Card/Certificate Release:
Cards and/or certificates will not be released until balance has been paid in full.
Payments can be made with cash, check, money order, or debit/credit card.
When cards/certificates are ready to be picked up, we will notify you via email.
You must have photo ID to pick up your card/certificate.
There is a $7 dollar mailing fee if you would prefer to have us send your
card/cert via USPS Priority Mail.

Lateness/Attendance:
If you are more than 20 minutes late to a class your name will be crossed out on
the attendance and you will have to make up that session. Any make up sessions
must be completed within six months from the course start date.

Proprietary Interest Policy


Students are notified at the beginning of each class of any proprietary interest the
instructor may have in any product, instrument, device, service, or material
discussed within the class as well as the source of any compensation related to the
presentation. This can be done verbally and/or in written form and must be done at
the start of every class held.

Intellectual Property Policy


It is likely that in the course of creation or development of materials, third-party
materials may be included in the final product. Intellectual property rights must be
respected at all times. Use of third-party content shall require the use of the
appropriate credit line and/or digital watermark. Permission from the
owner/creator must be obtained before including intellectual property as part of
instructional materials at MLI. Metropolitan Learning Institute owns the intellectual
property rights to each of the courses it delivers.

Confidentiality Policy
It is the policy of Metropolitan Learning Instituteto maintain up-to-date
records that are kept private and secure. This policy is intended to maintain
all company information, including all personal client information, private and
secure. Student records are maintained private and secure on a computer
database with password access, as well as in locked file cabinets. These
records include personal contact information, completed course information,
and awarded CEUs information. Students may request their information in
person or with a signed written request. No phone calls will be accepted.
Certificates and cards, as well as records, are issued within 15 days of the
course completion date, or date on which request was received.
Prerequisites
Students must be able to communicate with the
instructor in the language the course is held in.
Student must be a registered architect, licensed
engineer, OR have 5 years of construction
supervision/safety experience, including 3 years
supervising major buildings.
Successful Completion

In order to successfully fulfill the requirements for completion of the


8 Hour Site Safety Manager Refresher course, students must:
 Be able to clearly communicate with the instructor and complete all
paperwork in the language the course is delivered. No personal
interpreters permitted.
 Complete all required paperwork: registration, evaluation,
attendance, etc.
 Attend all required hours of the course. Any make up sessions must
be completed within six months from the course start date
 Participate during class activities and reviews
 Complete tests with a passing grade of 70%
No exceptions will be made. No partial credit awarded for any
course.

COMPARE AND CONTRAST
3301.3 Site Safety Managers, Coordinators and Superintendent
of Construction.
A Site Safety Manager or Site Safety Coordinator must be
designated and present on the construction or demolition of
major buildings as defined by and in accordance with Section
3310. A Superintendent of Construction is required for the
construction or demolition of such other buildings identified
pursuant to rules promulgated by the commissioner.
WHAT IS A MAJOR BUILDING?
3302.1 Major buildings. A major building is a building proposed
to have any of the following characteristics:
1. Be constructed to a height of 10 or more stories;
2. Be constructed to a height of 125 feet (38 100 mm) or more;
3. Have a lot coverage of 100,000 square feet (30 480 m2) or
more regardless of height; or
4. As designated by the commissioner.
REQUIREMENTS FOR SITE SAFETY MANAGER

• 3310.5 Requirement for a site safety manager or coordinator. A site safety manager
certified by the department in accordance with the requirements of Chapter 4 of Title
28 of the Administrative Code is required for the construction or demolition of a major
building, or the alteration of the façade of a major building when a sidewalk shed is
required.
• Exceptions:
– 1. A site safety coordinator certified by the department in accordance with the requirements of
Chapter 4 of Title 28 of the Administrative Code may be used instead of a site safety manager for
major buildings between 10 and 14 stories or 125 to 200 feet (38 100 to 60 960 mm) in height.
– 2. A site safety manager or coordinator is not required for the alteration of the façade of a major
building between 10 and 14 stories in height.
– 3. A site safety manager or coordinator is not required for partial demolition operations in major
buildings where the partial demolition operation is limited to the interior components of the
building and where mechanical demolition equipment, other than handheld devices, are not
used.
Designation of site safety manager
and site safety coordinator
3310.6 Designation of site safety manager and site safety coordinator. It shall be
the responsibility of the builder/owner, agent, construction manager, or general
contractor (the "Contractor") to designate a site safety manager or coordinator
who must be present on a construction or demolition site when required, and who
shall be responsible for all site safety requirements as specified in this chapter.
In the event that an alternate manager or coordinator will be acting as the full-
time safety manager or coordinator for a period longer than two weeks, the
department must be so notified. Any permanent change of site safety manager or
coordinator requires immediate notification of the department. No proposed
alternate manager or coordinator shall have as his or her primary duty the job of
site safety manager or coordinator on any other construction or demolition
project.
Site safety manager’s and coordinator’s
responsibility

• 3310.8 Site safety manager’s and coordinator’s responsibility.


• 3310.8.1 Monitor compliance. It is the responsibility of the site
safety manager or coordinator to monitor compliance with the
safety requirements of this chapter and to perform all other
safety duties assigned by the owner or contractor to meet legal
requirements.
• The site safety manager or coordinator shall meet on a weekly
basis with the designated representative of each subcontractor
to ascertain that all subcontractors are complying with the
applicable provisions of this chapter.
Notification
• 3310.8.2 Notification. The site safety manager or coordinator shall immediately
notify the department directly if he or she discovers any of the following conditions
in the routine performance of the job:
• 1. A person is operating a crane, derrick or hoisting equipment on the site without
a permit and refuses to desist from operating the equipment;
• 2. A crane is being operated by an unlicensed operator and such unlicensed
operator refuses to desist from operating the crane;
• 3. No flagperson is present during crane operation where required by this chapter;
• 4. Sidewalk sheds required by the site safety plan are not in place during
construction or demolition activity;
• 5. Permits have not been issued for the sidewalk sheds;
• 6. The designer and/or supplier of sidewalk sheds has not certified that the sheds
have been erected in accordance with the approved plans; or
• 7. There has been an accident involving the public, or private or public property.
Responsibility

3310.8.2.1 Responsibility. Upon proper notification to the


department of the existence of any of the above-noted
circumstances, any responsibility the site safety manager or
coordinator has under this code arising out of, relating to, or as a
result of the existence of that circumstance, shall cease.
Inspections
3310.8.3 Inspections. It shall be the responsibility of the site safety
manager or coordinator to inspect personally, on a regular basis,
specific areas and items on the construction or demolition site, as
prescribed by rules promulgated by the commissioner, and to notify
responsible personnel employed by the general contractor,
construction manager or any subcontractor when violations of this
chapter occur. The site safety manager or coordinator shall maintain a
log of the inspection in accordance with the requirements set forth in
rules promulgated by the commissioner.
3310.8.4 Reasonable prudence. In addition to the above
requirements, the site safety manager or coordinator shall use
reasonable prudence to ensure that safety is maintained at the job
site as job conditions dictate.
Site Safety Coordinator
Site safety coordinator will preform and have the same
responsibilities’ as a Site Safety Manager and he/she
will perform the task as the Site Safety Manager.
When do you need a SSC:
As per BC3310.5
• Structure is less then 15 stories or 200 feet( 60
960mm) in height
• Structure has a building footprint of 100,000 square
feet (30 480m2) or less.
Construction Superintendent
• Construction Superintendent will perform and
have the same responsibilities‘ as the site
safety manager and he/she will perform the
task as the Site Safety Manager.
• A Construction Superintendent is responsible
for building up to 9 stories
Construction Superintendent
Jobs that require a construction superintendent: The rule expands
the requirement for a construction superintendent to alterations,
including alterations of 1-, 2-, and 3-family dwellings, which
comprise at least one of the following:
– vertical or horizontal enlargement;
– alteration or demolition of more than fifty percent (50%) of the floor
area;
– the removal of one (1) or more floors; or
– work that requires a special inspection for underpinning or the protection
of sides of excavations.
The rule also eliminates overlapping oversight requirements that
exist between Chapter 48 and the New York City Construction Codes.
Construction Superintendent
• 1 RCNY 3301-02, effective May 30, 2016,
expands the duties and changes the types of
jobs requiring a Construction Superintendent
(CS). Implementation of these changes will
occur in two phases:
– Phase 1: Beginning May 30, 2016
– Phase 2: Beginning August 30, 2016
Construction Superintendent
Phase 1: Beginning May 30, 2016
• Construction Superintendent duties include:
- Assure compliance with Chapter 33 of the Building Code
- Assure work conforms to plans
- Designate a competent person to provide full-time safety supervision at the jobsite
- Notify the Department of accidents, damage to adjoining property, and certain other
conditions by contacting the BEST-SSM/SSC/CS hotline at (212) 393-2128
- Promptly correct any unsafe conditions discovered
- Upon each visit to the jobsite, inspect the entire work area and maintain a jobsite
log
• 1-, 2-, or 3-family NBs will no longer require a Construction
Superintendent
• All other job types requiring a Construction Superintendent will
continue to do so
Construction Superintendent
Phase 2: Beginning August 30, 2016
• The Construction Superintendent must visit the jobsite each day work
occurs
• Alteration permits issued or renewed on or after August 30, 2016 will
require a
• Construction Superintendent if the job is not a site safety job under a
Site Safety
• Program and the work includes one of the following:
- Vertical or horizontal enlargement
- Demolitions of more than 50% of floor area of the existing building
- Alterations of more than 50% of floor area of the existing building that require special
inspection for structural stability
- Complete removal of one or more floors (stories)
- Any work requiring a special inspection for support of excavation (SOE) or underpinning
Construction Superintendent:
Duties
• (1) Safe site. The construction superintendent must act in a reasonable and responsible
manner to maintain a safe job site and assure compliance with Chapter 33 of the New
York City Building Code and any rules promulgated thereunder at each job site for which
the construction superintendent is responsible.
• (2) Compliance with plans. To the extent that a registered design professional or
special inspection agency is not responsible, the construction superintendent must assure
compliance with the approved construction documents at each job site for which the
construction superintendent is responsible.
• (3) Administrative code duties. The construction superintendent must fulfill the duties
of a superintendent of construction assigned by Chapter 1 of Title 28 of the New York City
Administrative Code at each job site for which the construction superintendent is
responsible.
• (4) Daily visit. Beginning three months after the effective date of this rule, the
construction superintendent must visit each job site for which the construction
superintendent is responsible each day when active work is occurring.
Construction Superintendent:
Exceptions: The construction superintendent is not required to be present
at the site during the following activities, provided no other work is in
progress:
•          1.   Surveying that does not involve the disturbance of material,
structure, or earth;
•          2.   Use of a hoist to transport personnel only;
•          3.   Use of a material hoist that is fully enclosed within the
perimeter of the building;
•          4.   Finish trowelling of concrete floors;
•          5.   When personnel are provided for temporary heat, light, or
water; or
•          6.   Truck deliveries to the site where the sidewalk is closed and the
entrance gate is within that closed sidewalk area.
Concrete Safety Manager
As per §3310-02 Concrete Safety Managers term shall mean the
individual registered in accordance with subdivision (c) of this section
and responsible for those duties defined in subdivision (e) of this
section.
A concrete safety manager shall be designated by the concrete
contractor at all job sites in accordance with section 3310.9 of the New
York City Building Code("Building Code"). In accordance with section
3310.9 and any applicable Department rules, the concrete safety
manager and his or her alternate shall coordinate directly with the
designated site safety manager or site safety coordinator on the job
site.
Concrete Safety Manager
  Duties. A concrete safety manager shall have responsibilities
including, but not limited to:
•     Being onsite and available during all concrete operations and
until the removal of the reshores and horizontal safety netting is
completed. A concrete safety manager need not be present for
concrete operations involving exclusively sidewalks, driveways,
mechanical pads or other miscellaneous areas. The concrete safety
manager is not required to be onsite when no concrete operations
are taking place.
•       Being available to the Department at all other times until
completion of the concrete operations by email, mobile phone or
other means as determined by the Department. If the registered
concrete safety manager is unavailable, an alternate concrete safety
manager shall be available to the Department at all times until
completion of the concrete operations, by email, mobile phone or
other means as determined by the Department;
Concrete Safety Manager
Duties. A concrete safety manager shall have responsibilities
including, but not limited to:

• Monitoring compliance with and notifying the contractor of any


violation immediately notifying the site safety manager or the site
safety coordinator on the job site and the Department of:
             any fatality; any injury to a member of the public; any
worker injury resulting in emergency medical response or
hospitalization; any damage to public or private property
occurring on or adjacent to the job site that arises from the
concrete operations; any form failure; any material or debris
falling from the concrete operations;
   
Concrete Safety Manager
Duties. A concrete safety manager shall have responsibilities including, but not
limited to:
 Advising the Department of contact information and changes thereto;
•          Cooperating with any investigation by the Department, or other city or
law enforcement agency, into the activities at any job site under his or her
supervision and providing prompt, accurate and complete responses to
inquiries by the Department and other agencies about the conduct of such
activities;
•         Keeping a daily log of all concrete operations pertaining to the job site
including, but not limited to, the following:
            safety precautions put in place for concrete operation for each day;
any unsafe work or practice, the corrective action taken and the date of
correction;   amount of concrete poured for each day; location of pouring,
forming, stripping, and rebar tying for each day; name of the qualified
person designated by the contractor to inspect the formwork for each day;
name of the foreman in charge of the formwork for each day;   the
presence of the design drawings for the formwork, including shoring
foundations, required for the job under section 1906.3 of the Building
Concrete Safety Manager
Duties. A concrete safety manager shall have responsibilities
including, but not limited to:  
• Ensuring that the assigned concrete testing laboratory and special
inspector(s) are present as required by Chapter 17 of the Building
Code; and
• Performing inspections in accordance with the current Concrete
Safety Manager General Inspections checklist prescribed by
the Department.
Fire Safety Manager
• 1408.1 Fire Safety Manager - Where a Site Safety Manager or Site
Safety Coordinator is required by the Building Code, the owner shall
designate a person to be the Fire Safety Manager for the
construction site. The Fire Safety Manager may be the Site Safety
Manager or Site Safety Coordinator required by the Building Code.
The Fire Safety Manager shall be responsible for ensuring
compliance with the requirements of the Fire Code, and the FDNY
Rules.
Fire Safety Manager
• The Fire Safety Manager shall conduct an inspection of the
construction site and all fire safety measures on at least a daily
basis, and maintain a record of same in a bound log book or other
approved system of recordkeeping. The log book or other approved
recordkeeping shall be made available for inspection by any
representative of the department. Where fire watch service is
provided, the Fire Safety Manager shall be responsible for the
general supervision of the fire guards.
Fire Safety Manager
• 3 RCNY Section 1408 -A Construction Site Fire Safety Manager
shall be present at the construction site at all times when
construction, demolition and alteration work is being
conducted.

• The Fire Safety Manager may be the Site Safety Manager or


Site Safety Coordinator required by the Building Code.
As of October 2014, a Site Safety Manager can no longer be
assigned as both the Site Safety Manager and Fire Safety
Manager, where the building is above the 19th story.
