Scenario
Taufiiq can’t afford to buy a home with his existing salary range. He heard about Rent-to-Own
Scheme, but the owner told him, it’s not acceptable in Malaysia because not regulated under the law.
Is it true ?

FALSE!

Rent-To-Own is a commercial concept with no prescribed meaning legally and not regulated under
any specific legislation. It can be initiated by anyone for as long as it is agreed and accepted by the
parties.

Owner of ready property, existing Landlords, existing Tenants, Property Developer can all easily
entered into any form of Rent to Own arrangement on a willing parties basis.

It’s a hybrid of the legal concepts of a lease/ tenancy and property ownership ultimately. It’s not new
as you can easily drawn an analogy to the common practice of hire-purchase for cars in Malaysia.
Basically, you hire (rent) the property for a period of time that entitle you to an option to ultimately
purchase the same (own). Hence, Rent to Own.

Top 5 Myths about Conveyancing

1. “I can do it myself”
We hear this one a lot! Conveyancing work can only be completed by someone who holds
accounts with LHDN and Land Office, which cannot be done without a lawyer or firm practising
certificate. Conveyancing also requires skills, knowledge and expertise that are acquired through
studying and working in the industry (not to mention the law is always changing)!

2. “Cheapest is best and will save me money”


While value is always important, when it comes to conveyancing this should not be the number
one concern. Of course you should still shop around for price, but make sure you compare other
things like experience, reviews and whether or not the firm offers fixed fees. If they don't offer a
fixed fee service up front, you may find yourself hit with a huge and unexpected bill at the end,
making your cheap deal a false economy.

3. “Its impossible to talk with your Conveyancing Lawyer”


Conveyancing lawyer might be busy but in today's modern age of email, texting and instant
message, there's no reason why your lawyer should be missing in action. If you hire a reputable
lawyer, you should always be able to get a reply from them, or at least someone in the office who
can help with your enquiries.

4. “I must use the lawyer that my real estate agent refers me to”
Your estate agent will probably offer you a deal. This may seem like the easiest option rather than
spending time searching for your own lawyer, but in most cases you will end up bearing the cost
of the estate agent's referral fee!

5. “Conveyancing is a very long process”


The biggest myth out there is that conveyancing can take forever to complete, but this is just not
the case. Without any complications or delays from the other party, you could be looking at

Recently, there is a viral video where the security guard block the tenant of a condominium from
entering their unit and there are a few bloodsheds happen due to the incident. The netizen
commenting in the comment section of the video was divided with two opinions as to whether the
management body shall have the rights to block his tenants entering the condominium.

So what is the legal point of this?

Management body’s function is to maintain and manage the building and common property in
accordance with the Strata Management Act, 2013.

So long as you and your tenants do not breach any by-laws and additional by-laws of management
body, the management body has no rights to interfere you and/or your tenants from entering the
condominium.

If they block your tenants from entering the condominium for no reason or unreasonably, you may file
a claim to Strata Management Tribunal!

Therefore, we can’t really tell as to what triggered the incident in the video to happen but just
remember this tip whenever you are facing a problem like this.
