On motion presented by Councilor Marie Alethea SJ. Casal-Uy, duly seconded, all members of
the Sangguniang Panlungsod who are present approved the following City Resolution on second
and final reading:

CITY RESOLUTION NO. 2012-280

A RESOLUTION DECLARING THAT, AFTER A REVIEW, BARANGAY

SAN LORENZO ORDINANCE NO. 2012-018 ENTITLED: AN
ORDINANCE AUTHORIZING THE INCREASE IN FEES AND CHARGES
ASSESSED AND COLLECTED FOR THE ISSUANCE OF
CERTIFICATIONS, CLEARANCES, FILING AND SIMILAR SERVICES
RENDERED BY BARANGAY SAN LORENZO”, IS IN CONFORMITY
WITH EXISTING LAWS, RULES AND REGULATIONS

WHEREAS, the Sangguniang Panlungsod Chairpersons, Vice Chairpersons and Members of the
Joint Committees on Barangay Affairs; Rules, Legal Matters and Ethics; and Finance, Ways and
Means and Assessment, have undertaken an extensive review of Barangay Ordinance No. 2012-
018 of Barangay San Lorenzo;
WHEREAS, after review, Barangay San Lorenzo Ordinance No. 2012-018 has been declared to
be in accordance with Section 152, 153 & 186 of the RA 7160, or the Local Government Code of
1991 which state that:

“SECTION 152. Scope of Taxing Power. – The barangays may levy taxes, fees
and charges as provided in this Article, which shall exclusively accrue to them.”

“SECTION 153. Service Fees and Charges. – Local government units may
impose and collect such reasonable fees and charges for services rendered”

“SECTION 186. Power to Levy Other Taxes, Fees or Charges. – Local

government units may exercise the power to levy taxes, fees or charges on any
base or subject not otherwise specifically enumerated herein or taxed under the
provisions of the National Internal Revenue Code, as amended, or applicable laws:
Provided, That the taxes, fees, or charges shall not be unjust, excessive,
oppressive, confiscatory or contrary to declare national policy: Provided, further,
that the ordinance levying such taxes, fees or charges shall not be enacted without
any prior public hearing conducted for the purpose.”

NOW, THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED BY THE

SANGGUNIANG PANLUNGSOD OF MAKATI, METRO MANILA, BY VIRTUE OF
THE POWERS VESTED IN IT BY LAW, IN SESSION ASSEMBLED, to declare that, after
a review, Barangay San Lorenzo Ordinance No. 2012-018 entitled “ An Ordinance authorizing
the Increase in Fees and Charges Assesses and Collected for the Issuance of Certifications,
Clearances, Filing and Similar Services rendered by the Barangay San Lorenzo,”, is in conformity
with other existing laws, rules and regulations.

Let copy of this Resolution be furnished the Office of the Barangay Council of Barangay San
Lorenzo and other offices concerned for their information, guidance and reference.

This Resolution shall take effect immediately upon its approval.
