Question
The introduction of fundamental dishonesty was a long overdue response to
the increase in fraudulent low value personal injury claims. It is only fair that a
claimant found to be fundamentally dishonest should not be entitled to any
compensation.
You are required to produce an answer to this question in the form of an essay with a
research trail. A template research trail is attached if you wish to use it.
To answer this question, we advise that you start by using relevant primary and
secondary sources of information. You should focus on finding good quality
information, for example, reputable news sites, official and/or legal sources.
You should identify and define what is meant by fundamental dishonesty. You
may also want to locate appropriate information about the introduction of the
concept of fundamental dishonesty to civil claims, with relevant legislation, case
law and legal commentary.
You should analyse how the concept of fundamental dishonesty has been
applied and come to a reasoned discussion on what justifies your opinion.
Your discussion should be logical, and your arguments justified and easy to
follow.
Your total answer should not exceed 2000 words. We would normally expect a
research trail to be no more than 500 words, but you will not be penalised if it
exceeds 750 words, provided the Assessment does not exceed 2000 words in
total.
