Court Act Cap16, Section 40(2) of the Criminal Procedure Code Act Cap 116

Rule 3 Judicature (Criminal Procedure) (Applications) Rules S.I 13-8)

TAKE NOTICE that this Honorable Court shall be moved on the ………………day of

………...2021 at ………. O’clock in the forenoon or soon thereafter as Counsel for the
Applicant can be heard for orders that;

1. The applicant be released on bail pending his appeal and upon such terms and conditions
as this honorable court shall deem fit.

The grounds for this application are contained in the Affidavit of the Applicant attached hereto
but briefly state that:

1. The applicant is a first-time offender

2. There is a possibility of substantial delay in the determination of the appeal
3. That the offence with which he is charged is bailable by this honorable court
4. That the accused has infant children who he cares for and he is their sole breadwinner
 5. That the applicant suffers from asthma and cannot manage the conditions in a congested
jail
6. That the applicant has substantial sureties
7. That it is just and equitable that the Applicant be released on Bail pending appeal.

TAKE FURTHER NOTICE that the elaborate grounds of this application are contained in the
applicant’s affidavit annexed hereto and marked “A”. It shall also be relied upon at the hearing
of the application.
