At 9:40 in the morning, Vice Mayor J. Melchor B. Quitain Jr.called the session to
order. Councilor Al Ryan S. Alejandre led the prayer which was followed by the singing
of the Philippine National Anthem and “Tayo’y Dabawenyo”.
Upon direction of Presiding Officer Quitain Jr., Ms. Charito N. Santos, Secretary
to the Sanggunian, called the roll which established that twenty-two (22) Members
of the Body were present. Since the presence of a quorum was determined, the Body
continued with the agenda.
At this point, Presiding Officer (PO) Quitain Jr. acknowledged and welcomed
some members of the Student’s Assembly of Ateneo de Davao University who were
present to observe the proceedings.
After wishing everyone a happy 37th Kadayawan, Floor Leader (FL) Jesus Joseph
P. Zozobrado III proceeded to move for the approval of the Minutes of the Regular
Session held on August 9, 2022, duly seconded by Councilors Jessica M. Bonguyan,
Pilar C. Braga, Wilberto E. Al-ag, Trisha Ann J. Villafuerte, Dante L. Apostol Sr., Temujin
B. Ocampo, Augusto Javier G. Campos III, Conrado C. Baluran and Bai Hundra
Cassandra Dominique N. Advincula, . There being no corrections, the motion was
carried.
FIRST READING
Continuing with the next part of the agenda, FL Zozobrado III presented a
motion, duly seconded by Councilors Baluran, Ocampo, Campos III, Braga, Advincula,
B.E. Al-ag and J.M. Bonguyan, to consider the following Item Nos. 164 to 190 to have
been read and passed under First Reading:
164. Letter of Olegario T. Brito Jr., President, Davao Dencia’s Restaurant, requesting the
City Council to convert the portion of General Luna Street to a pay parking zone,
for appropriate action of the Body.
165. Letter from the City Transport and Traffic Management Office requesting for the
amendment of the Comprehensive Transport and Traffic Code of Davao City, to
include a provision which distinguishes Conventional Pedal-Operated Tricycles
from “Non-Conventional Pedal-Operated Tricycles”, for appropriate action of the
Body.
166. Petition letter from Calinan Tricycle Operators and Drivers Association relative to

Museums in the entire country who cited various problems in Bucana like improper
utilization of sidewalks, canals full of trash that causes flood, problem in parking,
etc., for appropriate action of the Body.

At this junction, PO Quitain Jr. directed the SP Secretary to change the status of
Councilor Diosdado Angelo Junior R. Mahipus from absent to present, which was duly
noted.
It was at this point when PO Quitain Jr. directed the SP Secretary to change the
status of Councilors Marissa S. Abella and Luna Maria Dominique S. Acosta from absent
to present, which was duly noted.
Reporting about the traffic situation of the City,P/SUPT Dionisio Abude (Ret.)
manifested that the Smart Traffic Signalization Concept started in 2004. Phase 1 was
completed in 2008 but said project was completed and became fully operational in
2010. The Traffic Operation Center (TOC) was operated by the Public Safety and
Security Command Center (PSSCC) in coordination with the Traffic Management Center
(now CTTMO). At this time, the No Contact Apprehension Policy was implemented

which means that the TOC captured vehicles which violated traffic rules especially on
signalized intersections. However, in 2019, the maintenance provider Abratique &
Associates failed to comply with the deliverables which led to the termination of the
contract. Since then, the City has no contractor for the maintenance of the traffic
signalization. Moreover, P/SUPT Abude presented the following challenges that the City
is facing when it comes to its traffic situation:
On the other hand, the following are other challenges that also affect the traffic
situation:
1. Road Works of the Department of Public Works and Highways (DPWH) and the
City Engineers Office (CEO) such as road widening and rehabilitation;
2. Road Excavations by Davao City Water District (DCWD) as well as the
Underground Cabling Project (City Ordinance 0152-17, Series of 2017);
3. Road Crashes which may lead to damaged traffic signal components; and
4. Obstructing Poles of Telecommunication Companies.
Citing some examples of projects that destroyed the City’s traffic lights, P/SUPT
Abude mentioned that there are no traffic enforcers or personnel from traffic planning
present when excavations are done. CTTMO usually discovers that the wireshave been
cut when they try to replace the bulbs. Furthermore, he mentioned that CTTMO
already made the recommendation that, before the different agencies start digging,
there should be presence of CTTMO personnel.
P/SUPT Abude likewise manifested that, at present, the City installed Eight
Hundred Thousand Pesos (PHP 800,000.00) worth of replacement LED bulbs in May
2022. Upon the other hand, they are already processing the procurement of additional
traffic signal cabinet components and wirings/cabling along with additional replacement
LED bulbs worth Eight Million Pesos (PHP 8,000,000.00).
In sum, there are 62 intersections with traffic lights. 29 of them are operational,
5 are flashing, 27 have been shutdown and 1 has been removed. The following are the
status of the aforementioned traffic lights:

Nevertheless, P/SUPT Abude pointed out that, although the Traffic Operations
Center will be upgraded, the City does not have enough facilities as the CTTMO does
not even have its own building.
Notwithstanding the foregoing, P/SUPT Abude revealed that CTTMO has been
exerting earnest efforts to address the problem on traffic congestion. Traffic
congestion may occur, not only because of construction of roads, but it may also be
caused by the limited capacity of thoroughfares such as the situation at the crossing in
Matina which has been identified as a bottleneck. DPWH plans to transfer the
pedestrian overpass near Centerpoint Plaza before the roads will be widened. In
addition, the traffic scheme for Panacan has been presented to the City Mayor. There
are also traffic plans that have been presented to the City Transport and Traffic
Management Board.
At this point, P.O. Quitain Jr. manifested that the status of Councilors Bonz Andre
A.Militar and Richlyn N. Justol-Baguilod have been changed from absent to present.

am while Richlyn N. Justol-Baguilod arrived 10:08 am.)

Addressing the questions of Councilor B.E. Al-ag, P/SUPT Abude stated that
the City does not have extra bulbs anymore. He explained that the maintenance
provider used to replace busted bulbs, however, there is no maintenance provider
anymore since the contract with Abratique and Associates was terminated. Further,
the City lacks personnel who are technically knowledgeable regarding traffic lights.
There is also a delay in the procurement of bulbs due to the cancelled contract. To be
more efficient and effective in replacing busted bulbs, P/SUPT Abude manifested that
they are planning on the full restoration of traffic lights especially those placed at
intersections. The estimated budget is pegged at One hundred Million Pesos (PHP
100,000,000.00). Since CTTMO does not have the capacity to perform the maintence
work, he recommended to find another contractor to perform such task.
On whether the City should go for the timed traffic lights or the sensor type,
P/SUPT Abude expounded that the traffic lights with timer or counter is obsolete since
the vehicles have to stay until the allotted time is done. Contrary to this, with the
sensor type, there is only a set period of time wherein if the sensor does not detect any
vehicle, then it will automatically give way to the other side. Thus, he recommended
the use of the sensor or camera type of traffic light. Councilor B.E. Al-ag suggested
to have a clear direction so the planning of the City will also be centralized and properly
coordinated.
P/SUPT Abude further manifested that, currently, CTTMO has 892 personnel.
Councilor B.E. Al-ag suggested to add personnel who are more knowledgeable
especially on information technology. He also asked for the recommendation of P/SUPT
Abude regarding the system, personnel and infrastructure in order to guide the
Sanggunian. In addition, P/SUPT Abude stressed that the plans must be in harmony
with HPBS.
Upon clarifying with the resource person that there is a need to procure a new
traffic signalization system but it has to wait for the HPBS project to be operational,
Councilor Mahipus emphasized that the Sanggunian needs his help in order to craft
policies to address the increasing traffic woes of the residents of the City. Traffic
signalization is just one of the components of traffic management. Since HPBS project
has to be taken into consideration, he asked P/SUPT Abude for recommendations as to
what policies should be enacted. Furthermore, he asked if they considered establishing
zipper lanes during peak hours so vehicles traversing the busy lanes may use part of
the less busy lanes.
In response, P/SUPT Abude explained that they already crafted a traffic plan
which includes their recommendation for a lane dedicated to trucks. As for the
question whether they have denied an application for Traffic Impact Assessment of
subdivision developers on the ground that the road capacity will not be able to
accommodate the new community, P/SUPT Abude answered that they do not deny the
application outright but the applicant is given a chance to make another traffic plan for

the new community. If there is a new plan already, they will conduct another
inspection then decide on the application based on the new plan.
Councilor Mahipus noted that there are certain areas where communities are
concentrated but the roads are not wide enough to accommodate the traffic that the
new communities will bring. He also manifested that the City Mayor already
reconstituted the Infrastructure Monitoring Advisory Group which will allow better
coordination amongst the various agencies. Since there are still lapses and some
agencies still fail to coordinate with CTTMO, he proffered that CTTMO can submit a list
of contractors who did not coordinate with them so the City Council may pass a
Resolution requesting DPWH to blacklist such irresponsible contractors. In this way, the
contractors will also realize that the City means business. To this, P/SUPT Abude agreed
and pointed out that it is one of their recommendations.
When Councilor Mahipus suggested to refer the matter to the proper committee,
PO Quitain Jr. added that the same will also be discussed in the Executive-Legislative
Agenda. He likewise suggested to deploy more traffic aides to watch over the
intersections mentioned earlier in the discussion since most of the traffic lights are
damaged or busted and netizens have been complaining in the different social media
platforms regarding the traffic situation of the City. M Furthermore, he suggested suing
those who damaged the facilities. When the Presiding Officer also announced that 3 rd
District Representative Isidro T. Ungab had the legislation on the Metro Davao
Development Authority, P/SUPT Abude explained that this will expand the scope of
CTTMO.
After Councilor Braga summed up the following issues identified during the
discussion: personnel, maintenance, expertise as far as traffic signalization is
concerned, and procurement, she stated that a well-maintained traffic system could
ease traffic congestion, save lives, and promote order in the streets, however, poorly
maintained non-functioning traffic lights may cause accidents and loss of lives and
property. She then suggested that the matter be referred to the Committee on
Transportation and Communications.
In view of the fact that the matter also entails budgetary requirement, Councilor
L’Dalodo-Ortiz suggested to refer the matter to the Committee on Transportation and
Communications jointly with the Committee on Finance Ways and Means and
Appropriations.

Afterwards, a recess was declared by the Chair to welcome distinguished guests
who are members of the Knights of Rizal, especially their Supreme Commander, Vice
Mayor Gerardo V. Calderon of the Municipality of Angono, Rizal and Dr. Rene Elias C.
Lopez, former Davao City Councilor and current member of the Board of Directors of
PhilHealth.

Upon resumption of the session at 11:15 in the morning, F.L. Zozobrado III
presented a motion, duly seconded by Councilors Braga, Acosta, Campos III, J.M.
Bonguyan and Baluran, to recast the agenda and proceed to the Privilege Hour.
PRIVILEGE HOUR
Raising the matter of the rights of Persons With Disability (PWD) to the forefront,
Councilor L.B. Villafuerte first recognized the accomplishments of para athletes who
participated in the ASEAN Para (Paralympic) Games.
With praises and salutations to the Davaoeño para athletes who participated in
the 2022 ASEAN Para Games, Councilor L.B. Villafuerte presented a motion, duly
seconded by Councilors Advincula, Acosta, Ocampo, Abellera Jr., Campos III, L.J.
Bonguyan, Baluran, Braga, W.E. Al-ag, Mahipus, Marohomsalic, Alejandre, Mande, T.A.

Villafuerte and J.M. Bonguyan; co-sponsored by Councilors J.M. Bonguyan, Braga, W.E.
Al-ag, Advincula, Baluran, and Alejandre, for the approval of the Resolution entitled:
The Chair then declared a recess to make way for the photo opportunities with
the para athletes.
When the session resumed at 11:28 in the morning, Councilor Baluran was
recognized to deliver his privilege speech.
He narrated that, on January 2021, Ordinance No. 0394-20 was signed into law
which amended Section 1 (o) of Ordinance No. 0564-13, otherwise known as the
Comprehensive Zoning Ordinance of Davao City. This amendment removed the
categories “CELL SITES” and “TELECOMMUNICATION TOWERS” from among those
entities necessitating a favourable endorsement from the Local Zoning Board of
Adjustment and Appeals (LZBAA). Pursuant to Memorandum Circular No. 1, Series of
2020 of the Department of the Interior and Local Government (DILG), at least six (6)
national and local requirements are no longer required including barangay and SP
Resolution. This measure allows TELCOs to fast-track their installation of cell site
towers.
Consequently, cell sites are sprouting like mushrooms without consulting the
barangay or residents of such areas. This caused residents to file complaints on
grounds of environmental and health based concerns.
At tis point, PO Quitain Jr. manifested that the status of Councilor Rodolfo M.
Mande has been changed from absent to present.
On the occasion of the 37th Kadayawan, the King of Festivals, Councilor Abella
passionately spoke of uniting the Indigenous Peoples/Indigenous Cultural Communities
(IP/ICC) in Davao City. According to her, the IP/ICC face the following difficult and
pressing issues:
1. The rampant buying and selling of Ancestral Domains has given way to economic
development but has starved the members of the IP.
2. The lack of economic opportunities for the IP members forced their hands to sell
said Ancestral Domains.
4. The dimming of the culture and tradition of the tribes due to the next
generation’s disinterest to preserve and protect their Cultural Heritage.
5. The lack of education among the tribes that’s why members are easily deceived,
misled, and deluded, resulting in their mistrust of those who are external,
making the duty of public servants extra difficult.
6. The fact that the few trees on the slopes of Ancestral Domains decrease water
infiltration and increase water runoff, thereby contributing to floods.
2. Giving workshops and sets of training to the members so they can learn about
the improved technology of planting high-value crops on their parcels of land.
3. Helping the members identify the right high-value, fruit-bearing trees to plant on
the slopes of their Ancestral Domains, and then connect them to a huge market
(e.g. The Puyat variety of Durian to be exported to China).
These efforts will have the following beneficial effects to the IP/ICC:
1. If they stop selling their Ancestral Domains for money, the clans of every tribal
group will remain intact; their traditions and practices preserved, and their
heritage safeguarded.

2. If they learn how to plant the trees that will give them sustainable income, there
will be less runoff of water and sediments to the lowlands, reducing flood risks
and keeping each resident safe from landslides and other similar natural
disasters.
3. If they stop worrying about the food security of their tribe, they will send their
children to schools so that someday the next generation will gain professions
that bear the pride of the tribe.
Although the City already installed 2,000 new light posts, there is still room for
improvement of roads and highways. The City must also improve road conditions and
add light studs and road signs. In the effort of furthering the goal of making Davao City
a safer place, Councilor J.M. Bonguyan presented a motion, duly seconded by
Councilors Advincula, Acosta, Justol-Baguilod, L’Dalodo-Ortiz, L.B. Villafuerte, T.A.
Villafuerte and Braga, to consider her privilege speech as having been read and passed

In view thereof, Councilor Justol-Baguilod presented a motion, duly seconded by

J.M. Bonguyan, to consider her privilege speech as having been read and passed under

PO Quitain Jr. took a moment to congratulate and thanked everyone for the
successful vaccination rollouts.
- The formation of programs that form part of regular activities allowing students
to develop their own faith and barring academic institutions from mandating
activities that cater only to one specific religion; or
- Developing Muslim / Islamic counterparts to Retreats and Recollection; and
- As an alternative, the formator in these programs can allow for Qur’an
counterparts to bible verses.

As for the Muslim Youth, they plan to gather the presidents and other officers of
the different MUSLIM YOUTH ORGANIZATIONS, MUSLIM STUDENT ASSOCIATIONS and
MADARIS SSG officers for a Bitiala Session in order to educate them on their role as
Davao Youth in Local Governance and the need for them to consolidate themselves and
select their representative to the Council.
Bringing to the attention of the Body the matter of dumping of charcoal waste,
Councilor Ocampo reported that he received an inspection report from the City
Environment and Natural Resources Office (CENRO) about the open dumping of
charcoal waste at Puroks 1 and 2, Barangay Mudiang and Sitio Lambo, Barangay
Indangan.
For Barangay Mudiang, the CENRO report described the incident as “inadvertent
disposal” wherein the charcoal waste was used as earth fill to level the road in Purok 1-
B and Purok 2-A as ordered by a certain “Mr. Rafael Intia, Jr.” and a certain “Mr. Orly
Marabi,” respectively.
However, the charcoal waste was not just regular charcoal. The inspection team
found out that the discarded substance was, in fact, a mixture of charcoal and oil. In
effect, the presence of oil made the roads slippery and threatened the safety of
residents passing through. Being a hazard, the substance was removed and temporarily
placed on the side of the road until a definite solution is settled.
Further, the inspectors said that the substance found in Barangay Indangan
emitted a strong odor of oil, which means that the charcoal waste also has the
presence of oil similar to that found in Barangay Mudiang.
The inspection report noted that the charcoal wastes were actually “activated
carbon” that is used to filter and refine edible oil such as those used by oil
manufacturing plants.

As Councilor Dayap was given leave by the Presiding Officer to discuss first Item
Nos. 45, 46, 47, 137 & 138, he presented the following subject matters:
The committee found that all five (5) applicants for accreditation have fully
complied with the requirements and that the documents they submitted are all in order.
Duly seconded by Councilors Advincula, Braga, Campos III, J.M. Bonguyan, T.A.
Villafuerte and L.B. Villafuerte, the motion presented by Councilor Dayap for the
approval and adoption of the Committee Report was carried.
Item No. 44
Councilor Dayap next presented Item No. 44 relative to the Loan Agreement to
be entered into by and between the City of Davao and Davao City Homesite and
Housing Multipurpose Cooperative for the financial assistance in the amount of Three

Hundred Thousand Pesos (PHP 300,000.00) under the Enhanced Livelihood and
Enterprise Assistance Program (ELEAP) of CSSP-Cooperative Financial Assistance
Program of the City (CFAP). The committee determined that Davao City Homesite and
Housing Multipurpose Cooperative complied with the requisites for the Cooperative
Financial Assistance Program (CFAP) in line with the Enhanced Livelihood and
Enterprise Assistance Program (ELEAP) of the City. The proponent presented a motion,
duly seconded by Councilors J.M. Bonguyan, L.B. Villafuerte, T.A. Villafuerte, Campos
III, Braga, L’Dalodo-Ortiz, Alejandre, Marohomsalic, Mande, L.J. Bonguyan and
Advincula, for the approval and adoption of the committee report.
Item No. 50
Councilor Ungab was next recognized to present Item No. 50 relative to the
letter of Daniel A. Cuizona, Regional President, Veterans Federation of the Philippines,
Region XI, requesting support for the acquisition of five hundred (500) square meter
government lot situated at Rasay St., Toril, this City, in favor of the federation for the
proposed construction of VFP- Regional Office building in Davao City. After deliberating
on the matter, the committee found that the property is registered under the name of
the Republic of the Philippines and that the Master Plan of the City is still being
completed by the City Architect. In view thereof, the committee recommended closing
Item No. 50. The proponent then presented a motion, duly seconded by Councilors
Braga, L.B. Villafuerte, Mande, T.A. Villafuerte and J.M. Bonguyan, for the approval and
adoption of the committee report.

As for the item from her own committee, Councilor Braga presented a motion,
duly seconded by Councilors Mahipus, L.B. Villafuerte, J.M. Bonguyan and T.A.
Villafuerte, for the approval of a Resolution commending the City Environment and
Natural Resources Office (CENRO) for its recent report on parks and playground
development.
Prior to the approval of the motion, Councilor Mahipus manifested his support for
the commendation, nevertheless, he took the opportunity to suggest that parks should
have facilities for physical fitness. Pointing out that Osmeña Park has such physical
fitness facility, there is none in other parks in the City. Furthermore, he proffered that
perhaps the Parks System Board can find ways for parks to be interconnected through
permeable pathways. Thereafter, the following resolution was approved:
