3 REPUBLIC ACT NO. 10915,OTHERWISE KNOWN AS THE
4 PHILIPPINE AGRICULTURAL AND BIOSYSTEMS ENGINEERING ACT OF 2016
5
6 Pursuant to Section 44, Article VI of Republic Act No. 10915, otherwise known as the Philippine
7 Agricultural and Biosystems Engineering Act of 2016, the Professional Regulatory Board of
8 Agricultural and Bioystems Engineering, after review and approval of the Professional
9 Regulation Commission and in consultation with various stakeholders, hereby prescribes,
10 issues and promulgates this Resolution to effectively implement, administer and enforce the
11 provisions of Republic Act No. 10915.

13 Republic Act No. 10915 was published last August 1,2016 and took effect last August 16,2016.

15 RULE I
16 GENERAL PROVISIONS

18 SECTION 1. Title. – This Resolution shall be known as the Implementing Rules and Regulations
19 of R.A. No. 10915, otherwise known as the "Philippine Agricultural and Biosystems Engineering
20 Act of 2016". For brevity, it is hereby referred to as the IRR of the Agricultural and Biosystems
21 Engineering (ABE) Law or IRR.

23 SECTION 2. Statement of Policy. – The IRR of R.A. No. 10915 shall be interpreted, construed and
24 carried out in the light of Section 2 of R.A. No. 10915 which states as follows:
25
26 “ It is hereby declared a policy of the State to promote, strengthen and regulate the practice of
27 agricultural and biosystems engineering profession in the Philippines by instituting measures
28 that will result in relevant agricultural and biosystems engineering education and enhanced
29 roles and better career prospects for agricultural and biosystems engineers.
30
31 Likewise, the State hereby guarantees the application and delivery of agricultural and
32 biosystems engineering services to accelerate agricultural and fishery modernization; and
33 ensure food and water security, bio-energy development, natural resources conservation,
34 environmental protection and human health and safety by fostering the training and
35 development of an adequate and well-trained pool of agricultural and biosystems engineers in
36 the country.”

38 SECTION 3. Coverage - This IRR shall cover the following aspects of the practice of the
39 Profession of agricultural and biosystems engineering:
40
41 3.1. Examination, registration and licensure of agricultural and biosystems engineers;
42
43 3.2. Supervision, control and regulation of the practice of agricultural and biosystems
44 engineering;
45
46 3.3. Development, upgrading and updating of the curriculum of the agricultural and
47 biosystems engineering profession in coordination with the Commission on Higher
48 Education (CHED) and the concerned state universities and colleges (SUCs);

1 3.4. Development and improvement of the professional competence and practice of
2 agricultural and biosystems engineers through, among others, Continuing Professional
3 Development (CPD) and career progression and specialization; and
4
5 3.5. Integration of all agricultural and biosystems engineers under one national Accredited
6 Integrated Professional Organization (AlP0) of agricultural and biosystems engineers
7 which shall be recognized by the Board of Agricultural and Biosystems Engineering and
8 the Professional Regulation Commission (PRC).

10 SECTION 4. Definition of Terms. – For purposes of this IRR, the following terms shall be defined
11 as follows:
12 4.1. Agricultural and Biosystems Engineering refers to the application of engineering science
13 and designs to the processes and systems involved in the sustainable production, post
14 production and processing of safe food, feed, fiber, timber and other agricultural and
15 biological materials and the efficient utilization, conservation, and management of
16 natural and renewable resources in order to enhance human health in harmony with
17 the environment. Agricultural and biosystems consist of crops, forestry and other plants,
18 poultry, livestock, fisheries and aquaculture resources and other animals, wildlife and
19 other living things;
20 4.2. Agricultural and Biosystems Engineer refers to a person who is registered and licensed
21 to practice agricultural and biosystems engineering in the country and who holds a valid
22 certificate of registration and professional identification card from the Board of
23 Agricultural and Biosystems Engineering and the PRC;
24 4.3. Agricultural and Biosystems Power and Machinery refers to farm power and machinery
25 for the production, harvesting, processing, storage, manufacture, preserving,
26 transporting and distribution of agricultural and biological products/materials and
27 includes, but is not limited to, tractors and their attachments, power tillers, seeders,
28 transplanters, windmills, harvesting machines, crop protection and maintenance
29 equipment, irrigation equipment and accessories, greenhouses and other thermal
30 conditioning equipment, livestock, poultry, fishery and forest equipment, slaughtering
31 equipment, meat/fishery and crop processing equipment, post harvest machines such
32 as milling machines, dryers, threshers, grain and other strippers, agricultural transport
33 machinery and storage;
34 4.4. Agricultural and Biosystems Buildings and Structures refer to buildings and structures for
35 the production, harvesting, processing, storage, manufacture, preserving, transporting
36 and distribution of agricultural and biological products/materials and includes, but is not
37 limited to, silos and its components, agricultural and biosystems machinery and
38 equipment sheds, farm houses, green/screen houses, poultry houses, piggery houses,
39 slaughterhouses, farm-to-market roads, farm bridges, agricultural and biological
40 products storage/warehouse, buildings and structures for poultry, livestock, fishery, and
41 forestry production and processing, kiln drying and lumber treatment structure, farm
42 equipment, farm supplies, and other structures such as self-feeders, and soil and water
43 conservation structures. Such agricultural and bioystems building and structures are
44 either located in rural or urban areas, small scale or commercial scale in nature.
45 4.5. Agricultural and Bio-Processing refers to local activity or series of activities to maintain
46 or raise the quality or change the form or characteristics of agricultural, fishery, forestry
47 and biological products/materials and includes, but is not limited to, cleaning, sorting,
48 grading, treating, drying, dehydrating, grinding, mixing, milling, canning, dressing,
49 slaughtering, freezing, pasteurizing, conditioning, packaging, repacking, transporting of
50 agricultural, fishery, forestry and other biological products/materials;
51 4.6. Agricultural and Biological Waste Utilization and Management refers to the
52 development of systems, processes, and equipment for agricultural waste disposal and
53 utilization and environment-friendly technologies such as, but is not limited to, compost
54 plants, biogas plants, biomass utilization technologies, systems and processes;

1 4.7. Agricultural and Bio -Information System refers to utilization of information systems,
2 database, and other information management tools for agricultural use, biological
3 systems modeling to understand the mutual response between life and the
4 environment; and application of Geographic Information System (GIS) technology for
5 inventory, analysis, and management of agricultural and biological resources, and
6 remote sensing technology for observation and examination of the landscape and its.
7 local forms and agricultural activities;
8 4.8 Agricultural and Biosystems Automation and Instrumentation refers to the use and
9 application of agricultural and biosystems sensors such as, but is not limited to,
10 computer models for control and automation in the agricultural and fishery production
11 industry and the biological systems and likewise, robotics for farm operation when use
12 of machines are difficult or impossible, agricultural and biosystems machine design and
13 automated controls, precision farming systems, agricultural safety and controlled-
14 environment agriculture; and the development and application of metrology equipment
15 such as moisture meters, weighing scale and other metrology equipment;
16 4.9. Agricultural and Biosystems Resource Conservation and Management refers to
17 measures of conservation and proper management of agricultural and biological
18 resources such as, but is not limited to, area development for agriculture, settlement
19 and recreation; parks and plant nurseries; beneficial ecosystem of life and environment;
20 study and analysis oj agricultural system as an integrated component of landscape;
21 monitoring and conservation of natural resources; rehabilitation of forest, lakes, rivers
22 and idle lands; and the sustainable development, management, and exploitation of the
23 agricultural ecosystem;
24 4.10 Accredited Integrated Professional Organization refers to the professional organization
25 of agricultural and biosystems engineers duly accredited by the Professional Regulatory
26 6ard of Agricultural and Biosystems Engineering and the PRC, hereinafter referred to as
27 the "AIPO";
28 4.11 Bachelor of Science in Agricultural and Biosystems Engineering refers to the tertiary or
29 higher education program which provides graduates with a Baccalaureate Agricultural
30 and Biosystems Engineering Degree and shall hereinafter be referred to as BSABE. This
31 program is effectively promulgated under enabling Policies, Standards and Guidelines
32 (PSG) issued by the CHED in coordination with the Board of Agricultural and Biosystems
33 Engineering and/or relevant SUCs;
34 4.12 Certificate of Registration - shall refer to the certificate issued by the Board after
35 passing the required examination and upon completion of all requirements prescribed
36 by the said Board;
37 4.13 Commission on Higher Education refers to the government agency created to lead,
38 promote, and regulate higher/tertiary education in the Philippines created under
39 Republic Act No. 7722, hereinafter referred to as the "CHED";
40 4.14. Farm Electrification refers to the design and installation of electric system for
41 agriculture, conservation equipment, micro-hydro-electric generators and motors for
42 power on the farm, village level power plant ; - (to be improved)
43 4.15. Integration - shall mean the unification or consolidation of existing organizations of
44 Agricultural Engineers into one national organization which shall be recognized by the
45 Board and the Commission as the only integrated and accredited association of
46 Agricultural Engineers;
47 4.16 Irrigation refers to the artificial application of water to the soil to assist in the growing of
48 agricultural and forest crops, maintenance of landscapes, and revegetation of disturbed
49 soils in dry areas and during periods of inadequate rainfall, and shall include drip,
50 sprinkler, shallow tube well and other pressurized irrigation system; national and
51 communal irrigation systems; surface and ground water resource management; and
52 irrigation structures and facilities such as dams, weirs, pump systems, conveyances,
53 canals, and flumes;

1 4.17 Professional Regulation Commission refers to the government agency described under
2 Republic Act No. 8981, hereinafter referred to as the "Commission";
3 4.18 Professional Regulatory Board of Agricultural and Biosystems Engineering refers to the
4 administrative body created by law to supervise and regulate the practice of agricultural
5 and biosystems engineering and is the ultimate authority in the practice of the
6 agricultural and biosystems engineering profession in the Philippines. It shall be
7 hereinafter referred to as the "Board";
8 4.19. Renewable/bio-energy refers to energy that is collected from resources which are
9 naturally replenished on a human timescale, such as sunlight, wind, rain, tides, waves,
10 and geothermal heat.
11 4.20 Soil and Water Conservation refers to measures that control soil and water degradation
12 and enhance farm productivity; and shall consist of small farm reservoir, farm ponds,
13 small water impoundments, contour farming, and terracing; soil erosion control, land
14 conditioning and mulching, and flood control.

17 4.21.1. CHED refers to the Commission on Higher Education
18 4.21.2. COA refers to the Commission on Audit
19 4.21.3. COR refers to Certificate of Registration
20 4.21.4. CSC refers to the Civil Service Commission
21 4.21.5. DA refers to the Department of Agriculture
22 4.21.6. DAR refers to the Department of Agrarian Reform
23 4.21.7. DENR refers to the Department of Environment and Natural Resources
24 4.21.8 DILG refers to the Department of Interior and Local Government
25 4.21.9 DOLE refers to the Department of Labor and Employment
26 4.21.10. DTI refers to the Department of Trade and Industry
27 4.21.11, LGUs refers to the Local Government Units
28 4.21.12. PIC refers to Professional Identification Card
29 4.21.13.SEC refers to the Securities and Exchange Commission
30 4.21.14. SUCs refers to State Universities and Colleges
31 4.21.15. TESDA refers to the Technical Education and Skills Development Authority

33 SECTION 5. Scope of Practice of Agricultural and Bio-systems Engineering- The practice of
34 Agricultural and Biosystems Engineering within the meaning and intent of this Act shall
35 embrace, but not limited to, the following:
36
37 5.1. Preparation of engineering designs, plans, specifications, project studies, feasibility
38 studies and estimates of irrigation and drainage, soil and water conservation and
39 management systems and facilities, agrometeorological systems, agricultural and
40 biosystems power and machinery, agricultural and bioystems buildings and structures,
41 renewable/bio-energy systems and farm electrification, agricultural and bio-processing
42 and post harvest facilities and system, agricultural and biological waste utilization and
43 management, agricultural and bio-information system, agricultural and bioystems
44 resource conservation and management, and agricultural and bio-automation and
45 instrumentation system;
46
47 5.2. Supervision or management on the construction, operation and maintenance of
48 irrigation and drainage, soil and water conservation and management systems and
49 facilities, agrometeorological systems, agricultural and biosystems power and
50 machinery, agricultural and bioystems buildings and structures, renewable/bio-energy
51 systems and farm electrification, agricultural and bio-processing and post harvest
52 facilities and system, agricultural and biological waste utilization and management,
53 agricultural and bio-information system, agricultural and bioystems resource
54 conservation and management, and agricultural and bio-automation and
55 instrumentation system;

1 5.3. Valuation, appraisal, investigation, inspection, monitoring and technical audit on
2 agricultural and biosystems machineries and equipment, structures and facilities and
3 agricultural and bioystems engineering projects;
4
5 5.4. Program/Project development and management, planning, evaluation and consultancy
6 services on agricultural and biosystems engineering undertakings which also includes
7 farm planning and management;
8
9 5.5. Conduct of research and development, training and extension on agricultural and
10 biosystems engineering;
11
12 5.6. Testing, evaluation and inspection of agricultural and biosystems machinery, and other
13 related agricultural and biosystems engineering facilities, equipment and projects;
14
15 5.7. Manufacture, distribution, installation and sale of agricultural and biosystems machinery
16 and other related agricultural and biosystems engineering facilities and equipment;
17
18 5.8. Teaching and or/conduct of lectures of agricultural and biosystems engineering subjects
19 in institution of learning in the Philippines;
20
21 5.9. Preparation and evaluation of farm development plans, farm suitability maps and land
22 use maps/reports for agricultural, livestock and poultry, fishery, aquaculature and
23 forest production and processing;
24
25 5.10. Training and supervision of agri-fishery machinery technicians and operators of agri-
26 fishery machinery service centers/pools, and agricultural and biosystems engineering
27 technicians and operators in agricultural and biosystems plants, establishments,
28 facilities and projects;
29
30 5.11. Employment with the government and private firms and establishments provided such
31 item or position requires the knowledge and expertise of an Agricultural and Biosystems
32 Engineer, or its duties and responsibilities covers the scope of practice agricultural and
33 biosystems engineering; and
34
35 5.12. Participation in the preparation of environmental studies for agricultural, fisheries, agro-
36 industrial and biosystems projects and its monitoring under the environmental impact
37 assessment (EIA) system;
38
39 The Board, subject to approval of the Commission, may add to, or exclude from, this section
40 any activity or act of professional practice, or revise it as the need arises to conform to changes
41 and new developments brought about by the latest trends in Agricultural and Biosystems
42 Engineering.
43
44 RULE II
45 PROFESSIONAL REGULATORY BOARD OF
46 AGRICULTURAL AND BIOSYSTEMS ENGINEERING:
47 ORGANIZATION, TERM OF OFFICE, QUALIFICATIONS, POWERS AND DUTIES
48
49 SECTION 6. Creation and Composition of the Board. - There is hereby created a Board to be
50 composed of a Chairman and two (2) Members under the administrative control and
51 supervision of the Commission. They shall be appointed by the President of the Philippines
52 from a list of three (3) recommendees for each position which were ranked by the Commission
53 from a list of five (5) nominees for each position submitted by the AIPO in the Philippines. The
54 Board shall be organized not later that six (6) months from the effectivity of R.A. No. 10915.
55
56 Pursuant to Section 43 of R.A. No. 10915, the incumbent Chairman and Member of the Board
57 of Agricultural Engineering, shall act as interim Chairman and Member of the Board of
58 Agricultural and Biosystems Engineering until the Chairman and Members of the first Board

1 of Agricultural and Biosystems Engineering have been constituted and duly appointed by the
2 President of the Philippines and assumed office, in accordance with the guidelines of R.A. No.
3 10915 and its Implementing Rules and Regulation and E.O. No. 496, s. 1991.

5 SEC 7. Qualifications of Members of the Board. - A member of the Board shall, at the time of
6 their appointment, possess the following qualifications:
7
8 7.1. Must be a Filipino citizen and resident of the Philippines;
9
10 7.2. Must be at least thirty-five (35) years of age;
11
12 7.3. Must be a holder of Bachelor's Degree in Agricultural and Biosystems Engineering,
13 Agricultural Engineering or its equivalent, conferred by a school, academy, college or
14 university in the Philippines or abroad which is accredited by CHED;
15
16 7.4. A registered Agricultural and Biosystems Engineer with a valid professional license and
17 an active practitioner for not less than ten (10) years prior to his/her appointment;
18
19 7.5. Must not, for a period of three (3) consecutive years prior to the appointment, be a
20 member of the faculty of, directly or indirectly, any school, academy, institute, college
21 or university where a regular course in Agricultural Engineering or Agricultural and
22 Bioystems Engineering is being taught; or have any pecuniary interest, directly or
23 indirectly, in or administrative supervision over any such institutions of learning;
24
25 7.6. Must not, for a period of three (3) consecutive years prior to the appointment, be
26 connected with a review center or any group or association where review classes or
27 lectures in preparation for the licensure examination are offered or conducted at the
28 time of appointment;
29
30 7.7. Must be a member in good standing of the AIPO for at least five (5) years, but not
31 incumbent officer or trustee thereof; and
32
33 7.8. Has never been convicted of any offense involving moral turpitude.

34 SECTION 8. Term of Office. The Chairman and two (2) Members of the Board shall hold office
35 for a term of three (3) years from the date of their appointment and until their successors shall
36 have been appointed and qualified. The first Board under this Act shall hold these term of
37 office: the Chairman for three (3) years; the first Member for two (2) years; and the second
38 member for one (1) year; Provided, That any appointee to a vacancy with an unexpired term
39 shall only serve such period.

40 The Chairman or a member of the Board may be reappointed to their positions for another
41 term of three (3) years immediately after the expiry of their terms. Provided further, That the
42 holding of such position shall not be for more than two (2) terms nor more than six (6) years,
43 whichever is longer. The Chairman and two Members of the Board shall take their oath of
44 office prior to entering upon the performance of duty.

45 SECTION 9. Compensation and Allowances of the Board. - The Chairperson and members of the
46 Board shall receive compensation and allowances comparable to the compensation and
47 allowances being received by the Chairpersons and Members of existing Professional
48 Regulatory Boards under the PRC as provided for in the General Appropriations Act.

49 SEC. 10. Vacancy and Removal of Board Members. - Any vacancy occurring in the Board within
50 the term of a member shall be filled for the unexpired portion of the term only. The President
51 may remove the Chairman or any member of the Board on the following grounds:
52
53 10.1. Gross neglect, incompetence or dishonesty in the discharge of duty; Neglect of duty;

1 10.2. Violation or tolerance of the violation of this Act or the Code of Ethics for agricultural
2 and biosystems engineering;
3
4 10.3. Involvement in the manipulation, tampering or rigging of the licensure examination, its
5 questions and/or its results, and in the disclosure of classified and confidential
6 information pertaining to the licensure examination;
7
8 10.4. Final judgment of crimes involving moral turpitude; and
9
10 10.5. Unprofessional, unethical, immoral or dishonorable conduct.
11
12 The Chairman or Member concerned shall be given due notice and hearing where his right to
13 be heard and to defend himself, assisted by counsel, shall be respected in the proper
14 administrative investigation.
15
16 SEC. 11. Powers and Duties of the Board. - The Board shall exercise the following
17 specific powers, functions and duties:
18
19 11.1. Promulgate and adopt the rules and regulations necessary for carrying out the
20 provisions of this Act;
21
22 11.2. Supervise the registration, licensure and practice of Agricultural and Biosystems
23 Engineers in the Philippines;
24
25 11.3. Administer oaths of successful examinees entering the practice of Agricultural and
26 Biosystems Engineering;
27
28 11.4. Issue the certificate of registration to successful examinees;
29
30 11.5. Issue, suspend or revoke the license for the practice of Agricultural and Biosystems
31 Engineering profession;
32
33 11.6. Adopt an official seal of the Board;
34
35 11.7. Look into the conditions affecting the practice of the Agricultural and Biosystems
36 Engineering profession through the conduct of ocular inspections and monitoring in
37 agricultural and biosystems engineering offices, plants or establishments both public
38 and private, and in the case of schools, in coordination with the CHED, and whenever
39 necessary adopt such measures, including promulgation of agricultural and biosystems
40 engineering standards, rules and regulations and best practices for the enhancement
41 and maintenance of high professional and ethical standards of the profession and the
42 formulation and implementation of agricultural and biosystems engineering profession
43 development plan/road map.

45 In line with this, the Board shall update the existing Philippine Agricultural
46 Engineering Profession Competitiveness Road Map to align and support to the
47 provisions of R.A. No. 10601 and the Food Security Program and Environmental
48 Protection Program of the government, and likewise periodically to meet and respond
49 to the needs of the time.

51 11.8. Prescribe and/or adopt, and enforce a Code of Ethical and Professional Standards for
52 the practice of agricultural and biosystems engineering profession.
53
54 11.9 Hear and try administrative cases involving violations of R.A. No. 10915, its
55 implementing rules and regulations, the code of ethics for agricultural and biosystems
56 engineers and for this purpose, to issue subpoena and subpoena duces tecum to secure
57 the appearance of witnesses and the production of documents in connection therewith;

1 11.10 Prescribe guidelines in the CPD program for Agricultural and Biosystems Engineers in
2 coordination with the AIPO of Agricultural and Biosystems Engineers;

4 11.11. Ensure, in coordination with the CHED and/or SUCs, that all educational institutions
5 offering agricultural and biosystems engineering education comply with the policies,
6 standards and requirements of the course prescribed by CHED in the areas of
7 curriculum, faculty, library and facilities;
8
9 11.12. Prepare, adopt, issue or amend the syllabi of the subjects for examinations including its
10 Table of Specifications in consultation with the academe, and cause the determination
11 and preparation of questions for the licensure examination which shall strictly be within
12 the scope of the syllabi of the subjects for examinations as well as administer, correct
13 and release the result of the licensure examinations;
14
15 11.13. Approve, issue, limit or revoke temporary/special permit (TSP) to practice agricultural
16 and biosystems engineering.
17
18 11.14. Issue a cease or desist order to any person, associations, partnership, corporation or
19 cooperative engaged in violation of any provision of R.A. No. 10915, any agricultural and
20 biosystems engineering standards and/or rules or regulations duly promulgated by the
21 Board as part of the rules governing the practice of Agricultural and Biosystems
22 Engineering in the Philippines;
23
24 11.15. Punish for contempt of the Board, both direct and indirect, in accordance with the
25 pertinent provision of and penalties prescribed by, the Rules of Court;
26
27 11.16. Perform regulatory, administrative, and quasi-legislative functions as mandated under
28 Republic Act No. 8981, otherwise known as the “PRC Modernization Axt of 2000”, and
29 such other functions as may be necessary to implement the provisions of R.A. No.
30 10915;
31
32 11.17. Discharge such other duties and functions as may be deemed necessary for the
33 enhancement of the Agricultural and Biosystems Engineering profession and the
34 upgrading, development and growth of agricultural and biosystems engineering
35 education in the Philippines; and
36
37 11.18. Accreditation of specialty organizations.

39 All policies, resolutions, rules and regulations of the Board shall be subject to the review and
40 approval of the Commission.
41
42 SECTION 12. Supervision of the Board; Custodian of its Records, Secretariat and Support
43 Services.- The Board shall be under the administrative control and supervision of the
44 Commission. All records of the Board, including applications for examination, examination
45 papers and results, minutes of deliberation, administrative cases and other investigations
46 involving agricultural and biosystems engineers shall be kept by the Commission.
47
48 The Commission shall designate the Secretary of the Board and shall provide the secretariat and
49 other support services to implement the provisions of R.A. No. 10915.
50 SECTION 13. Annual Report. - The Board shall, at the close of each calendar year, submit an
51 annual report to the President through the Commission giving a detailed account of its
52 proceedings and accomplishments during the year and making recommendations for the
53 adoption of measures that will upgrade and improve the conditions affecting the practice of
54 agricultural and biosystems engineering in the Philippines.

56 SECTION 14. Board, a Collegial Body. - The Chairman and Members of the Board shall act as a
57 collegial body in matters involving the exercise of its powers and functions as well as the

1 implementation of its policies. Official action on such matters by the Board shall be effective
2 only when approved by the Commission.

5 SECTION 15. Meetings. - The Board shall hold regular meetings at least once a month within
6 the premises of the Commission or in such other places as may be agreed upon by the Board.
7 A special meeting may be called by the Chairman or any two members. The Chairman shall
8 preside over the meetings of the Board. ln the absence of the Chairman, the senior member,
9 if any, or the member designated by the Chairman shall act as Presiding Officer.
10
11 SECTION 16. Duties and Functions of the Chairman- The Chairman shall be the head of the
12 Board and, as such, he shall equitably assign the subjects for examination to the members of
13 the Board in accordance with their expertise; designate members to conduct investigations of
14 administrative cases and designate members to undertake the visitorial powers of the Board.
15 He shall also be responsible for the assignment of other duties and responsibilities to the
16 members and for the supervision and management of their work. The Chairman shall be the
17 spokesman of the Board in the Commission.
18
19 SECTION 17. Enforcement and Implementation.- The Board, in the enforcement and
20 implementation of the provisions of Republic Act No. 10915 and in the execution and
21 performance of its powers, duties and functions and responsibilities provided therein, shall
22 be assisted, supported and/or advised by the commission through its offices, divisions,
23 sections and units.
24
25 SECTION 18. Promulgation of Decisions, Rules, Orders, etc. To promulgate a decision,
26 resolution or order which is not interlocatory in an administrative case, or a policy, rule or
27 regulation and for the implementation of other provisions of R.A. No. 10915, the Board shall
28 meet en banc and vote personally. Both a quorum and a majority vote are required for the
29 validity of any of the foregoing actions. The presence of two (2) members shall constitute a
30 quorum and the vote of two (2) members shall constitute a majority vote.
31
32 Any official action of the Board other than a decision, resolution or order issued in an
33 administrative case shall be valid, enforceable, and effective only after it shall have been
34 approved by the Commission and published in the Official Gazette or newspaper of general
35 circulation. Publication shall not be required of a Board's resolution, order, or their issuances
36 which are internal or not penal or disciplinary in nature, and not affecting the public in
37 general.
38
39 SECTION 19. Meetings and Official Business with the Commission. - Unless all members of the
40 Board are required by the Commission, the Chairman shall be the representative of the Board
41 in all official meetings and businesses with the Commission. The Chairman of the Board shall
42 be the spokesman in such meetings or official businesses.
43
44 SECTION 20. Action on Papers, Communications and Other Documents. - The Board shall act
45 on all papers, communications, certificates, cases or other documents within the premises of
46 the Commission Action on such documents outside the premises of the Commission shall be
47 with the written consent of the Chairman of the Commission.
48
49 SECTION 21. Interpretation of the Provisions of R.A. No. 10915 and the Rules and Regulations
50 and Code of Ethics and Professional Standards issued by the Board- The Board may, at first
51 instance, resolve issues arising from the implementation of the provisions of R.A. No. 10915
52 in the form of opinions issued by the Board through its Chairman. It may also issue opinions
53 on questions arising from the implementation of its Rules and Regulations and Code of Ethics
54 and professional Standards through its Chairman.
55
56 SECTION 22. Action on Ministerial Matters. -Ministerial matters arising from the
57 implementation of the Rules and Regulations issued by the Board or communications whose
58 subject for action are ministerial in nature shall be acted upon by the Chairman of the Board.

4 RULE III
5 EXAMINATION, REGISTRATION AND LICENSE
6 SECTION 23. Examination Required. - All applicants for registration for the practice of
7 agricultural and biosystems engineering shall be required to undergo and pass the licensure
8 examination as provided for in R.A. No. 10915.
9
10 SECTION 24. Qualification of an Applicant for Examinations. - Every applicant for the
11 examination for agricultural and biosystems engineers shall have the following qualifications:
12
13 24.1. A citizen of the Philippines or a foreign citizen whose country or State has a policy on
14 reciprocity in the practice of the profession;
15
16 24.2. A graduate of Bachelor of Science in Agricultural and Biosystems Engineering or its
17 equivalent, or Bachelor of Science in Agricultural Engineering prior to or after ten (10)
18 years after the approval of R.A. No. 10915, in a school, academy, institute, college or
19 university or an institution duly recognized by the CHED; and
20
21 24.3. Of good moral character.

23 SECTION 25. Application for Examination. - The applicant for examination shall file the duly
24 accomplished application form at the Application Division of the Commission or in any of its
25 Regional Offices, accompanied by authentic or authenticated copies of the required
26 documents.
27
28 A Filipino citizen who graduated from a foreign educational institution desiring to take the
29 licensure examination for agricultural engineers shall be required to present an endorsement
30 from the Commission on Higher Education in order that he will be allowed to take the
31 examination.

35 SECTION 26. Fraudulent Application. - The Board may suspend or revoke any certificate of
36 registration obtained through misrepresentation made in the application for examination.
37
38 SECTION 27. Program of Examination.-The Board shall issue a "program for every scheduled
39 examination not later than twenty (20) days before the first day of the examination which
40 contain the subjects for examination with their corresponding percentage weights, the
41 date/s, time and place of examination. The program shall include the instructions to the
42 examinees and the names and signatures of the Chairman and members of Board.
43
44 SECTION 28. Publication of Examination. – The dates, time, and venues of the licensure
45 examinations shall be published in a newspaper of general circulation or disseminated to
46 prospective examinees through schools, colleges and universities offering agricultural
47 engineering courses at least one (1) month prior to the first day of examination.
48
49 SECTION 29. Licensure Examination Requirements. – Each applicant for examination shall
50 comply with/accomplish all the requirements prescribed by the Board and the Commission.

2 SECTION 30. Scope of Examination. - The licensure examination for agricultural and biosystems
3 engineers shall cover the required competencies for the entry level of the practice of
4 agricultural and biosystems engineering and shall include the following subjects:

7 The said subjects and their syllabi may be periodically amended by the Board so as to conform
8 with the latest technological changes brought about by continuing trends in the profession.

10 SECTION 31. Rating in the Board Examinations. - To be qualified as having passed the Board
11 examination for Agricultural and Biosystems Engineers, a candidate must obtain a weighted
12 general average of seventy percent (70%), with no grades lower than fifty-five percent (55%) in
13 any given subject. However, an examinee who obtains a weighted general average rating of
14 seventy percent (70%) or higher but obtains a rating below fifty-five percent (55%) in any given
15 subject must take the examination in the subject or subjects where he obtained a grade below
16 fifty-five percent (55%).
17
18 SECTION 32. Report of Ratings. - The Board shall submit to the Commission the ratings obtained
19 by each candidate within ten (10) days after the examination, unless extended for just cause.
20 Upon the release of the results of the examination, the Board shall send by mail the rating
21 received by each examinee at his given address using the mailing envelope submitted during
22 the examination.

23 SECTION 33. Re-examination. - An applicant who fails to pass the examination for the third
24 time shall be allowed to take another examination only after the lapse of one (1) year and only
25 after having undertaken a refresher program in a duly accredited institution. The Board shall
26 issue guidelines on the refresher program requirement.
27
28 SECTION 34. Oath. - All successful candidates in the examination shall be required to take their
29 oath before the Commission, the Board or any government official authorized to administer
30 oaths, prior to entering upon the practice of the Agricultural and Biosystems Engineering
31 profession.

1 SECTION. 35. Issuance of Certificate of Registration and Professional Identification Card. –
2
3 35.1. A Certificate of Registration (COR) shall be issued to those who are registered after
4 payment of fees prescribed by the Commission. It shall bear the signatures of the
5 Chairperson of the Commission and of the Chairman and Members of the Board,
6 stamped with the official seal of the Commission and of the Board, certifying that the
7 person named therein is entitled to the practice of the profession, with all the privileges
8 appurtenant thereto. Until withdrawn, revoked or suspended in accordance with R.A.
9 No. 10915, the COR shall remain in full force and effect.
10
11 35.2. A professional Identification Card bearing the registration number and its validity and
12 expiry dates duly signed by the Chairperson of the Commission shall likewise be issued
13 to every registrant who has paid the prescribed fees, and has submitted a certificate of
14 membership in good standing from the AIPO and proof of completion of the CPD
15 requirements. The said card shall be renewed every three (3) years, subject to
16 requirement/s as the Board may thereafter prescribe and upon proof of completion of
17 the mandatory CPD requirements.
18
19 Once registered, the Agricultural and Biosystems Engineer may use Engr. as the official
20 appendage title. No person shall practice Agricultural and Biosystems Engineering in the
21 country unless such person has secured a license to practice Agricultural and Biosystems
22 Engineering in the manner herein provided.
23
24 SECTION 36. Refusal to Register. – The Board shall not register any successful applicant for
25 registration with or without licensure examination who has been:
26
27 36.1. Convicted of an offense involving moral turpitude by a court of competent jurisdiction;
28
29 36.2. Found guilty of immoral or dishonorable conduct by the Board;
30
31 36.3. Adjudged guilty for violation of the General Instructions to Examinees by the Board; and
32
33 36.4. Declared of unsound mind by a court of competent jurisdiction; and
34
35 36.5. Proven to be afflicted with addiction to drug or alcohol impairing one’s ability to practice
36 the profession through a finding to this effect by a medical or drug testing facility
37 accredited by the Government.
38
39 In refusing such registration, the Board shall give the applicant a written statement setting forth
40 the reasons therefor and shall file a copy thereof in its records.
41
42 SECTION 37. Revocation or Suspension of the Certificate of Registration and Cancellation
43 of Temporary/Special Permit (TSP). – The Board shall have the power, upon notice and hearing,
44 to revoke or suspend the COR of a registered and licensed agricultural and biosystems engineer
45 or to cancel TSP granted to a foreign agricultural and biosystems engineer, for the same
46 grounds enumerated in Section 23 of R.A. No. 10915, except paragraph (c) thereof, and any of
47 the following grounds:
48
49 37.1. Violation of any provision R.A. No. 10915, implementing rules and regulations, Code of
50 Ethics, Code of Technical Standards for the practice of Agricultural and Biosystems
51 Engineering, and of policies and regulatory measures of the Board and/or the
52 Commission;
53
54 37.2. Perpetration or use of fraud in obtaining his/her COR, professional identification card,
55 and TSP;

1 37.3. Gross incompetence, negligence or ignorance in the conduct of the profession resulting
2 to death, injury of persons and/or damage to property;
3 37.4. Unjustified refusal to join or to remain a member in good standing of the AIPO;
4
5 37.5. Unjustified or unexplained neglect or failure to pay the annual registration fees for five
6 (5) consecutive years;
7
8 37.6. Unjustified or unexplained non-renewal of the Professional Identification Card after the
9 lapse of five (5) consecutive years;
10
11 37.7. Aiding or abetting the illegal practice of a non-registered and unlicensed agricultural and
12 biosystems engineer by, among others, allowing him/her to use his/her COR and/or
13 professional identification card or his/her TSP;
14
15 37.8 Practicing the profession during his/her suspension from the practice thereof; and
16
17 37.9 Addiction to a drug or alcohol abuse impairing his/her ability to practice his/her
18 profession or being declared with unsound mind by a court of competent jurisdiction.
19
20 The Board shall periodically evaluate the aforementioned grounds and revise or add new ones
21 as the need arises subject to approval by the Commission in order to meet the trends and
22 developments in the profession.
23
24 SECTION 38. Reissuance of Revoked COR, Replacement of Lost or Damaged COR, Professional
25 Identification Card or Temporary /Special Permit. - The Board may, upon petition, reinstate or
26 reissue a revoked COR after two (2) years from the effectivity of the revocation, which is
27 reckoned from the date of surrender of the said certificate and/or the professional
28 identification card to the Board and/or the Commission. The Board may not require the holder
29 thereof to take another licensure examination. The petitioner shall prove to the Board that
30 he/she has valid reasons to resume the practice of his/her profession. For the grant of his/her
31 petition, the Board shall issue a Board Resolution subject to approval by the commission.
32
33 A duplicate copy of a lost COR, professional identification card or TSP may be reissued in
34 accordance with rules thereon and upon payment of the prescribed fee therefor.
35 RULE IV
36 PRACTICE OF AGRICULTURAL AND BIOSYSTEMS ENGRINEERING
37
38 SECTION 39. Vested Right. - Automatic Registration of Practicing Agricultural and Biosystems
39 Engineers. - All Agricultural Engineers holding valid CORs and PICs at the effectivity of R.A. No.
40 10915 shall automatically registered and recognized as Agricultural and Biosystems Engineers
41 and shall be issued new CORs and PICs with the same license number as their original CORs
42 and PICs, subject to the payment of prescribed fees and other requirements of the Board
43 and/or the Commission.
44
45 SECTION 40. Seal and Use of Seal.
46 40.1. Each registrant shall, upon registration, obtain a seal of such design as the Board may
47 prescribe and adopt. Plans and specifications prepared by, or under the direct
48 supervision of a registered agricultural and biosystems engineer, shall be stamped with
49 said seal during the validity of the professional license. No person shall stamp or seal
50 any document with the seal of a registrant after his/her professional license has expired
51 or lost its validity unless he/she has been reinstated to the practice and/or unless
52 his/her license has been renewed.
53 The seal of an agricultural and biosystems engineer is represented by dodecagon
54 inscribed in a circle 42 mm in diameter, the widest clearance between the circle and
55 the octagon is 5 mm with a rectangular band drawn horizontally across the middle
56 part of the seal. The sides of the octagon represents the twelve (12) functional scope
57 practice of agricultural and biosystems enumerated under Section 5 of R.A. No.

1 10915. The space between the upper part of the circle and the octagon shall be
2 inscribed the name of the agricultural and biosystems engineer, the space on the
3 opposite side shall be inscribed the words " AGRICULTURAL AND BIOSYSTEMS
4 ENGINEER" and on the rectangular band with 5 mm width shall be inscribed the
5 registration number of the agricultural and biosystems engineer. The facsimile of the

17 40.2. No officer or employee of the government, chartered cities, provinces and municipalities
18 now or hereinafter charged with the enforcement of laws, ordinances or regulations
19 relating to the implementation, construction, repair, operation and maintenance,
20 testing and evaluation of agricultural and biosystems buildings, structures, machineries
21 and equipment, irrigation, soil and water conservation structures and other agricultural
22 and biosystems engineering facilities, shall accept or endorse any plans, designs,
23 specifications or project studies which have not been prepared and submitted in full
24 accord with the provisions of this Act, nor shall any payment be approved by any such
25 Officer for any work, the plans and specifications of which have not been so prepared,
26 signed and sealed by a duly registered agricultural and biosystems engineer. This
27 provision shall be implemented by the Department of Public Works and Highways
28 (DPWH) and Local Building Officials in the issuance of building permits and certificate of
29 occupancy under the National Building Code, and by all concerned national government
30 entities and local government units (LGUs) in the procurement and in the discharge of
31 their regulatory and auditing functions pertaining to agricultural and biosystems
32 buildings, structures, machineries and equipment, irrigation, soil and water conservation
33 structures, and other agricultural and biosystems engineering facilities/projects.
34
35 40.2.1. The Board and the Commission shall issue a Memorandum Circular with
36 concerned national government agencies and LGUs for the implementation of
37 this particular provision of R.A. No. 10915.
38
39 40.2.2.The Board shall coordinate with the following government agencies for the
40 implementation and enforcement of this particular provision of R.A. No.
41 10915:
42
43 40.2.2.1. DPWH and Local Building Officials for the implementation and
44 enforcement in the issuance of building permits and certificate of
45 occupancy for agricultural and biosystems buildings and structures
46 under the National Building Code of the Philippines;
47
48 40.2.2.2. COA as part of the auditing of government projects on agricultural
49 and biosystems buildings, structures, machineries and equipment,

1 irrigation, soil and water conservation structures, and other
2 agricultural and biosystems engineering facilities/projects
3
4 40.2.2.3. DILG, DA and other concerned national government agencies and
5 LGUs for the implementation and enforcement in the procurement
6 and pertinent regulations on agricultural and biosystems buildings,
7 structures, machineries and equipment, irrigation, soil and water
8 conservation structures, and other agricultural and biosystems
9 engineering facilities/projects.
10 40.3. No agricultural and biosystems engineer shall sign his/her name, affix his/her seal or use
11 any other method of signature on plans, designs, specifications or other documents
12 made by or under another agricultural and biosystems engineer's supervision unless the
13 same is made in such manner as to clearly indicate the part of such work actually
14 performed by him/her, and no person, except the agricultural and biosystems engineer-
15 in-charge shall sign for any branch of the work or any function of agricultural and
16 biosystems engineering practice not actually performed by him/her. The agricultural and
17 biosystems engineer-in-charge shall be fully responsible for all plans, designs,
18 specifications and other documents issued under his/her seal or authorized signature.
19
20 40.4. Drawings, plans, designs and specifications duly signed, stamped or sealed as
21 instruments of service are the property and documents of the agricultural and
22 biosystems engineer, whether the projects for which they were made is executed or
23 not. No person without the written consent of the agricultural and biosystems engineer
24 or author of said documents, shall duplicate or make copies of said, documents' for use
25 in the repetition of and for other projects, whether executed partly or in whole.
26
27 40.5. All drawings, plans, specifications and other documents and reports to be used for the
28 design, construction, test and evaluation, research and extension of agricultural and
29 biosystems buildings, structures, machineries and equipment, irrigation, soil and water
30 conservation structures and other Agricultural and biosystems engineering
31 facilities/projects shall be signed and sealed by a licensed agricultural and biosystems
32 engineer.
33
34 Violation of any of the foregoing shall be ground for administrative and/or criminal action.
35
36 The Board shall formulate, adopt and promulgate all necessary rules and regulations for the
37 effective implementation of the provisions relating to the use of the seal, the signing and
38 sealing of drawings, reports and other documents by agricultural and biosystems engineers.
39
40 SECTION 41. Indication of License Number and Professional Tax Receipt Number. - The
41 agricultural and biosystems engineer shall be required to indicate his/her professional license
42 number, the duration of its validity, including the professional tax receipt number on the
43 documents he/she signs, uses or issues in connection with the practice of his/her profession.
44
45 SECTION 42. Firms, Partnerships, Corporations, Cooperatives, Associations and Foundations
46 Engaged in Agricultural and Biosystems Engineering Practice. - A firm, partnership, corporation,
47 cooperative, association or foundation may, engage in the practice of agricultural and
48 biosystems engineering in the Philippines: Provided, That it complies with the following
49 requirements:
50
51 42.1. The firm, partnership, corporation, cooperative, association or foundation applies for
52 and is issued a COR by the Board and the Commission to engage in the practice of
53 agricultural and biosystems engineering in the Philippines: Provided, That the majority
54 of the partners of the partnership are registered and licensed agricultural and
55 biosystems engineers: Provided, further, That the majority of themembers of the board
56 of directors or members of corporations or cooperatives shall be registered and licensed
57 agricultural and biosystems engineers; and

1 42.2. The practice of the firm, partnership, corporation, cooperative, association or foundation
2 in agricultural and biosystems engineering shall be carried out by duly registered and
3 licensed agricultural and biosystems engineers.

10 SECTION 43. Integration of Agricultural and Biosystems Engineers. - The agricultural and
11 biosystems engineering profession shall be integrated into one (1) national organization
12 registered with the Securities and Exchange Commission which shall be recognized by the Board
13 and the Commission as the one and only integrated and accredited association of agricultural
14 and biosystems engineers. An agricultural and biosystem engineer duly registered with the
15 Board shall automatically become a member of the integrated and accredited association of
16 agricultural and biosystems engineers, and shall receive the benefits and privileges appurtenant
17 thereto upon payment of the required fees and dues.
18

19 Membership in the integrated and accredited association shall not be a bar to membership in
20 other associations of agricultural and biosystems engineers.
21 SECTION 44. Foreign Reciprocity. - No foreign agricultural and biosystems engineer shall be
22 issued a temporary license to practice the agricultural and biosystems engineering profession or
23 consultancy thereof or be entitled to any of the rights and privileges under this Act unless the
24 country of which he/she is a subject or citizen specifically permits Filipino agricultural and
25 biosystems engineers to practice within its territorial limits on the same basis as the subjects or
26 citizens of such foreign State or country.
27 SECTION 45. Temporary /Special Permits for Foreign Agricultural and Biosystems Engineers. -
28 The practice of foreign agricultural and biosystems engineers in the Philippines shall be limited
29 to natural persons only and shall be governed by the provisions of Republic Act No. 8981,
30 otherwise known as the "PRC Modernization Act of 2000": Provided, That any foreign national
31 who has gained entry in the Philippines to perform professional services as an agricultural and
32 biosystems engineer or render such services or prepare or produce such documents which are
33 within the scope of practice of agricultural and biosystems engineering as set forth in R.A. No.
34 10915 such as, but not limited to, being a consultant in foreign funded or assisted project of the
35 government or employed or engaged by Filipino or foreign contractors or private firms whether
36 or not the nomenclature of his/her profession is specifically called in his/her country of
37 nationality as agricultural and biosystems engineer, but who does not meet or wish to comply
38 with the requirements for admission to take the licensure examinations shall, before assuming
39 the duties, functions and responsibilities as agricultural and biosystems engineer or consultant,
40 secure temporary/special permit from the Board, subject to the approval of the Commission to
41 practice his/her profession in connection with the project to which he/she was commissioned:
42 Provided, further, That the following conditions are satisfied:
43 45.1. That he/she is a citizen or subject of a country which specifically permits Filipino
44 professionals to practice their profession within the territorial limits on the same basis
45 as the subjects or citizens of such foreign country or State;
46 45.2. That he/she is legally qualified to practice agricultural and biosysems engineering in his/
47 her own country, and that his/her expertise is necessary and advantageous to the
48 Philippines, particularly in the aspects of technology transfer and specialization; and
49 45.3. That he/she shall be required to work with a Filipino counterpart, a natural person who
50 is a registered and licensed agricultural and biosystems engineer, and professional
51 services fees and expenses of documentation pertaining to the project shall be
52 proportionately shared by both foreign and Filipino agricultural and biosystems
53 engineers, including liabilities and taxes due to the Philippine government, if any,
54 relative to his/her participation therein, or professional services rendered to the project
55 in accordance with established rules and regulations.

1 SECTION 46. Positions in Government and Private Firms and Establishments with Agricultural
2 and Biosystems Engineering Functions. - Only registered and licensed agricultural and
3 biosystems engineers with valid PRC license shall be appointed or designated to all positions in
4 government and private firms and establishments with agricultural and biosystems engineering
5 functions and responsibilities, which shall include, but not be limited to, the following:
6

7 46.1. All levels of engineer positions whose duties, functions and responsibilities constitute
8 the practice of agricultural, and biosystems engineering pursuant to Section 5 of R.A.
9 No. 10915 in the :
10 46.1.1. Bureau of Agricultural and Fisheries Engineering, Agricultural Engineering or
11 Agricultural and Fishery Engineering Division/Section or other operating units
12 of concerned Bureaus, Attached Agencies/Corporations, Regional Field Units
13 and Foreign Assisted Project Offices of Department of Agriculture;
14 46.1.2. Engineering Department/Division/Section or concerned operating units of
15 National Irrigation Administration, Philippine Coconut Authority, National
16 Food Authority, Department of Agrarian Reform, DENR and other concerned
17 government agencies/entities; and
18 46.1.3. Agricultural Engineering Division/Section of the Agricultural Offices and other
19 concerned offices of the Local Government Units.
20 46.2. All levels of instructor/professor positions in public and private schools, colleges and
21 universities whose main duties and functions involve the teaching of Agricultural and
22 Biosystems Engineering subjects for Agricultural and Biosystems Engineering Degree,
23 Agriculture/Agribusiness Degree, Fisheries Degree and other related curriculum or
24 degrees;
25 46.3. All levels of science research specialist/assistant positions in government and private
26 institutions whose main duties and functions involve research and development and
27 training and extension on agricultural and biosystems engineering. These institutions
28 include but not limited to the following:
29 46.3.1. Research Division/Section/Centers of the Regional Field Offices of the
30 Department of Agriculture and its concerned bureaus and attached
31 agencies/corporations, Philippine Coconut Authority and National Food
32 Authority;
33 46.3.2. Department of Science and Technology; and
34 46.3.3. Research Centers and Units of agri-fishery based Colleges and Universities,
35 agri-based plantations and agro-industrial firms.
36 46.4. Head or assistant head, director or manager and other executive positions of agricultural
37 or agricultural and biosystems or agricultural and fisheries engineering or aquaculture
38 engineering or forest engineering group, unit, section, division, bureau, department,
39 center and branch in all national government departments or agencies, government-
40 owned and -controlled corporations, LGUs and colleges and universities, private offices,
41 firms and establishments. These include but not limited to :
42 46.4.1. Director and Assistant Director of the Bureau of Agricultural and Fisheries
43 Engineering of the Department of Agriculture created through Section 24 of
44 R.A. No. 10601 (Agricultural and Fisheries Mechanization Law);
45 46.4.1. Chief and Assistant Chief of Agricultural Engineering Division/Section/Unit of
46 the Department of Agriculture and its bureaus and attached
47 agencies/corporations, and Local Government Units
48 46.5. Head or assistant head, director or manager and other executive positions of a group,
49 unit, section, division, bureau, department, center or branch of any of the specialized
50 areas of agricultural and biosystems engineering in government and private firms,
51 offices and establishments.

1 46.4.1. The specialized areas of agricultural and biosystems engineering are those
2 listed in Section 35 of R.A. No. 10915.

4 46.4.1. The Board shall conduct ocular inspections and visits to determine
5 government and private entities undertaking specialized areas on agricultural
6 and bioystems engineering.
7 46.6. All levels of planning officer, project evaluation officer, project development officer,
8 development management officer, environmental management specialist and technical
9 audit specialist positions in government and private firms and offices that deal with, or
10 undertake any of the specialized areas of agricultural and biosystems engineering or its
11 main functions and responsibilities which involve the planning, project development,
12 evaluation, inspection, monitoring and technical audit of agricultural and biosystems
13 infrastructure, facilities, nachineries and processes and other agricultural and bioystems
14 engineering facilities; and
15 46.7. All professional and sub-professional positions either supervisory or non-supervisory
16 and career executive positions in government, and all other positions in private firms,
17 establishments and enterprises whose duties, functions and responsibilities mainly
18 constitute the practice of agricultural and biosystyms engineering.
19 Moreover, registered and licensed agricultural and biosystems engineers may also qualify for
20 appointment in all positions in government and private firms and establishments whose duties
21 and functions partly, constitute the practice of agricultural and biosystems engineering. This
22 include, among others, Provincial/City/Municipal Engineer, Agriculturist, Building Official,
23 Environment and Natural Resources Officer, and Planning and Development Officer of the LGUs,
24 subject to the candidate's compliance with the rest of the requirements imposed by the law or
25 issuance creating the said positions.
26 The Board and the Commission shall coordinate with CSC for the updating and/or
27 amendment of the qualification standards of these positions enumerated under Section 33 of
28 R.A. No. 10915 as well as to strictly enforce in the approval of appointments, and for the
29 purpose, issue a Memorandum Circular to all concerned national government agencies, local
30 government units and state colleges and universities for their information and compliance.
31 The Board and the Commission and in coordination and collaboration with CSC shall monitor
32 compliance of all concerned national government agencies, LGUs and SCUs of this particular
33 provision of R.A. No. 10915.
34 The Board shall also coordinate with the Peoples Management Association of the Philippines
35 for the implementation of this provision in the appointment to positions with functions on
36 agricultural and bioystems engineering.
37
38 SECTION 47. Personnel Required.-
39
40 47.1. All concerned national government agencies, LGUs and SUCs implementing, regulating,
41 funding and undertaking research, development, training and extension, testing,
42 evaluation and inspection as well as technical audit of irrigation, farm mechanization,
43 post harvest and agro-processing facilities, agricultural and biosystems infrastructures,
44 farm-to-market roads, agro-meteorology, forest mechanization development programs,
45 and environmental protection and conservation programs and projects shall employ the
46 required number of agricultural and biosystems engineers, and for this purpose, create
47 various levels of agricultural and biosystems engineer positions;
48
49 47.2. All agricultural and biosystems engineering facilities/projects supervised and maintained
50 or accredited by the government must have at least one (1) or the required number of
51 registered and licensed agricultural and biosystems engineer such as, such as but not
52 limited to :
53
54 47.2.1. Grain/agro-processing complex;
55 47.2.2. Slaughterhouses ;

1 47.2.3. Communal and national irrigation systems
2 47.2.4. Agricultural Machinery and Equipment Service Centers;
3 47.2.5. agricultural machinery and equipment service centers;
4 47.2.6. Agricultural Machinery Testing and Evaluation Centers

8 47.3. Firms, companies, partnerships, cooperatives or associations which are engaged in the
9 installation, fabrication, manufacture, distribution or sale of agricultural and biosystems
10 machinery and equipment, facilities and other agricultural and biosystems engineering
11 processes, shall hire or engage the services of at least one (1) or the required number of
12 licensed agricultural and biosystems engineer;
13
14 47.4. All contractors of irrigation, farm-to-market roads and agricultural and biosystems
15 structures and facilities shall have at least one (1) or the required number of registered
16 and licensed agricultural and biosystems engineer as part of their sustaining technical
17 employees; and
18
19 47.5. The following offices and establishments shall also employ or engage the services of at
20 least one (1) or the required number of registered and licensed agricultural and
21 biosystems engineers:
22
23 47.5.1. Agro-processing establishments such as rice mills, feed mills, sugar mills,
24 coconut oil mills, fiber extraction processing plants, meat processing plants,
25 fish processing plants, poultry and meat processing plants, food processing
26 plants and agricultural and fishery products storage facilities;
27
28 47.5.2. Agro-industrial firms or establishments, corporations and cooperatives and
29 government entities engaged in agricultural, livestock, poultry and fishery
30 production and processing, the operation and maintenance of plant/forest
31 nurseries and parks, and other agricultural and biosystems engineering
32 endeavors;
33
34 47.5.3. Financing and banking institutions engaged in providing credit and financial
35 assistance on agribusinesses which are commercial in nature such as irrigation,
36 post harvest facilities, agro-processing and storage, forest products,
37 aquaculture, food and fiber production facilities and machineries;and
38
39 47.5.4 Consultancy firms, foundations, nongovernment organizations and other
40 organized groups engaged in providing agricultural and biosystems engineering
41 services relative to management and consultancy, training and extension,
42 research and development and/or the provision of irrigation, post harvest
43 facilities, agro-processing and storage, forest products, aquaculture, food and
44 fiber production facilities and machineries and soil and water conservation.
45
46 Provided, That there shall be no understaffing and/or overloading of agricultural and
47 biosystems engineers. The ratio of agricultural and biosystems engineers to clientele shall be
48 such as to reasonably effect a sustained quality of agricultural and biosystems engineering
49 services at all times without overworking the agricultural and biosystems engineers.

51 The Board shall promulgate guidelines and standards on the required manpower complement
52 of agricultural and biosystems engineers in concerned public and private offices and
53 establishments.
54
55 The Board shall coordinate with the Department of Budget and Management and concerned
56 government agencies for the hiring and creation of agricultural and bioystems engineer
57 plantilla positions in government, as well as the assistance of the Department of Labor and

1 Employment for the creation of same positions in the private sector, and to conduct ocular
2 inspections with concerned government agencies and private firms to monitor compliance.

8 SECTION 48. National Career Progression and Specialization Program. - There shall be an
9 institutionalized national agricultural and biosystems engineering career progression and
10 specialization program to be formulated by the Board in consultation with the AIPO, Civil
11 Service Commission and concerned government agencies: Provided, That any agricultural and
12 biosystems engineer before being allowed to work in specialty areas to perform beyond
13 generalist function or have specific specialties, must finish the formal education or training
14 towards specialization, possess recognized practice competencies and must be certified by the
15 Board and must be a member of a relevant and accredited agricultural and biosystems specialty
16 organization: Provided, further, That agricultural and biosystems engineering specialty
17 organizations shall be recognized and certified by the Board.

19 The Agricultural and Biosystems Engineering Specialization shall include, but not limited to, the
20 following:
21
22 48.1. Agricultural and Biosystems Power and Machinery;
23 48.2. Irrigation and Drainage Engineering;
24 48.3. Soil and Water Conservation Engineering;
25 48.4. Agricultural and Biosystems Buildings and Structures;
26 48.5. Agricultural and Bio-process Engineering;
27 48.6. Food Engineering;
28 48.7. Renewable/Bio-Energy and Farm Electrification;
29 48.8. Agricultural and Biological Waste Management;
30 48.9 Aquacultural Engineering;
31 48.10 Forest Engineering;
32 48.11 Agricultural and Biosystems Automation and Instrumentation;
33 48.12 Agricultural and Bio-Information System;
34 48.13 Agrometeorology; and
35 48.14. Agricultural and Biological Resource Conservation and Management.

37 SECTION 49. Code of Technical Standards. - The existing Philippine Agricultural Engineering
38 Standards (PAES) shall be transformed into a Philippine Agricultural and Biosystems Engineering
39 Standards (PABES) and shall serve as Code of Technical Standards of all registered and licensed
40 agricultural and biosystems engineers in the practice of their profession. The Board, in
41 collaboration with the AIPO of agricultural and biosystems engineers, the DA, the Department
42 of Science and Technology (DOST), the DENR and other concerned government agencies and
43 private organizations, shall develop new standards and update the existing standards under the
44 PABES.

46 RULE V
47 AGRICULTURAL AND BIOSYSTEMS ENGINEERING EDUCATION
48 AND CONTINUING PROFESSIONALEDUCATION/DEVELOPMENT

50 SECTION 50. Curriculum Development and Updating - The CHED, in consultation with the Board
51 and the industry stakeholders and concerned SUCs, shall develop and continuously update the
52 Agricultural and Biosystems Engineering Curriculum in accordance with required competencies
53 on the practice of the profession prescribed under this Act, in order to align with international
54 standards of agricultural and biosystems engineering education and practice, and to become
55 responsive to the industry requirements.

1 The Technical Education and Skills Development Authority (TESDA) shall likewise include in its
2 program, the development and promulgation of competency standards and training programs
3 and regulations for agricultural and biosystems engineering technicians and operators.
4
5 SECTION. 51. Rationalization and Upgrading Program. - The CHED in collaboration with the
6 Board, the DA, the DENR, the DOST the TESDA, the concerned SUCs and the Department of
7 Education (DepEd) and in consultation with the industry stakeholders, shall formulate and
8 implement a rationalization and upgrading program on agricultural and biosystems engineering
9 education in the country with the end view of upgrading and modernizing school facilities and
10 equipment, faculty development and training, provision of scholarships, developing ladderized
11 program on agricultural artd biosystems engineering and other developmental undertakings to
12 produce globally competitive agricultural and biosystems engineering graduates, professionals,
13 technicians and operators.
14
15 In line with this, all concerned Higher Education Institutions (HEIs) shall formulate and
16 implement their Agricultural and Biosystems Engineering Education Competitiveness Road Map
17 as part of the Philippine Agricultural and Biosystems Engineering Profession Development
18 Plan/Road Map and shall serve as one of the basis in the provision of grants from the
19 government for the upgrading program.
20
21 SECTION 52. Career Guidance and Advocacy. - The Board and the Commission, in collaboration
22 with the DOLE, the Philippine Overseas Employment Administration, the CHED, the DepEd, the
23 DA, the DENR, the Department of Trade and Industry, the AIPO and other concerned
24 government agencies and private organizations, shall formulate and implement a Career
25 Guidance and Advocacy Program on Agricultural and Biosystems Engineering. The Program shall
26 include the conduct of research studies on the supply and demand and qualifications of the
27 agricultural and biosystems engineering profession, both local and abroad, employment
28 promotion and entrepreneurship assistance for Filipino agricultural and biosystems engineers,
29 and integration of the practical application of agricultural and biosystems engineering in basic
30 education.

32 SECTION 53. Continuing Professional Development (CPD). - The Board and the Commission, in
33 consultation with the academe, AIPO, concerned government agencies and stakeholders, shall
34 prescribe guidelines in the implementation of the CPD programs for agricultural and biosystems
35 engineers in accordance with R.A. No. 10915. The CPD for every agricultural and biosystems
36 engineer registered under the PRC is hereby made mandatory for the practice of the
37 profession. The CPD credit units earned by the professional shall be required in the renewal of
38 professional license and accreditation systems for advance level of practice and for ASEAN
39 Chartered Professional Engineers, Asia-Pacific Economic Cooperation (APEC) Engineers and
40 other international accreditations.
41
42 The CPD credit units earned by an agricultural and biosystenis engineer shall likewise be applied
43 as the training requirement for promotion for positions in government agencies and private
44 firms and for teaching positions in academic institutions, and shall be accumulated subject to
45 credit transfer under the Pathways and Equivalencies of the Philippine Qualification
46 Framework.

48 RULE VI
49 ENFORCEMENT OF THIS ACT AND PENAL PROVISIONS
50
51 SECTION 54. Enforcement. - It shall be the primary duty of the Commission and the Board to
52 effectively implement and enforce the provisions of R.A. No. 10915 and its IRR, conduct
53 investigations on complaints including violations of the Code of Ethics and Professional
54 Standards of the profession and prosecute the same when so warranted. The Chairperson of
55 the Professional Regulation Commission shall include in the Commission’s Program the
56 implementation of R.A. No. 10915 and its IRR, the funding of which shall be included in the
57 Annual General Appropriations Act.

1 Furthermore, all duly constituted law enforcement agencies and offices of national, provincial,
2 city or municipal government, or of any political subdivision thereof, shall, upon the call or
3 request of the Board or the Commission, render assistance in enforcing the provisions of this
4 Act and prosecute any person violating the provisions of the same. Any person may bring
5 before the Commission, Board, or the aforementioned officers of the law, cases of illegal
6 practice or violations of R.A. No. 10915 committed by any person or party.
7
8 The Board shall assist the Commission in filing the appropriate charges through the concerned
9 prosecution office in accordance with law and Rules of Court.

12 SECTION 55. Penalties. - In addition to the administrative sanctions imposed under this Act, any
13 person who violates any of the provisions of this Act, or any of the following acts shall, upon
14 conviction, be penalized by a fine of not less than one hundred thousand pesos (P100,000.00)
15 but not more than five hundred thousand pesos (P500,000.00), or imprisonment of not less
16 than six (6) months but not more than five (5) years, or both fine and imprisonment, at the
17 discretion of the court:
18
19 55.1. Engaging in the practice of agricultural and biosystems engineering in the Philippines
20 without being registered or without conforming to the provisions of this Act;
21
22 55.2. Presenting or attempting to use as his/her own the COR and/or professional
23 identification card of another registered agricultural and biosystems engineer or a
24 holder of a TSP;
25
26 55.3. Giving any false or forged evidence of any kind to the Board, or impersonating any
27 registered agricultural and biosytems engineer or a holder of a TSP;
28
29 55.4. Using a revoked or suspended COR; or an expired or unrenewed professional
30 identification card or TSP;
31
32 55.5. Using in connection with his/her name or otherwise assuming, using or advertising any
33 title or description tending to convey the impression that he/she is an agricultural and
34 biosystems engineer without holding a valid COR and professional identification card or
35 a valid TSP;
36
37 55.6. Implementing or causing the implementation of any plans, designs, technical
38 specifications and other documents not prepared and signed by a registered agricultural
39 and biosystems engineer in those cases where this Act specifically requires that these be
40 prepared and signed by a registered agricultural and biosystems engineer; and
41
42 55.7. Violating any of the provisions of this Act and the rules and regulations thereof.
43
44 In case the offender is a corporation, partnership, association, foundation or juridical person,
45 the penalty of imprisonment shall be imposed on the agricultural and biosystems engineer-in-
46 charge jointly and solidarily with the responsible professionals, as well as the controlling officer
47 or officers thereof responsible for permitting or causing the violation.

49 RULE VII
50 TRANSITORY AND FINAL PROVISIONS
51
52 SECTION 56 Transitory Provision. - The incumbent Chairperson and members of the Board of
53 Agricultural Engineering shall, in an interim capacity, continue to carry out their functions
54 under the provisions of this Act without need for new appointments as Chairperson and
55 members thereof until the first Board, created under R.A. No. 10915, shall have been
56 constituted or organized pursuant thereto.

1 SECTION 57. Separability Clause. - If any clause, provision, paragraph or part of this IRR shall be
2 declared unconstitutional or invalid, such judgment shall not affect, invalidate or impair any
3 other part hereof, but such judgment shall be merely confined to the clause, provision,
4 paragraph or part directly involved in the controversy in which such judgment has been
5 rendered.

7 SECTION 58. Repealing Clause. - All laws, decrees, executive orders and other administrative
8 issuances and parts thereof which are inconsistent with the provisions of this Act are hereby
9 modified and/or superseded. Republic Act No. 8559 is hereby expressly repealed.

11 SECTION 59. Effectivity. - This IRR shall take effect after after sixty (60) days following its
12 publication in the Official Gazette or in a major daily newspaper of general circulation in the
13 country whichever comes first.
