SUBJECT : Memorandum of Agreement (MOA) and Terms of Reference (TOR)


for the Post-Residency Deployment Program (PRDP) Implementation
under the National Health Workforce Support System (NHWSS)

Pursuant to the Administrative Order No. 2021-0068, "Guidelines on the Deployment


Graduate Physicians of Residency Training Program (RTP) under the Department of Health
of
Teaching and Training, and Specialty Hospitals under the National Health Workforce Support
System," the Department of Health (DOH) has implemented the Post-Residency Deployment
Program (PRDP) with the intention to provide the country with adequate, competent, and
compassionate medical practitioners to address the inequitable distribution of specialized
medical care particularly in the unserved and underserved areas in the country.

Relative to this, the DOH Centers for Health Development (CHDs) shall enter into a
Memorandum of Agreement (MOA) with the Local Government Unit (LGU) for the
implementation of the program. Meanwhile, the Terms of Reference (TOR) between the DOH
Teaching and Training and Specialty Hospital, RTP Graduate Physician, and Recipient Hospital
will serve as guide to fulfill the roles and responsibilities of the parties involved.

MEMORANDUM OF AGREEMENT
POST-RESIDENCY DEPLOYMENT PROGRAM (PRDP)

KNOW ALL BY THESE PRESENTS:

This AGREEMENT is entered into by and among:

The DEPARTMENT OF HEALTH (DOH) Center For Health


Development a government agency created and existing under the laws of the Republic of
the Philippines, with its principal office located at San Lazaro Compound Sta. Cruz, Manila
herein represented by , in his capacity as the Director IV of
DOH- Center for Health Development, and herein referred to as the “DOH”;

AND

The PROVINCIAL GOVERNMENT of Philippines, a local


government unit (LGU) duly created and existing under the laws of the Republic of the
Philippines, including all hospitals under its jurisdiction, herein represented by its Governor
, with principal address at Capitol Compound, City of San Fernando, and
(CHD)

hereinafter referred to as the “LGU”;

WITNESSETH
Director

WHEREAS, Republic Act No. 7160, otherwise known as the Local Government
Code (LGC) of 1991, states that the functions and responsibilities for the delivery of basic
health services and other related facilities have been transferred from the DOH to the LGU;

WHEREAS, EO No. 102 mandates the Department of Health to provide assistance to


local government units in effectively implementing programs, projects and services for the
provision of health care services to every Filipino;

WHEREAS Republic Act No. 11223, otherwise known as the Universal Health Care
Act of 2019, states that the DOH shall deploy health workforce under the National Health
Workforce Support System to augment human resource needs in
public health systems;

WHEREAS, the LGU is in dire need of a Medical Specialist who will provide
specialty healthcare and augment the medical human resource requirement in the area;

WHEREAS, the provisions stated in this instrument shall extend to all hospitals
within the jurisdiction of the LGU;

WHEREAS, to
ensure availability of skilled health professionals who can deliver
quality health care services in priority poor and underserved areas, the DOH shall deploy
of
physicians who finished the Residency Training Program (RTP) in DOH Teaching and
Training Hospital as human resource complement in government hospitals in priority
Province
underserved areas;

WHEREAS, the DOH will deploy RTP graduate physicians to LGUs where the need
exists and as part of the requirements of the residency training program pursuant to
Govemor, Administrative Order No. 2021-0068 and Department Memorandum No. 2021-0548.

NOW, THEREFORE, for and in consideration of the foregoing premises, by mutual


consent, the parties do hereby enter into this covenant with the terms and conditions hereof
under stipulated:

SECTION I. The Department of Health (DOH) through the Center for Health
Development (CHD) shall:
1. Assess, validate and consolidate the requests of government hospitals for medical
specialists in accordance with the existing criteria and guidelines;

Facilitate the deployment of RTP graduate physicians to identified priority hospitals
in the region in coordination with the Professional Education, Training and Research
Office (PETRO) and Health Human Resource Development Bureau;
Conduct social preparation to LGUs and recipient hospitals including orientation on
the Post-Residency Deployment Program (PRDP) and processing of the
Memorandum of Agreement prior to deployment;
Conduct pre-deployment orientation of RTP graduate physicians in coordination
with the recipient hospitals;
Accompany and endorse the RTP graduate physicians to LGUs through the
Provincial DOH Offices;
Facilitate the processing of appointments for deployed RTP graduate physicians
within the region;

Process the monthly salaries and benefits of the RTP graduate physicians upon
submission of the signed daily time records (DTR);

Designate a point person for PRDP within the CHD to document, validate, address,
and provide feedback on all issues/concerns related to deployment;

Maintain database of priority hospitals, its corresponding need for health human
resources, and deployed RTP graduate physicians under PRDP;
10. Coordinate with the LGUs and hospitals and provide technical assistance as
necessary for the implementation and monitoring of the PRDP;
11. Conduct regular consultations with the deployed RTP graduate physicians, base and
recipient hospitals;
12. Ensure the safety of deployed RTP graduate physicians;
13. Issue endorsement letter and Regional Personnel Order of the RTP graduate
physicians that will be deployed to the identified hospital of the Province; and
14. Ensure that the stakeholders of the PRDP, particularly the DOH Teaching and
Training Hospital (Base Hospital) and the RTP graduate physicians sign the Terms of
Reference which shall set forth their respective rights and obligations pursuant
hereto.

SECTION
1.
II. Local Government Unit shall:
The Recipient Hospitals through its Chief of Hospital under the management of the
LGU
shall sign the Terms of Reference indicating the herein responsibility relative
to the implementation of the PRDP prior to the deployment of RTP graduate
of physicians;
Conduct necessary orientation of deployed RTP graduate physicians prior to the

Provide modest board and lodging (i.e shared or solo house with kitchen, bedroom,
dining room, and bathroom, food provision or monetary equivalent) for deployed
RTP graduate physicians outside the hospital premises. Alternative arrangements

Provide the RTP graduate physicians with Philhealth share equal to that of the hired
full time physicians of the hospital;
Ensure the occupational health safety and security of deployed RTP graduate
physicians;
Supervise, evaluate and monitor the performance and attendance of the deployed
RTP graduate physicians. The Chief of Hospital will sign the monthly DTR as the
immediate supervisor;
Support and collaborate with the RTP graduate physicians for endeavors that will
improve the services of the hospital, upgrade the capabilities of its personnel and
establish training programs and activities for its personnel.
Support the Health Facilities Enhancement Program of the DOH to upgrade the
physical conditions and services of the hospitals under its managementas necessary.

SECTION III. ALL PARTIES FURTHER AGREES THAT:
1. This Agreement shall not be amended or modified without the consent of the
contracting parties;
2. This Agreement shall take effect immediately upon signing hereof and shall remain in
force and in effect for a period of three (3) years with annual periodic review, if
warranted, until revoked, modified, or amended accordingly; and
The deployed RTP graduate physicians shall be pulled out from his/her area of
assignment should the Local Government Unit fail to comply with the provisions
stipulated or where there is grave threat to his/her personal safety.
The Administrative Order No. 2021-0068 shall apply suppletorily to this Agreement.
Any undertaking that will and may involve the processing and disclosure of personal
information or sensitive personal information shall be governed by the Data Privacy
Act of 2021, its Implementing Rules and Regulations (IRR) and other issuances by
the National Privacy Commission (NPC).”
The parties shall not disclose any information or documents that are identified as
confidential and obtained from the other Party during the course of this Agreement
and the program, except as may be required in carrying out the Agreement and with
the written consent of the providing Party.

In view of the foregoing covenants, the parties hereto mutually bind themselves the
full responsibility and accountability to the stipulated conditions contained herein.

TERMS OF REFERENCE
FOR THE POST RESIDENCY DEPLOYMENT PROGRAM
(PRDP)

The Post Residency Deployment Program (PRDP) is


one of the Department of Health's (DOH)
strategies aimed at achieving the overall goal of Republic Act (RA) 11223, also known as
the Universal
Health Care (UHC) Act. The program's goal is to promote equal distribution of physicians, with a
particular emphasis on priority poor and underserved areas. To ensure the success of its implementation,
the Department Memorandum No. 2021-0548 and Administrative Order No. 2021-0068 were issued on
December 28 and 31, 2021, respectively, and cover all RTP graduate physicians who entered as medical
residents and those who had their lateral entry from July 26, 2015 onwards in DOH Teaching and
Training Hospitals and Specialty Hospitals with accredited RTPs based on the evaluation of critical
needs by the Department of Health.

Following the Memorandum of Agreement herein attached entered into between the
DEPARTMENT OF HEALTH (DOH)- Center For Health Development (CHD)/
{ Ministry of Health-Bangsangmoro Autonomous Region of Muslim Mindanao (MOH-BARMM)

a. Conduct orientation seminars on the deployment of Residency Training Program (RTP) graduate
physicians for newly accepted residents of DOH Teaching and Training Hospital, Specialty
Hospitals, and Regional Teaching and Training Hospitals including the signing of contracts.
b. Through Professional Education, Training, and Research Office (PETRO), shall submit the

deployment plan of RTP graduate physicians to HHRDB at least 6 months prior to planned
deployment. It shall include the details on the preference on the area of deployment (region and

physician to take the specialty board exam while on deployment as applicable;
f. Coordinate closely with the recipient hospitals and CHDs for the monitoring and evaluation of the
deployed RTP graduate physicians;

a. Fulfill the duties and functions of a Medical Officer IV, serving the designated hospital for at least
40 hours per week from to , or as stipulated in the Contract of
Residency Training.
b. Manage problematic cases in the ward, emergency room, and intensive care units and facilitate
referral to higher facilities, as necessary, in relation to his/her field of specialty;
c. Conduct seminars, lectures, and lay-fora for patients;
Formulate and implement activities that will improve the services of the recipient hospital and
upgrade the capabilities of its personnel, in collaboration with the Hospital Administration.
Provide technical assistance in the establishment or upgrading of the residency training program in
the designated hospital;
Attend consultation and program review activities as facilitated by the DOH for the improvement
of PRDP;
Participate in conferences, research projects, and other activities in the hospital;

Individual Performance Commitment and Reviews (IPCRs), and other administrative
documents/reports for purposes of compensation, program monitoring, and evaluation based on the

conform with his/her field of specialty.
Issue a Certificate of Completion of RTP graduate physicians and clearance from any hospital
liabilities at the end of the deployment period. Jt shall include the actual start and end of

m. Endeavor to retain the deployed RTP graduate physicians by providing employment and other
incentive mechanisms;
. Devise a mechanism to establish a residency training program initially for the major specialty

consideration of the CEDAW provisions for gender sensitivity and responsiveness.
