AN ACT PROVIDING FOR A MORE RESPONSIVE AND COMPREHENSIVE REGULATION FOR


THE REGISTRATION, LICENSING AND PRACTICE OF ARCHITECTURE, REPEALING FOR THE
PURPOSE REPUBLIC ACT NO. 545, AS AMENDED, OTHERWISE KNOWN AS "AN ACT TO
REGULATE THE PRACTICE OF ARCHITECTURE IN THE PHILIPPINES," AND FOR OTHER
PURPOSES.

PROFESSIONAL REGULATORY BOARD OF ARCHITECURE

SECTION 4. 

The Professional Regulatory Board of Architecture, usually referred to as the Board, is therefore
established as a collegial body subject to the supervision and administrative authority of the
Professional Regulation Commission, subsequently referred to as the Commission, that composed
of chairman together with 2 members assigned by the President of the Philippines from a lists of
three 3 recommendees chosen from the 5 nominess of each position submitted to the Commission
by the integrated and the accredited professional organization of architects.

For the efficiency of this Act the Board must be organized as soon as plausible with the span of no
more than 6 months.

SECTION 5. Qualifications of Members of the Professional Regulatory Board. - Each member


must have the following credentials at the time of appointment:

A. be a legal resident and citizen of the Philippines;

B. have a title/degree that proves that he/she has finished the 5 consecutive years of
Bachelor of Science in Architecture bestowed by a school, college or university in the
Philippines and even abroad that is accredited and authorized by the Commission on Higher
Education (CHED);

C. be an architect with valid and legitimate Certificate of Registration and Professional


Identification Card who has been practicing and actively working in the field
of architecture with high credibility for at least ten (10) years on the date of appointment;

D. being a part of such organizations held by a school such as college, university or review
institution where the course review of architecture has taught is strictly forbidden. Having a
relationship with these such institutions will never get pass be qualify to become a member
of the Board unless he/she has decided to quit or resigned from that institution and stop
teaching, advising, and reviewing about the course for at least 5 consecutive years prior to
the nomination; and

E. has never been engaged and committed to any illegal act involving deviant behavior and
violence.

SECTION 6. Term of Office. - The Board members must have given a 3 years term in the office
after the appointment or until the next appointed member who has successfully qualified is going to
take the office role. Any vacancy that occurs during a member's mandate will be filled for the
remainder of the term only. There are some instances that each of the Board members may
reappointed for a full 3 years of term. Of the members of the Board first appointed under this Act, 1
member must be assigned to take the role as chairman of the office for 3 years, hence, 1 member
for 2 years and 1 member for 1 year. Each Board member must qualify by taking the necessary oath
prior to performing their duties.

Provided, That the responsibility of board members must have taken necessarily and continue to
serve for the remainder of their term as members, created by the Professional Regulatory Board of
Architecture.

SECTION 7. Powers and Functions of the Board. - The Board should have the following specific
powers, duties, and responsibilities:

A. Authorize and adhering the rules and regulations is crucial for carrying out the provisions
of this Act;

B. Administer the registration, licensure and practice of architects;

C. Conduct oaths in relation with the administration of this Act;

D. Invalid, issue, suspend, revoke, or restore the Certificate of Registration and the
professional identification Card for the application of the Architecture profession;

E. Adopt the Board's official seal;

F. Evaluate the circumstances impacting the practice of architecture and take whatever steps
are necessary to enhance and maintain the profession's high professional, ethical, cultural
and technical standards.

G. Adhere and embrace the Code of Ethical Conduct and Standards of Professional Practice
are must;

H. Understand and decide administrative cases involving violations of this Act, its
implementation rules and regulations, the Code of Ethical Conduct and Standards of
Professional Practice, and to this purpose, to issue subpoena ad testifcandum and subpoena
duces tecum to secure the appearance of witnesses and the production of documents in
connection therewith: Provided, however, that the decision of the Board shall become final
and executory after fifty days, unless appealed to the Commission. The Commission's
judgment may be appealed to the Court of Appeals in line with the Rules of Court.

I. Recommend rules for the Continuing Professional Development (CPD) program in


cooperation with the integrated and recognized professional association of architects;
provided, however, that attendance to said CPD is not an obligatory prerequisite for
professional license renewal;

J. Prepare, adopt, issue, or improve the syllabi of the subjects for exams by selecting and
preparing questions that will be within the scope of the syllabi of the subject for examination,
along with administer, correct, and disclose the outcomes of the licensure examinations;

K. Approve, grant, limit, or reject a temporary or special architectural license;


L. Assure, in collaboration with the CHED, that all higher academic architectural teaching
and offers adhere to the policies, standards, and requirements of the course specified by the
CHED in the areas of curriculum, faculty, library, and facilities.

M. Adopting a scheme for full computerization of the licensing examination; and

N. Perform any additional responsibilities or duties considered necessary for the


advancement of the architectural profession and the upgrading, development, and expansion
of architecture education.

The Commission shall evaluate and approve all policies, resolutions, rules, and regulations
established or imposed by the Board. However, judgments, resolutions, or orders issued by the
Board in administrative proceedings are subject to review only if they are challenged.

SECTION 8. Administrative Supervision of the Board, Custodian of its Records, Secretariat


and Support Services. - The Commission will have administrative authority of the Board. The
Commission shall have custody of all records of the Board, including request for examination and
administrative and other investigative matters undertaken by the Board. To carry out the
requirements of this Act, the Commission must appoint the Secretary of the Board and provide the
secretariat and other support services.

SECTION 9. Grounds for Suspension or Removal of Members of the Board. - The President of
the Philippines may suspend or remove any member on the following reasons, on the suggestion of
the Commission, after providing the concerned member an opportunity to defend himself in a proper
administrative inquiry to be performed by the Commission:

A. Incompetence or neglect of duty;

B. Tolerance violation of this Act, or its implementing rules and regulations, or the Code of
Ethical Conduct for Professional Practice;

C. Final verdict in cases involving moral turpitude; and

D. Manipulation or cheating of architectural licensing examination outcomes, exposure of


secret and sensitive information in examination questions prior to the examination's
administration, or grade tampering

SECTION 10. Compensation and Allowances of the Board. -The chairman and members of the
Board shall receive payment and allowances equal to those received by the chairman and members
of existing regulatory Boards under the Commission as provided for in the General Appropriations
Act.

SECTION 11. Annual Report. - After the conclusion of each annual year, the Board should submit
to the Commission an annual report detailing its activities and making any recommendations it
deems appropriate.

Membership Type
Membership with the UAP is classified into the following:

Charter Member. Members of the three architect groups that merged to become the UAP are considered
charter members if they joined the UAP on or before December 31, 1975.

Regular Member. Current attendees of the UAP are people who joined the UAP in accordance with
Sections 1 and 2 of Article II of the UAP By-laws of 2009.

Member Emeritus. A Member Emeritus is a regular member who has been in good standing with the
UAP for at least thirty-five (35) years and has demonstrated loyalty and excellent service to the company.

Senior Member. Any UAP member who is unable to study architecture due to disability and wishes to
participate in the organization's activities and functions may be deemed a Senior Member, subject to the
permission of the National Board of Directors and the terms of these By-laws.

Fellow Member of the College of Fellows. Regular members must have been in good academic standing
with the UAP for at least ten (10) years at the time of nomination and must have made a significant
contribution to the advancement of the architectural profession, whether in design, education, literature,
public service, or outstanding service to the UAP. Payment of arrears to meet the 10-year minimum will
disqualify any nominee.

Honorary Member of the College of Fellows. Honorary membership in the College of Fellows may be
granted on any foreign architect in the nation in which they are licensed and registered who is of high and
respectable character and has made extraordinary contributions to the progress of the architectural
profession.
