INTELLECTUAL PROPERTY (IP)

a. Definition of Intellectual Property - refers to creations of the mind, such as
inventions; literary and artistic works; designs; and symbols, names and images used
in commerce.
b. INTELLECTUAL PROPERTY IS PROTECTED IN LAW
Republic Act No. 8293 [An Act Prescribing the Intellectual Property Code and
Establishing the Intellectual Property Office, providing for its Powers and Functions,
and for other Purposes] otherwise known as the Intellectual Property Code of the
Philippines.

Four types of Intellectual Property:

TYPES OF INTELLECTUAL
PROPERTY

COPYRIGHT PATENT TRADEMARK INDUSTRIAL

DESIGN

Most products can be protected by all four types of intellectual property

rights. Take, for example, a can of Coca-Cola®. The brand, “Coca-Cola,” is a
trademark. copyright protects the packaging art. The shape of the Coca-
Cola® bottle is protected by (1) a Industrial design, (2) patent and (3) a
trademark (i.e. trade dress).

1. COPYRIGHT - the exclusive legal right, given to an originator or an assignee

to print, publish, perform, film, or record literary, artistic, or musical material,
and to authorize others to do the same.

Doctrine in the Law of United States of America that permits limited use of
copyrighted material without having to first acquire permission from the copyright
holder. Wikipedia
2. PATENT -  an exclusive right granted for an invention
- provides the patent owner with the right to decide how - or whether
– the invention can be used by others.

Patent Infringement?

3. TRADEMARKS - a sign capable of distinguishing the goods or services of one

enterprise from those of other enterprises.

Example for Trademarks:

TRADEMARK INFRINGEMENT?

4. INDUSTRIAL DESIGN -  is the professional practice of designing products

used by millions of people around the world every day. Industrial
designers not only focus on the appearance of a product, but also on
how it functions, is manufactured and ultimately the value and experience
it provides for users.
Example for Industrial Design:
 Coke Contour Bottle. Coke's bottle needed to be distinctive and
instantly recognisable - even in the dark. ...
 Rocking Wheel Chair. ...
 Dyson cyclone vacuum.
Industrial Design Infringement?
 Industrial design infringement occurs when someone applies a registered
industrial design or a design not differing substantially, to an article, for
the purposes of sale, rental, or exposure for sale, without the permission
of the owner.

c. ABSTRACTION:

Intellectual Property meaning if an idea stays in your head, it is just an idea, if we

convert an idea into a song, book, product or design then, it becomes an Intellectual
Property. Now, the Idea has value and many protections. Protection can be a form of
trade secret, trademarks, copyright and patent.

c. APPLICATION:

FACT OR BLUFF?

This activity allows the students to choose same product brand name or Intellectual
Property. Each group will present to the class with the product selected and identify
what types of Intellectual Property. Define ways to modify which product is original
and derivative works.
