REPORT OF OVERSIGHT COMMITTEE IN COMPLIANCE OF ORDER OF HON’BLE
NATIONAL GREEN TRIBUNAL PASSED IN O.A. NO. 648/2019 IN RE: M/S.
HINDON RIVER RESORTS PVT LTD & ANR VERSUS GHAZIABAD DEVELOPMENT
AUTHORITY & ORS WITH REGARD TO NON-OPERATIONAL STPS
IN INDRAPURAM, GHAZIABAD, U.P.
(In continuation of earlier Report dated 24.09.2020)

1. INTRODUCTION
The Hon’ble NGT had taken up the issue of three STPs at Indirapuram, Ghaziabad which were
not working properly resulting in pollution of the area on 14.08.2019, 02.01.2020 and
29.09.2020. In its last order dated 29.09.2020 the Hon’ble NGT had considered the report of
Oversight Committee dated 24.09.2020, Ghaziabad Nagar Nigam’s report dated 19.09.2020 and
Ghaziabad Development Authority’s (GDA) report dated 22.09.2020, based on all these reports
the directions made were as follows:
a) Out of the three STPs, the 56 MLDSBRSTP maintained by Ghaziabad Development

Authority (GDA) is running properly, hence there are no recommendations regarding this
STP.
b) The 74MLD SBRSTP run by UP Jal Nigam was handed over to M/s VA Tech Wabag which
has repaired it. This STP is likely to stabilize and function properly within a week. RO,
UPPCB may inspect and confirm the status after 10 days. However, there is another
problem with the conveyance channel. Since all the three STPs are falling in the same
conveyance drain, this conveyance drain gets choked. Hence this STP is forced to run
below its capacity at 30 to 32 MLD against its designed capacity of 74 MLD. The
construction of separate pipelines to augment the conveyance system has been delayed
and is likely to be completed by November, 2020. Only thereafter its capacity utilization
will improve. The Oversight Committee is not satisfied with the progress of construction
of this conveyance pipeline system. Jal Nigam may be directed to ensure that the
construction is expedited and the new proposed timeline of November is strictly adhered
to.
c) The 56 MLD UASB STP which was earlier maintained by Nagar Nigam, has been handed
over to UP Jal Nigam and thence to VA Tech Wabag. The work has started and is likely to
be completed in next three months. Then it should be able to achieve the existing
pollution norms of 30 BOD. However, this STP is a very old STP which is being run on
Upflow Anaerobic Sludge Blanket (UASB) technology, which is a very old technology. If

there is any revision in pollution norms, this STP will not be able to adhere to the revised
norms in the long run. The UP Jal Nigam should plan for upgrading this UASB STP to
Sequential Batch Reactors (SBR) Technology or some contemporary technology.
d) Regarding the Environmental Compensation (EC), the UPPCB has informed that they
have imposed Environmental Compensation (EC) for these STPs till May, 2020 though so
far no EC has been recovered. While the GDA plant is working properly, both Nagar
Nigam and Jal Nigam have to pay the environmental compensation till they rectify their
STPs. After December, Nagar Nigam has handed over its STP to UP Jal Nigam. So UP Jal
Nigam will have to pay environmental compensation with liberty to collect it from their
contractor. All the three institutions need to comply with the EC directives.
e) At times the STP influent is not following the COD norms. The STPs have not been
designed for controlling the COD parameters. UPPCB has to ensure that the registered
industries in the industrial areas are complying with the COD norms. In fact there should
be insistence on installing OCEMS in the registered industrial areas. At the same time,
Nagar Nigam should ensure that there are no illegal industries operating in the
residential areas. They need to be immediately closed and their electric connections need
to be disconnected. Instructions to this effect need to be given to Nagar Nigam and UP
Power Corporation to ensure that there are no industries operational in residential
areas.
f) The UP Jal Nigam should prepare a proper plan for reuse of treated waste water. This is
all the more necessary in the light of the restrictions on drawl of ground water for
industries in OCS Blocks. The Water Reuse Plan would not only help control illegal drawal
of ground water but also ensure optimal use of the treated waste water.
g) The Oversight Committee also feels that there should be a regular system of water
quality assessment of all the three STPs done on quarterly basis to ensure the efficacy
and efficiency of the STPs.
h) The progress regarding removal of encroachments is not satisfactory. In fact, none of the
agencies has sent a report to the Oversight Committee regarding this issue. There should
be a standing encroachment removal mechanism under District Magistrate comprising
of representatives from Nagar Nigam, Development Authority and Jal Nigam who may
review the progress periodically. The operator under 'One District One Operator scheme'
may also take recourse to this mechanism on a continuing basis regarding his
encroachment related grievances.
i) The Chief Secretary should monitor the performance of the STPs and come out with an
appropriate action plan. It should include measures for scientific disposal of waste,
cleaning of drains, remedial action against removal of encroachments, compliance of
directions regarding environmental compensation and action against negligent officers.

2. COMPLIANCE STATUS
The Oversight Committee reviewed the compliance status in the aforesaid mentioned order in
continuation with the non-complying issues of the earlier orders. Summary of Compliance

3. RECOMMENDATIONS
In view of the above we recommend as follows:
1. The Committee noted the progress of rehabilitation of the 56 MLD UASB STP at
Indirapuram. However in the long run, it is advisable to upgrade it to SBR technology
instead of the current UASB technology which is an outdated technology.
2. The process of realization of EC is slow. UPPCB may be directed to ensure strict
timelines for depositing the EC by the departments.
3. Regarding furnishing of the performance guarantee, there is still confusion between UP
Jal Nigam and Ghaziabad Nagar Nigam as to who will furnish the performance
guarantee. Urban Development Department may resolve the issue and ensure
compliance.
4. As per the compliance report of UPPCB it is apparent that action against all the
defaulting industries had been taken. However, this committee feels there are still
many industries are there which are running which have neither proper access to CETPs
nor are having their own STPs. UPPCB alongwith UPSIDC may launch special drives to
identify such industries and ensure effective enforcement action against them.
5. The timelines for providing the treated water to the industries should be notified so
that industries can get them registered with the ULBs to receive the facility of getting
treated water.
The Member Secretary, UPPCB is directed to send this report to the Registrar General, National Green
Tribunal, Principal Bench, New Delhi for placing the same before the Hon’ble Tribunal with a copy to the
Chief Secretary, Government of UP for necessary action. The report be uploaded on the website of the
committee.
