the hotel
was empty and my companions and I were the only group at that time
to enter the hotel. I further state that the temperature at your
Perundurai Branch was extremely hot and considering the heat wave
and climatic changes, I requested the employees of your Perundurai
Branch to turn on the air conditioner. In response, the employees
stated that they will turn on the air conditioner within 2 minutes and
the employees of your Perundurai Branch asked us to order food.
Thereafter, we placed our order with the bearer and the food arrived
only after an inordinate delay. I further state that on considering the
time had been extended the usual lunch hours, I overlooked the delay
in arrival of the food.

3. I state that after I have ordered food, the employees of your Perundurai
Branch turned on a table fan which was sufficient for only two people
at our table. After repeated requests as I was perspiring a lot, the
employees of your Perundurai Branch turned on a pedestal fan, which
was producing a scratchy noise and therefore, we experienced an
extremely unpleasant environment at your Perundurai Branch.

4. I state that during the entire time of my presence in your Perundurai


Branch to have my lunch, despite repeated requests the employees of
your Perundurai Branch did not turn on the air conditioner but gave all
sort of lame excuses and purposefully neglected my words, left with no
other option as to me and my other companion were starving we have
decided to eat quickly and go out of the hotel as soon as possible. I
further state that at the time of finishing my lunch, another group of
customers entered to have their lunch, and to my shock and surprise,
the employees of your Perundurai Branch turned on the air conditioner
without even any insistence from them.

5. I state that when I asked the employees “why can’t you turn on the air
conditioner for us even though we are your customers?”, the employees
were speechless. I further state that I stated to the employees that I
shall not pay any charges towards air conditioner in the final bill as I
did not avail the service of air conditioner from the hotel and I will pay
only the amount towards food and GST. I further state that the
employees of your Perundurai Branch did not accept such payment,
and I left with no other option, paid the entire bill amount of Rs. 1670/-
(Rupees One Thousand Six Hundred Seventy Only) in Bill No: AC –
3690.

6. I state that though I believed in your customer service and your


goodwill, to my dismay, I only experienced the unprofessional conduct
and actions of your employees and partial treatment and miserable
experience at your Perundurai Branch.

7. I further state that due to climatic conditions in India, the majority of


the customers who visit hotels wish to enjoy their meal with air
conditioning facilities. Needless to say that the climatic condition in the
month of May was extremely hot, and I state that even though I wished
to have a peaceful lunch, I was totally disheartened by the way I was
treated in your Perundurai Branch.

Therefore, through this legal notice, I call upon you to:

i. tender an open and unconditional apology to me within 48 (forty-


eight) hours from receipt of this notice;
ii. pay an amount of Rs. 5,00,000/- (Rupees Five Lakhs Only), as
compensation for my mental agony, humiliation and deficiency in
service that I had experienced, within 15 days from the receipt of
this notice;

failing which I will be constrained to take appropriate civil and criminal


proceedings before the Court of Law against you, by holding you liable
for all costs and consequences arising therefrom without any further
communication in this regard.
