Colonie Town Attorney Memorial Town Hall 534 Loudonville Road Newtonville, NY 12128 Dear Mr. Magguilli, Under the provisions of the New York state Freedom of Information Law we hereby request the following records which may either be in the possession of the Town of any of the Town contractors: 1) Any and all bid documents and supporting documents in response to the Town of Colonie RFP for landfill operation; 2) Any and all written or electronic correspondence between Town officials and staff and prospective bidders. This includes, but not limited to, written documentation and emails; 3) The names of each representative for the Town of Colonie landfill exploratory committee, and a resume for each representative on the Town of Colonie landfill exploratory committee; 4) Any and all notes and minutes of meetings of the Town of Colonie landfill exploratory committee; 5) Any and all internal memoranda prepared and sent by any Town employee or official related to the Town of Colonie landfill exploratory committee or the Colonie landfill operation RFP process. This includes, but not limited to, descriptions, evaluations, and descriptions of discussions with prospective bidders; 6) Any and all reports, documentation, publications and information reviewed and/or relied upon by the Colonie landfill exploratory committee in its deliberations both leading up to its initial report or in its review of proposals submitted in response to the landfill RFP. 7) Any and all correspondence or e-mails sent by the Colonie Town Supervisor, town staff or any Colonie Town Board member concerning the Colonie landfill exploratory committee or Colonie landfill operations, or the Colonie landfill RFP process. 8) Any and all written or electronic correspondence, minutes, and memoranda prepared by town officials or staff concerning the Capital Region Solid Waste Management Partnership Planning Unit. This includes, but not limited to, written documentation and emails; and 9) Any and all evaluations and/or analysis of current Town of Colonie landfill operations and analysis of options to improve landfill operations 10) Any documentation and all information on the subcontractors and key personnel that the prevailing bidder intends to utilize As you know, the Freedom of Information Law requires a response to a request within five business days of receipt of a request. Therefore, we would appreciate a response as soon as possible and look forward to hearing from you shortly. If you are unable to provide the requested information as soon as possible, we encourage

the Town of Colonie Supervisor to delay the public information meetings set for next week until such time as this information is provided to the public and the public is given ample opportunity to review it. If for any reason any portion of our request is denied, please inform us of the reasons for the denial in writing, and provide the name and address of the person or body to whom an appeal should be directed.
