The Competition:

1.1. The competition is being organised by the distributor of 1800 Tequila


Proximo Spirits (the Organiser) and is being run by Cow PR (the Agency).

1.2. The competition will be open on the 31st August 2022 to the 6th September
2022. By entering the competition, the participant expressly accepts these
terms and conditions. Participants can enter the competition by sharing a
comment about ‘who they would take along to the 2022 Mercury Prize with
FREE NOW ceremony’ on the 1800 Tequila UK’s Instagram, Twitter or
Facebook profiles. A winner will be randomly selected from the responses.

1.3. The Organiser and the Agency are making the competition available on
Facebook, Instagram and Twitter in the UK. Internet access is required to
participate.

1.4. Participation is free of charge and independent of the purchase of goods or


services. The judges’ decision is final.

Who can enter?

2.1. Any person aged 18 years or over, is able to supply proof of ID and is a
resident in the United Kingdom is eligible to enter.

2.2. Employees of the Organiser and its affiliated companies, employees of the
Agency, freelance contractors and agents and each of their respective family
members and other persons who are professionally connected with this
competition are not eligible to enter.

2.3. Participants may enter the competition more than once.

2.4. The close of entries for the prize is at 11.59pm (BST) on the 6th September
2022.

How can I enter?

3.1. During the promotional period, participants have the chance to win two
tickets to the 2022 Mercury Prize Awards with FREE NOW by sharing ‘the
artist they want to see go home with the Mercury Prize this year’ via a
comment on one of the 1800 Tequila UK’s profiles on Instagram, Twitter or
Facebooksocial media platforms.
3.2. The Organiser and the Agency reserve the right to exclude submissions
from the competition and to delete them if they do not fulfil the task or if they
contain any undesired content such as insults, inaccuracies, infringements of
competition, trademark or copyright law, violence, threats, self-harm,
bullying, harassment, hate speech, discriminatory content, obscene or explicit
content, nudity, the intellectual property of third parties or content that poses
a risk to safety, or reputation. In such cases, prizes may also be disallowed in
retrospect.

3.3. The participant indemnifies the Organiser and the Agency from all claims
arising in connection with such non-permitted entries and/or any undesired
content as listed in Clause 3.2.

3.4. Messages will be checked for any possible obscenity or other undesired
content as listed in Clause 3.2, e.g. discriminatory content. The Organiser and
the Agency reserve the right at their sole discretion not to publish these
contents. If this happens, the comment will be deleted and the entrant barred
from entering the competition.

3.5. The participant affirms that he/she/they is/are the sole creator of the text
submitted or holds all the necessary usage rights for the purposes of the
competition. If the text depicts other persons or property in addition to the
participant in recognisable form, the participant affirms that he/she/they
has/have the consent of such persons to freely dispose of the text for the
purposes of the competition and in particular to disseminate it to third parties
and publish it on the Internet. In general, the participant affirms that
he/she/they has/have respected all relevant usage rights, ancillary copyrights
and other rights relating to the text and that the text is free of third-party
rights.

3.6. By entering this competition, the participant transfers all transferable


usage rights to the text submitted, unlimited in time and without geographic
or content-related restrictions, to the Organiser, particularly the right to
publish the text on 1800 Tequila’s social media accounts, or make it otherwise
publicly available, the right of duplication and the right to give third parties
usage rights for the photo produced. No payment shall be due. The participant
will take all necessary steps and obtain all necessary documents to assert the
rights promised here to the Organiser. In particular, the participant may be
required to personally assert the rights of the Organiser. The participant
indemnifies the Organiser and the Agency from all claims arising against the
Organiser or the Agency in connection with the uploaded image.

3.7. Participation via competition services and automated competition


procedures (or similar) is not permitted, and no purchase is necessary. The
Organiser and the Agency reserve the right to remove or exclude participants
from the competition without stating reasons. Participants who try to disrupt
the competition or give themselves an unfair advantage by using prohibited
tools shall also be excluded from taking part.

3.8 The Organiser cannot be held accountable for entries submitted via social
media platforms which are not visible or searchable due to user’s social media
privacy settings.

4. What is the prize?

4.1. Throughout the promotional period, 1 recipient will be selected to win two
tickets to the 2022 Mercury Prize Awardswith FREE NOW to be held at
Eventim Apollo, 45 Queen Caroline St, London W6 9QH at 7pm on Thursday
8th September 2022 (the Event).

4.2. Please note, there is 1 prize available across all three social platforms,
Instagram, Twitter and Facebook. Not 1 for each.

4.32. If a prize (or part of the prize if applicable) is no longer available for
reasons beyond the Organiser’s control, the Organiser reserves the right to
offer an alternative prize.

4.4.3 The prize winner and his/her/their guest will be subject to the Mercury
Prize Limited Ticket terms and conditions, a copy of which can be viewed at
http://www.mercuryprize.com/terms-conditions, and the full terms and
conditions of the Eventim Apollo which can be viewed on the venue’s website.
Prize winner and his/her/their guest are prohibited from reselling,
transferring, exchanging or auctioning the prize to other people or on third
party websites.

5. How will the winner be selected and notified?

5.1. The independent judges will choose one winner from all eligible entries.

5.2. The winners will be notified after the draw via DM on their chosen
platform. If the winner cannot be contacted using the handle provided, or if
he/she/they fails/fail to confirm his/her/their email address details during
this period, the prize will be forfeited.

5.3. Winner’s Christian first names will be made available on the 7th of
September if requested.
5.4. The Organiser and the Agency accept no liability if the winner’s
notification is lost when electronically sent and/or does not reach the winner
for reasons beyond their control.

6. How will I receive my prize?

Winner will be requested to send his/her/their email address by direct


message. The prize will then be sent to the email address provided. The
notified winner is responsible for providing the correct name and email
address. The Organiser and/or the Agency accept no responsibility if a prize
cannot be delivered for any reason or is lost in the transit.

7. Miscellaneous

7.1. The Organiser and Mercury Prize Limited hereby makes it known that the
availability and functioning of the competition and the Event cannot be
guaranteed. If the competition has to be ended or removed due to external
circumstances or constraints, e.g. technical problems, rule changes or
decisions by platforms such as Instagram, participants shall not be entitled to
make any claims against the Organiser, Mercury Prize Limited or the Agency.
If any individual provisions of these terms and conditions are or become
ineffective, the effectiveness of the remaining provisions shall not be affected.

7.2. The Organiser, Mercury Prize Limited, the Agency and their associated
agencies and companies shall not accept any contractual, non-contractual or
other liability as far as this is legally admissible, particularly any liability for
any loss (including, without limitation, indirect, special, or consequential loss
or loss of profits), expense, injury, damage or disappointment suffered or
sustained (whether or not arising from any person’s negligence) connected in
any way with accepting and using the prize, except for any liability which
cannot be excluded by law (including personal injury, death and fraud) in
which case that liability is limited to the value of the prize.

8. Changes to the terms and conditions

The Organiser reserves the right to change the terms and conditions at any
time if there are good reasons for doing so. The Organiser will make every
effort to ensure that any changes do not affect participation in the
competition. If any individual provisions should be or become invalid, the
validity of the remaining terms and conditions of use shall not be affected.
