beingabused and neglected and that the said Lisa Perdue observed the child being subjected to conditions that were likely to result in abuse and neglect, failed to within 24 hours report the circumstances of the abuse and neglect to the Department of Health and Human Resources, to-wit: did observe the classroom teacher, Nancy Boggs, repeatedly verbally abusing A.S., a non-communicative child of nine years of age, without reporting the incident to the Department of Health and Human Resources within 24 hours, against the peace and dignity of the State of West Virginia, in violation of
