LEAVE AND LICENSE AGREEMENT

This Agreement of Leave and License is made & executed at Pune on this 30 th
day of August in the Christian year Two Thousand & Twenty Two.

BETWEEN

NAME: - Mrs. Anju Murari Jana.

Age: - 58 yrs, Occupation: - Service,

Residing At: - Flat no. 04, Omkar Co. Op. Housing So.,

Someshwar wadi, Pashan, Pune 411014.

      …….. Hereinafter referred to as the Licensor (which expression,


unless repugnant to the context or meaning thereof, shall mean and include his
executors, administrators and assigns) of the FIRST PART.

AND

NAME: - Pankaj Dnyaneshwar Charpe

Age: - 30, Occupation:- Service.

Residing At: Near Sitaram Maharaj Math, Matakhedi

Saoner, Nagpur, Pin-441107 Maharashtra.

..… Hereinafter referred to as the Licensee alone of the SECOND PART.

WHEREAS

A) The licensor is the absolute owner of the property described in the schedule
I, written hereunder (hereinafter referred to as the said premises);

B) And the licensor does not require the said premises for a temporary period;

C) And the licensee requested the licensor to grant to the licensee the license
for the temporary period of 11 months for Residential purpose in respect of
the said premises.

NOW THEREFORE THIS INDENTURE WITNESSETH AND IT IS HEREBY

AGREED BY AND BETWEEN THE PARTIES as under:

1. The licensor agreed to grant the license to the licensee for residential use of
the said premises for the period of 11 months, commencing from 1 st
September 2022 to 31st July 2023, on the terms and conditions mentioned
hereunder.

2. The licensee shall pay to the licensor the license fee of Rs. 16,000/- (Rupees
Sixteen Thousand only) per month (that includes Society maintenance
charges) on or before 5th day of each month in respect of the said premises.

3. On expiry of the period of the said Leave and License agreement, if it is so


desired, the said agreement can be renewed subject to mutual consent of
both the parties; otherwise the licensee shall hand over possession without
any excuses.

4. The licensee agrees with the licensor as follows:

i) To use the said premises temporarily for the purpose of residential use
of the licensee and for no other purpose.

ii) To pay the license fee on or before 5th day of each month.

iii) To surrender the vacant possession of the said premises in the event of
early determination/expiry of the period of 11 months.

iv) To pay by way of security deposit an amount of Rs.30,000/- (Rupees


Thirty Thousand) only, this is refundable interest free at the time of
completion or termination of the said License.

v) To use the premises as a reasonable and prudent man and would


observe rules of the Society or condominium.

vi) Not to sub-lease the said premises or any part thereof.

vii) Electricity charges shall be paid by the licensee and; However, the
society maintenance charges and other taxes / dues are not to be
borne separately by the licensee during the period of the agreement.

5. Notwithstanding anything contained in this agreement/elsewhere, it is


agreed and expressly declared by and between the parties that there is no
intention to create in favour of the licensee any lease tenancy or any interest
of whatsoever nature in the said premises. There is no intention of creating
any relationship of landlord and tenant or any relation except that of
licensor and licensee.

6. The agreement is renewable at option of both the parties after 11 months


and license fee will be decided at the time of every renewal in future.

7. The licensee shall keep as and by way of security deposit a sum of


Rs.30,000/- (Thirty Thousand) only for due performance of this agreement.
The said amount shall not carry any interest subject to the deductions, if
any, on account of default in payment of license fee and other amount under
this agreement to be made by the licensee, the said amount or balance

thereof, if any, shall be repayable against the licensee handing over
possession of the said premises on the expiry of the period or termination of
license and not otherwise.

8. Either party to this agreement may terminate or rescind the agreement


without assigning any reason, by giving to other party One months’ notice.

9. Damages:

At the time of handing back possession by termination/early determination,


if it is found that some damages are caused to the said premises, the
licensor shall be entitled to recover damages/compensation for the same.

10. Fixtures & Furniture Maintenance:

a) Licensor shall maintain the said premises through


painting and repairs at his own cost.

b) Licensee may put up his furniture & fixtures and shall


remove it at the time of surrendering the possession.

11. TERMINATION BY LICENSOR & LICENSEE:

The Licensor and Licensee shall be entitled to terminate this agreement by


giving 30 (Thirty) days prior notice in writing to the other party. Such
termination shall be deemed and is agreed by the parties hereto, to be
treated as expiration of the period of licence and all consequences thereof
shall follow.

12. The license is not transferable and is personal and for temporary period.

SCHEDULE - I

All that piece and parcel of the flat no B-304, and Area admeasurin
about 980 sq.ft. built up in the building known as ONELLA NEST I Patil Nagar,
Susgaon, Pune 411021.

IN WITNESS WHEREOF THE PARTIES HAVE SIGNED AND EXECUED THIS
AGREEMENT ON THE DATE HEREINABOVE MENTIONED.
