MIISTARI, who after being sworn, @eposos and says as follows: 1. My name de GREGORY J. MUSTARI? and Xam on- ployed as a police investigator for the Garfield county Sherifé's Department, Gafielé County, State of Colorado, and have been so employed for approximately fifteen (15) months. 2. That on Neconber 31, 1977, a Garfield county Sheriff's Pepartnant Conplaint Report was filed by Mr. Robert Hart, and stated as follow! a. That a report was made to Mx. Mart that theodore Robert Aundy was not in his cell and could not he located. That Mr. Frank Perry, the night jailer, had contacted Mr. tart with the inforna~ tion about Aundy's Aisappearance at 12:10 Pen. on Recembor 21, 1977. ‘That ‘te. Hart responded to the Garfielé county Sheriff's office and inspected Rundy's. cell, Cell #5, and discovered that Bundy was in fact gone. That Me. Hart observes the Cell #5 and ob- served that Bundy's bunk had books and papers piled up and a shirt with one sleeve stutfed with paver, aiving the appearance that he was in the bunk, @ copy of the Complaint Report 477056? is attached hereto as Pxhibit "A", 3. That Me. Frank Perry, tho jailer on duty at the Garfield County gail on December 39th and 31st, 1977, stated the following:‘That Mr. Perry arrived at the Garfield County Jaid on Decenber 39, 1977, at 5:30 pam. and that pon his arrival, he checked the lodaing book in said jail, which took approximately forty- five (45) minutes. ‘that Me. Perry stated that he spoke with Bundy two (2) times between 6:25 pains and 7:00 peme on Recember anth, 1977. 1, ‘The first conversution was when Perry left ‘the hooking room to gat to the kitchen. ‘The second conversation took place when Porny returned from the kitchen on his vay back to the booking room. ‘that Perry stated both conversations between himself and Bundy consisted of "just passing the tine of day", and that Nundy informed Perry thet he wasn't feeling vel and vas going to “turn in early". ‘That Perey stated that he conducted threo (3) bed checks on Pecenher 31st, 1977 and each time observed what he felt was Sundy sleeping im cell #5. 1, Reé check No. 1 at 12:00 a.m. Red check No. 2 at 1:30 asm. 3, Bod chock No. 3 at 3:00 a.m. hat Mr. Porry stated that Sonez, the cook, served breakfast to Dundy at A:00 a.m. on Pecenber 31st, 1977, and thet the food was placed on a door which epens and allovs xoon for a food tray. hat Perry returned to Hundy's Cell #5 aain fon December 31st, 1977, at 9:30 am. to do~was on duty on the following: 770s5¢a Liver @ letter, which was adéressed to Bundy, and that it appeared that Bundy was asleep. hat Perry was at Rundy's Coll #$ again on December 21st, 1977, af 11:30 a.m. or 12:00 Pom. to aseist in serving lunch. That the letter which Perry left on the food door was still there, ‘That Perry ontered nundy's: cell #5 and shook what he thought was Bundy, only to discover that there was a “dumay" in the cell bunk: and Rundy was gone. Garfield county Jail Planket. 2, nundy's transister radio that Polores Goner, the Garfielé County Jail cook, pecenber 31st, 1977 at 6:20 asm, and reported ‘ghat Gonex reported for duty as the Garfield county Jail coo on Yecember Bist, 1877, at 6:20 a.m. and proceeded to propare the inmates! breakfact for that day. that Gone served breakfast at 7:49 a.m. on pecenber 31st, 1977, and started with Rundy cell, #5. Gonor stated that she opened thewindow door, locked n and told Fundy, "Here's your breakfast". Gonez stated it appeared ‘that Punay was s}eopina. ‘that Gomez collected the breakfast dishes at 120 a.n., Recenher 318¢, 1977, and noticed that Sundy had not eaten any of his breakfast. cone inforned the jailer of this, this date. ‘hat Gonex was in the Kitchen aren of the Garfield County Jail on Reconher 31st, 1977, at @:30 to 19:00 a.m. and heard a "racket" from the jail apartment, which is right next to the Kitchen, Gonez stated the "racket" sounged like doors heing slanned or thins being azopped. ‘chat Goner, on Recenber 31st, 1977, between 9:30 and 19:09 a.m., knocked on the apartment door as she had to (2) letters for the off duty jatler and his wife. At this tine, Gonoz hearé the front door slam. ‘hat Gonez served lunch to the Garfield County inmates on Deconber 31st, 1977, at 11:40 a.my ana returned to pick the dishes up at 11:55 aun this date, Gomer stated that she, at this tine, requested that the jailer, Nr. perry, go in and check Bundy in his Cell 45. Goner stated she watched from the hall in gront of Cell #5 as Porry shook what Gone thought was Bundy, and discovered that Bundy was not in his cell and the object Conc chouaht was Bundy was in fact, stacks of books under the blanket, made it look 11Fe someone was sleeping in the bunk.5. That Robert Morrison,:the off duty Jailer, who Lives in the Garfield County Jail apartment, reported thée following: hat on December Hut, 1977, at 6245 Pamey Morrison and his wife left the Garfield County gail apartment and went out for the evening and returned on Necenber 31st, 1977, at 9130 pene That Horrison stated he was unable to sleep and aot up from hed at approximately 12:00 aim. and vas up until 4:00 a.m. reading, that he vent back to sleep at approximately 0 asm, January Ist, 1978. that Noreison stated he woke up at approxi~ nately :00 a.m. on January Ist, 1978, and took a shower and that he and his wife left the Garfield county gail apartment approximately 9:00-9:15 e.m., and returned at 11:45 ams on January Ist, 1978, at which time Morrison was informed that Bundy had escaped. hat on January 1st, 1978, at 1:30 Pam, Morrison went inte the ceiling space in Bundy's cell and worked his way to the apartment, where Morrison observed a hole in the coiling, which went into @ closot in the apartment. That woreisen further discovered his murzle-loading rifie and derrinaer pistol were missina from tthe closet in the Garfield County Jail opart- mont. These were @iscovered up on the collins next to the hole which led out to the spares ment closet. Horrison also discovered « flash= Light, which was not there on an carliex Sn6 spection of the ceiling prior to Mundy's escape. hat this tnvestiaator, GREGORY J.
