In the event the Contractor fails to provide such estimate within the stipulated period or the ER. is of the opinion that the estimate is not a proper estimate, the E.R. shall estimate the value of the varied work, the time that is required for its completion and extension of time (if any), as he considers in his absolute discretion to be appropriate and shall notify the Contractor accordingly. The E.R’s decision shall be final and binding on the Contractor. The valuation of variations and measured works by the Contractor and/or the estimation or any verification made by the E.R thereof shall be made in accordance with the provisions hereinafter provided, 25.2 Quantities which are conclusive Unless where the quantities of the Works or any part thereof are stated as “PROVISIONAL” in the Bills of Quantities such quantities are conclusive and not subject to remeasurement.
