HISTORICAL
BACKGROUND
CODE OF HAMMURABI
(King of Babylonia 2200 BC)

 If a builder build a house for a man and do not


make its construction firm and the house which
he has built collapse and cause the death of the
owner of the house – that builder shall be put to
death.
 If it cause the death of the son of the owner of
the house – they shall put to death a son of that
builder.
 If it cause the death of a slave of the owner of
the house – he shall give to the owner of the
house a slave of equal value.
CODE OF HAMMURABI

 If it destroys property, he shall restore


whatever it destroyed, and because he did not
make the house which he built firm and it
collapsed, he shall rebuild the house which
collapsed at this own expense.

Industrial revolution –
England in 1837

 The extensive use of power machinery initially imported from


England during a time referred to as the Industrial
Revolution ushered in a period of work deaths and disability
never seen before or since

1880 with the rapid increase of steel production.

 Revealed that 526 fatal industrial accidents occurred in this


country alone during the 12 months of 1906-

 30,000 fatal industrial injuries in the US in the same year
(1909)

 1600 of 2200 employees lost time from work because of injury


during a four year period (1900’s) at one of the steel company at
Pennsylvania.
A Demand for Change: Legislative Progress

 1870 – Employer’s Liability Acts (first corrective


measures)
 1897 – First true compensation act was passed by the
British Parliament
 1911 – The Compensation Law of Wisconsin (first
significant legislation in the US)
 1913 – The US Dept. of Labor was created
 1915 – The American Society of Safety Engrs. Was
organized.
 1948 – all states in the US had workmen’s compensation
law
 1970 – US congress passed OSHA of 1970

Liability Act
 1927 - Workmen’s Compensation Act No.
3428 was passed
 1936 - Commonwealth Act No. 104 was
passed called the First Industrial Safety
Law - ensure the safety of workers in the
mines, quarries and metallurgical
operations, and other enterprises.

 1945 - Commonwealth Act No. 696


redefined CA No. 104 to include safety in
the installation and operation of boilers and
pressure vessels.
 1946 - Republic Act 184, or the Electrical
Engineering Laws, (Section 38, Article III
of the law, empowered the DOLE safety
inspectors to check plans, designs and/or
specifications for any electrical construction
or installation, and enforce the
requirements of the Act pertaining to
operation, installation tending and
maintenance of electric generating plants.

 Republic Act No. 226, or the Mechanical


Engineering Laws, like the electrical Engineering
Law, it conferred enforcement of its Article III to
other enforcing agencies like the DOLE.
 1954 - Enactment of Republic Act. No. 1054 –
Free Emergency Medical and Dental Treatment
Act.
 1959 - SOPI was organized.
 1967 - Proclamation NO. 115-
115-A was issued
declaring the year and every year thereafter as
SAFETY ACCIDENT PREVENTION YEAR.

 1974 - Philippine Government issued/promulgated
PD 442 (Labor Code of the Philippines)
 1975 - The then Ministry of Labor started the program
on accreditation recognizing/accrediting safety
training organization including WSO, SOPI, UPCPH,
etc.
 1978 - The “OCCUPATIONAL SAFETY AND
HEALTH STANDARDS” was approved by then
Minister of Labor.
 1988 - The OSHC was inaugurated (the first in
Southeast Asia), created per Executive Order No.
307.

 Emergency Hospital – An employer need not put


up an emergency hospital or dental clinic if there is a
hospital of dental clinic which is not more than five(5)
kilometers away or which can be reached by motor
vehicle within twenty-
twenty-five(25) minutes of travel and
that the employer provides transportation facilities.

 Health Program – The physician engaged by the


employer, in addition to providing medical services
in cases of emergency, must also perform the
following:
 Conduct pre-
pre-employment medical examination,
free of charge, for the proper selection of workers
 Conduct free of charge annual physical
examination of the workers
 Collaborate with safety and technical personnel in
the selection and placement of workers, including
investigation of work related accidents due to
exposure to health hazards
 Develop and implement a comprehensive health

 Rule 1070 - Occupational Health and Environmental Control
 The employer shall exert efforts to maintain and control the
working environment in comfortable and healthy conditions for
the purpose of promoting and maintaining the health of his
workers.
 The employer shall carry out the working environment
measurement in indoor or other workplaces where hazardous
work is performed and shall keep a record of such
measurement which shall be made available to the enforcing
authority.
 WEM shall include temperature, humidity, pressure, illumination, ventilation,
concentration of substances and noise.
 The working environment measurement shall be performed
periodically as may be necessary but not longer than annually.
