Final test for week 1: European Governance

1) Please tick those statements that are correct:
Governance is a broader term, compared to government.

EU regulations are binding upon all EU citizens.

According to Article 263 TFEU, the president of the United States of America
can bring annulment cases before the Court of Justice of the EU.

limited direct access to the Court of Justice of the EU (CJEU): Please explain
briefly (ca. 10 lines) the options how they may indirectly bring their cases to the

Even though Individuals and , corporations and NGOs have limited direct access
to the Court of Justice of the EU they can directly be approached by citizens when
their fundament rights have been violated or when they feel they that a law has been
passed which by the EU parliament which is in contradiction to the constitution.
They can also be indirectly approached by an Individual corporation or NGO if
any actions taken by any EU institute has caused them any damage they can do so
reaching out to their national court who intern will refer their case to the Court of
Justice of the EU. Or they can also do so through the general court ( in which
cases or less significance or petty cases are brought) if a decision passed by the
general court is not acceptable to an Individual corporation or NGO they can
make an appeal in the CJEU.

3) [Essay question]:
In February 2022, Russia opened a war against Ukraine. Please discuss the impact
that this war may have on
a) the further development of EU governance before and after a future
Treaty reform,
b) the EU’s Common Foreign and Defence Policy (CFDP),
c) the EU’s environmental policy.

3) (a)
 The European union is one of the many who criticise Russians decision to invade
Ukraine’s border with unjustified military aggression. And the initial response
strategies of the EU governance was cutting out it’s dependence on Russia and
Russian resources and coming up with frameworks which does so, this will intern
also cripple Russia to fight the wat because if EU cuts ties with it they will suffer
economic losses which will unable them to continue with the warfare.
 The EU in it’s response to the war so far has come up with sanctions on how to go
about the crisis. In the future however, in my opinion the EU should come up with
policies that better protect their cyber security and shields them from any Russian

(b) The war has been one the greatest security threats for the EU in decades and it has
certainly resulted in EU amending/ equipping it’s forgein security policies to deal
with the crisis.
It has extended it’s support to ukarine in stopping resistance from Russia while at the
same time ensuring that it does not end up having a direct conflict with Moscow in
doing so.
The 27-member states have been quicky in their response to the war and have
released sanctions including. One of the major policy shifts has been in supplying
lethal weapons to a third country. Earlier, the EU was at a standpoint which would not
intervene in any wars, however this war had called for the member states to help out
Ukraine and supply weapons to it, which is extremely unlike the EU.
As far as the foreign policy is concerned EU has imposed some harsh sanctions with
respect to trade, economy and finance against Russia. However at the same time it
has ensured that
