Dear Ma’am,

Under Instructions from my client Mr. J. Abdul Khader Sait aged 70 years,
son of Late. Jaffer Mohammed Sait residing at New No 66, Balaclava Cottage,
Coonoor-643102. My client instructs me to notify you as hereunder:-

1. That my Client is the absolute owner of the immovable bearing Shop bearing
No.45 A, Cash Bazaar Commercial Road, Ootacamund 643001 measuring about
236 sq.ft, (which is morefully described in the Schedule hereunder and
hereinafter referred to as the ‘Schedule Premises’).

2. That you approached my Client with to rent out the Schedule Premises for
running a commercial business. My Client agreed to rent out the said premises
to you for a reasonable consideration.

3. That you are a tenant under my client in respect of the Schedule Premises. That
the tenancy is a month on month tenancy and you are paying a monthly rental
of Rs.350/- (Rupees Three Fifty Only) to my client for the use and occupation of
the Schedule Premises.

4. That you have occupied the Schedule Premises under my client and your
tenancy in respect of the schedule premises is that of an English calendar
month commencing on the First day of every month and ending on the last day
of the same month. That the Schedule Premise is occupied by you for non-
residential / commercial purpose, wherein you are running a Laundry Service.

5. That the Schedule Premises is located in the heart of Ootacamund’s central


business district. The Schedule Premises is located in a prime and yet
picturesque and quiet commercial area and being such the rentals of the
Schedule Premises are much higher that what you have been paying our Client.

6. As has been intimated to you time and again, my Client does not intend to
continue your tenancy with respect to the Schedule Premises and requested
you to hand over peaceful and vacant possession of the Schedule Property. But,
unfortunately you have failed to honor the request of my clients. Hence my
client without any option or remedy is terminating / determining your tenancy
in respect of the schedule premises through this notice of termination of notice
which is being issued to you in accordance with and as per section 106 of the
Transfer of Property Act. Accordingly, you are hereby called upon to vacate and
return vacant possession of the Schedule Premises, in the condition it was let
out on rent to you, within 15 days from receipt of this notice. This notice is
issued in terms of Section 106 of the Transfer of Property Act, 1882.

7. That my client through this notice is terminating your tenancy in respect of the
Schedule Premises by way of this termination notice. Hence your tenancy in
respect of the schedule premises stands terminated and determined

8. If you fail to vacate the Schedule Premises, my Client will not receive any
payments as ‘rents’ for the period after 30 th March 2017 as your continued
occupation of the Schedule Premises after 30 th March 2017 will be
unauthorized and illegal. Payments made, if any, would be without prejudice,
adjusted towards part payment of the damages due from you. Any sums that
you may remit directly into the bank accounts of my Client’s will also be
adjusted accordingly.

TAKE NOTICE that if despite this notice if you fail to vacate and deliver vacant
possession of the Leased Premises by end of day on 30th March 2017, my Client will
be compelled to initiate such legal proceedings as may be essential for your
eviction and for recovery of damages arising from your continued illegal use or
occupation, at your risk as to the cost and consequences.

All that piece and parcel of the immoveable property bearing Shop No. No.45 A,
Cash Bazaar Commercial Road, Ootacamund 643001 measuring about 236 sq.ft
