The LESSEE shall use the cleaning services of Prime Key unless they are not available for the type of maintenance work needed, Within thirty (30) days prior to the return of the Leased Premises, the LESSOR may show the Leased Premises to prospective tenants at reasonable hours of the day, provided that the LESSOR gives at least two (2) days prior written notice to the LESSEE. ‘Should the LESSEE refuse to vacate the Leased Premises after the termination of this Contract of Lease for any reason whatsoever, the LESSOR shall have the right to eject the LESSEE from the Leased Premises and for his purpose, the LESSEE: hereby expressly appoints the LESSOR as her duly authorized Attomey-In-Fact with power and authority to cause the Leased Premises to be opened in the presence of representatives of Green Residences Condominium Corporation to take inventory of the LESSEE’s equipment, furniture and other property. Should the LESSEE fail to claim her equipment, furniture and other property within thirty (30) days from notice. LESSOR is hereby given the right to dispose of said property in a private sale and to apply the proceeds to the payment of whatever indebtedness of LESSEE to the LESSOR and the balance, if any, shall be given to the LESSEE. LESSOR shall not incur civil and criminal liabilities whatsoever by exercising their rights granted under these provisions 23, SOLIDARITY LIABILITY AGREEMENT: The LESSOR and LESSEE acknowledges and agrees that they are solidary Gointly and severally) liable with the payment and performance of all obligations under this Contract of Lease ranging from unpaid association dues, utilities, penalties, and/or damages to the LEASED PREMISES. 24, CONFIDENTIALLY: The LESSOR and the LESSEE shall keep confidential the terms of this Agreement and all confidential information that they may acquire in relation to the business or affairs of the other party. PETS: The LESSEE shall NOT allow any animal, fowl, fish, reptile, and/or pet of any kind on or about the Leased premises for any amount of time without obtaining the prior written consent of the LESSOR. 18, UNIT MAINTENANCE: The LESSEE hereby expressly acknowledges that the Leased Premises, including the furniture and fixtures, which were delivered by the LESSOR, are in good, clean and tenantable condition and, with respect to the furniture and fixtures, in good working condition. The LESSEE, in tur, shall at all times keep and maintain the Leased Premises as well as the furniture and fixtures, at his expense, in as good, clean and tenantable condition and, with respect to the furniture and fixtures, in good working condition, as when received ftom the LESSOR, taking into consideration any ordinary weat and tear on the Leased Premises and the furniture and fixtures. ‘The LESSOR shall be responsible for all major repairs on the Leased Premises, such as repairs on the ‘water heater, plumbing, electrical and sewerage installations caused by structural defects, including repa ddue to damage caused by fire, earthquake, war, storm, or other unforeseen or unavoidable causes or acts of nature; and on the furniture and fixtures fount to be defective or not functioning for the intended purpose under this Contract of Lease, except repairs due to the fault or negligence of the LESSEE, members of his household, guests or relatives. ‘The LESSEE shall be responsible for minor repairs incurred through ordinary usage, such as but not limited to replacement of light bulbs and fuses, breakage ot loss of faucet handles, drawers or cabinet pulls and catches, keys, locks, toilet mechanisms (seats and water tank covers), electrical switches or outlets and buzzers, minor faucet leaks and damaged door knobs, clogged toilet bowls, clogged sinks, broken screens and similar items that may be required in the Leased Premises, routine service and maintenance to be cleaned every 3 month by the authorized cleaner of air-conditioners (January ~ March, April ~ June, July = September and October ~ December) and other equipment in the Leased Premises which may be necessary for its preservation. It is understood, however, that the ownership of any fixture supplied or furnished shall still be with the LESSOR, It is further understood that any damage caused to the leased premises or to any fixture supplied or furnished by the LESSOR for the Leased premises (see Annex A list of furniture’ appliances) resulting from the fault or negligence of the LESSEE or any of the LESSE's occupants or guests shall be solely for the LESSEE’s account, and the cost to repair such damage to the leased premises or to repair or replace such damaged fixture shall be for the account of the LESSEE. Lessee shall ensure proper maintenance of appliances inside the unit by observing a regular cleaning schedule of the following ( but not limited to): Air Conditioning Unit ( quarterly), Grease Trap (every 3 ‘months), Range Hood Filters. Control of pests, such as cockroaches, rats, and the like are for the LESSEE’s account. 19, ENTRY AND INSPECTION: The LESSOR or its duly authorized representative, shall have the right to inspect or enter the Leased Premises at reasonable times, provided that the LESSOR gives at least one (1) day prior notice to the LESSEE for the purpose of checking the Leased Premises for repairs which may be deemed necessary for the use of the Leased Premises or for determining if there is any violation by the LESSEE of the terms and conditions of this Contract of Lease. The LESSOR shall be entitled without incurring any liability whatsoever, in the event of an emergency, to enter the LESSEE all unused rental payments and security deposit net of the amounts which may be deducted therefrom under this Contract. TThe foregoing does not preclude the LESSEE from pursuing all other legal remedies available under law. 20. SALES, TRANSFER, OR MORTGAGE: In the event of sale, transfer, morgage or any other encumbrance of the LEASED PREMISES, or in case of any existing sale, transfer, mortgage or encumbrance of the same, the LESSOR shall warrant that the purchaser, mortgagee, or encumbrancer shall respect and abide by all the terms and conditions of this Contract of Lease including the provision on renewal hereof, In case of a breach on the part of the LESSOR, or in case the LESSEE is evicted from the LEASED PREMISES before the expiration of the period of lease, the LESSOR shall pay the LESSEE by ‘way of liquidated damages the amount equivalent to one (1) month rental and shall return to the LESSEE all unused rental payments and security deposit net of the amounts which may be deducted therefrom ‘under this Contract. The foregoing does not preclude the LESSEE from pursuing all other legal remedies available under la 21, HOLD HARMLESS: The LESSEE during the occupancy of the Leased Premises shall hold the LESSOR. and SMDC representative free and harmless from any liability for any illegal and /or immoral acts by the LESSEE, its agents, guests, etc., including injury to any person or damage to property arising out of or as ‘consequence to the use of the Leased Premise: 22, RETURN OF PREMISES: Upon the termination of this Contract of Lease for any reason whatsoever, the LESSEE shall immediately vacate the Leased Premises and retum possession thereof to the LESSOR with all the keys thereto appertaining, devoid of all occupants, furniture and articles, and other movable effects of any kind owned by the LESSEE, except the Equipment. The Leased Premises shall likewise be 6. 14 Is. 16. UTILITIES: Water, Electric, Telephone, Cable, and Internet (but not limited to), shall be for the account of the LESSEE. Any fraction of the month shall be considered on the whole month in computing! paying the aforesaid expenses, except for water and electricity wherein charges are based on actual consumption. BREACH: Should the LESSEE fail to comply with the terms and conditions hereof, the LESSOR shall be entitled to terminate this Contract of Lease by notice of termination which shall become effective ten ( 10) days from service of such notice. Within ten (10) days from receipt of the notice of termination, the LESSEE shall immediately surrender the Leased Premises to the LESSOR, Moreover, all unused portions ‘of the advance rentals and the full amount of the Security Deposit shall be forfeited in favor of the LESSOR. In addition to the foregoing, any violation by the LESSEE of the terms and conditions of this Contract of Lease other than by non-completion of the term hereof shall be a sufficient ground for the LESSOR to terminate this Contract of Lease, without prejudice to any claim for damages arising from such violation, USE OF PREMISES: The premises shall be used exclusively for RESIDENTIAL purposes only of the OCCUPANTIS listed below. However, it shall remain the responsibility of the LESSEE to make the required monthly rental payments to the LESSOR notwithstanding the presence of any OCCUPANT of the LEASED PREMISES. The LESSOR reserves the right to terminate this Agreement if there are more than two (4) OCCUPANTS staying in the LEASED PREMISES at a time. a, OCCUPANT 1: CARA AMILA MARIE MACARAIG. b. In case LESSEE changes or replaces the OCCCUPANT/S more than twice, LESSEE shall be charged a penalty of Php 1,000 per person. Violation by the LESSEE shall be a sufficient ground for the LESSOR to terminate this Contract of Lease, without prejudice to any claim for damages arising from such violation, LIABILITIES NOT ASSIGNED: Any fe, particularly assigned and designated for the tenanUresident. (ic. Parking sticker expenses, RFID / Proximity card application fees, Miscellaneous fees pertaining to tenaney, or any other analogous fees) shall be for the account of the LESSEE (and its occupants) ASSIGNMENT AND SUB-LEASE: The LESSEE hereby shall have no right to assign or transfer its tights, interest, and obligation tothe leased premises or any portion thereof to any person or entity without the prior written consent of the LESSOR, ALTERATIONS: The LESSEE shall not make any alteration ineluding but not limited to; no drilling of holes, no sticking of hooks in the walls, locks, structural changes, or improvement in the leased premises ‘without the prior written consent of the LESSOR. However, at the termination of the lease, the same not having been renewed by the parties, the LESSEE shall restore the leased premises in its original state existing at the commencement of the agreement. Restoration of the leased premises shall be for the exclusive account of the LESSEE. Any improvement after the lease is terminated and after the LESSEE has vacated the premises shall belong to the LESSOR; ABANDONMENT: In case the LESSEE abandons or vacates the leased premises for more than thirty (80) days, the LESSOR shall be entitled to terminate this Contract and exercise its rights as provided hereunder. Any personal property belonging to the LESSEE and left on the leased premises shall be deemed to have been abandoned. In addition, LESSOR is hereby given the right to dispose of said property in private sale and to apply the proceeds to the payment of whatever indebtedness of LESSEE to the LESSOR and the balance, if any, shall be given to the LESSEE. LESSOR shall not incur civil and criminal liabilities whatsoever by exercising theit rights granted under these provisions. RULES AND REGULATIONS: The LESSEE agrees to abide by the existing rules and regulations contained in the Master Deed with Declaration of Restriction, Articles of Incorporation and By-Laws of Pacific Teon 1. HAZARDOUS AND PROHIBITED MATERIAL: The LESSEE shall not keep or store in the lease premise and hazardous and obnoxious substance or inflammable material or substance that might constitute a fire hazard or other chemicals and materials or prohibitive drugs in violations of the laws of the Philippines; NOISE: The LESSEE shall not allow any noise or activity on the leased premises which might disturb the peace and quiet of another residence and/or neighbor which may result in dispute. The LESSEE shall notify, in writing, the LESSOR Two (2) Months in advance on whether t0 renew or terminate this LEASE CONTRACT. Provided, however, that the security deposit cannot be applied to unpaid back rentals ‘owed by the LESSEE prior to the expiration of said contract, In case of renewal of lease contract, the Security Deposit of this contract shall be applied to renewal, provided, that any increase in the Secutity Deposit resulting from the increase of the monthly rent under renewal shall be paid by the Lessee along with the Advance Rent; PRETERMINATION: The LESSEE may terminate the lease before the expiration of its Term, provided that the LESSEE gives at least thirty (30) days written notice to the LESSOR prior tothe intended date of termination. In such a ease, the security deposit and any unused advance rent shall be forfeited in favor of the LESSOR, and the LESSEE shall remain, liable to pay any unpaid bills and damages to the LEASED PREMISES up until the time the pre-termination date has taken in effect. ‘The LESSOR may terminate the lease before the expiration of its Term, provided that the LESSOR gives at least thirty (30) days written notice to the LESSEE prior to the intended date of termination. In such a cease, the LESSOR shall return to the LESSEE all unused rental payments and security deposit net of the amounts which may be dedueted there from under this Contract. NONPAYMENT OF RENTAL: In case the LESSEE fails to pay rental, the LESSOR shall be entitled to temminate this Contract and exercise its rights as provided hereunder. The LESSEE futher authorizes the LESSOR to cut water and clectrcity in case of default of rental. In any case, the LESSOR shall be entitled to forfeit the security deposit paid to him by the LESSEE as and by way of liquidated damages.
