This Agreement is made and entered into this, between M/S Mamhridya
Traders and having its Corporate office at 1/908 Sanjay Gandhi Colony
Aligarh (202001) UTTAR PRADESH.
NOW THEREFORE, in consideration of mutual promises and undertakings herein contained and
other good and valuable consideration, the receipt and sufficiency of which is hereby
acknowledged, the Parties agree as follows:
1. Quantity Variation:
The quantities mentioned in the Work Order are tentative and shall be executed based on site
requirements.
3. ESI / PF:
Subcontractors should be registered under PF & ESI Act. Sub-contractors has to submit the PF &
ESI Paid challan along with the invoice in order to avoid recovery
TERMS OF PAYMENTS:-
Statutory Variation in T&D is not applicable. GST shall be applicable as per guidelines of GST Council,
Govt. of India Income Tax – TDS as applicable shall be deducted at source of each running account bill
4. ESI / PF:
Subcontractors should be registered under PF & ESI Act. Sub-contractors has to submit the PF &
ESI Paid challan along with the invoice in order to avoid recovery.
5. Terms of Payment:
During implementation, 80% payment will be released to subcontractor based upon the certification of
measurements by Engineer In charges, project manager and submission of GST invoice.
20% retention shall be released by the end of Operation & maintenance of the project .
During Implementation subcontractor shall raise the Invoice IN every 15 Days basis. Invoice shall be
raised only after approval of Engineer Measurments,
Work completion certificate / sign off documents / validation from M/S Mamhridya Traders must
accompany the invoice which submitting the same for payment
6. Resource deployment
Subcontractor has to deploy below resources at site during work in case of non availability of below
resources M/s Mamhridya Traders has right to recruit the resource on his own expense and same
amount will be recovered from Subcontractor’s running bills :
TO take your work material from store will be in sub contractors scope.
7. Warranty: The subcontractor shall guarantee that all services rendered under this contract
will confrm to requirement of work specifications. All such works are guaranteed against
defects in workmanship and confirm to operating requirements / against failure of
performance as stipulated in the work.
10% retention up to end of the project handover, which will be released only after submission of proper
material reconciliation .
9. Manpower Mobilization:
The Contractor shall mobilize the labor within 7 days from the date of receipt of LOI. Contractor shall
ensure that required manpower shall be deployed for achieving the work progress within stipulated time
period.
M/S Mamhridya Traders will not bear at any cost for any kind of consequences or misbehavior and
misconduct of contractor’s staff, workmen at any juncture.
11. Materials:
Contractor shall be responsible for any damage occurred to materials while loading/unloading, shifting
and erection. The cost towards damages shall be recovered from the running bills.
In addition, Contractor shall make his own arrangements for proper security and safety of materials
issued by M/S Mamhridya Traders for erection works.
Contractor shall nominate authorized person for taking over of materials issued by M/S Mamhridya
Traders at its designated stores/site and accompanying with material till destination.
12. Site Facilities:
Contractor shall arrange labor accommodation, medical facilities and other welfare requirements as per
standard norms and relevant government labor acts.
Contractor has to rectify all defects/faults occurred due to poor quality of erection works.
Insurance: The subcontractor will take appropriate insurance policy and maintain in force
during the duration of the project in order to cover the liabilities that likely to incur with respect to the
performance of the contract. The workforce should be adequately covered for the mishap which may occur
during the course of the project.
1. Safety
All workmen must be screened and medically fit before engaging them to work. Contractor shall arrange
medical fitness certificate for all the workmen engaged in the work. Workmen with age below 18 years
and above 58 years must not be enrolled for the work. Female workers must not be allowed to work at
site. All workmen must strictly adhere to the safety instructions of the Safety All workmen must wear
necessary PPEs during execution of works.
PPE required for the workmen shall be arranged by Contractor for the workmen engaged at site.
All tools and tackles shall be inspected before use. Defects to be reported immediately.
Subcontractor shall be responsible for arrangement of safe drinking water facilities to workmen at site.
Subcontractor shall provide First-Aid kit at each working site under the supervision of gang leader.
Contractor has to ensure the availability of Proper supervision of work and deployment of Project
Manager, Site engineer, supervisor, Quality engineer & Safety stewards
