2.3.1. AN INTRODUCTION TO PATENT
2.3.1.1. Definitions/Concepts
Invention
• “Invention” means a solution to a specific problem in the field
of technology. An invention may relate to a product or a
process.
Sáng chế là một giải pháp cho một vấn đề cụ thể trong lĩnh vực công nghệ.
Một sáng chế có thể liên quan tới một sản phẩm hay một quy trình.

PATENT
A patent is a document, issued, upon application, by a
government office, which describes an invention and creates a
legal situation in which the patented invention can normally
only be exploited (manufactured, used, sold, imported) with
the authorization of the owner of the patent.
Bằng độc quyền sáng chế là một văn bản được cơ quan chính
phủ cấp trên cơ sở đơn đăng ký, trong đó mô tả một sáng chế
và tạo ra một tình huống pháp lý theo đó sáng chế được cấp
bằng độc quyền chỉ có thể được khai thác (sản xuất, sử sụng,
bán, nhập khẩu) với sự cho phép của chủ sở hữu bằng độc
quyền sáng chế.
History of Patent
• In 500 BC, in the Greek city of Sybaris (located in what is now southern
Italy): patent to encourage new courses
"encouragement was held out to all who should discover any new refinement in
luxury, the profits arising from which were secured to the inventor by patent for the
space of a year.“
• At least since 1474, when first granted by the Republic of Venice, patent
protection has encouraged the development and distribution of new
technologies.

• In the reign of Queen Anne (1702–1714) lawyers of the English Court developed
the requirement that a written description of the invention must be submitted. These
developments, which were in place during the colonial period before independence
of the U.S., were the foundation for patent law in the United States, New Zealand
and Australia.
• In the United Kingdom, the Patents Act 1977 harmonised UK patent law with the
European Patent Convention. Consequently, UK patent law is no longer based on
the Statute of Monopolies, but an amalgam of UK and European practices.
Coincidentally, the current length of UK/EU patents is still 20 years, similar to that
of the original declaration by Henry VI on the manufacture of stained glass
(destined for Eton College).

The Roles of Patent
• Many products would not exist without patent protection,
especially those that require substantial investments but, once
sold, can be easily duplicated by competitors.
Nhiều sản phẩm sẽ không tồn tại nếu không có sự bảo hộ thông qua bằng
độc quyền sáng chế, đặc biệt là những sản phẩm đòi hỏi đầu tư đáng kể
nhưng khi tung ra thị trường sẽ dễ bị đối thủ cạnh tranh sao chép.
Khi không có patent, các công nghệ sẽ được giữ kín. Nếu nhà sáng chế
phải dựa vào việc giữ bí mật để bảo vệ các sáng chế của mình, những
thông tin quan trọng nhất, đồng thời là những thông tin được giũ kín
thường sẽ mất đi khi họ qua đời.

• The effects of the grant of a patent are that the patented invention may not
be exploited in the country by persons other than the owner of the patent
unless the owner agrees to such exploitation.
• The right to take action against any person exploiting the patented
invention in the country without his agreement constitutes the patent
owner’s most important right, since it permits him to derive the material
benefits to which he is entitled as a reward for his intellectual effort and
work, and compensation for the expenses which his research and
experimentation leading to the invention have entailed.

Exceptions to granted patent rights (2)

a/ Using ... in service of their personal needs or for noncommercial purposes, or for purpose
of evaluation, analysis, research, teaching, testing, trial production or information collection
for carrying out procedures of application for licenses for production, importation or
circulation of products;
=>private and non-commercial use, experimental use
