MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THIS PRESENTS:

This agreement made and entered into by and between three parties as follows:
The LOCAL GOVERNMENT UNIT OF MUNICIPALITY OF CAMALIG, Albay
represented by its Municipal Mayor CARLOS IRWIN G. BALDO, JR. herein referred to as
FIRST PARTY;
The private land owners of Barangay Cabraran Pequeňo, Camalig, Albay representing
their families namely, MARLIN T. NERO; DOLORES T. BANOTAN, LORETA N.
RECOMENDABLE, JERRY V. MULLASGO, ALEJANDRO L. MORILLA, MELANIA L.
OLIVER, ALFREDO M. MABINI, JR., CESAR OSIA, GINA M. PAMA and CLARA O.
PACHECHO herein referred to as SECOND PARTY; and
The LOCAL GOVERNMENT UNIT OF BARANGAY CABRARAN PEQUEŇO,
Camalig, Albay represented by its Punong Barangay SALVADORA G. AROGAR herein
referred to as THIRD PARTY.
WITNESSETH, that;
WHEREAS, the first party have approved a project “Road Opening” worth three million pesos
at Barangay Cabraran, Pequeňo, Camalig, Albay as requested by the third party;
WHEREAS, the first party together with the third party conducted a survey and found out that
many parcels of land with different private owners will be affected by the project;
WHEREAS, as a consensus with the private owners, such project must push through,
provided that they entered into a Memorandum of Agreement for proper and legal
understanding;
NOWTHEREFORE, for and in consideration of these premises the parties hereby agree on
each responsibilities and commitments as follows:
A. RESPONSIBILITIES AND COMMITMENTS OF THE FIRST PARTY:
1. Conduct all relevant proper survey of the exact area where the project will be
constructed;
2. Complete the project as to its specifications and Program of Works;
3. Furnish copy at least authenticated copy of Program of Works, the Third Party and all
of the Second Party members;
4. Observe safety standards during the duration of the construction of project;
5. Regularly update the Second and Third Party of the progress of the project; and
6. By all instance always make a protocol to the Third Party before pursuing any
development about the project implementation.

B. RESPONSIBILITIES AND COMMITMENTS OF THE SECOND PARTY:

1. Provide a space/parcel of their property with an area of not less than 1.5 meters and
not more than 3.0 meters depending in the location and situation to give way for the
construction of the project;
2. Provide necessary assistance to First and Third Party as to the identification of proper
boundaries or exact land location where the project will be placed;
3. Ensure that their decision is what actually agreed upon with other family members
sharing the same rights and privileges as co-owners of the property; and
4. Report any untoward observation during the construction of the project.

C. RESPONSIBILITIES AND COMMITMENTS OF THE THIRD PARTY:

1. Provide necessary assistance to the First Party any matters relevant to the project;
2. Oversees that First and Third Party abides with the conditions agreed herein;
3. Regularly monitor the progress of the construction of the project through the SB
Committee on Infrastructure and DRRM; and
4. Ensures that all parties give updates relevant to the construction of the project.
 D. COMMON UNDERSTANDING AND CONDITION:
1. That the parcel of land used by the project remains to be a property of the individual
private owners, and
2. Any breach made by or any of the party to this MOA would mean automatic
termination of the same.
