Subject: Request to consider the Supreme court judgement for deciding the inter seniority
reg.

Respected sir,
I, working as X-ray technician (Radiotherapy) since 2012, have several times requested for
the issue of seniority list through proper channel. But did not receive any list so far.
Last year a Note from ADMIN-1(promotion cell) dated 10July2020 was received by all 4 of
the X-ray Technician (Radiotherapy) concerned that our recruitment merit list was not
found, and hence was asked to produce if any document regarding the same is available
with us, which we did not have and did not receive since the joining of the service.

In this context, I would like to kindly request you to consider the attached Supreme court
order in the case of D. P. Das v. Union of India, (2011) 8 SCC 115, which has observed
regarding seniority and promotion in the absence of merit list, that “for determination of
seniority of the officers who were recommended on the same date, ‘AGE’ is the only valid
and fair basis as such their seniority should be decided on the basis of age of the
candidates.”

Thanking you and expecting quick action regarding the aforesaid issue, since it has been
almost 10 years from the date of joining the service.
