This Judicial Affidavit of KENDEE MONTERONA, witness for the

Defendant of the above case, is executed to serve her direct testimony in

the instant case.

PURPOSE AND OFFER

The testimony of the witness is offered to prove the following:

1. To issue a testimony as witness to the criminal complaints for Grave

Oral Defamation under Article 358 of the Revised Penal Code filed by

Nor-Hannah Alawi.

2. To prove that the respondent is not guilty of Grave Oral Defamation

3. All other related matters, facts and circumstances relevant and

material to this case.

KENDEE MONTERONA: I do.

1. Question: Please state your name, your relationship to the


respondent and other personal circumstances, witness.

Answer: My name is Kendee Yabeetys Monterona, I am the younger


sister of the respondent and a resident of Pala-o IIligan City.

2. Question: Can you state where you were on around 9:00 in the
morning on February 1, 2022?
Answer: Before the Baranggay event started, I was accompanying
my mother together with my brother Eldee at Mrs. Alawi’s residence
to visit my father who is working as a driver for her. Our mother was
looking for my father while me and Eldee are on his quarters when
she suddenly bumped into Mrs. Alawi. I and my brother Eldee heard
the conversation between them.

3. Question: Can you state what you heard during their conversation?

Answer: I could hear Mrs. Alawi shouting “Gaunsa man mo diri?


Nganong gabisita-bisita man mo? Makaisturbo ra jud mo sa akong
mga tawo. Wala na gani kay matabang sa imong bana, magsinamok
pa jud ka samtang nagtrabaho siya. Unsa ka nga klase nga
pagkabaye, imo rang bana imo patrabahoon para sa inyoha,
palamonin ra kaayo mo sa imohang mga anak. Awa, wa man unta
kay gihimo pero lusyang kay ka. Mao ng di ka ulion sa imong bana
kay di na siya ganahan mutan aw ana imong nawong”. (What are you
doing here? Why do you even bother to visit? You’ll just be a
disturbance to my workers, You can’t even help your husband, you’ll
just interrupt him from his work. What kind of a woman are you, you
only let your husband do the work for all of you. Look at you! You
aren’t even working but you cannot even take care of yourself. That is
the reason why your husband wouldn’t even bother to go home
because he doesn’t want to see your face.)

4. Question: What did you do after that? What did you remember
happened after that?

Answer: I was in shock after I heard those statements. I remember


my mother froze in where she is standing while my brother was
obviously angry about those statements. I remember after Mrs. Alawi
said those words, she went into her car and went to the Baranggay
event, my brother angrily followed her car while me and my mother
were just speechless and frozen because of the statement.

5. Question: Did you follow your brother who followed Mrs. Alawi?

Answer: Yes. We followed him eventually.

6. Question: What happened when you arrived to the barangay event?


Answer: We saw Eldee standing on stage and seemingly confronting
Mrs. Alawi. We want to stop him from doing that because we don’t
want to cause trouble.

7. Question: Did you hear what your brother had said?

Answer: We did not. When we arrived, he was already confronted by


security, and I believe he already finished speaking when we arrived.

8. Question: What did you do when you arrived?

Answer: Me and my mother went and tried to get near him on stage
but there were too many spectators and we were unable to get near
him no matter how hard we pushed through the crowd.

9. Question: It was stated by Mrs. Alawi that your brother Eldee have
defamed her and humiliated her. Your brother allegedly said
““UWAGAN KA! Kabalo ka nga buhi pa akong mama, ming kalabit na
dayon ka sa akong papa! Usa ka, ka mananapaw! Ug sa tanan
nimong ma tilawan, ako pang amahan imong gipili!” (You are a Bitch!
You know that my mother is still alive, still you chose to have an illicit
relationship with my father! You are an Adulterer! Of all the people
that you can taste, you chose my Father!) Is the statements made by
your brother true?

Answer: Yes. It is true.

10. Question: Why do you say that it is true? Is it true that your father,
Jade Monterona and Mrs. Alawi have an illicit relationship?

Answer: Yes. It is true because we are aware of the illicit relationship


between my Father and Mrs. Alawi. My father have registered the
number of Mrs. Alawi in his phone with the name of “Babe” and we are
aware of the romantic and sexual text messages shared between
them. We observed that our Father seldom comes home and prefers
to stay on his quarters on the regular. Due to this circumstances, my
mother was prompted to visit my father at work. My mother want to talk
about it
