SUBJECT: Package-I: Construction of Remaining Sewerage System in North West

Industrial Zone (NWIZ) and South West Industrial Zone (SWIZ) at Port Qasim,
Karachi.

Package-II: Construction of Remaining Water Supply Network in North West


Industrial Zone (NWIZ) and South West Industrial Zone (SWIZ) at Port Qasim,
Karachi.

Package-III: Construction of Remaining Road Works and Storm Water Drains


in North West Industrial Zone (NWIZ) and South West Industrial Zone (SWIZ)
at Port Qasim, Karachi.

1. Reference Ministry of Maritime Affairs letter No. 1(4)/2020-PQA Islamabad, dated


18th June, 2020 and subsequent reminder-I dated 4th September, 2020 (Refer Sl-1-
2), where Ministry of Maritime Affairs have directed for reasons behind the delay
during finalization of subject projects and asked for fact finding inquiry by the PQA in
this regard. Further, MOMA directed to provide the detail of losses of the public
exchequer during this processing the projects. It was also asked to furnish the
timeline for the completion of all projects i.e. starting date and completion date.

2. The detailed Summary of subject packages is as under:

(1) The subject works were advertised through leading newspaper on 4th August,
2018 with submission (Technical & Financial bids) and opening of Technical
bids.

(2) The pre-bid meetings were held on 11th, 12th and 13th September, 2018.

(3) After pre-bid meeting, considering on request of the Contractors and public
holidays (20th to 23rd September, 2018) the time for submission (Technical &
Financial bids) and opening of Technical bids was extended and new date
was fixed on 4th October, 2018. Accordingly, Corrigendum in this regard were
published in newspapers on 21st September, 2018.

(4) As per NITs Technical & Financial bids were submitted and only Technical
bids opened on 4th October, 2018. However, Technical bids were handed
over to the consultant of the projects M/s ECIL on the same day for
evaluation purpose and Financial Bids kept in safe custody. Thereafter,
Consultant M/s. ECIL submitted their preliminary report before the PQA in-
house Committee, in the meeting dated 22nd October, 2018 where findings of
the Consultants M/s ECIL were discussed and accordingly, decided for their
clarification by the bidders and subsequently, letters to the bidders were
written accordingly.

(5) After obtaining the clarification by the bidders, the consultant M/s. ECIL
finalized the technical evaluation reports which were presented before PQA
in-house Committee on 20th November, 2018.

(6) The financial bids of the technically successful bidders for all package works
were opened on 24th January, 2020.
(7) The said financial bids were forwarded by PQA to the Project Consultant M/s
ECIL, through letter reference No. PQA/P&D/XEN(D)/22/2018, on 24
January, 2020, for evaluation.

(8) Consultant M/s. ECIL submitted Bid Evaluation Reports (Financial Part) for
the packages I & II on 29th January, 2020 and for package III 8th March, 2019
before the PQA in-house Committee.

(9) The cases of work packages-I & II were forwarded to the then Chairman for
approval with regard to prepare & present the summary in PQA Board for
approval on 25th January, 2019 and case for package-III work forwarded to
then worthy Chairman for obtaining the approval for scraping the tender and
re-advertisement for new tender on 25th March, 2019.

(10) The then Chairman accorded approval for preparation of Summary for the
Board on 14th February, 2019.

(11) Draft summaries (Package-I & II works) for the PQA Board were forwarded to
Finance Division on 20th February, 2019. Finance Division and Legal
Departments cleared summaries on 6th March, 2019.

(12) These cases were submitted to Secretary on 6th March, 2019 for placing them
in the agenda of PQA Board meeting which was to be held on 11th March,
2019.

(13) The then worthy Chairman’s directives on 7th March, 2019:

“Pls. get it reviewed by external Auditors; after placing it at the Board


meeting on 11/3/19”

(14) These cases were not discussed in PQA Board meeting held on 11th March,
2019.

(15) After attending Board meeting, worthy Chairman left for abroad and charge
was assigned to Chairman KPT.

(16) The Chairman PQA’s directives on the report of DG (Finance) on 25th March,
2019, “The papers were ought to be received by the Auditors M/s E&Y to
ensure that all requirements are fulfilled and complied. Why the same is
being held back for two weeks. Plz forward the same immediately. The
directions passed should have been followed or clarification had been sought
if there is any ambiguity”.

(17) The files of two (02) packages (I&II) were submitted in Chairman office
through DG (P&D) on 26th March, 2019. The file related to package-III was
forwarded to worthy Chairman on 26th March, 2019 for scraping of the tender
and re-advertisement the new tender on the recommendations of in-house
committee, however, this case was also forwarded to EYFR consultant for
scrutiny as well by the worthy Chairman.
(18) Director (Accounts) forwarded M/s EYFR’s list of information / documents on
24th May, 2019 for Package-I, II & III works on urgent basis.

(19) P&D Deptt. replied vide letter No.PQA/XEN(D)/24/2018 dated 3rd June, 2019
that the original files of subject packages had already been forwarded to M/s.
EYFR through DG (Finance), hence, the required information/ documents
could only be provided after receiving the said files.

(20) PA to Director (Accounts) forwarded files of three packages vide letter dated
14th June, 2019.

(21) In response, P&D Department forwarded information required by consultant


M/s EYFR under relevant files in package-I (vide paras-62 to 66 ante),
package-II (vide paras-53 to 57 ante) and package-III (vide paras-36 to 39/N.)
on 17th June, 2019.

(22) It is pertinent to mention that P&D Department was continuously pursuing the
matter verbally as well as in writing and also mentioned under para-65/N with
Finance Division for early action as there is a limited time period to complete
bidding process. However, Director Accounts have handed over the files on
19th July, 2019 without furnishing any report on the matter but asked that
within two-three days report will be forwarded to P&D Department. The draft
report was emailed on ID account of Director (P&D) on 24th July, 2019 which
was further discussed in the meeting of in-house Committee called by the DG
(P&D) on 1st August, 2019 where Consultants of the work M/s ECIL and M/s
EYFR’s representatives including Director (Accounts) were also remained
present. However, replies of the queries were forwarded on the same day of
the meeting by the Consultant M/s ECIL through P&D Department i.e. 1st
August, 2019.

(23) Final report of M/s EYFR was forwarded by the Accounts Department by
email on 7th August, 2019 which was with observations.

(24) After joining of duties by the present Chairman on 12th July, 2019, the time for
briefing on the matter was sought before presenting the case in PQA Board.
However, after getting time, briefing on the case was given to the Chairman
by the P&D Division on 2nd September, 2019 where besides officials of P&D
Department, the Consultants of the project M/s ECIL and M/s. EYFR
Consulting Firm including Director (Accounts) were remained present.
However, before starting briefing to the worthy Chairman, matter with the
senior level of M/s EYFR officials and consultants had discussed in presence
of P&D Division and Director (Accounts) where M/s EYFR agreed to give
clear recommendations on the cases.

(25) During briefing to worthy Chairman, P&D Department had explained details of
the case including M/s EYFR consultant’s remarks that they will give clear
recommendations on the cases and have no reservations so far as well as
apprised that bid validity of this packages are going to be expired on 3rd
October, 2019.
(26) Worthy Chairman directed to put up Summary for upcoming PQA Board
meeting for approval.

(27) The cases (package-I&II) were forwarded to worthy Chairman for approval in
connection to present the summaries in PQA Board for approval of the works
on 5th September, 2019.

(28) Worthy Chairman forwarded cases to Secretary on 21st September, 2019,


however, Secretary forwarded the case files of package-I & II to the DG
(P&D) with note “Pls process the same as per existing policy”.

(29) As the bid validities of said package-I & II works (extended) were to be
expired on 3rd October, 2019, whereas, award of the works was linked with
the approval of PQA Board & specific sanction to be accorded by the Federal
Government and posting of evaluation report on PPRA & PQA websites could
be done ten (10) days before the award of the works. The matter was also
discussed with worthy Chairman and accordingly note was put up that only
eight (08) days are remaining in expiring the bid validity period i.e 3rd October,
2019 where as at least one (01) month is required to complete all process of
approvals i.e. PQA Board and Federal Government. Hence, tenders were
scraped and re-advertised the tenders of packages-I, II & III on 25th October,
2020. Letter of Acceptance have been issued to all the construction firms on
21st August, 2020 and submission of Performance Security is in process.

3. Reference Ministry of Maritime Affairs letter No. 1(4)/2020-PQA Islamabad, dated


18th June, 2020 and subsequent reminder-I dated 4th September, 2020 (Refer Sl-1-

(32) After pre-bid meeting, considering on request of the Contractors and public
holidays (20th to 23rd September, 2018) the time for submission (Technical &
Financial bids) and opening of Technical bids was extended and new date
was fixed on 4th October, 2018. Accordingly, Corrigendum in this regard were

(35) The financial bids of the technically successful bidders for all package works

(36) The said financial bids were forwarded by PQA to the Project Consultant M/s
ECIL, through letter reference No. PQA/P&D/XEN(D)/22/2018, on 24
January, 2020, for evaluation.

(37) Consultant M/s. ECIL submitted Bid Evaluation Reports (Financial Part) for
the packages I & II on 29th January, 2020 and for package III 8th March, 2019
before the PQA in-house Committee.

(38) The cases of work packages-I & II were forwarded to the then Chairman for
approval with regard to prepare & present the summary in PQA Board for
approval on 25th January, 2019 and case for package-III work forwarded to

I, II & III) to P&D Department by email on 3rd September, 2019 (Refer Sl-6).

(56) Worthy Chairman directed to put up Summary for upcoming PQA Board

(57) The cases (package-I&II) were forwarded to worthy Chairman for approval in
connection to present the summaries in PQA Board for approval of the works
on 5th September, 2019.

1. The subject work was advertised through leading newspaper on 4th August, 2018
with submission (Technical & Financial bids) and opening of Technical bids (Sl-5).

2. The pre-bid meeting was held on 11th September, 2018.

3. After pre-bid meeting, considering on request of the Contractors and public

discussed and accordingly, decided for its clarification by the bidders and
subsequently, letters to the bidders were written placed at Sl-40 to 41.

5. After obtaining the clarification by the bidders, the consultant M/s. ECIL finalized
the technical evaluation report which was presented before PQA in-house
Committee on 20th November, 2018 (Sl-42).

6. Chairman had accorded approval on 26th November, 2018 (refer para-48 placed at
Sl-47).

7. In pursuance to the result of the technical evaluation, the financial bid of the
technically successful bidder was opened on 4th December, 2018 (Sl-54).

8. Consultant M/s. ECIL submitted Bid Evaluation Report (Financial Part) for the
subject package-I work on 16th January, 2019 (Sl-58) before the PQA in-house
Committee (minutes of meeting placed at Sl-60).

9. The results of Financial Bid Evaluation of Package-I are summarized hereunder:

10. The Consultant recommended that the bid of M/s NLC may be considered for
award of the project works.

11. As per PQA practice, the case was forwarded to the Chairman for approval with
regard to prepare & present the summary in PQA Board for approval on 25th
January, 2019.

12. Chairman handed over the subject file to Director (Legal). Legal Department
cleared file vide para-35/N on 7th February, 2019. Chairman accorded approval for
preparation of Summary for the Board vide para-36/N on 14th February, 2019.

13. After clearance of Summary by Finance Division PQA and Legal Department vide
paras-38 to 45/N, it was placed under Agenda of Board meeting which was
held on 11th March, 2019 with approval of Chairman along with note/ remarks vide
para-50/N reproduced hereunder:

“Pls. get it reviewed by external Auditors; after placing it at the Board


meeting”

14. This project did not get priority in Board meeting despite clear direction of Water
Commission constituted by the Honorable Supreme Court of Pakistan.

15. Later on, as per instruction of then Chairman vide note initiated by the DG
(Finance) placed at Sl-68, the relevant files were forwarded to Finance Division
through Chairman under para-52 to 60/N on 26th March, 2019. Then after, the files
were remained with them till 14th June, 2019 and during scrutiny of the case, P&D
Department has replied the queries under para-62 to 66/N on 17th June, 2019 in
connection to the correspondence made by the Finance Division and P&D Division
vide letters/ memos placed at Sl-69 to 80.

16. P&D Department was continuously pursuing the matter and also mentioned under
para-65/N with Finance Division for early action as there is a limited time period to
complete bidding process. However, Director Accounts have handed over the files
on 19th July, 2019 without furnishing any report on the matter but asked that within
two-three days report will be forwarded to P&D Department. The draft report was

17. Final report of M/s EYFR was forwarded by the Accounts Department by email on
7th August, 2019.

Package-II: Construction of Remaining Water Supply Network in North


West Industrial Zone (NWIZ) and South West Industrial Zone (SWIZ) at
Port Qasim, Karachi.

1. The subject work was advertised through leading newspaper on 4th August, 2018
with submission (Technical & Financial bids) and opening of Technical bids (Sl-5).

2. The pre-bid meeting was held on 12th September, 2018.

3. After pre-bid meeting, considering on request of the Contractors and public


holidays (20th to 13rd September, 2018) the time for submission (Technical &
Financial bids) and opening of Technical bids was extended and new date was
fixed on 4th October, 2018.

4. However, Technical bids were handed over to the consultant on 4 th October, 2018
for evaluation purpose (Sl-32). Thereafter, Consultant M/s. ECIL submitted their
preliminary report before the PQA in-house Committee, in the meeting dated 22nd
October, 2018 (Sl-43) where findings of the Consultants M/s ECIL were discussed
and accordingly, decided for its clarification by the bidders and subsequently,
letters to the bidders were written placed at Sl-44 to 49.

5. After obtaining the clarification by the bidders, the consultant M/s. ECIL finalized
the technical evaluation report which was presented before PQA in-house
Committee on 20th November, 2018 (Sl-50).

6. Chairman had accorded approval on 26th November, 2018 (refer para-48 placed at
Sl-55).

7. In pursuance to the result of the technical evaluation, the financial bid of the
technically successful bidder was opened on 4th December, 2018 (Sl-68).

8. Consultant M/s. ECIL submitted Bid Evaluation Report (Financial Part) for the
subject package-I work on 16th January, 2019 (Sl-72) before the PQA in-house
Committee (minutes of meeting placed at Sl-75).

9. The results of Financial Bid Evaluation of Package-I are summarized hereunder:

10. The Consultant recommended that the bid of M/s Noorulhaq & Brothers may be
considered for award of the project works.

11. As per PQA practice, the case was forwarded to the Chairman for approval with
regard to prepare & present the summary in PQA Board for approval on 25th
January, 2019.

12. Chairman handed over the subject file to Director (Legal). Legal Department
cleared file vide para-37/N on 7th February, 2019. Chairman accorded approval for
preparation of Summary for the Board vide para-38/N on 14th February, 2019.

Then after, the files were remained with them till 14th June, 2019 and during
scrutiny of the case, P&D Department has replied the queries under para-52 to
57/N on 17th June, 2019 in connection to the correspondence made by the
Finance Division and P&D Division vide letters/ memos placed at Sl-87 to 100.

16. P&D Department was continuously pursuing the matter and also mentioned under
para-65/N with Finance Division for early action as there is a limited time period to
complete bidding process. However, Director Accounts have handed over the files
on 19th July, 2019 without furnishing any report on the matter but asked that within
two-three days report will be forwarded to P&D Department. The draft report was
emailed to Director (P&D) on 24th July, 2019 which was further discussed in the
meeting called by the DG (P&D) on 1st August, 2019 where in-house Committee
as well as Consultants of the work M/s ECIL and M/s EYFR’s representatives
including Director (Accounts) were present. However, replies of the queries were
forwarded on the same day of the meeting by the Consultant M/s ECIL through
P&D Department.

17. Final report of M/s EYFR was forwarded by the Accounts Department by email on
7th August, 2019.

18. This is for your kind information please.


1. M/s. ECIL was appointed on 31st October, 2017 for preparation of tender
documents, design, BOQ and to assist in tendering as well as construction
supervision of above three packages.

2. After completion of design and tender documents, BOQ etc. the remaining works
pertaining to Sewerage System, Water Supply network, Road works and Storm
Water Drains in NWIZ and SWIZ were advertised through leading newspaper on
4th August, 2018 and accordingly, pre-bid meeting and submission of Technical
and Financial bid were submitted on 11th, 12th & 13th September, 2018 and 4th
October, 2018 respectively, by the bidders before the PQA in-house Committee
and representatives of the consultant of the project M/s. ECIL.

3. However, Technical bids were handed over to the consultant vide letter #
PQA/P&D/M(P)/60/2015 dated 4th October, 2018 for evaluation purpose (Sl-36).
Thereafter, Consultant M/s. ECIL submitted their preliminary report before the PQA
in-house Committee, in the meeting dated 22nd October, 2018 (Sl-41) where
findings of the Consultants M/s ECIL were discussed and accordingly, decided for
its clarification by the bidders and subsequently, letters to the bidders were written
placed at Sl-42 to 49.

4. After obtaining the clarification by the bidders, the consultant M/s. ECIL finalized
the technical evaluation report which was presented before PQA in-house
Committee on 20th November, 2018 (Sl-50). After discussing and deliberation, PQA
in-house Committee was agreed with the recommendations of consultant M/s.
ECIL. It had also been decided that the bidders who were not qualified, their
financial bid may be returned back un-opened and qualified bidders may be called
for opening of bids, minutes of meeting placed at Sl-52.

5. Chairman had accorded approval refer para-48 placed at Sl-54. Accordingly the
required letters were issued to the bidders according to the decision of PQA in-
house Committee.

6. As per recommendations in M/s ECIL report and decision of the PQA Committee,
the substantially responsive and Technically Qualified Bidders were invited in
writing to attend the opening of their financial bids on 4th December, 2018 at
Conference Room, Admin Building No.1, PQA (Sl-56 to 58). However, the bidders
who had been rejected being non-responsive or evaluated as not technically
qualified were notified and returned their Financial Bids unopened (Sl-59 to 72).

7. In pursuance to the result of the technical evaluation of the work Package-III:


“Construction of Remaining Road Works and Storm Water Drains in North West
Industrial Zone (NWIZ) and South West Industrial Zone (SWIZ) at Port Qasim,
Karachi” the financial bid of the technically successful bidder was opened on 4 th
December, 2018 in the presence of representatives of the bidders (Sl-73).

8. However, financial bid was handed over to the consultant vide letter #
PQA/P&D/M(P)/60/2015 dated 4th December, 2018 for evaluation purpose (Sl-74).

9. The meeting of in house committee along with Consultants was held on 8th March,
2019 at 1100 hours, wherein, the Project Consultant M/s Engineering Consultants
International (ECIL) Pvt. Ltd. presented the Financial Bid Evaluation Report
(Package III) before PQA in-house Committee.

10. The ECIL apprised the PQA Committee about the Financial Bid Evaluation results
and recommendations of the Consultants as contained in the Financial Bid
Evaluation Report.

12. The Consultant (ECIL) briefed the PQA in-house Committee that in the light of
detailed evaluation, M/s Sachal Engineering Works is the technically qualified and
lowest evaluated competitive bidder with his corrected bid price of
Rs.1,560,383,324.76.
13. Moreover, M/s ECIL apprised the PQA in-house Committee that initially decision
was made that no provision with regard to Cluase-70.1 (Increase or Decrease of
Cost) Copy placed at Sl-83 will be provided in the project of “Engineering
Consultancy services for planning, designing, Preparation of Tender documents
and construction of remaining Infra structure facilities i.e Roads, storm water drain,
water supply system and sewerage system in NWIZ & SWIZ at Port Qasim”.
However, the project was further sub-divided into three packages (I, II & III).
Accordingly, M/s ECIL have prepared the tender documents for the “Package-I:
Construction of Remaining Sewerage System in North West Industrial Zone
(NWIZ) and South West Industrial Zone (SWIZ) at Port Qasim, Karachi” and
“Package-II: Construction of Remaining Water Supply Network in North West
Industrial Zone (NWIZ) and South West Industrial Zone (SWIZ) at Port Qasim,
Karachi”. A mistake has been done under “Package- III: Construction of Remaining
Road Works and Storm Water Drains in North West Industrial Zone (NWIZ) and
South West Industrial Zone (SWIZ) at Port Qasim, Karachi” where provision of
Cluase-70.1 was included. M/s Sachal Engineering Works have enclosed the copy
of weightages with regard to material i.e High Speed Diesel (HSD), Asphalt
Cement, Steel Reinforcement & labour to be used in the construction of Package-
III and shall be adjusted in respect of rise or fall in the cost labour and material as
above.

14. M/s ECIL further informed that during pre-bid meetings of Package I, II & III the
question with regard to Clause 70.1 was raised by M/s Shamsi Builders Ltd (pre-
bid meeting held on 12th September, 2018 regarding Package-II work) where it was
categorically replied by the Consultant that “Price adjustment is not applicable, the
Bidder should assess his future risk and include in his quoted rates/ prices” and all
copies were forwarded to the all prospective bidders participated in Packages-I, II
& III and also uploaded on PQA website. It was also informed by the Consultant
that M/s Sachal Engineering Works is ready to provide undertaking that they will
not claim escalations (Increase or Decrease of Cost) as per Clause-70.1 during
currency of contract.

15. After detailed briefing by the Consultant and going through the minutes of the pre-
bid meeting and contract documents of Package-III, it was observed by the in-
house Committee that if any change is made in the tender documents that could
only be made through Addendum as per Clause IB.9 & IB.17 (17.3) under
instructions to bidders, copies placed at Sl-84 to 85, whereas in the instant case
such action has not been taken by the Consultant M/s ECIL and in-house
Committee further decided that conditional bid will also not be accepted. Hence, to
avoid any contractual and legal implications in future the Package-III is required to
be scrapped and re-advertised.

16. In the light of detail discussion and examinations of entire documents provided by
the Consultants M/s ECIL, PQA in-house Committee have unanimously decided
that the tender of “Package- III: Construction of Remaining Road Works and Storm
Water Drains in North West Industrial Zone (NWIZ) and South West Industrial
Zone (SWIZ) at Port Qasim, Karachi” may be scrapped and new tender in this
connection may be re-advertised after obtaining the approval by the Chairman
PQA, minutes of the meeting are placed at Sl-89 to 91.

u) The Chairman PQA’s directives on the report of DG (Finance) on 25th March, 2019, “The
papers were ought to be received by the Auditors M/s E&Y to ensure that all
requirements are fulfilled and complied. Why the same is being held back for two weeks.
Plz forward the same immediately. The directions passed should have been followed or
clarification had been sought if there is any ambiguity”.

v) The files of two (02) packages were submitted in Chairman office through DG (P&D) on
26th March, 2019.

w) DG (Finance) forwarded M/s EYFR’s list of information / documents on 24th May, 2019
for Package-I, II & III works on urgent basis.

x) P&D Deptt. replied vide letter No.PQA/XEN(D)/24/2018 dated 3rd June, 2019 that “ The
original files to subject packages had already been forwarded to M/s. EYFR through DG
(Finance), hence, the required information/ documents could only be provided after
receiving the said files”.

y) PA to Director (Accounts) forwarded files of three packages vide letter dated 14th June,
2019.

z) In response to M/s. EYFR’s requirement for information/ documents, P&D Department


forwarded information vide paras-62 to 66 ante on 17th June, 2019. It is pertinent to
mention that P&D Department was continuously pursuing the matter and also mentioned
under para-65/N with Finance Division for early action as there is a limited time period to
complete bidding process. However, Director Accounts have handed over the files on
19th July, 2019 without furnishing any report on the matter but asked that within two-
three days report will be forwarded to P&D Department. The draft report was emailed to

bb) Due to joining of new Chairman, time for briefing on the matter was sought before
presenting the case in PQA Board. However, briefing on the case was given to the
Chairman by the P&D Division on 2nd September, 2019 where besides officials of P&D
Department, the Consultants of the project M/s ECIL and M/s. EYFR Consulting Firm
including Director (Accounts) were remained present. During briefing, P&D Department
had explained details of the case as well as apprised that bid validity of this packages
are going to be expired on 3rd October, 2019.

cc) However, before starting briefing, matter with the senior level of M/s. EYFR officials and
consultants had discussed where M/s. EYFR agreed to give recommendations on the
cases. Accordingly, M/s. EYFR forwarded the final report to P&D Department by email
on 3rd September, 2019.

dd) Chairman directed to put up Summary for upcoming PQA Board meeting for approval.

ee) The cases were forwarded to Chairman for approval in connection to present the
summaries in PQA Board for approval of the works on 5th September, 2019.

ff) Chairman forwarded cases to Secretary on 21st September, 2019.

gg) As the bid validities of said package works (extended) was expiring on 3rd October,
2019, whereas, award of the works was linked with the approval of PQA Board &
specific sanction was to be accorded by the Federal Government and posting of
evaluation report on PPRA & PQA websites could be done ten (10) days before the
award of the works after obtaining all approvals. Therefore, Chairman scrapped the
cases and accord approval for retendering.

Consultant of the project M/s. ECIL.

112. However, Technical bids were handed over to the Consultant on 27 th November,
2019 for evaluation purpose (Sl-118). Thereafter, Consultant M/s. ECIL have
submitted their preliminary report before the PQA in-house Committee, in the
meeting dated 4th December, 2019 where findings of the Consultants M/s ECIL
were discussed and accordingly, decided for its clarification by the bidders and
subsequently, letters to the bidders were written placed at sl-120 to 121.

113. After obtaining the clarification by the bidders, the Consultant M/s. ECIL have
finalized the technical evaluation report which was presented before PQA in-house
Committee on 10th January, 2020. After discussing and deliberation, PQA in-house

detailed evaluation, M/s Frontier Works Organization (FWO) is the technically
qualified bidder and has offered the lowest evaluated bid price of Rs.
882,937,435.83.

121. The Consultant (M/s ECIL) also enlightened that bid of M/s FWO contained high
rates for Part – A Scheduled Items and low rates for Non-Scheduled Items,
however the overall bid price is 16.96% lower in comparison to the estimated cost
of the works, which results in project cost saving. As such, the bid of M/s FWO may
be considered for award of the project works.

122. The Consultant recommended that the bid of M/s FWO may be considered for
award of the project works.
123. The PQA Committee has gone through the financial bid evaluation report
submitted & briefed by the Consultant M/s ECIL and decided to recommend the
case on the basis of recommendations of the Consultant to award the subject work
to the lowest bidder M/s Frontier Works Organization (FWO) at amounting to
Rs.882,937,435.83 after obtaining approval by the Competent Authority.

124. It is necessary to mention here that, this work is of the Capital nature and its
worth is more than 2.5 Million, hence, it is required to be approved by the PQA
Board and specific sanction obtained by the Federal Government under Section
56 (3) of PQA Act, copy placed at Sl-61.

125. In view of the above, case may be forwarded to the Chairman for approval with

118. The Financial Bids of M/s NLC Engineers & M/s FWO were forwarded by PQA to
the Project Consultant M/s ECIL, through letter reference No.
PQA/P&D/XEN(D)/24/2018, dated 24 January, 2020, for evaluation (Sl-218).

119. Consultant M/s. ECIL submitted Bid Evaluation Report (Financial Part) for the
subject package on 29th January, 2020 before the PQA in-house Committee.

125. The Consultant (M/s ECIL) briefed the PQA in-house Committee that in light of the
detailed evaluation, M/s Sachal Engineering Works is the technically qualified
bidder and has offered the lowest evaluated bid price of Rs.1,618,014,852.00.
126. The Consultant (M/s ECIL) also enlightened that bid of the lowest bidder M/s
Sachal Engineering Works contained high rates for Bill No. 6 “Ancillary Works” and
low rates for all other bills of BOQ, the overall bid price is 13.36% lower in
comparison to the estimated cost of the works, which results in project cost saving.
As such, the bid of M/s Sachal Engineering Works may be considered for award of
the project works.

127. The Consultant recommended that the bid of M/s Sachal Engineering Works may
be considered for award of the project works.

128. The PQA Committee has gone through the financial bid evaluation report
submitted & briefed by the Consultant M/s ECIL and decided to recommend the
case on the basis of recommendations of the Consultant to award the subject
work to the lowest bidder M/s Sachal Engineering Works at amounting to
Rs.1,618,014,852.00 after obtaining approval by the Competent Authority.

129. It is necessary to mention here that, this work is of the capital nature and its
worth is more than 2.5 Million, hence, it is required to be approved by the PQA
Board and specific sanction obtained by the Federal Government under Section
56 (3) of PQA Act, copy placed at Sl-223.

130. In view of the above, case may be forwarded to the Chairman for approval with
regard to present the Summary in the forthcoming PQA Board meeting for
approval.

1. Reference Ministry of Maritime Affairs letter No. 1(4)/2020-PQA Islamabad, dated


18th June, 2020 and subsequent reminder-I dated 4 th September, 2020 (Refer Sl-1-
2), where Ministry of Maritime Affairs have directed for reasons behind the delay
during finalization of subject projects and asked for fact finding inquiry by the PQA
in this regard. Further, MOMA directed to provide the detail of losses of the public
exchequer during this processing the projects. It was also asked to furnish the
timeline for the completion of all projects i.e. starting date and completion date.

2. The detailed Summary of subject projects is as under:

February, 2019.

(x) Summaries were forwarded to Finance Division on 20th February, 2019. Finance
Division and Legal Departments cleared summaries on 6th March, 2019.

(xi) These cases were submitted to Secretary on 6th March, 2019 for placing them at
PQA Board meeting on 11th March, 2019.

(xii) Chairman’s directives on 7th March, 2019:

“Pls. get it reviewed by external Auditors; after placing it at the Board


meeting on 11/3/19”

(xiii) Unfortunately, these projects did not get priority in Board despite clear directives
of Water Commission constituted by the Honorable Supreme Court of Pakistan.

(xiv) Chairman left for abroad charge was assigned to Chairman KPT.

(xv) Later on, DG (Finance) asked for sending subject tender documents for
preparing TORs hire C/A Firm under PPRA Rules to evaluate all bidding/
tendering process of works awarded items procured in PQA under PPRA Rules
2004.

(xvi) The Chairman PQA’s directives on the report of DG (Finance) on 25th March,
2019, “The papers were ought to be received by the Auditors M/s E&Y to ensure
that all requirements are fulfilled and complied. Why the same is being held back
for two weeks. Plz forward the same immediately. The directions passed should
have been followed or clarification had been sought if there is any ambiguity”.

(xvii) The files of two (02) packages were submitted in Chairman office through DG
(P&D) on 26th March, 2019.

(xviii) DG (Finance) forwarded M/s EYFR’s list of information / documents on 24th May,
2019 for Package-I, II & III works on urgent basis.

(xix) P&D Deptt. replied vide letter No.PQA/XEN(D)/24/2018 dated 3rd June, 2019 that
“ The original files to subject packages had already been forwarded to M/s. EYFR
through DG (Finance), hence, the required information/ documents could only be
provided after receiving the said files”.
(xx) PA to Director (Accounts) forwarded files of three packages vide letter dated 14th
June, 2019.

(xxi) In response to M/s. EYFR’s requirement for information/ documents, P&D


Department forwarded information vide paras-62 to 66 ante on 17th June, 2019.
It is pertinent to mention that P&D Department was continuously pursuing the
matter and also mentioned under para-65/N with Finance Division for early action
as there is a limited time period to complete bidding process. However, Director
Accounts have handed over the files on 19th July, 2019 without furnishing any
report on the matter but asked that within two-three days report will be forwarded
to P&D Department. The draft report was emailed to Director (P&D) on 24th July,
2019 which was further discussed in the meeting called by the DG (P&D) on 1st
August, 2019 where in-house Committee as well as Consultants of the work M/s
ECIL and M/s EYFR’s representatives including Director (Accounts) were
present. However, replies of the queries were forwarded on the same day of the
meeting by the Consultant M/s ECIL through P&D Department.

(xxii) Final report of M/s EYFR was forwarded by the Accounts Department by email
on 7th August, 2019.

(xxiii) Due to joining of new Chairman, time for briefing on the matter was sought
before presenting the case in PQA Board. However, briefing on the case was
given to the Chairman by the P&D Division on 2nd September, 2019 where
besides officials of P&D Department, the Consultants of the project M/s ECIL and
M/s. EYFR Consulting Firm including Director (Accounts) were remained present.
During briefing, P&D Department had explained details of the case as well as
apprised that bid validity of this packages are going to be expired on 3 rd October,
2019.

(xxiv) However, before starting briefing, matter with the senior level of M/s. EYFR
officials and consultants had discussed where M/s. EYFR agreed to give
recommendations on the cases. Accordingly, M/s. EYFR forwarded the final
report to P&D Department by email on 3rd September, 2019.

(xxv) Chairman directed to put up Summary for upcoming PQA Board meeting for
approval.

(xxvi) The cases were forwarded to Chairman for approval in connection to present the
summaries in PQA Board for approval of the works on 5th September, 2019.

(xxvii) Chairman forwarded cases to Secretary on 21st September, 2019.

(xxviii) As the bid validities of said package works (extended) was expiring on 3rd
October, 2019, whereas, award of the works was linked with the approval of
PQA Board & specific sanction was to be accorded by the Federal Government
and posting of evaluation report on PPRA & PQA websites could be done ten
(10) days before the award of the works after obtaining all approvals. Therefore,
Chairman scrapped the cases and accord approval for retendering.

(i) The subject works were advertised through leading newspaper on 4th August,
2018 with submission (Technical & Financial bids) and opening of Technical bids.

0. The pre-bid meetings were held on 11th, 12th and 13th September, 2018.

1. After pre-bid meeting, considering on request of the Contractors and public


holidays (20th to 23rd September, 2018) the time for submission (Technical &
Financial bids) and opening of Technical bids was extended and new date was
fixed on 4th October, 2018. Accordingly, Corrigendum in this regard were
published in newspapers on 21st September, 2018.

2. As per NITs Technical & Financial bids were submitted and only Technical bids
were on 4th October, 2018. However, Technical bids were handed over to the
consultant of the purpose M/s ECIL on the same day for evaluation purpose.
Thereafter, Consultant M/s. ECIL submitted their preliminary report before the PQA
in-house Committee, in the meeting dated 22nd October, 2018 where findings of
the Consultants M/s ECIL were discussed and accordingly, decided for their
clarification by the bidders and subsequently, letters to the bidders were written.

3. After obtaining the clarification by the bidders, the consultant M/s. ECIL finalized
the technical evaluation reports which were presented before PQA in-house
Committee on 20th November, 2018.

4. Chairman had accorded approval on 26th November, 2018.

5. In pursuance to the results of the technical evaluation, the financial bids of the
technically successful bidder were opened on 4th December, 2018.

6. Consultant M/s. ECIL submitted Bid Evaluation Report (Financial Part) for the
subject package-I work on 16th January, 2019 (Sl-58) before the PQA in-house
Committee (minutes of meeting placed at Sl-60).
