1.0 Purpose
1.1 This standard document sets out the minimum standards that shall be applied
when Ma’aden Aluminium or Ma’aden work with Contractors. It is intended that
this standard will lead to efficient and safe delivery of contracted scopes of work
while developing optimum business outcomes and better relationships for all
stakeholders.

2.0 Scope
2.1 All International Standards requirements applicable through Ma’aden or National
agreement or signatory shall be included in the relevant management system
documents and shall be complied with.
2.2 The most stringent of the requirements of applicable local/regional regulations
or Ma’aden MSHEM Framework, Elements and or Sub-Element shall take
precedence.
2.3 This Element shall apply to all Ma’aden Aluminium facilities that have a role in the
development, implementation, supervision, and closeout of Contracted scopes
of work, including Projects.
2.4 Government organizations that have a legal right of entry are exempt from the
outlined contractor duties.
2.5 This Element does not apply to Contractor employees included under the
organizational structure of Ma’aden Aluminium Entity/Divisions, i.e., acting under
direct supervision of Ma’aden personnel. Note: These contracted employees are
excluded as they are subject to the same requirements which are applicable for
Direct Hire Ma’aden employees.

3.0 Expected Results


3.1 The expected results would be that the Ma’aden Aluminium Contractor EHSS
Management Programs meet and exceed the standards prescribed within this
standard.
3.2 Only pre-qualified contractors are utilised for contracts within the business.
3.3 Scopes or work are effectively risk assessed, risks are predicted, and risk controls
are designed for sustainable and effective prevention of associated risks.
3.4 Key stakeholders in the scope of work accept and act on their responsibility for
delivering safe operations or construction.
3.5 The Ma’aden Aluminium Contractor community culturally develop aligned safe
operations/construction values in line with the intent of this standard. This also
assists with increasing the safe work capabilities of Contractors which is in line
with the Kingdom of Saudi Arabia Vision 2030 and the perception that Ma’aden
Aluminium is a good corporate citizen.

4.0 Definitions
4.1 All terms and definitions can be found in MSHEM Glossary Index. Definitions from
the MSHEM Glossary shall be used. If no definition is available in the Glossary,
then definitions shall be submitted separately with the document so the Glossary
can be updated.

4.3 Competent Person – a person with sufficient knowledge and experience – “a


person who is capable of identifying existing and predictable hazards in the
surroundings or working conditions which are unsanitary, hazardous, or
dangerous to employees.
4.4 CONOPS – Combined operations where 2 or more separate parts of the same
organization or business unit are working in close proximity to each other under
the same EHSS-MS and permit system.
4.5 Contract - a written agreement, between Ma’aden and the contractor or services
provider setting out the terms under which the work or services will be delivered
or conducted and is enforceable by law.
4.6 Contract Accountable Person – The person assigned specific responsibilities by
the employer or the contractor in respect of the planning, communicating,
implementation, management and monitoring of the contract and contractor
activities.
4.7 Contract Responsible Person – A person deemed competent who represents
Ma’aden’s interests; has a working knowledge Ma’aden and regulatory standards
normally applicable to the type of contracted work and has successfully
completed a Ma’aden Contractor, Subcontractor and Contracted Services
Responsible Person Training Course. Another name for the Ma’aden Responsible
Person could be the Single Point of Accountability (SPA). A Plant Manager,
Procurement Manager, Engineer or Maintenance personnel could all be a
Ma’aden Responsible Person. The Ma’aden Responsible Person(s) does not
necessarily need to be a Ma’aden direct employee.
4.8 Contractor Responsible Person – A person deemed competent who has been
appointed by the Contractor and who possesses the detailed knowledge to fulfil
the Contractor Contracted Services EHSS obligations under the contract which
applies to the work. The Contractor Responsible Person(s) shall be appointed
from the Contractor organization only and shall not be passed down to sub-
contractors.
4.9 Contractor - Companies or individuals contracted to perform work in the facility
but are not included on the Ma’aden pay roll and are hired to provide services or
to support any department/activity. The term Contractor includes
turnaround/project and sub-contractors.
4.10 EHSS Requirements – Requirements that shall be set out in a Ma’aden or
contractor management system, standard, policy or procedures, and legal and
regulatory requirements.
4.11 EHSS Implementation Plan – The plan, formulated by the contractor or services
provider, in consultation with Ma’aden, that will be utilized to manage, minimize
and assure EHSS risks through the delivery of the contract.
4.12 Fitness-for-purpose – Equipment that has been designed or constructed and is
rated for the specific task and that is in good working order and will be operated
by competent people.
4.13 Hazard - A source of potential harm, or a situation with a potential for causing
harm, in terms for human injury, damage to health, property, environment, and
other things of value or some combination of these.
4.14 High Potential Incident - An EHSS incident or near miss that could have
reasonably led to death, permanent or temporary disability.

4.15 Health Safety and Environmental Management System (EHSS-MS) as described


in the Ma’aden EHSS Framework.
4.16 Ma’aden: Any Ma’aden owned, affiliated, managed, operated and/or leased
facility or site on which Ma’aden carry the legal, regulatory or permitted
responsibilities; duty of care and/or primacy.
4.17 On-the-job – While working at the work site or conducting company business
while off site.
4.18 Off-the-job – While not working at the work site. For example, at the camp or
temporary accommodation established by the contractor.
4.19 Operating area – An area where Ma’aden is conducting operating activities, such
as a mine, mine site, smelter, refinery, mineral processing areas, storage, logistics
or other potentially hazardous activities.
4.20 Operating procedure - Procedures or work instructions that clearly describe how
to accomplish operational tasks and define activities in a way that ensures safe
operation.
4.21 Permit to work - A written certificate to register a work task and document the
controls required to be in place to conduct that task safely. Used to authorize
the task to commence provided the controls are fully implemented. The terms
‘permit-to-work’, ‘permit’ or ‘work permit’ refer to the certificate or form which
is issued as part of an overall safe systems of work and which has been devised
by a company to meet its specific needs.
4.22 PTQQRT – Purpose, Task, Quality, Quantity, Resources & Time a term that refers
to the completeness of any (particularly EHSS) information outlined in the scope
of work.
4.23 Risk – A situation involving an exposure to a hazard.
4.24 Safety induction training - An overview training program given to new
employees and contractors in all job categories that describe the overall hazards
associated with the facility including Environment, Health, Safety, Security
procedures and emergency response.
4.25 Risk Assessment (RA) - a risk assessment is the combined effort of identifying
and analyzing potential (future) events that may negatively impact individuals,
assets, and/or the environment; and making judgments "on the tolerability of the
risk on the basis of a risk analysis" while considering influencing factors.
4.26 SIMOPS – Simultaneous Operations – where 2 or more operating groups are
working in close proximity to each other and they are operating under separate
management systems (such as the operator and the Contractor).
4.27 STEPS – (Safe Steps) Stop; Think; Evaluate; Proceed Safely. Ma’aden risk-based
safety cultural program.

5.0 Procedure
General Requirements
5.1 This procedure and the requirements found here in section 5 against all the
activities / facilities / plants / sites or any business unit managed by Ma'aden
Aluminium.

5.2 Any change to this approved procedure shall follow the Management of Change
Procedure MSHEM 02.06 Management of Change.
5.3 Any clarification required to this procedure shall be in accordance with MSHEM
Sub-Element-13.01 Clarifications, Exemptions and Variances.
5.4 Compliance of this program in accordance with the MSHEM Framework and
Policy the management commitment, accountability, and responsibilities are
identified in section 6.0 of this document.
5.5 Refer to MSHEM 13.02 EHSS Element Administration procedure for assigned
element and sub-element administrator’s details.
5.6 The roles and responsibilities of all other positions that are responsible to support
the implementation of this program are clearly identified and documented in
section 6.0 and responsibilities shall be communicated through relevant training.
5.7 The most stringent of the requirements of applicable local/regional regulations
or MSHEM Framework, Elements and or Sub-Element shall be complied with.
5.8 All applicable local and or Regional or National regulations shall be complied with
as a minimum. Further all applicable local authority approvals, licenses and
permits shall be identified and be included in the relevant management system.
5.9 Establish, maintain and implement processes and or management system that
fully align with this Element.
5.10 The frequency of KPIs review shall be as follows:
5.10.1 Every Quarter the Site Senior management shall review the status of all
the KPIs for this Element and ensure that corrective actions are identified
to meet the KPI targets.
5.11 Recommended actions identified (through investigations, audits, meetings,
plans, etc.) shall be assigned with clear responsibilities and target due dates for
completion. Changes to the initial and subsequent target due dates shall be
controlled and formally approved. The following are the authority levels for
changes to the due dates:
5.11.1 For first change in due date – the concerned Department Manager.
5.11.2 For the second and any subsequent changes – the concerned Department
Director.
5.12 Contractors shall be grouped based on common EHSS concerns and to facilitate
having certain minimum requirements for that group. Contractors shall be
categorized, as follows:

Contractors can be hired to construct new facility and/or modify
the existing facilities, perform maintenance work on process
equipment, and in some cases operate the facility.

suppliers and Equipment suppliers

5 Terminal operators and Transporters (air, marine & inland

Note: The amount of supervision shall be based on a risk assessment of the


intrinsic risks associated with the area, scope of work and a competent
assessment of the Contractors capabilities in delivering the scope of work safely.
5.13 Requirements to develop the scope of work.
5.13.1 The contract owner shall develop the scope of work with assistance from
the contract responsible person.
5.13.2 The requirements to develop the scope of work is based on the category
of the contract as mentioned in clause 5.12.
5.13.3 General Requirements for all categories.
5.13.3.1 Scope of work is a documented, legal description of the Work/
project. The scope of work should be concise with adequate
information to explain the sequential steps of the project in
enough detail to ensure that the contractor understands the
work. The scope of work becomes part of the contract
specifications.
i. Communicate the scope of work, site conditions and other
expectations to the Contractor, Subcontractor and
Contracted Services.
ii. Ensure the scope of work and site conditions are included in
Request for Quotation / Purchase Orders.

iii. Any changes in scope, conditions, hazards, etc., impacting


the Contractor job specific EHS plan shall be communicated
immediately to the Contractor, Subcontractor and or
Contracted Service.
iv. Project Manager/ Leader/ MRP should Coordinate in
preparation of the scope of work, site condition and other
expectations documents.
v. Contractor, Subcontractor and Contracted Service
Management should fully comply with site conditions and
other expectations as defined in the scope of work and
purchase order.
vi. Stop work, modify, and update the job specific EHS Plan to
address site condition, scope of work or operating changes
or when other unforeseen circumstances arise.
vii. Contractor EHS plan should include nature and description
of the scope of work to be performed by the contractor.
Contractor shall include a list of the work process or short
description of work to be performed by job type (e.g.
foundation or excavating, electrical installations, roof work,
plumbing, duct work, etc.)
viii. Prior to submitting a bid, the Contractor shall visit the site
along with the Ma’aden Aluminium Project Leader/Project
Manager and respective BU EHS representative or their
delegate, and review the EHS requirements, conditions, site
conditions and scope of work.
ix. A selection process shall be conducted by Procurement
Department to ensure a contractor, subcontractor or
contracted service can safely complete a specific scope of
work. The selection process shall be completed prior to any
work at Ma‘aden Aluminium location.
x. After the contract has been awarded, a Pre-Job EHS meeting
shall be conducted to ensure Contractor, Subcontractor or
Contracted Services management understands the EHS
expectations set forth in the contract. Scope of Work, Site
Conditions, permits, training, accident reporting, and other
administrative requirements shall be discussed.
xi. Throughout the duration of the job and as conditions dictate,
the plan shall be reviewed, updated, and revised to reflect
changes in the project scope, and/or operating conditions.
5.14 Amongst other deliverables, the key deliverables and requirements of the
Ma’aden Aluminium Contractor EHSS Management program shall be:
5.14.1 Effective prediction and prevention of all foreseeable risks through
competent risk assessments when planning work throughout the differing
phases of any scope of work;
5.14.2 A clear scope of which is communicated clearly to all stakeholders that
includes clear EHSS expectations and leading risk control measures;

5.14.3 A pre-qualification process that is suitable for the scope of work but is
effective in understanding the contractor’s intrinsic safe production
culture but also provides the scope owner with an understanding of the
contractors EHSS shortcomings in the event of an award to that
contractor;
5.14.4 Confirmation that all bidders understand clearly the EHSS expectations
prior to bid as well as conformation by the successful bidder of same prior
to award and pre-mobilization;
5.14.5 Inclusion of scope specific information and data into contracts that is
designed to effectively overcome risks with the scope of work and
identified shortcomings in the contractor’s safe work culture and intrinsic
values;
5.14.6 Ma’aden Aluminium being provided clear evidence of the contractor’s
compliance to Government required registration of company and
personnel (e.g GOSI), certifications (e.g. machine licenses) and other
forms of competency. Equipment certification as required from the
contractor for the contractor’s workforce;
5.14.7 A level of competent supervision by Ma’aden Aluminium and the
Contractor that is commensurate with the risk and known shortcomings
of the Contractor during the execution of any scope of work;
5.14.8 A working together relationship between all scope of work stakeholders
where the “Safe Step” principles are at the heart of all decisions and all
personnel focus on and care about safe production/construction;
5.14.9 Unsafe acts, conditions or events are identified and acted upon in an
effective way and shared where appropriate to do so; and
5.14.10 Lessons learned and the scope of work owners EHSS experiences with the
contractor is retained and shared amongst appropriate Ma’aden
Aluminium and other Affiliate (MPC, MGBM etc) groups.
5.15 Description of work/services required
5.15.1 The description of Work/ Services required will be as specified in Scope
of work provided to the contractor.
5.15.2 The Contractor and its Subcontractors Work/ services should comply with
Ma’aden Aluminium Policies, Management Systems, Programs, and
Standards, and other additional provisions as specified by Ma’aden
Aluminium representatives and in project scope of work.
5.15.3 Contractors, Subcontractors and Contracted Services required who can
demonstrate the capability to meet EHS criteria in accordance with all the
Pre-Qualification Process and other Pre-bid requirements.
5.15.4 Communicate the scope of work, site conditions and other expectations
to the Contractor, Subcontractor and Contracted Services and ensure that
they can safely complete a specific scope of work in compliance with all
applicable laws, regulations and codes along with Ma’aden Aluminium EHS
Values, and Code of Conduct policy.

5.16 Legal requirements


5.16.1 Full Compliance required from all contractors with all applicable
laws, regulations and codes.
5.16.2 The Contractor, Subcontractors and Contracted Services shall
comply with all applicable governmental EHS laws, regulations,
rules, which includes HCIS, RC, PME, SASO and other documents
referenced in the contract specifications. In addition, the
Contractor and its Subcontractors shall comply with Ma’aden
Aluminium Policies, Management Systems, Programs, and
Standards, and other additional provisions as specified by
Ma’aden Aluminium representatives and in project scope of
work.
5.16.3 All activity shall be performed in such a manner to minimize
interference with normal Ma’aden Aluminium operations.
Contractor’s employees shall remain in their assigned work areas
and not wander to other parts of the facility.
5.16.4 Contractor shall communicate to his employees, subcontractor,
suppliers and delivery persons that adhered to Ma’aden
Aluminium site conditions is a requirement for doing business
with Ma’aden Aluminium.
5.16.5 Any violation or deviation from the above conditions by the
Contractor may result in the dismissal of the Contractor or
Contractor employee from the property and cancellation of
contracts with Ma’aden Aluminium. Furthermore, it is expected
that the Contractor shall counsel, discipline and/or dismiss their
employees from Contractor Company for violating Ma’aden
Aluminium Live Saving Rules, demonstrating a negative attitude
towards EHS policy, engage in any dangerous, illegal or
outrageous conduct.
5.16.6 If Ma’aden Aluminium observes or is made aware of unsafe acts
or behaviours in regard to regulation, policies, rules, or
procedures by employees, visitors, or sub-contractors, the
contractor, depending on the seriousness of the situation, may
be subjected to a penalty of up to SR 10,000 per occurrence
and/or termination of the contract.
5.16.7 Contractor shall not use any subcontractor without prior
approval from Ma’aden Aluminium Procurement Department
and shall complete all EHS pre-qualification requirements.
5.16.8 Any delay in project/work schedule due to untimely request for
subcontractor approval or failure to schedule orientation is the
Contractor’s responsibility.
5.17 Fitness to work requirements for Contractor Employees as per
Appendix B, Sub-Element 07.08: Occupational Health. Certification
before mobilizing to site and annual recertification requirements.
5.17.1 Health monitoring shall be conducted by the contractor, as
applicable (as identified in the EHSS Risk Assessment or JSA),
to protect their personnel against exposure to health hazards

Element 07.08: Occupational Health and as per MSHEM-07.09-
Industrial Hygiene and best practices agreed in Contractor
Committee meeting and implemented by Ma’aden Aluminium.
5.17.2 The contractor and sub-contractor line management including
supervisor and foreman shall directly be involved in the
contractor ‘s responsibilities for the safety and health of all
personnel at the work site and for making safety and health
compliance a part of all work assignments.
5.17.3 Contractor shall verify that its personnel are fit for duty relative
to medical, physical and substance abuse considerations as per
MSHEM 07.08 Occupational Health.
5.17.4 Upon request by the Ma’aden Aluminium, contractor’s site
management shall provide Health Monitoring documents.
5.17.5 Individuals with heart pacemakers, implanted defibrillators and
pumps, epidural nerve stimulators, muscle stimulation devices,
insulin pumps, cochlear implants, ferromagnetic foreign bodies in
the eye, and other types of medical implants that could be
affected by magnetic fields, including cardiac stents that were
installed in the last 4 weeks, are prohibited entering and working
in Pot rooms, Rodding Room, Rectifier Station and Electrical High
Yards.
5.18 All Contractor, Subcontractor, and Contracted Services shall comply
with the Ma’aden Aluminium EHSS Policy and Code of Conduct Policy.
5.19 While on Ma’aden Aluminium premises, the Contractor's employees
shall not engage in any dangerous, illegal or outrageous conduct,
including but not limited to the following:
5.19.1 Violating EHSS rules or common EHSS practices or causing an
EHSS threat to a co-worker.
5.19.2 Violating Ma’aden Life Saving Rules.
5.19.3 Violating Ma’aden business units specific rules
5.19.4 Creating or contributing to any unsafe or unsanitary condition.
5.19.5 Unnecessarily distracting the attention of any employee who is
working or participating in a non-work-related activity that
interferes with the job.
5.19.6 Using abusive words or phrase.
5.19.7 Immoral conduct or indecency, sexual harassment, or possessing
or displaying offensive verbal, visual or physical material or
objects of any kind.
5.19.8 Horse playing and fighting or instigating a fight.
5.19.9 Theft, abuse, or deliberate destruction of property, tools, or
equipment of employees or the Company.
5.19.10 Gambling of any type.

5.19.11 Possessing or consuming any intoxicating beverage or illegal


substance on the premises.
5.19.12 Reporting for work in an unfit condition, including being under
the influence of intoxicants or controlled substances, or misuse
of any prescription drug.
5.19.13 Refusing to submit to drug and/or alcohol testing when properly
directed by supervisor. Test results showing the presence of
alcohol or illegal drugs in any amount shall be grounds for
dismissal.
5.19.14 Possessing firearms or other weapons on Company premises.
5.19.15 Making false or malicious statements concerning an employee,
the Company, or its products.
5.19.16 Falsifying records, including timecards, or making untrue
statements that may result in the falsification of records.
5.19.17 Misusing or removing employee lists, blueprints, records, or
confidential information of any nature, in any form from premises
without permission.
5.19.18 Soliciting, collecting contributions, or distributing written or
printed matter without permission of Ma’aden Aluminium
management.
5.19.19 Removing notices, signs, or writing in any form on bulletin boards
or Company property without specific permission of Ma’aden
Aluminium management.
5.19.20 Possessing or using mobile phones in production areas,
contractor radios, or cameras for personal use on Company
premises without Ma’aden Aluminium permission.
5.19.21 Throwing materials on Company premises or not giving attention
to job during working hours.
5.19.22 Failure to obey supervisor or other forms of insubordination.
5.19.23 Frequent tardiness or absences from work.
5.19.24 Leaving job or work area during working hours without
permission.
5.19.25 Leaving a designated work area. Contractors shall not visit other
areas of the Plant/Business Units without authorization.
5.19.26 Performing personal work on Company time or excessive use of
mobile phones and electronic gadgets for personal use.
5.19.27 Any action or behavior illegal under local and legal law.
5.19.28 Smoking in offices, lunchrooms, or other areas not designated
for smoking.
5.19.29 Prohibited items: No cardiac pacemakers, finger rings or loose
jewelry is allowed in maintenance or production areas
5.20 Any requirement defined by the EHSS Manager or Contract Owner as
per the scope of work, including requirement based on the level of Risk.

5.20.1 For all Ma’aden Aluminium contracts, the contractor and/or


subcontractor(s) shall develop, implement and adhere to
contract specific risk assessment (Refer MSHEM-02.03-Risk
Assessment Techniques and Analysis). The risk assessment shall
list all task/activities associated with the scope of work, potential
hazards of each task/activities and control measures to mitigate
these hazards. The risk assessment shall not be a list of generic
hazards.
5.20.2 Ensure EHS risk assessments are conducted as per MSHEM-
02.03-Risk Assessment Techniques and Analysis.
5.21 Specify all EHSS requirements including but not limited to:
5.21.1 Pre-Contract Procedure
5.21.2 Contractor EHS Pre-Qualification Questionnaire as per specific
job category as mentioned in clause 5.12.
5.21.3 Prior to entering into contractual agreement, all potential
Contractors. Subcontractors and Contracted Services shall be
pre-qualified and selected by evaluating the Contractor's,
Subcontractor's or Contracted Service's past EHSS performance
and current ability to meet Ma’aden Aluminium EHSS
expectations as outlined in Attachment- 1 Prequalification Form.
5.21.4 All questions in Prequalification Form shall be completed by
contractors, subcontractors and contracted services who desire
to be considered to perform work at any Ma‘aden Aluminium
location.
5.21.5 The Contractor shall agree to complete in full, the Contracted
Services Safety Pre-qualification Questionnaire, and return by a
specified time frame set by the location in order for their bid to
be considered.
5.21.6 The Contractor shall be required to update and resubmit the Pre-
qualification Questionnaire annually.
5.21.7 The Pre-qualification questionnaire shall be reviewed and
evaluated for acceptance by the Ma’aden Responsible Person.
5.22 Project Environment, Health and Safety Review (PEHSR)
5.22.1 Projects or contracted services normally require management
approval prior to expenditure of funds. The Project/Manager
Leader shall complete the location- specific documentation and
route for approval. The authorizing manager has the
responsibility to ensure a Pre-funding Approval Project
Environment, Health and Safety Review Hazards checklist (See
Attachment-2) has been completed before approving
expenditure of funds.
5.22.2Project Manager/ Leader shall implement and maintain a Project
Environment, Health and Safety Review process to identify and
eliminate or control all Environment, Health and Safety hazards
that may potentially occur in the Engineering and Design,

5.22.3Eliminate or control Environment, Health and Safety hazards by
effective engineering and design and by using a written process
to record actions and progress. Elimination of hazards by
engineering and design is the best method of control.
5.23 Contractor EHS Plan (Preliminary)
5.23.1 The contractor shall submit a preliminary EHS plan for the
contracted services applied. As minimum, the Contractor EHS
Plan shall include the following information:
a) Nature and description of the scope of work to be
performed by the contractor. Contractor shall include a
list of the work process or short description of work to be
performed by job type (e.g. foundation or excavating,
electrical installations, roof work, plumbing, duct work,
etc.)
b) Line management accountability.
c) Employee safety induction.
d) Training/certification.
e) Safety meetings.
f) Safety inspections.
g) Incident reporting and investigation.
h) Identification of any major potential hazard/risk (e.g. fall
hazards, fire hazards, environmental contamination and
liabilities). Determine potential EHS permit requirements.
i) Personnel protective equipment.
j) Emergency response procedure as per MSHEM-08.01-
Emergency Planning and Response
k) Subcontractor oversite.
l) Information relative to the Contractor Responsible
Person.
m) Contractors’ general precautions to eliminate or mitigate
the risks and liabilities.
n) Type of materials and equipment to be used on site.
o) Anticipated quantity and description of waste to be
generated.
p) Safe Job Procedures (if available). These procedures may
be used in preparation of the detailed EHS plan.
q) Safety personnel details and qualifications.
r) Heat stress management plan.
s) Respiratory protection.
t) Fire prevention and protection.
u) Minor or repetitive jobs may be covered by a job specific
EHS Plan that may reference the specific task or tasks
performed.
v) Contractor preliminary EHS plan shall be evaluated by
Ma’aden Aluminum.
5.24 Invitation to Quote
5.24.1 When the project or contracted services request has been
completed, the Procurement Department shall send an Invitation

to Quote to the selected Contractors who have met the minimum


expectations of the EHS Prequalification process. Included in the
bid package will be the Scope of Work, Site Conditions, and any
other related information. Note to Procurement: Each Business
Unit location is responsible for modifying the Site Conditions to
the specifics of their location.
5.25 Preliminary Site Visit
5.25.1 Prior to submitting a bid, the Contractor shall visit the site along
with the Ma’aden Aluminium Project Leader/Project Manager and
respective BU EHS representative or their delegate, and review
the EHS requirements, conditions, site conditions and scope of
work.
5.25.2General and specific EHS expectations and risks at the site shall
be explained or provided to the Contractor. Each
contractor/visitor shall receive the MA-EHS-S-009.1- Contractor
EHS Requirements program copy.
5.25.3The Contractor shall also be provided with the locations
applicable EHS Management System and Program requirements
(Refer to Section 9.0 for the location’s Site Conditions).
5.25.4 The Contractor shall provide Ma’aden Aluminium with MSDS’s
for materials they expect to use on the job with the bid package.
5.25.5The above information shall be used by the Contractor in
preparation of submitting a bid package to Ma’aden Aluminium.
5.26 Contract Award
5.26.1 The contractual process shall be completed prior to any work at
Ma‘aden Aluminium location.
5.26.2 Using predefined criteria (see Attachment-3 Prequalification
EHS Evaluation Form), evaluate and determine whether each
contractor is prequalified in EHS. NOTE: this is not a financial or
technical evaluation/prequalification.
5.27 Post-Contract Procedure
5.27.1 Job Specific EHS Plan and Pre-Job EHS Meeting
5.27.2 Upon awarding the contract and prior to beginning the work, the
Contractor shall prepare and submit a Job Specific EHS Plan to
the Ma’aden Aluminium.
5.27.3The project manager/leader and respective EHS member shall
review the Contractor job specific EHS Plan with Contractor
Management and resolve any deficiencies.
5.27.4 Work shall not begin until the plan is reviewed and approved by
the Ma’aden Aluminium Central EHS or respective BU EHS
Manager.
5.27.5The Contractor shall be reminded that Subcontractors shall not
be used without specific written consent from the Procurement
Manager. Subcontractors shall be prequalified and meet all the

5.27.6 The Job Specific EHS Plan shall be discussed at a Pre-Work EHS
Meeting. Meeting attendance shall be documented.
5.27.7 Depending on the Scope of Work, the following people should
attend the Pre-Work EHS Meeting:
a) Ma’aden Aluminium Project Manager/ Leader
b) Ma’aden Aluminium Responsible Person
c) Contractor Responsible Person
d) BU and Contractor EHS Representative
e) Maintenance Manager/Supervisor
f) Facilities Manager/Coordinator
g) Other Technical Personnel.
5.27.8The contents of the Job Specific EHS Plan shall be communicated
to the Contractor and Subcontractor employees.
5.27.9 Contractor shall designate and provide a Job Site Responsible
Person to be on site during the duration of job. The responsible
person will direct the job in accordance with the job specific EHS
Plan.
5.27.10 Contractor, Subcontractor or Contracted Services shall
provide responsible resources on site to direct the work and
enforce the job specific EHS Plan and safe work practices.
5.28 Audits, Enforcement and Incident Reporting
5.28.1 Each Contractor, Subcontractor or Contracted Services shall
perform field observations of work activities to verify the job
specific EHS Plan and safe work practices are being followed.
5.28.2The designated Ma’aden Aluminium Responsible Person and
Contractor Responsible Person or Job Site Responsible Person
shall perform documented periodic audits (minimum every
month one audit) during the duration of the job to ensure
compliance with the Job Specific EHS plan.
5.28.3 The Contractor, Subcontractor or Contracted Services shall
report, record, and investigate injuries, illnesses and major injury-
free events in accordance with MSHEM-10.00-Incident Reporting
Classification Investigation and Record Keeping.
5.28.4 Incidents or observances of non-compliance shall be
reported/documented as per MSHEM-10.00-Incident Reporting
Classification Investigation and Record Keeping taken shall be
noted, a copy of which will be forwarded to the Ma’aden
Aluminium Responsible person or designated SPA. This
information will be incorporated into the yearly contractor
evaluation spreadsheet.
5.28.5 Throughout the duration of the job and as conditions dictate, the
plan shall be reviewed, updated, and revised to reflect changes in
the project scope, and/or operating conditions.

5.28.6 Any modifications made to the job specific EHS Plan shall be
communicated to all Contractor employees, the Ma’aden
Aluminum Responsible Person and to other project participants
as affected by the change.
5.28.7During the auditing of the job, interviews shall be conducted with
contractor employees to determine their level of understanding
with regards to applicable required programs (e.g. Critical
Processes, Mobile Equipment, Confined Space, Fall Protection
and Lockout/Tagout Verify) and environmental rules and
regulations.
5.29 Training
5.29.1 Ma’aden Aluminium employees involved with coordinating,
scheduling, researching, purchasing and contract administration
shall be trained in accordance with the contents of this program.
5.29.2 The Ma’aden Aluminium Responsible Person or designee shall
conduct the training annually or as deemed necessary at Ma’aden
Aluminium site or by Ma’aden Aluminium approved third party
with a valid agreement with Ma’aden Aluminium. The selection of
the third party shall be subjected to the Ma’aden Aluminium
procurement process and Central EHSS shall be involved in the
final selection process.
5.29.3 The Contractor, Subcontractor or Contracted Service all
employees shall attend Ma’aden Aluminium EHS
induction/orientation and mandatory trainings.
5.29.4 The Contractor, Subcontractor or Contracted Service shall
ensure that all permit receivers are trained and certified by
Ma’aden Aluminium.
5.29.5 The Contractor, Subcontractor or Contracted Service shall
provide all job specific regulatory training as required for the
performance of the Scope of Work. Ma’aden Aluminium will
periodically monitor for compliance.
5.29.6 Contractor, Subcontractor or Contracted Service shall obtain a
prior approval from relevant EHS for their training packages to
ensure they are incompliance with Ma’aden Aluminium EHS
requirements.
5.29.7 Contractors are required to provide evidence that proves job
specific training has been conducted where required by
governmental regulations. (Some disciplines include, but are not
limited to: Electrician, Mechanical / Sheet Metal Fabrication,
Forklift / Mobile Equipment, Scaffolding, Boom Lift, Hilti Gun,
etc.)
5.30 General Requirements
5.30.1 Contractors shall be prohibited from using Ma’aden Aluminium
tools and equipment without the expressed, written permission
of the Ma’aden Aluminium Responsible Person or designee.

5.30.2 Contractor shall obtain appropriate work permit prior to task as


per MSHEM 02.07 Work Permit Procedure.
5.30.3 Contractors shall limit mobile equipment to the extent of what is
prescribed in the Job Specific EHS Plan. Under no circumstances
can this be circumvented without first notifying and consulting
with Purchasing and the Ma’aden Aluminium Responsible Person.
A Ma’aden Aluminium Hold Harmless Agreement shall be
completed and approved by the location’s General Manager, or
his designee prior to the loaning of equipment.
5.30.4 Violations of location Site Conditions or applicable regulatory
requirements shall result in the immediate stoppage of work and
corrective actions will be implemented to ensure there is no
reoccurrences prior to the continuation of work.
5.31 Ma’aden Aluminium Specific Site-Conditions
5.31.1 Procurement shall send out Ma’aden Aluminium Site Conditions
with each bid package and Purchase Order or Contract that is
sent to a Contractor.
5.31.2 Refer Contractor EHS Requirements for minimum specific Site
Condition in appendix A Serial Number 06.
5.32 Contractor EHS Committee (CEHSC)
5.32.1 CEHSC will perform the role of Contractor Performance
Monitoring and improvement of Ma’aden Aluminium Contractor
safety process.
5.32.2CEHS committee shall have assigned A Chairman, A Secretary
and Committee Members.
5.32.3Chairman shall be Business Unit VP and VP shall select Secretary
and Committee Members.
5.32.4 Nomination of an ad-hoc member in a committee is subjected to
a chairman decision in relevance to the agenda item.
5.32.5 Following are the key roles of the committee but not limited to:
5.32.6 Ensure the implementation of the Ma’aden Aluminium
Contractor safety process.
5.32.7Review and monitor the effectiveness of the EHS measure taken
on site.
5.32.8 Coordinate the interface safety measures of all sub-contractor,
central maintenance undertakers or other construction parties
working on the Ma’aden Aluminium premises.
5.32.9 Promote contractor safety awareness and training.
5.32.10 Review the health and safety statistics and monitoring the
performance.
5.32.11 Provide a forum for contractor to discuss construction EHS
matters.
5.32.12 Escalate contractor concern in monthly EHS steering committee.

5.32.13 As minimum, the following effective key elements shall be


established by the CEHSC:
5.32.14 Hold meeting on a regular basis, following a consistent
schedule.
5.32.15 Set clear meeting agenda; publish the agenda in advance to
attendees.
5.32.16Any addition or modification to the meeting agenda shall be
communicated to a committee secretary at least two days prior
the committee meeting.
5.32.17 Maintain minutes of each committee meeting that summarize
the issues been discussed and the proposed actions.
5.32.18SPA shall be assigned for the proposed actions.
5.32.19Meeting minutes shall be published and provided to each
committee member.
5.32.20 Members shall be required to attend all meetings. If a
member cannot attend a meeting, then deputy shall be assigned.
5.32.21 Attendance shall be recorded at each meeting in the minutes.
5.33 Other MSHEM Elements and Sub-Elements that are applicable and
where the contractor or contracted services providers Elements and
procedures shall apply;
5.34 Ensure that the planned scope of work is designed or planned in a way
that reduces risk during construction, operations, maintenance and
decommissioning where applicable; for level of risks see document MA-
EHS-MS-02-EHS Aspects, Risks and Impacts Assessment
5.35 Other relevant EHSS expectations that are not covered by Elements or
procedures;
5.36 An expectation that contractor either qualify to or as a minimum align
with ISO 14001:2015 and ISO 45001:2018; see document MA-EHS-MS-
02-EHS Aspects, Risks and Impacts Assessment
5.37 The requirement for nominating a contractor accountable person,
providing contact details and the obligation to communicate any
change of the contract responsible person;
5.38 Ensure that Contractor and any Subcontractors meet all regulatory and
EHS obligations under the contract that applies to the work are fulfilled.
5.39 Advise and direct the Contractor and any Subcontractors to work in
accordance with Ma’aden Aluminium EHS Policies, Principles and
Standards, contractual EHS obligations and applicable Regulatory
requirements.
5.40 Perform and/or coordinate the appropriate EHS risk assessment(s) for
all phases of its work, including any work conducted by Subcontractors.
5.41 Enforce the necessary level of hazard control for Contractor and any
Subcontractors.

5.42 Ensure that the Contractor and any Subcontractors meets the
mandatory requirements of all Ma’aden Aluminium EHSS Programs and
obtain work permit prior to task.
5.43 Specify that the bidder undertake a risk assessment on their
understanding of the scope of work and outline their view on what
actions shall be taken to control the expected project / scope risks;
5.44 EHSS reporting and incident reporting / investigation requirements
that shall be met prior to, during and after the scope of work is
completed;
5.45 Contractor shall establish a policy and procedures to promote timely
reporting of all EHS incidents in accordance with MSHEM-10.00-
Incident Reporting Classification Investigation and Record Keeping.
Proper corrective and preventive actions shall be promptly taken.
5.46 The Contractor is responsible for ensuring that all environmental
incidents involving their employees are recorded and reported.
5.47 All medical emergencies shall be reported to Ma’aden Aluminium Clinic
(013 350 9111). In the event of injury, occupational illness, injury-free
event or property damage and Environmental incidents, the Contractor
shall notify the Ma’aden Aluminium Responsible Person or Project
Manager and or Project Leader immediately. If injured, no matter how
slight, get medical treatment immediately. The Contractor shall
investigate all recordable injuries and high potential injury-free events
within 24 hours of the incident and a written report submitted to the
Ma’aden Aluminium Responsible Person. The Ma’aden Aluminium
Responsible Person and EHS Department representative shall
participate in the investigation.
5.48 Contractor shall investigate all incidents involving their personnel and
or their subcontractors’ personnel and shall participate in any Ma'aden
Aluminium incident investigation as requested by the Ma'aden
Aluminium.
5.49 All Contractor’s shall maintain weekly and monthly EHS statistics report
and submit the report to Ma’aden Aluminium Business Unit EHS
Department on attached form (Attachment 8). Weekly report every
Thursday afternoon before 15:00hrs and Monthly report 3rd day of each
month.
5.50 Documentation shall specify that contractors shall only use
subcontractors with the express and written permission of the Ma’aden
Aluminium Contract Accountable Person and that sub-contractors shall
be required to meet all EHSS requirements that are set out in the
contract. A copy of the local legal requirements for both the Contractor
and Sub-Contractor shall be provided.
5.51 Contractor shall not use any subcontractor without prior approval from
Ma’aden Aluminium Procurement Department and shall complete all
EHS pre-qualification requirements.
5.52 Any delay in project/work schedule due to untimely request for
subcontractor approval or failure to schedule orientation is the
Contractor’s responsibility.

5.53 A clear statement that the Contractor is fully responsible for the work
of their subcontractors and that the contractor shall maintain their own
management and EHSS presence on site whilst subcontractors are on
duty.
5.54 The Contractor's Management is accountable for the safety and health
of the Contractor's employees. The Contractor is also accountable for
the impact that the actions of their employees and subcontractors may
have on the safety and health of others.
5.55 Any delay in project/work schedule due to untimely request for
subcontractor approval or failure to schedule orientation is the
Contractor’s responsibility.
5.56 Competency requirements that the contractor, subcontractor and
contracted services personnel shall possess prior to the
commencement of work. Competency assessment and assurance
requirements shall be specified but must include Govt. and third-party
training / licensing as per industry standard;
5.56.1 No one shall work on site without successfully completing
an EHS orientation.
5.56.2 The site orientation will be presented by the Ma’aden
Aluminium authorized orientation personnel. The
orientation program will conclude with a skill check.
Orientation attendance will be documented, and a badge
will be presented to employees who have successfully
completed the orientation.
5.56.3 Contractor shall ensure that all its personnel are qualified,
competent and have demonstrated they have the
necessary knowledge and skills to safely and properly
perform their assigned work.
5.56.4 Contractor shall establish job classifications (e.g., welder,
rigger, crane operator, heavy equipment operator, and
driver) required to perform the work and the specific job
skills/craft competence and training requirements for each
of these job classifications, including Saudi Arabian
Government certification and or license requirements.
5.56.5 Contractor shall ensure their personnel receive
documented training, based on job classification.
5.56.6 Where a specific job requires Ma’aden Aluminum and or
Saudi Arabian Government certification and or license,
these job functions shall be assigned only to properly
certified and or licensed personnel.
5.56.7 Contractor shall establish additional training programs for
personnel who perform high-risk activities, such as but not
limited to: confined space entry, fire watch, lock-out/tag-
out verify, working on or near energized electrical
equipment, working at height, lifting and rigging,
excavation, specialized power tools and equipment,

handling of hazardous chemicals, waste storage and


handling, etc.
5.56.8 Safety training shall also address off-job hazards (e.g., seat
belt use, Defensive driving).
5.57 Contractor’s in-house or third-party training facility shall include as
minimum:
5.57.1 Training facilities complete with multimedia (audio/visual)
resources.
5.57.2 Adequate furniture seating writing desk.
5.57.3 Class (group) size shall be restricted to suitable trainee to
trainer ratio.
5.57.4 Away from noisy construction areas and activities.
5.57.5 Qualified instructors to ensure personnel properly receive
the required training.
5.57.6 Verbal instruction and written materials in a language
clearly understood by the personnel receiving the training.
5.57.7 Documented post-training competency assessments.
5.57.8 Documentation of completed safety training (e.g., pocket
card, “safety passport” or file copies of training records).
5.57.9 Contractors shall maintain training records for review by
the Ma’aden Aluminium upon request.
5.57.10 Ma'aden Aluminium reserves the right to test/verify the job
skills/craft competency and qualifications of contractor’s
employees and to remove any employee failing this
test/verification.
5.57.11 Refresher training shall be conducted at the frequency not
less than that established by Saudi Arab Government
regulation and or Ma’aden Aluminium requirements as per
MA-EHS-MS-06- EHS Training Awareness and
Competency.
5.57.12 If an employee is found to be working without Ma’aden
Aluminium mandatory training, it will be considered a
breach of contract and necessary actions shall be taken by
Ma’aden Aluminium.
5.58 Specify any requirements in respect of the mobilization of contractor
personnel, including EHSS induction training, Work permit
certifications, scaffolder, rigger certifications, driver / operator
certifications any other special skill and training (e.g. certification,
registration, license and experience);
The ratio of contractor personnel to supervisors and the ratio of
personnel to EHSS personnel shall be based on the scope of work and
the assessed risks. 1:20 for Extreme risk, 1:30 for High Risk. 1:40 for
moderate Risk and 1:50 for low risk jobs. Category 1 contractors are
exempt from this requirement;

5.59 Contractor shall appoint and maintain at minimum one EHSS person in
the workplace whilst any work is occurring on the scope of work. This
applies even when the work team is less than 50 (category 1 exempt);
5.59.1 The Contractor shall be responsible for the safety of its own
employees as well as the safety of all its Subcontractor’s
employees. To this end, the contractor is responsible for
ensuring that there is always adequate supervision.
5.59.2 The contractor and sub-contractor line management
including supervisor and foreman shall directly be involved
in the contractor ‘s responsibilities for the safety and health
of all personnel at the work site and for making safety and
health compliance a part of all work assignments.
5.59.3 As a minimum Contractor shall provide full-time qualified
site safety staff in accordance with Table 1, with respect to
the maximum number of contractor and subcontractor
employees who are present at the job site at a given time,
or as otherwise requested by the Ma’aden Aluminium (e.g.,
during a Pre-Job Meeting).
5.59.4 Safety staffs shall be fluent in English (Speak, Read and
Write) and shall have a relevant experience in EHS field as
per Table 1.
5.59.5 Prior to mobilizing contractor EHS staffs, the Ma'aden
Aluminium Central EHS or respective Business Unit EHS
shall screen and approve the contractor EHS staffs. If

required, the Ma'aden Aluminium may also take a written


examination.
5.59.6 The Ma’aden Aluminium EHS department reserve the right
to require the contractor replace the any EHS staffs whose
work is deemed unacceptable by the Ma‘aden Aluminium.
5.59.7 The Ma'aden Aluminium EHS reserve the right to require the
contractor to provide additional safety, health and
environmental specialist where special technical expertise
is required.
5.59.8 Contractor EHS staff shall not be assigned in dual roles
5.60 The fitness-for-purpose requirements for any equipment that is
brought to the Ma’aden or Affiliate facility. This shall include any
inspection requirements by Ma’aden or Affiliate personnel or assigned
third party inspection groups;
5.61 Ma’aden requirements in respect of the health and well-being and
fitness for work of contractor personnel. This shall include both on-the
-job and off-the-job health and well-being. This shall include the
provision for routine, emergency and injury / illness medical treatment;
5.62 Ma’aden Aluminium requires that an employee of a Contractor who is
engaged to work at a Ma’aden Aluminium facility for a period exceeding
three months at any one time shall undertake a health assessment
comprising:
5.62.1 A record of the persons works history.
5.62.2 A respiratory questionnaire
5.62.3 A lung function test.
5.62.4 An audiometric test.
5.62.5 Initial” and “periodic” health assessments shall be carried
out in accordance with the above. A health assessment is
carried out on each employee at intervals not exceeding 5
years.
5.63 The Contract shall specify that the Contractor or Service provider shall
meet or exceed the requirements set out within the MSHEM
Occupational Health Elements/Sub-Elements and associated
procedures applicable at the time;
5.64 Based on the contract risks and in consultation with the concerned
EHSS Manager, the Contract Accountable Person and the Procurement
lead shall specify in the contract the penalties for non-compliance with
EHSS requirements and for poor EHSS performance; and
5.65 The contract shall include the provision for termination for poor EHSS
performance, EHSS regulatory violation or continual failure to meet
contractual EHSS requirements. Termination of the contract shall be
without penalty to Ma’aden Aluminum and at the request of the
Contract Accountable Person.
5.65.1 Any violation or deviation from the above conditions by the
Contractor may result in the dismissal of the Contractor or

Contractor employee from the property and cancellation of


contracts with Ma’aden Aluminium. Furthermore, it is
expected that the Contractor shall counsel, discipline
and/or dismiss their employees from Contractor Company
for violating Ma’aden Aluminium Live Saving Rules,
demonstrating a negative attitude towards EHS policy,
engage in any dangerous, illegal or outrageous conduct.
5.65.2 5.2.5. If Ma’aden Aluminium observes or is made aware of
unsafe acts or behaviors in regard to regulation, policies,
rules, or procedures by employees, visitors, or sub-
contractors, the contractor, depending on the seriousness
of the situation, may be subjected to a penalty of up to SR
10,000 per occurrence and/or termination of the contract.
Note: Without exception, the contract must contain clear advice that
the approved Ma’aden Aluminium EHSS Elements and systems shall
apply to all Contractor facilities or workplaces within the Ma’aden or
Affiliate land boundaries irrespective of whether the day to day
management of that place is under the control of Ma’aden, the Affiliate
or the Contractor.

5.66 Following additional requirements shall be included in the Scope of work for
applicable category:

5.66.1 Additional requirements for developing Scope of work for


Category 2 contractors:
a) Qualification & Certification requirements.
i. EHS Orientation/Induction, Training and Competency
ii. The Contractor, Subcontractor or Contracted Service
shall provide all job specific regulatory training as
required for the performance of the Scope of Work.
Ma’aden Aluminium will periodically monitor for
compliance.
iii. Contractor, Subcontractor or Contracted Service shall
obtain a prior approval from relevant EHS for their
training packages to ensure they are incompliance
with Ma’aden Aluminium EHS requirements.
iv. Contractors are required to provide evidence that
proves job specific training has been conducted where
required by governmental regulations. (Some
disciplines include, but are not limited to: Electrician,
Mechanical / Sheet Metal Fabrication, Forklift / Mobile
Equipment, Scaffolding, Boom Lift, Hilti Gun, etc.)
v. Contractor shall ensure that all its personnel are
qualified, competent and have demonstrated they
have the necessary knowledge and skills to safely and
properly perform their assigned work.
vi. Contractor shall establish job classifications (e.g.,
welder, rigger, crane operator, heavy equipment

clearly understood by the personnel receiving the
training.
xviii. Documented post-training competency assessments.
xix. Documentation of completed safety training (e.g.,
pocket card, “safety passport” or file copies of training
records).
xx. Contractors shall maintain training records for review
by the Ma’aden Aluminium upon request.
xxi. Ma'aden Aluminium reserves the right to test/verify
the job skills/craft competency and qualifications of
contractor’s employees and to remove any employee
failing this test/verification.

xxii. Refresher training shall be conducted at the frequency


not less than that established by Saudi Arab
Government regulation and or Ma’aden Aluminium
requirements as per MA-EHS-MS-06- EHS Training
Awareness and Competency.
xxiii. If an employee is found to be working without Ma’aden
Aluminium mandatory training, it will be considered a
breach of contract and necessary actions shall be
taken by Ma’aden Aluminium.
b) Specification and legal requirements for equipment &
facilities to be provided by the contractor.
c) Copies of Procedures and Work Practices applicable
to the work assigned to the contractor.
i. Prepare invitation to quote, scope of work, site
condition and other expectations documentations.
Any changes in scope, conditions, hazards, etc.,
impacting the Contractor job specific EHS plan shall
be communicated immediately to the Contractor,
Subcontractor and or Contracted Service.
ii. Perform an Engineering, Design, Construction,
Commissioning and Operating Project Environment,
Health and Safety Review (PEHSR) for all projects with
the potential to impact the Environment and the
Health or Safety of people or communities as per
Attachment-2.
d) Requirement for Risk Assessment or Job Safety
Analysis (JSA) for critical jobs, tasks or activities.
i. Contractor shall prepare Job Safety Analysis for any
job done under a work permit condition, any critical
jobs and new jobs as per MA-EHS-SP-15- Job Safety
Analysis Program.
e) The need for full time / part time representative
responsible for on-site EHSS performance supervision
of contractor employees.
i. The Contractor shall be responsible for the safety of
its own employees as well as the safety of all its
Subcontractor’s employees. To this end, the
contractor is responsible for ensuring that there is
adequate supervision at all times.
ii. The contractor and sub-contractor line management
including supervisor and foreman shall directly be
involved in the contractor’s responsibilities for the
safety and health of all personnel at the work site and
for making safety and health compliance a part of all
work assignments.
iii. Contractor shall provide full-time qualified site safety
staff in accordance with Table 1., with respect to the

employees who are present at the job site at a given
time, or as otherwise requested by the Ma’aden
Aluminium (e.g., during a Pre Job Meeting).
iv. Safety staffs shall be fluent in English (Speak, Read
and Write) and shall have a relevant experience in EHS
field as per Table 1.
v. Prior to mobilizing contractor EHS staffs, the Ma'aden
Aluminium Central EHS or respective Business Unit
EHS shall screen and approve the contractor EHS
staffs. If required, the Ma'aden Aluminium may also
take a written examination.
vi. The Ma‘aden Aluminium EHS department reserve the
right to require the contractor replace the any EHS
staffs whose work is deemed unacceptable by the
Ma‘aden Aluminium.
vii. The Ma'aden Aluminium EHS reserve the right to
require the contractor to provide additional safety,
health and environmental specialist where special
technical expertise is required.
viii. Contractor EHS staff shall not be assigned in dual
roles.
ix. Contractor’s site safety staff shall be present at the job
site at all times while contractor and/or subcontractor
personnel are working, including nights, weekends,
holidays and extended working hours.
x. Contractor shall provide communication devices to all
their EHS staff.
a. Employees’ welfare (medical treatment) and medical
check-up/fitness requirements as per local / regional /
(inter)national regulations.

5.66.2 Additional requirements for developing Scope of work for


Category 3 contractors:
a. Availability of license or permit required as per local /
regional / (inter)national regulations for handling waste.

i. Contractor shall establish additional training programs for


handling of hazardous chemicals, waste storage and handling,
etc.
ii. It shall be the responsibility of the Contractor, Subcontractor,
and Contracted to follow Ma’aden Aluminium Waste
Management Program.
iii. Collection, storage and disposal of non-hazardous and
hazardous waste in accordance with Royal Commission
Regulations and Al Baitha Mine in accordance with GAMEP.

iv. The specific locations for the disposal of various wastes (clean
excavated material, common construction trash, etc.) shall be in
accordance with Ma’aden Aluminium instructions.
v. Hazardous waste materials such as PCB’s, asbestos or fibrous
materials shall be disposed of in a manner approved by Ma’aden
Aluminium and RCER.
vi. Waste hazardous materials shall be disposed of in a manner
approved by Ma’aden Aluminium.
vii. The Contractor is responsible for the disposal of its own waste
unless otherwise agreed to with Ma’aden Aluminium. All waste
shall be disposed of in accordance with the requirements of
RCER.
viii. Ma’aden Aluminium operates a waste segregation system,
where waste types are segregated in accordance with the type
and disposed of appropriately. Bins and dumpsters are labelled,
and color coded to assist with segregation of waste. Bins are
regularly assessed for cross contamination.
ix. Waste from other premises, the public, or your home is not
permitted for disposal in Ma’aden Aluminium bins or any waste
facility or accumulation area at each Ma’aden Aluminium
Operation.
x. Process wastes such as residue material, scale, alumina or sand
shall not be placed in general waste or recycling bins. Process
waste dumpster bins are located around site to safely dispose
of process wastes.
xi. Contractors handling or transporting hazardous or large
volumes of wastes should consult with the Ma’aden Aluminium
environmental department to ensure that they meet Ma’aden
Aluminium standards and the relevant legislation. All
contractors disposing or receiving waste from Ma’aden
Aluminium shall be audited prior to commencing work to ensure
they meet these requirements and shall be subject to regular
audits thereafter.
xii. All wastes travelling offsite shall be transported by Ma’aden
Aluminium approved contractors and disposed of at Ma’aden
Aluminium approved facilities. The details of each load shall be
recorded on a Ma’aden Aluminium standard Waste Manifest
form report and shall be reported to the site Environmental
Department.
xiii. For more information on correct waste disposal contact the site
contractor waste coordinator or the site Environmental Dept.
5.66.3 Additional requirements for developing Scope of work for Category
4 contractors:
a. Specification and legal requirements for equipment & facilities
operated by the contractor.
b. Risk assessment of the nature/hazards of products involved,
previous performance of Customer, Distributor, etc.

5.66.4 Additional requirements for developing Scope of work for Category
5 contractors:
a. In case of Transporters: Requirements of applicable MSHEM
Elements and Elements (including transportation risk assessment
requirement) for marine & inland waterway, rail & road
transportation of materials and local / regional / (inter)national
regulations as applicable.
b. In case of Terminal operators and/or Warehouses: Availability of
license or permit required as per local / regional / (inter)national
regulations for storage of products.
5.67 Risk Assessments of the scope of work
5.67.1 Risk assessment of the planned scope of works shall be conducted
by the Contract Responsible Person / nominee as per the MSHEM
Standard Element-02.00. In coordination with the concerned EHSS
personnel and the purchase personnel as applicable.
5.67.2 Risk assessment shall consider the worst EHSS consequence for the
scope of work and the likelihood of such consequence to occur.
5.67.3 Risk shall be categorized as Extreme, High, Moderate or Low based
on the Risk assessment methodology and the Ma’aden EHSS Risk
Matrix.
5.67.4 The required risk mitigation measures shall be identified to ensure
that all identified risks are brought to a low level before commencing
the work. Appropriate EHSS documentation or strategies are
identified for inclusion into the scope of work package for the RFQ
as well as specific inclusions into the contract and any attached
contract schedules.
5.67.5 Risk Scope of work shall be distributed to potential Contractors but
they must be qualified / registered and meet the requirements of pre-
qualification / registration before the contract being awarded to
them.
5.68 Prior to entering into contractual agreement, all potential Contractors.
Subcontractors and Contracted Services shall be pre-qualified and selected by
evaluating the Contractor's, Subcontractor's or Contracted Service's past EHS
performance and current ability to meet Ma’aden Aluminium EHS expectations
as outlined in Attachment- 1 Prequalification Form.
5.69 All questions in Prequalification Form shall be completed by contractors,
subcontractors and contracted services who desire to be considered to perform
work at any Ma‘aden Aluminium location.
5.70 The Contractor shall agree to complete in full, the Contracted Services Safety
Pre-qualification Questionnaire, and return by a specified time frame set by the
location in order for their bid to be considered.
5.71 The Contractor shall be required to update and resubmit the Pre-qualification
Questionnaire annually.

5.72 The Pre-qualification questionnaire shall be reviewed and evaluated for


acceptance by the Ma’aden Responsible Person.
5.73 System shall be developed to identify Trusted Suppliers. This system shall include
the following:
5.73.1 The system shall include a Risk assessment methodology for the
Trusted Supplier, which meets the intent of MSHEM Element-02.00.
The assessment of Risk associated with the Trusted Supplier shall
consider the worst EHSS consequence of the scope of work assigned
to it and the likelihood of such consequence to occur based on its
EHSS performance, profile and Ma’aden’s past experience of working
with them.
5.73.2 Approval of Trusted Supplier shall be given in accordance with the
approval process based on the level of Risk.
5.73.3 The list of identified Trusted Suppliers shall be updated every year in
consultation with the EHSS Department
5.74 Prequalification/registration of Contractors
Ma’aden shall have a Contractor Pre-qualification program in place that is
designed to:
5.74.1 Identify that the potential contractor has an effective EHSS
Management System in place;
5.74.2 Identify EHSS system or culture issues with Contractors prior to the
award of work so that consideration of any risks shall be accounted
for in any contract or owners team strategies to minimize risks;
a. be suitable for achieving the intended outcomes for each of the
five (5) categories of Contractor. Category 1, 2, 3, 4, 5;
b. enable the Contractor to understand what will be required to
align with the Ma’aden or Affiliate expectations regards EHSS
and safe production/construction;
c. have a basic risk focussed questionnaire suitable for the lower
risk potential of the category 1 and 5 contractors designed to
determine the adequacy of the Contractors EHSS Management
Program and likelihood of aligning with the Ma’aden or Affiliate
expectations regards EHSS shall be developed and applied;
d. have a more risk focussed questionnaire for Category 2 and 3
Contractors suitable for the higher risk potential and designed
to determine the adequacy of the Contractors EHSS
Management Program and likelihood of aligning with the
Ma’aden or Affiliate expectations regards EHSS shall be
developed and applied;
e. require a full physical audit of contractor’s safe work culture and
EHSS system to both mentor the contractor but also to gauge
the Contractors commitment to safe
work/construction/production outcomes as well as compliance
to Government regulations (licensing/labour laws/GOSI etc).
This audit shall occur on a site other than a Ma’aden, Sabic or
Aramco location and shall include the Contractors home office;

f. utilise past leading and lagging lessons learned from the


Contractors past works within the collective Ma’aden group; and
g. enable the contractor that does not qualify and as a result, is
excluded from the bid list to learn from the pre-qualification
process, improve and re-apply later if appropriate to do so. Any
Contractor or Service Provider that does not qualify due to
inadequate pre-qualification results may reapply at any time.
h. In considering which contractor may advance to the commercial
assessment phase for the scope of work, the Ma’aden or Affiliate
shall have in place a process where only those contractors that
achieve a physical score in excess of 80% during EHSS pre-
qualification shall advance to the technical review phase of bid
evaluation (prior to commercial assessment).
i. Ma’aden shall design and agree upon a common system for the
retention of Contractor pre-qualification results, key lead and
lag learnings and actionable findings (including results of
closeout) which shall be available for future bid analysis or
Contractor selection.
5.74.3 Registration and pre-qualification of Third Party may be conducted
as a combined activity or as two separate activities based on the
decision by the Purchase Department.
5.74.4 Purchase department shall ensure that the following information is
submitted by the contractor for pre-qualification prior to its
selection.
5.74.5 Acknowledgement of meeting Ma’aden EHSS Policy and Code of
Ethics Policy requirements.
5.74.6 Previous experience and references within Ma’aden or other
organizations.
5.74.7 Any award/recognition received.
5.74.8 Whole or part of the attached sample prequalification, evaluations or
Inspections should be referred as an example for pre-qualification of
all Contractors based on the scope of work and level of Risk
identified.
5.74.9 Other documents defined by EHSS Manager or Contractor
Responsible Person.
5.74.10 In case the Contractor will engage any sub-contractor for carrying
out the scope of work (complete or partially), it shall communicate
its internal process for sub-contractor qualification, communication,
monitoring and auditing. Contractor shall also ensure that the above-
mentioned required information is also submitted for the sub-
contractor. Contractor shall not use any subcontractor without prior
approval from Ma’aden Aluminium Procurement Department.
5.74.11 Any international certification such as ISO, Responsible Care etc. if
any.
5.74.12 The prequalification process shall identify whether a full physical
audit conducted by competent personnel is required based on the

scope of work and the submitted documents. The audit shall be of


the contractor’s safe work culture and EHSS system in order to gauge
the Contractors leadership and organizational commitment to safe
work / construction / production outcomes as well as compliance to
Government regulations (licensing / labour laws / GOSI etc.). This
audit shall occur on a site other than a Ma’aden or Affiliate, SABIC or
Aramco location and shall include the Contractors home office and
be conducted by a person or third-party organization competent to
do so. Category 1 Contractors are exempt from the physical site audit.
5.75 Purchase department shall ensure that the following additional requirements are
provided by the contractor for pre-qualification based on the contract category.
5.75.1 Additional Requirements for Category 1 and Category 2 contractors.
a. EHSS management system
b. EHSS performance of last three years, at a minimum
including injury and illness rate.
c. Incident reporting and investigation process.
d. Employees’ welfare requirements.
e. Emergency Response Plan and preparedness appropriate to
nature of the job.
f. Risk Assessment/ Job Safety Analysis (JSA) for critical jobs,
tasks or activities as required to be provided by the
Contractor.
g. Employees training, certification and qualification
documentation.
5.75.2 Additional Requirements for Category 3 contractors.
a. EHSS management system
b. Declaration and documentary evidence of compliance with
all applicable legal regulations and regulatory requirements.
5.75.3 Additional Requirements for Category 4 contractors.
a. (M)SDS and other applicable hazard communication
information.
5.75.4 Additional Requirements for Category 5 contractors.
a. Declaration and documentary evidence of compliance with
all applicable legal regulations and regulatory requirements
for Transportation of Goods and Materials as per Element-
12.00.
5.76 Contractor or Service Providers “Qualified” status shall be for a period of no
greater than 12 months for the specific scope of work and category after which
they shall pre-qualify for the next contract they bid for. The prequalification is
only for the particular category and a scope. If the scope/category changes then
the contractor needs to apply for pre-qual for that scope.
5.77 A contractor need not re-qualify during an ongoing contract.

5.78 Pre-qualified status shall not be transferrable for any reason (including change
of ownership of the contractor’s business).
5.79 Include a process where only those contractors that the pre-qualification audit
finding indicate no concerns regards EHSS alignment risks between
Ma’aden/Affiliate or the contractor and achieve an actual audit score in excess
of 80% during EHSS pre-qualification shall advance to the technical review phase
of bid evaluation (prior to commercial assessment).
5.80 Design and agree upon a common system for the retention of Contractor pre-
qualification results, key lead and lag learnings and actionable findings (including
results of closeout) which shall be available for future bid analysis or Contractor
selection.
5.81 Planning and Invitation to Quote
Contract Development Procedure
Shall ensures that the contract shall specify all EHSS requirements including but
not limited to:
a. Where Ma’aden Aluminium EHSS and other standards and procedures are
applicable and where the contractor or contracted services providers
standards and procedures shall apply.
b. A competent high-level risk assessment of the planned scope of works is
conducted by the Contract Responsible Person/nominee and the correct
EHSS documentation or strategies are identified for inclusion into the scope
of work package for the RFQ as well as specific inclusions into the contract
and any attached contract schedules.
c. Ensure that the planned works and scope of work documentation are
aligned with the intent of the Ma’aden Safe Steps program and the planned
scope of work is designed or planned in a way that reduces risk during
construction, operations, maintenance and decommissioning where
applicable.
d. Other relevant EHSS expectations that are not covered by standards or
procedures.
e. The requirement for nominating a contractor responsible person, providing
contact details and the obligation to communicate any change of the
contract responsible person.
f. The bid package must specify that the bidder undertake a risk assessment
on their understanding of the scope of work that outlines their view on what
actions shall be taken to control the expected project risk.
g. EHSS reporting and incident reporting/ investigation requirements that
shall be met prior to, during and after the scope of work completed.
h. Documentation shall specify that contractors shall only use subcontractors
with the express and written permission of the Ma‘aden contract owner and
that sub-contractors shall be required to meet all EHSS requirements that
are set out in the contract. A copy of the Ajeer for both the Contractor and
Sub-Contractor shall be provided to Ma’aden at bid.
i. Competency requirements that the contractor, subcontractor and
contracted services personnel shall possess prior to the commencement of

specified.
j. Specify any requirements in respect of the mobilisation of contractor
personnel, including EHSS induction training, Work permit certifications,
scaffolder, rigger certifications, driver/operator certifications any other
special skill and training (e.g. certification, registration, license and
experience);
k. The ratio of contractor personnel to supervisors and the ratio of personnel
to EHSS personnel (minimum EHSS 1:30);
l. The fitness-for-purpose requirements for any equipment that is brought to
the Ma’aden facility. This shall include any inspection requirements by
Ma’aden personnel or assigned third party inspection groups.
m. The requirements in respect of the mobilisation of contractor personnel,
including EHSS induction and other EHSS core training;
n. Ma’aden‘s requirements in respect of the health and well-being and fitness
for work of contractor personnel. This shall include both on-the -job and off-
the-job health and well-being. This shall include the provision for routine,
emergency and accident medical treatment;
o. That contractors shall only use subcontractors with the express and written
permission of the Ma’aden contract owner and that sub-contractors are the
full responsibility of the Contractor in meeting all EHSS requirements that
are set out in the contract;
p. The Contract shall specify that the Contractor or Service provider shall meet
or exceed the Ma’aden Corporate Contractor Health criteria standards
applicable at the time;
q. The contract shall specify the penalties for non-compliance with EHSS
requirements and for poor EHSS performance; and
r. The contract shall include the provision for termination for poor EHSS
performance or EHSS regulatory violation or continual failure to meet
contractual EHSS requirements. Termination of the contract shall be
without penalty to Ma’aden.
5.82 Invitation to Quote
a. When the project or contracted services request has been completed, the
Procurement Department shall send an Invitation to Quote to the selected
Contractors who have met the minimum expectations of the EHS
Prequalification process. Included in the bid package will be the Scope of
Work, Site Conditions, and any other related information. Note to
Procurement: Each Business Unit location is responsible for modifying the
Site Conditions to the specifics of their location.
5.82.1 Only those contractors who have successfully passed the EHSS pre-
qualification assessment shall be invited to bid.
5.82.2 Only those contractors pre-qualified for the category of contract
being sent for RFQ shall be invited to bid for that category of work.

5.83.1 Pre-tender meeting and (Preliminary Site Visit). Once the bid list is
identified, Ma’aden shall have a process where all EHSS expectations
required from the contractor shall be explained to them prior to
submission of the bid. Meeting topics shall include:
a. expectations regard safe operations / work;
b. any EHSS / Other pre-deliverables, quality, content and time;
c. shared understanding of high-level risks and expected
controls; associated with the scope of work.
d. A walk through where appropriate shall be conducted.
e. Clear minutes of the pre-bid meeting shall be shared with all
stakeholders. The Preliminary Site visit shall be preceded by a
pre-bid meeting. Minutes of Meeting (MOM) of the Pre-bid
meeting shall include all the points observed during the site
visit and shall be shared to all the stakeholders. The above
information shall be used by the Contractor in preparation of
submitting a bid package to Ma’aden Aluminium.
5.84 Evaluation and Contract Award
5.84.1 Contract Award
a. A selection process shall be conducted by Procurement
Department to ensure a contractor, subcontractor or
contracted service can safely complete a specific scope of
work. The selection process shall be completed prior to any
work at Ma‘aden Aluminium location.
b. Using predefined criteria (see Attachment-3 Prequalification
EHS Evaluation Form), evaluate and determine whether each
contractor is prequalified in EHS. NOTE: this is not a financial
or technical evaluation/prequalification.
5.84.2 Evaluation Criteria shall include the information required based on
the contractor category.
5.84.3 Evaluation criteria for EHSS requirements shall be established prior
to the bid request being issued but should include whether the
contractor or contracted service provider are ISO 14001, ISO 45001
or OHSAS 18001 certified or commit to alignment with same.
5.84.4 EHSS requirements that have binary (pass / fail) criteria shall be
established. Any contractor, subcontractor or contracted services
provider shall not be awarded the contract if they fail to meet a binary
criterion.
5.84.5 The selection of contractors and contracted services shall be based
on a combination of their capability, contractor employee
competency, financial viability and EHSS performance, taking into
account the technical, and EHSS risks of the specific work.
5.84.6 The weighting of EHSS requirements in any contract award process
shall not be less than 25%. The contract shall not be awarded to any
contractor or contracted services provider that achieves less than
80% of the weighting for EHSS requirements or where the audit

findings indicate a concern that the Contractor are unlikely to align


with the required EHSS requirements.
5.84.7 The EHSS related aspects included in the contractor or contracted
services response to the bid request shall be evaluated by the
Contract responsible Lead in collaboration with the relevant EHSS
leader or their delegate and the contract owner.
5.84.8 Prior to award, Procurement team shall schedule and deliver a pre-
award meeting (with minutes) attended by key personnel (EHSS /
QA / Engineering / Contracts etc) that confirms the bidders
understanding and commitment to delivering the scope of work
safely and in accordance with all agreements made during the pre-
bid meeting. Refer to 5.15.2.1.E of this document. The Preliminary Site
visit shall be preceded by a pre-bid meeting. Minutes of Meeting
(MOM) of the Pre-bid meeting shall include all the points observed
during the site visit and shall be shared to all the stakeholders.
5.85 Planning and preparation for Mobilization
5.85.1 The Contractor or Service provider shall submit the names and CV’s
of proposed EHSS personnel for approval by the Senior EHSS lead
assigned to the scope of work before appointment. All Contractor
nominated EHSS personnel shall be subjected to a formal assessment
process based on the EHSS risk profile of the scope of work.
a. Prior to mobilizing contractor EHS staffs, the Ma'aden
Aluminium Central EHS or respective Business Unit EHS shall
screen and approve the contractor EHS staffs. If required, the
Ma'aden Aluminium may also take a written examination.
b. The Ma'aden Aluminium EHS reserve the right to require the
contractor to provide additional safety, health and
environmental specialist where special technical expertise is
required.
c. The Ma’aden Aluminium EHS department reserve the right to
require the contractor replace the any EHS staffs whose work
is deemed unacceptable by the Ma‘aden Aluminium.
5.85.2 kick-off meeting shall be conducted pre-mobilization for Category 2
and as required for Category 3 to 5 contractors. Category 1
contractors may be exempted from this requirement. Minutes of
meeting will be shared with the key Contractor personnel for
executing the works will be held to discuss key EHSS matters as they
pertain to the scope of work, Ma’aden Safe Steps initiative and the
works high level risk profile. Also discussed in this meeting would
again be EHSS pre-deliverables and compliance of Govt. regulations.
5.85.3 kick-off meeting shall be conducted pre-mobilization for Category 2
and as required for Category 3 to 5 contractors. Category 1
contractors may be exempted from this requirement.
5.85.4 The Contractor In conjunction with the Contract Accountable Person
will undertake a detailed risk assessment of the scope of work
(including Sim-Ops, fatigue, night shift, remote works etc. where
applicable) and deliver an action plan to bring all identified risks to a
“Low” level. Appropriate approvals as per MSHEM Element-02.00

shall be obtained for any Risk higher than low risk level. This risk
assessment shall include all risks associated with sub-contracted
works. Reference to MSHEM MSHEM-02.03-Risk Assessment
Techniques and Analysis.
5.85.5 The contractor or contracted services provider shall be required to
appoint a site-based contactor accountable person at least 2 months
before work is due to commence or as soon as possible if the contract
is issued later than this. 4.8.
5.85.6 Appoint a contract accountable person. The contract accountable
person may be the Contract owner. Below are some of the
responsibilities of Contract Responsible Person
d. Familiar with this program requirements.
e. Ensure the mandatory requirements of this program and the
SWI are met.
f. Work with Procurement in evaluating the Contractor,
Subcontractor or Contracted Services EHS Prequalification;
g. Assist Procurement in completing and analysing the
Contractor, Subcontractor or Contracted Services Pre-
qualification Questionnaire.
h. Assist Ma’aden Aluminium Engineers/Contractors,
Subcontractors or Contracted Services with the Standard
Work Instruction review and Permit to Work.
i. Review Contractor EHS Plans (preliminary) with the Project
Leader/Project Manager.
j. Support location management, project leader/project
manager in ensuring that the contractual EHS obligations of
the Contractors, Subcontractors or Contracted Services are
met.
k. Manage the process to conduct appropriate assessments
and/or audits of such Contractors, Subcontractors or
Contracted Services as necessary to confirm the Contractors',
Subcontractors' or Contract Services' on-going compliance
with contractual EHS obligations including surveillance,
document reviews, walk around observations, incident follow
up, etc..
l. Attend Site Visits for major projects.
5.85.7 The contractor accountable person, other representatives from the
contractor or contracted services provider, in consultation with the
contract accountable person shall formulate a detailed EHSS
implementation plan. The EHSS implementation plan shall address all
identified hazards / risks and shall be updated in the event that new
hazards and risks are identified or emerge. Below are some of the
responsibilities of Contractor Responsible Person (Contractor
Accountable Person)

a. Ensure that Contractor and any Subcontractors meet all


regulatory and EHS obligations under the contract that applies
to the work are fulfilled.
b. Advise and direct the Contractor and any Subcontractors to
work in accordance with Ma’aden Aluminium EHS Policies,
Principles and Standards, contractual EHS obligations and
applicable Regulatory requirements.
c. Perform and/or coordinate the appropriate EHS risk
assessment(s) for all phases of its work, including any work
conducted by Subcontractors.
d. Enforce the necessary level of hazard control for Contractor
and any Subcontractors.
e. Ensure that the Contractor and any Subcontractors meets the
mandatory requirements of all MA EHS Programs and obtain
work permit prior to task.
f. Manage the process to oversee the appropriate self EHS audits
of Contractor and any Subcontractors to confirm on-going
compliance with contractual EHS obligations.
g. Ensure the necessary EHS orientation and training is provided
to employees. Complete routine EHS periodic monitoring of
the work site and communicate results to Ma’aden Aluminium
responsible person.
h. Attend all Site Visits.
i. Attend all Pre-job Meetings.
5.86 The EHSS implementation plan shall include the provisions for scope of work risk
profile based EHSS induction training and training in the Ma’aden Life Saving
Rules.
5.87 All contractor personnel shall be required to confirm in writing that they have
been trained, understand and shall comply with the Ma’aden Life Saving Rules
(LSR) and other applicable MSHEM requirements.
5.88 Contractor shall be required to integrate the applicable MSHEM requirements
into their EHSS implementation Plans and Procedures and demonstrate to the
Contract Responsible Person and the Ma’aden EHSS representative that
applicable MSHEM requirements are met and preferably exceeded. Contractor
shall provide a bridging document showing conformance. Contractor,
Subcontractor and Contracted Service Management should
5.88.1 Comply with all applicable laws, regulations and codes.
5.88.2 Comply with Ma’aden Aluminium EHS Values, Policies and Principles.
5.89 The Contractor accountable person shall be accountable for the communication
of the EHSS implementation plan to their workforce. The Ma’aden or Affiliate
contract accountable person shall be accountable for verifying that the EHSS
implementation plan has been communicated to the contractor or contracted
services provider’s workforce.
5.90 The contractor accountable person, EHSS and other representatives from the
contractor or contracted services provider, the Ma’aden/ Affiliate contract

accountable person, and EHSS and other Ma’aden/Affiliate representatives shall


formulate work method statements as required.
5.91 The contractor accountable person, EHSS and other representatives from the
Contractor or contracted services provider shall be required to produce a
detailed mobilization plan. This will include how health and well-being
requirements shall be met which shall include risks associated with fatigue as well
as the leave, rest and welfare of personnel through compliance with the Kingdom
of Saudi Arabia Labour laws as it applies at the time.
5.92 The contractor accountable person, EHSS and other representatives from the
contractor or contracted services provider, the concerned Ma’aden/Affiliate
contract accountable person and other concerned Ma’aden/Affiliate
representatives shall formulate a detailed EHSS induction plan that shall be based
on the hazards to which contractor personnel may be exposed. Job Specific EHS
Plan and Pre-Job EHS Meeting will discuss
5.92.1 the Contractor shall prepare and submit a Job Specific EHS Plan to
the Ma’aden Aluminium once contract is awarded
5.92.2 The project manager/leader and respective EHS member shall review
the Contractor job specific EHS Plan with Contractor Management
and resolve any deficiencies.
5.92.3 Work shall not begin until the plan is reviewed and approved by the
Ma’aden Aluminium Central EHS or respective BU EHS Manager.
5.92.4 After the contract has been awarded, a Pre-Job EHS meeting shall be
conducted to ensure Contractor, Subcontractor or Contracted
Services management understands the EHS expectations set forth in
the contract. Scope of Work, Site Conditions, permits, training,
accident reporting, and other administrative requirements shall be
discussed. The Contractor shall be reminded that Subcontractors
shall not be used without specific written consent from the
Procurement Manager. Subcontractors shall be prequalified and meet
all the pre-job requirements including orientation, training, and photo
IDs.
5.92.5 The Job Specific EHS Plan shall be discussed at a Pre-Work EHS
Meeting. Meeting attendance shall be documented.
5.92.6 Depending on the Scope of Work, the following people should attend
the Pre-Work EHS Meeting:
a. Ma’aden Aluminium Project Manager/ Leader
b. Ma’aden Aluminium Responsible Person
c. Contractor Responsible Person
d. BU and Contractor EHS Representative
e. Maintenance Manager/Supervisor
f. Facilities Manager/Coordinator
g. Other Technical Personnel.
5.92.7 The contents of the Job Specific EHS Plan shall be communicated to
the Contractor and Subcontractor employees.

5.92.8 Contractor shall designate and provide a Job Site Responsible Person
to be on site during the duration of job. The responsible person will
direct the job in accordance with the job specific EHS Plan.
5.92.9 Contractor, Subcontractor or Contracted Services shall provide
responsible resources on site to direct the work and enforce the job
specific EHS Plan and safe work practices.
5.92.10 The contract owner shall be accountable for gaining the confirmation,
evidence and assurance from the Contractor accountable person of
the EHSS competency of the Contractor personnel assigned to tasks.
5.93 Central & BU EHS Responsibilities
5.93.1 Provide a competent member for Pre-Qualification Process for
Business Unit respective contractors.
5.93.2 Assist and advise Procurement in implementing this program.
5.93.3 Review and update Ma’aden Aluminium Contractor Program.
5.93.4 Shall evaluate the Contractor EHS plan (preliminary) and should be
reviewed annually for contracted services that are routine in nature.
5.93.5 Shall review and approve the Contractor job specific EHS plan prior
to work start.
5.93.6 Conduct Contractor Safety Process trainings & train the trainer
session.
5.93.7 Perform frequent field audit to ensure compliance with job specific
EHS plan.
5.94 Project Manager/ Leader Responsibilities
5.94.1 Initiates and coordinates the project.
5.94.2 Don’t allow to initiate the work until the Contractor job specific EHS
Plan has been appropriately reviewed and modified.
5.94.3 Prepare invitation to quote, scope of work, site condition and other
expectations documentations. Any changes in scope, conditions,
hazards, etc., impacting the Contractor job specific EHS plan shall be
communicated immediately to the Contractor, Subcontractor and or
Contracted Service.
5.94.4 Perform an Engineering, Design, Construction, Commissioning and
Operating Project Environment, Health and Safety Review (PEHSR)
for all projects with the potential to impact the Environment and the
Health or Safety of people or communities as per Attachment-2.
5.94.5 Ensure EHS risk assessments are conducted as per MA-EHS-MS-02-
EHS Aspects, Risk and Impact Assessment.
5.94.6 Coordinate preparation of the scope of work, site condition and other
expectations documents.
5.94.7 Coordinate with Contractors, Subcontractors or Contracted Services
on Safety Hazard Assessments.
5.94.8 Initiate and coordinate Pre-job Meetings.
5.94.9 Enforce Location’s EHS requirements.

5.94.10 Conduct audits and inspections to maintain compliance with job


specifications.
5.94.11 Complete routine EHS periodic monitoring of the Work Site and
communicate results to Contractor, Subcontractor and Contracted
Services management.
5.94.12 Ensure the necessary EHS orientation and training is provided to
Contractor employees.
5.95 The Contractor accountable person, EHSS and other representatives from the
Contractor or contracted services provider, the concerned Ma’aden contract
accountable person, and EHSS and other concerned Ma’aden/Affiliate
representatives shall agree and document the permit to work process that shall
be used. It shall require contractor and concerned Ma’aden/Affiliate
authorization prior to any permitted work being carried out.
5.96 The Contractor accountable person, EHSS and other representatives from the
contractor or contracted services provider, the concerned Ma’aden/Affiliate
contract accountable person, and EHSS and other concerned Ma’aden/Affiliate
representatives shall formulate EHSS self-verification, assurance and audit
programs and define their frequency.
5.97 The Contractor accountable person, EHSS and other representatives from the
contractor or contracted services provider, the concerned Ma’aden/Affiliate
contract accountable person, and EHSS and other concerned Ma’aden/Affiliate
representatives shall undertake a pre-occupation walkthrough of the allocated
work spaces and record the site condition and sign over responsibility to the
Contractor.
5.98 Work Execution
5.98.1 Appropriate form of risk assessments and management as per
MSHEM Element-02.00 (e.g. audit of leading and/or key performance
indicator compliance by contractor) shall be undertaken throughout
the course of contract execution.
5.98.2 The ongoing commitment of Contractor line and senior management
towards agreed implementation plan for meeting EHSS performance
expectations shall be adjudged by monitoring the following;
5.98.3 Performance of any subcontractors particularly on EHSS
performance matters;
5.98.4 Application of controls resulting from the detailed risk assessment.
5.98.5 Adherence to approved EHSS implementation plans, standards,
Elements, procedures and any other formal EHSS performance
requirements;
5.98.6 Compliance to applicable Elements regards quality and maintenance
of tools, equipment (mobile and stationary);
5.98.7 Ability to continually improve based on formal assessments by the
concerned Ma’aden/Affiliate team; and
5.98.8 Application and maintenance of acceptable worker welfare Elements.

5.99 Contractors program effectiveness for compliance to Government or local


regulations, competency, licensing or reporting requirements and expectations
for both their own and subcontractor personnel shall be verified.
5.100 Exposure assessment and other MSHEM occupational health and hygiene
requirements shall be continually implemented during work execution.
5.101 General EHSS performance recording and reports shall be retained in approved
data bases for later use or data analysis.
5.102 The concerned Ma’aden contract owner and/ or Ma’aden contract accountable
person, in collaboration with the affiliate EHSS leader or delegate, shall review
the EHSS performance of the contractor or contracted services provider at
defined intervals. The defined interval shall not exceed 3 months. The review shall
include:
5.102.1 Incident and injury reports;
5.102.2 Incident and injury investigation reports;
5.102.3 High potential incident reports and investigations;
5.102.4 Detail of any regulatory health, safety and environmental violations;
5.102.5 EHSS Observations;
5.102.6 Leading and lagging EHSS indicator reports.
5.103 Reports shall be recorded and provided to the procurement team for later use
by others.
5.104 The concerned Ma’aden/Affiliate Contract owner and/ or concerned
Ma’aden/Affiliate contract accountable person, in collaboration with the affiliate
EHSS leader or delegate, shall meet with the contractor accountable person
following each review. Corrective action, where necessary, shall be formulated
and recorded. Actions shall be tracked to completion.
5.105 Appropriate recognition for outstanding EHSS performance by the contractor,
subcontractor or contracted services provide should be considered and
recognized by Ma’aden Contract owner and/ or Ma’aden contract accountable
person, in collaboration with the affiliate EHSS leader.
5.106 Demobilization and Closeout
5.106.1 On completion of the contract, the concerned Ma’aden contract
owner and concerned Ma’aden contract accountable person, in
collaboration with the affiliate EHSS leader or delegate, shall review
and evaluate the overall EHSS performance of the contractor
(including the performance of their subcontractor or contracted
services provider). Subcontractor performance will be recorded as
the Contractors performance.
5.106.2 The concerned Ma’aden contract owner and concerned
Ma’aden/Affiliate contract accountable person, in collaboration with
the affiliate EHSS leader or delegate, shall meet with the contractor
accountable person for a final review meeting. An improvement plan
shall be formulated and recorded. Actions shall be tracked to
completion.
5.106.3 The concerned Ma’aden contract owner or concerned Ma’aden
contract accountable person shall issue a final report on the EHSS

performance of the contractor that shall be used in future contractor,


subcontractor of contracted services provider evaluations for new
work once the scope of work and any residual work / actions is
complete.
5.107 Prior to full demobilization of the Contractor or Service provider, the concerned
Ma’aden/Affiliate contract owner and concerned Ma’aden/Affiliate contract
accountable person, in collaboration with the affiliate HSSE leader or delegate,
shall meet with the contractor accountable person for a walk down that is
designed to ensure that the contractor has returned all Ma’aden/Affiliate
properties, removed all unwanted materials and have returned the allocated
space in pre-occupation condition.
5.108 Training and Competence
5.108.1 All personnel shall complete all training required to complete their
duties safely, as per MSHEM-03.00-Competency and Training and in
alignment with Site, Ma’aden, National and Industry requirements
prior to start of work.
a) Ma’aden Aluminium employees involved with coordinating,
scheduling, researching, purchasing and contract
administration shall be trained in accordance with the
contents of this program.
b) The Ma’aden Aluminium Responsible Person or designee
shall conduct the training annually or as deemed necessary.
c) The Contractor, Subcontractor or Contracted Service all
employees shall attend Ma’aden Aluminium EHS
induction/orientation and mandatory trainings.
d) The Contractor, Subcontractor or Contracted Service shall
ensure that all permit receivers are trained and certified by
Ma’aden Aluminium.
e) The Contractor, Subcontractor or Contracted Service shall
provide all job specific regulatory training as required for the
performance of the Scope of Work. Ma’aden Aluminium will
periodically monitor for compliance.
f) Contractor, Subcontractor or Contracted Service shall obtain
a prior approval from relevant EHS for their training
packages to ensure they are in compliance with Ma’aden
Aluminium EHS requirements.
g) Contractors are required to provide evidence that proves job
specific training has been conducted where required by
governmental regulations. (Some disciplines include, but are
not limited to: Electrician, Mechanical / Sheet Metal
Fabrication, Forklift / Mobile Equipment, Scaffolding, Boom
Lift, Hilti Gun, etc.)
h) Contractor are required to develop and maintain SOP, SWI
and Method of Statements for specific critical activities and
provided in multi-languages.
5.108.2 Contractor personnel shall not mobilize to site until all EHSS training
or assessments for mobilization is completed.

5.108.3 Contract Accountable & Responsible Personnel shall be trained and


where appropriate assessed as competent to effectively act upon
their appointed accountabilities and responsibilities. As a minimum
the employee shall attain effective skills in the following subjects:
a) An understanding of the Contractor HSSE Management
procedures and expectations s;
b) Identification and effective management of HSSE risk;
c) Developing quality scope of work;
d) Conducting effective meetings with Contractors;
e) Field HSSE Leadership skills; and
f) Contractor performance review program.
5.108.4 The Contract accountable person assigned to the contract shall be
trained and where appropriate assessed as competent to effectively
act upon their appointed accountabilities and responsibilities. As a
minimum the employee shall attain effective skills in the following
subjects:
a) An understanding of the Contractor EHSS Management
expectations of the Contractor Accountable persons;
b) Identification and effective management of EHSS risk;
c) Field EHSS Leadership skills; and
d) Contractor performance review program.
5.108.5 Contractor HSSE Manager and Contractor Field EHSS Personnel shall
be competent at effectively undertaking their duties particularly as it
pertains to their employers’ scope of work.
5.108.6 The concerned Ma’aden EHSS person for the scope of work shall
develop a formal interview and assessment program for Contractor
HSSE personnel that as a minimum indicates the person subjected to
the test understands the following:
a) Ma’aden expectation of the persons accountabilities and
responsibilities for EHSS matters relevant to the scope of
work;
b) Key technical aspects of EHSS in the workplace as it pertains
to the scope of work; and
c) EHSS Reporting requirements.
5.109 Contractor Development (EHSS Day/s)
5.109.1 Ma’aden and/or the Affiliate shall facilitate group meetings of Pre-
qualified Contractors designed to be both informative and
developmental to all forms of contractor regards HS&E in the
workplace. The meeting will occur:
a) Quarterly for relationship and general communications; and
b) As required for key HSSE changes to Elements or urgent
communication resulting from unacceptable risks.

effectively, and any resulting changes or expectations required of the
contractors by Ma’aden or the Affiliates is received and/or verified
without exception. Any Contractor that fails to participate shall have
