Course Description: A clinical offering which exposes the students to the practical
aspect of the law, particularly in the trial of cases.

Part I. Genesis of a case

A. Criminal Case

Learning Objectives:
-Review of Rule 113, Section 5, Rules of Court
-Review of Rule 112, Rule 110 of the Rules of Court
-Immerse in real life legal work situations, acquaint one’s self with the early stages of a
case for filing in court
-Confront client problems in a way practicing lawyers do
-Develop analytical and problem-solving skills necessary in preparing for
inquest/preliminary investigation/trial and arriving at correct and viable solutions
-Review of and familiarization with rules on evidence in the actual
set up

Activity Requirements:
-Case Study, written report (with recommendation of action, laws and rules applicable,
evidence and manner of prosecution)

Guidelines:
1. Team/Group of 2 students
2. Select a potential or actual case; source out from acquaintances, family, friends or your
online community
3. Case may be for filing; already in the barangay lupon; under police investigation;
under inquest or preliminary investigation.
4. Get factual antecedents.
5. Obtain evidence available; if none available, prepare your own like affidavits, pictures,
etc...
6. Submit written report (to include factual background on arrest [Rule 113, Section 5]
and/or inquest/preliminary investigation [Rule 112]; pieces of evidence obtained or
evidence to be presented or utilized and their purposes in the proceedings)
7. Report must include preparatory paper/written work and requirements in the Rules
(Rule 110) for the filing of cases in court.
8. Provide ID and contact numbers for clients or officer in-charge from government
office from where the case is taken.

Alloted period of compliance: 3 meetings (August 16, 23 and 30, 2022)

Date of Submission of Written Report: September 6, 2022

B. Civil/Labor Cases:

Learning objectives:
-Encourage hands-on learning
-Enhance problem solving skills through a specialized case
-Review of rules of procedure in the filing of civil, corporate, or labor cases

Activity Requirements:
-Case study, written and oral reports (with recommendation of action, laws and rules
applicable, evidence and manner of filing)

Guidelines:

1.Team/Group of 2 students
2. Select a case study from 2 types of cases (civil or labor)
3. Groups should be equally divided with the assignments (e.g. if there are 8 groups in the
class, 4 groups will handle civil cases and 4 groups will have labor cases)
4. Provide identification cards for client and contact numbers

5. Identify case to file, provide possible evidence (actual or available, or draft those
intended to be used and offered as evidence); actual pending cases or already filed in the
barangays or courts are not allowed

6. Provide ID and contact numbers for clients or officer in-charge

Alloted period of compliance: 3 meetings (September 6, 13 and 20, 2022)

Part II. Case in Court

Learning Objectives:
-Know preliminaries to trial
-Review Rules of Court - Review Rules on Civil Procedure, Criminal Procedure &
Evidence
-Immerse in actual preparation for and participation in (mock) trial.

-Develop analytical and problem-solving skills necessary in trial


-Review of and familiarization with rules of procedure and evidence Integrate rules of
procedure and evidence with trial technique
-Hone one’s sense of discretion and judgment by developing a sound legal strategy from
a variety of cases observed in actual trials
-Appreciate and consider the externalities that may result from a
lawyer’s course of action

Activity Requirements:
Summary of objections and illustrations, case folder with pleadings and evidence, mock
trial

Guidelines:
A. Grounds of objections

1. Individual work

2. Prepare a written summary of at least 15 objections with illustrations/ situations (cite


authority: rules of procedure, jurisprudence, book annotations or opinion of experts)

Alloted period of compliance: 2 meetings (October 4 and 11, 2022)

Date of Submission: October 18, 2022

B. Preparation of pleadings and mock trial

1. Class will be divided in two or three groups (for criminal and civil cases)
2. Case assignments will be given
3. Depending on assigned grouping, prepare pre-trial briefs and evidence for marking
(additional assignments on incidents or motions may be given
4. Mock trial to be held (upon completion of paper work requirements) onsite, face-
to-face
Alloted period to prepare case folder: 3 meetings (October 25, November 8 and 15,
2022)
(e.g. for crim case, case folder will include Information, Resolution of Investigating
Prosecutor, etc..)

Date of submission of case folder: November 22, 2022


Online consultation before actual mock trial: Anytime

Actual mock trial sched: November 29, 2022

Part III. Trials and Appeals

Learning Objectives:
1. Review of trial & appeal procedures;
2. Review of the Rules of Court (Civil and Criminal Procedure, Evidence, Special
Procedure)

Guidelines:
1. Individual Work
2. Prepare a Flow Chart of the Procedure in the Filing and Prosecution or Trial of a Case
until Appeal to the Supreme Court
3. Chart should include specific rule/s applicable in filing for plaintiff or petitioner, rule/s
for remedies or pleadings available to respondent or defendant. Ex: Crim Case: Rule 114
(Bail)
4. Incomplete flow chart will be returned with “fail” grade

5. Subject matter assignments to be announced

Alloted period of compliance: 2 meetings (December 6 and 13, 2022)
