FOR: PROTEST ON THE GROUND

OF ERRONEOUS CARP COVERAGE

PETITION

COME NOW, the PROTESTANT and unto this Honorable Office, most respectfully
aver THAT:

1. Protestant is of legal age, Filipino and with postal address at Vilma Lane,
Marasbaras, Tacloban City, Leyte, Philippines, where she may be served with
summons, notices and other processes of this Honorable Office;

2. Subject landholding is designated as Lot No. 1757, Psc-15, containing a total area of
Three Hundred Two Thousand Four Hundred Eighty (302,480) square meters, more
or less, located at Brgy. Patong, Alangalang, Leyte.

3. That through the implementation of the Comprehensive Agrarian Reform Program

(CARP), subject landholding was covered and documented as UNTITLED
PROPERTY. As a consequence, Original Certificate of Title No. OC-19606 with
the Office of the Registry of Deeds for the Province of Leyte, in the name of Karen
A. Maraya, et. al., pursuant to a Certificate of Land Ownership Award (CLOA). A
copy of the said CLOA is hereto attached and marked as Annex “A” and made an
integral part of this protest;

4. That subject landholding was already titled in the name of SPS CRESCENTE
MARAYA, SR. and CONSORCIA MARAYA prior to the coverage under the MC
14 & 19 Scheme, a copy of the title is hereto attached and marked as Annex “B”,

5. That petitioner is one of the children of SPS CRESCENTE MARAYA, SR. and
CONSORCIA MARAYA and one (1) of the farmer beneficiaries of the above-
mentioned CLOA;

6. That petitioner came to know that there was an error in the documentation process
of the subject landholdings and was advised to file a Protest,

7. That it is clear therefore that the documentation proceeding of Lot No. 1757 as
untitled property was erroneous, and that, the generation issuance and registration of
Original Certificate of Title No. OC-19606 was void ab initio.

PRAYER
 WHEREFORE, premises considered, it is most respectfully prayed of this
Honorable Office that an ORDER be issued:

1. DECLARING the CARP coverage of Lot No. 1757, with Original Certificate
of Title No. OC-19606 with an area of 302,480 Square Meters, CLOA No.
00046409, located at Brgy. Patong, Alangalang, Leyte in the name of Karen
A. Maraya. et. al. as ERRONEOUS and VOID AB INITIO;

2. ORDERING the CANCELLATION of the above-mentioned Certificate of

Land Ownership Award (CLOA), and

3. DIRECTING the Register of Deeds for the Province of Leyte to effect the
Cancellation of the above-mentioned CLOA.

Protestants further pray for such other relief just and equitable in and about the
premises.

STATEMENT
 I, VIRGINIA MARAYA HIDALGO, Filipino, of legal age, married and resident of
Vilma Lane, Marasbaras, Tacloban City, Leyte, Philippines, respectively after having been duly
sworn to in accordance with law, do hereby deposes and states:

1. That I am the party-in-interest being the Protestant of the herein Petition for Cancellation;

2. That I have caused the preparation and filing of said Protest involving a parcel of land
with CLOA No. 000464091 located in Brgy. Patong, Alangalang, Leyte;

3. That I have not commenced and/or aware of any action or proceeding involving the same
land, or a portion thereof, or issue in any court, tribunal, or quasi-judicial agency; and to
the best of my knowledge, no such action or proceeding is pending in any court, tribunal,
or quasi-judicial agency

4. That if there is any action or proceeding which is either pending or may have been
terminated, I shall state the status thereof; and

5. That if I have thereafter learn that a similar action or proceeding has been filed or is
pending before any court, tribunal or quasi-judicial agency, I undertake to report within
five (5) days therefrom to the DAR office where the said ALI case is pending;

6. That I have understood the allegations contained therein and the same are true of my own
personal knowledge.
