“A RESOLUTION RECOMMENDING TO THE DIRECTOR, MARITIME


GROUP THE RETENTION IN THE PNP SERVICE AND THE
CONTINUATION OF TRAINING OF Patrolman Neil Mark Lagua Cruz
WITH BADGE NO. 353201

WHEREAS, R.A. No. 8551 provides that all uniform members of the PNP
shall undergo a Field Training Program for 12 months involving actual experience
and assignment in patrol, traffic and investigation as a requirement for permanency
of appointment in the police service;
WHEREAS, NAPOLCOM Memorandum Circular (NMC) No. 2007-009 was
promulgated providing for the procedures and guidelines in the recruitment, selection
and appointment of PNP Uniformed personnel and termination of service of newly
appointed patrolman/patrolwoman while still in temporary status;
WHEREAS, Police Trainee Neil Mark L Cruz (Pat Cruz) was appointed in the
Philippine National Police as Patrolman under temporary status pursuant to Special
Order No. MG-SO-PA-2020-529 with a monthly salary of Twenty-Nine Thousand Six
Hundred Sixty- pesos (PhP29,668.00) effective September 13, 2020. He was then
included in the MG Masidlakan Class 2020-03. Said class is undergoing Public
Safety Field Training Program (PSFTP) at Barangay Osorio, Trece Martires, Cavite
City;

WHEREAS, on April 26, 2021, a complaint was lodged against him by Ms


Janel Mangulad regarding her revived criminal case against Pat Cruz for Violation of
Republic Act (RA) No. 9262 1 (Psychological Violence). The said criminal case was
filed at Branch IV, Regional Trial Court (RTC) of Tuguegarao City, Cagayan. Ms
Mangulad, then personally appeared at RSTU 4A, Camp Vicente Lim, Calamba City
and stated that she had a relationship with Pat Cruz for almost five years which
resulted to their one common child. She emphasized that Pat Cruz caused her
emotional pain which led to her disgrace, agony and sleeplessness nights primarily
due to the respondent’s refusal to fulfill his promise to marry;

WHEREAS, immediately RSTU 4A conducted an investigation and found


probable cause2 that Pat Cruz violated Section 9-4 para (a), 1(d) “Conduct
Unbecoming of Officers and Non-officers whether gentlemen or ladies that are
prejudicial to good order and discipline” of the Training Administrative Manual.

Consequently, the RSTU4A Training Board on May 10, 2021, resolved to
terminate the training of Pat Cruz 3. He was then ordered to return to his unit (MG)
pursuant to SO No. 05-145-2021;

WHEREAS, on May 12, 2021, after Investigation of MG, Pat Cruz was
formally charged for violation of Section VII para A sub p(1)(B) of PNP MC 2017-035
(Lack of Aptitude in Service), in relation to NMC No. 2007-009. Said case was
docketed under TPC No. 024-051221. Subsequently, respondent was summoned
and directed to submit his Answer in affidavit form accompanied by documentary
evidence in support of his defense;

WHEREAS, this Termination Board generally looked in disfavor the retraction


of testimonies previously given by affiants. However, after careful deliberation, this
Termination Board considered the reconciliation of the two parties’ as well as the
well-being of their child. This Termination Board recognizes the family as the basic
foundation of the nation, its solidarity should be strengthened and the State should
promote its development as provided and protected by the Philippine Constitution.
This Board is of the view that the subsequent reconciliation and the dismissal of the
criminal case against respondent had rendered the instant case moot and academic;

WHEREAS, in view of the foregoing, the undersigned members of the


Termination Board found Pat Neil Mark L Cruz’s fitness to remain as member of the
Philippine National Police and be allowed to join the next batch of Field Training
Program for police recruits;

NOW, THEREFORE, BE IT RESOLVED, as it is hereby resolved to


recommend to the Director, Maritime Group that Pat Neil Mark Cruz to remain in the
PNP Service and continue his training.

SO RECOMMENDED.
