Task 1: Justifying health and safety improvements

Q1. What financial arguments could you use to justify your proposed recommendations to
segregate FLTs and the workers?
Ans. Following financial arguments, I use to justify my proposed recommendations to
segregate FLTs and the workers
Many accidents reported every year in the company, Due to these accidentthe company had to face
several direct and indirect costs in order to avoid these cost, segregation can prevent such accidents
in future.
Due to accident worker got injured and hospitalised so company has to face hospital cost and, in this
period, he will get sick pay. If any fatality occurs then compensation has to be given.
Enforcement or labour court can fine for non-compliances for health and safety policies or they can
take legal action against company.
Disruption in the business while dealing with the injury in form of lost time injury and investigation
process. Given extra over time to the worker to cover this loss of time.and also due to these accidents
company has to face reputation damage.
If company segregate FLTs and the workers then collisions can be preventing work injuries, material
damages, and many accidents like fire, slip trip hazards,

Task 2: Managing contractors


Site management have accepted your proposed health and safety improvement solution to segregate
FLTs and the workers. They have made the budget available. The organisation intends to use
external contractors for the work.
Q2.When selecting the external contractors, what would you consider when assessing their
competence?
Ans.External contractor’s competence can be assessed based on
Contractor Health and safety policy had they covered any accident prevention plan in their policy or
not.
Have they suitable method statement and Risk assessment for the work so that an accident can be
prevented.
Contractor have competent manpower and adequate equipment’s for work.
Maintenance records of the contractor equipment, plants, machinery whether the contract is
maintaining his equipment in safe condition and safe to use at the warehouse so there will not be any
accident due to faulty equipment.
Investigate previous work record (If possible)

Task 3: Discussing moral reasons for managing health and safety You have been asked to chair
the health and safety committee meeting. Before the meeting, you decide that you will open the
meeting by reminding everyone of moral expectations of health and safety
Q3. Prepare notes of the moral arguments you will use at the meeting.

Ans.When anyone joins a work they wanted to go to a place where they will feel safe and secured.
And it is the moral duty of any employer to keep the workplace safe for the employees. As if the
workplace is safe and if the workers are feeling safe they will love to come to work and it will be a
safer and happy place to work. Which will not only create an environment where everyone wants to
come but also it will also increase the productivity of the workers. And all this will only result in the
profit of the business and as we know the profit of business results in the profit or appraisals for the
employees. So in pursuit of having a good output out of the business and to provide the best for the
employees the first and foremost thing that should be done by an employer is to make the workplace
safe for the employees. A duty of care comes in when someone is using or coming up your workplace
to do the work.

Task 4: Explaining the obligations of employers to workers


Q4. What employer obligations are likely to have been contravened, leading to the accident in this
scenario?
You only need to consider those obligations placed upon employers under Recommendation 10 of
International Labour Organisation R164 - Occupational Safety and Health Recommendation,1981
(No. 164).
Ans.Obligation on employer under article 10 of 164 are followings.
1. Provide safe work place and work equipment to the workers which are safe and have no risk
to the health.
2. Provide adequate training.
3. Proper supervision for work.
4. Provide necessary PPE’s for work free of charge.
5. Adequate Health and safety arrangements put in place.
6. Ensure that work hour do not affect the employee’s safety and health.
7. Take measure to eliminate any physical and mental fatigue to the worker.

Task 5: The legal reasons for health and safety management


Q5. What are the legal reasons why health and safety should be managed at the retail showroom?

Ans. It is not morally acceptable that a people go to work and they will be exposed to danger resulting
in pain, injuries, or ill-health. Everybody expect to work in a safe environment and to return back safe
tothere families and friends at the end of the shift.

When a worker is died, injured, or suffering with any disease by any accident he is not the only one to
suffer but also his family, friends, and colleagues pass through a massive impact. So it is a must for
workers to be provide them a reasonable standard care to prevent them from suffering.

Above are the moral reasons and following are the legal reasons for health and safety management.

 Laws are made to protect human rights so it’s compels the employer to do what he morally do
in order to take reasonable care of employees.
 Laws define the framework that governs the conduct of business and organization.
 It sets the rights and responsibilities of employers and employees so that they can be made
accountable for that.
 Failure to achieve minimum standards set by laws can lead to enforcement actions
 Legal reasons also include preventive reasons to avoid enforcement notices such
as improvement notices and prohibition notices.
 It also includes preventing idemnity where the criminal prosecution due to breaches of legal
duty may result in a fine for organizations and imprisonment or fine or both to individuals.
 Organizations have a legal responsibility to ensure the health and safety of their employees,
customers, and other stakeholders. Failing to do so can result in heavy fines, penalties, and
even jail time.
