Ang Tibay vs.

Court of Industrial Relations February 27, 1940 Facts: Toribio Teodoro claimed that there was a shortage of leather soles in Ang Tibay, which resulted to the laying off of some of the members of the National Labor Union Inc. The National Labor Union claims that this is entirely false and unsupported by documents for the Customs. They say that it was only Teodoro s scheme of discharging all the members of the National Labor Union from work, since he favors the National Worker s Brotherhood (a company union dominated by Teodoro himself). The National Labor Union prays that the case be remanded to the Court of Industrial Relations for a new trial. Issues: WON the Motion for New Trial should be granted Held: Yes. Ratio: The Court of Industrial Relations is a special court. It shall take cognizance for purposes of prevention, arbitration, decision and settlement, of any industrial or agricultural dispute. It should be free from rigidity of certain procedural requirements but it doesn t mean that they should ignore the fundamental requirements of due process in trials. Cardinal primary rights! (close your eyes and recite this XD) a. Right to a hearing right of a party to present his own case and submit evidence b. The tribunal must consider the evidence. c. It must have something to support its decision. d. The evidence must be substantial. (~relevant; adequate to support a conclusion) e. The decision must be rendered on the evidence presented at the hearing. f. It must act on its own independent consideration of law and the facts of the controversy. g. It should render its decision in such a manner that the parties can know the issues and reasons for the decisions rendered. The record is barren and doesn t satisfy the thirst for a factual basis. The movant is given the opportunity to present documents referred in his motion and other evidence relevant to the issues. Case is remanded to receive more evidence.
