Exercise 1:
Shyam  has  agreed  to  sell  his  house  situated  in Delhi, to Ram. They have also entered 
into  a written agreement on 1st March 2019 for the same. As per the agreement, Ram 
had  to  pay  Rs.  10,00,000  as  consideration  for  the  house.  Ram  had  to  pay  Rs.  3,00,000 
as  an  advance  on  which  Shyam  had  to transfer the possession to Ram within 15 days 
of  payment  of  advance  and  Ram  had  to  pay  the  remaining  amount  within  a  week of 
such  transfer. Both the parties had to sign a formally registered sale deed at the time 
of final payment and documents were to be registered at the expenses of Shyam.  
 
Ram  paid  Rs.  3,00,000  as  agreed.  Before  Shyam  transferred  the  property  to  Ram,  Shyam 
got  another  offer  from  Raghu.  According  to  the  proposal,  Raghu  will  pay  Rs.  15,00,000  to 
Shyam  for  the  transfer  of  the  same  property  to  him.  Shyam  cancelled  the  agreement 
alleging that Ram has taken advantage of his illiteracy and cheated him.  
 
Ram  has  given  a  notice  to  Shyam  to  perform  his  part  of  the  contract.  Shyam  has 
approached  you  for  advice  regarding  the  matter.  According  to  him  Ram  took  advantage of 
his  illiteracy  and  got  his  signatures  on  the  agreement  with  a  lesser  consideration  (Rs. 
1,00,00,000)  than  what  was  agreed  (Rs.  15,00,000)  between  the  parties.  Ram  has  not  even 
paid  any  advance  (Rs.3,00,000)  to  him  as  agreed  in  the  agreement.  He  reminded  Ram 
multiple  times  to  pay  the  amount  and  get  the  documents  registered,  however,  Ram  has 
changed  his  mind  and  is  asking  him  to  transfer  the  possession  of  the  property  at  a  lesser 
amount.  
 
Draft a reply to the notice given by Ram to Shaym on behalf of Shyam. 
  
Exercise 2:
Dr.  Manohar  is  a  surgeon  in  a  government  hospital  in  Delhi.  One  day  a  patient  (Raju)  was 
admitted  in  the  emergency  ward of the hospital. He was badly injured in an accident. It was 
a  late  night  and  he  had  lost  a  lot  of  blood.  His  condition  was  very  critical  and  hence,  Dr. 
Manohar  decided  to  go  for  surgery  to  save  his  life.  Even  after  all  the  efforts,  Raju  died  on 
the operation table.

Later  it  was  discovered  that  the oxygen cylinder was not available in the hospital and blood 

of  the  blood  group  of  Raju  was  not  available.  Still, the Doctor decided to operate him. Even 
the  permission  form  was  not  signed  by  any  relative  or  other  person  and  he  didn’t  wait  for 
Raju’s relatives to reach the hospital.  
 
Later,  relatives  of  Ruju  sent  a  legal  notice  to  Dr.  Manohar  claiming  compensation  of  Rs. 
25,00,000 for the death of Raju due to negligence of Dr. Manohar.  
Draft a reply to such notice on behalf of Dr. Manohar.
