PART I GENERAL PROVISION

Section I. Short Tittle

CHILD PROTECTION AND ANTI-BULLYING POLICY

Section II. Statement of the Policy

Ruperto Zubia Elementary School in collaboration with its partners and stakeholders promotes
gender sensitive, safe, loving and caring environment for all learners. The best interest of the child is the
paramount consideration in all decisions and actions involving children.

The school recognized that cases of abuse may arise as a result of the difficult situations faced by
teachers and other officials within and outside school.

The policy provides special protection to children who are gravely threatened or endangered
circumstances which affect their normal development and over which they have no control, and to assist
the concerned agencies in their rehabilitation.

Furthermore, Ruperto Zubia Elementary School aims to ensure such special protection from all
form of abuse and exploitation and care as it is necessary for the child’s well - being

Section III. Definition of Terms


a. Children in School – refers to bona fide pupils, students or learners who are
enrolled in school whether regular, irregular, transferee or repeater, including
those who have been temporarily out of school, who are in the school or
learning centers premises or participating in school-sanctioned activities.

b. Pupil, student or learner – means a child who regularly attends the classes
in any level of the basic education system, under the supervision and tutelage
of the teachers
c. School Personnel- means the persons working in Ruperto Zubia Elementary
School.
d. Guardians or Custodians - Refers to legal guardians, foster parents and
other persons, including relatives or even non-relatives, who have physically
custody of the child.

e. Child abuse – refers to maltreatment of the child, whether habitual or not,


which includes the any of the following:

1. Psychological or physical abuse, neglect, cruelty, sexual abuse and


emotional maltreatment.
2. Any act by deeds or words which degrades, demeans the intrinsic
worth or dignity of a child as a human being.
3. Unreasonable deprivation of the child’s basic needs for survival
such as food and shelter.
4. Failure to immediate medical treatment to an injured child
resulting in serious impairment of his or her growth and
development or in child’s permanent incapacity or death.

f. Child exploitation – refers to the use of children for someone else’s


advantage, gratification or profit often resulting to an unjust cruel and harmful
treatment of the child.

g. Violence against children committed in school – refers to a single acts or


series of acts committed by a school administrator, academic and non-
academic personnel against a child, which result in or is likely to result in
physical, sexual, psychological harm or suffering or other abuses including
threat of such acts, battery, assault, coercion, harassment or arbitrary
deprivation of liberty.

1. Physical violence refers to an acts that inflict bodily or physical


harm. It includes assigning children to perform task which are
hazardous to their physical well-being.
2. Sexual violence refers to act that are sexual in nature. It includes
rape, sexual harassment, act of lasciviousness, making demeaning
and sexually suggestive remarks, physically attacking the sexual
parts of the victim’s body.
3. Psychological violence refers to acts or omissions causing or
likely to cause mental or emotional suffering of the child, such as
but not limited to intimidation, harassment, stalking damage to
property, public ridicule or humiliation, deduction or threat of
deduction from grade or merit as a form of punishment and
repeated verbal abuse.

m. Bullying or peer abuse – refers to willful aggressive behaviour that is


directed, towards to a particular victim who may be out-numbered, younger,
weak with disability, less confident, or otherwise vulnerable imposed for an
alleged or actual offense, which is carried out or inflicted, for the purpose of
discipline, training or control by a teacher, school administrator an adult or
any other children who have been given or has assumed authority or
responsibility for punishment or discipline.

o. Corporal Punisment – refers to a kind of punishment or penalty

PART II: DUTIES AND RESPONSIBILITIES


Section I. SCHOOLS
The Schools Head shall have the following duties and responsibilities:

 Ensure the institution of effective child protection policies and procedures and
monitor compliance thereof;
 Ensure that the school adopts a child protection policy, organize and convene Child
Protection Committee (CPC) for the school;
 Conduct the capacity building activities for the members of the CPC and Guidance
Counselors/Teachers;
 Ensure that the participatory and other rights of children are respected and upheld in
all matters and procedures affecting their welfare;
 Coordinate with appropriate offices and other agency or instrumentality for
appropriate assistance and intervention, as may be required in the performance of its
functions

Section II. SCHOOL PERSONNEL


The Schools personnel shall have the following duties and responsibilities:

 Keep children in their company and support, educate and instruct them by
right precept and good example
 Give them love and affection, advice and counsel, companionship and
understanding
 Enhance, protect, preserve, and maintain their physical and mental health at
all times.
 Furnish them with good and wholesome educational materials, supervised
their activities, recreation and association with others, protect them from bad
compony and prevent them from acquiring habits detrimental to their health
studies and morals;
 Represent them in in all matters affecting their interest.
 Inculcate the value of respect and obedience.
 Practice positive and non-violence discipline, as Maybe required under the
circumstances; provided that in no case shall corporal punishment be
inflicted upon them.
 Perform such other duties as are imposed by law upon them, as substitute
parents or guardians
 School personnel shall also strictly comply with the child protection policy.

Section III. PUPILS AND LEARNERS

The pupils and learners shall have the following duties and responsibilities
A. Comply with the school’s regulation. Pupils and learners shall refrain from:

 Engaging in discrimination, or leading a group of pupils to discriminate others, with


reference to one’s physical appearance, weaknesses and status of any sort;
 Doing any acts that are inappropriate or sexually provocative
 Participating in behavior of other pupils that is illegal unsafe or abusive.
 Making or damaging school property, including books, in any way
 Engaging fights or any aggressive behavior;
 Introducing into a school premises or otherwise possessing prohibited articles, such
as deadly weapons, drugs alcohol toxic and noxcious substances, cigarettes and
pornographic materials
 Performing other similar acts that cause damage or injury to others

Section IV. ESTABLISHMENT OF CHILD PROTECTION


COMMITTEE (CPC)

All public and private elementary schools shall establish a Child Protection Committee (CCP)
A. The CPC shall composed of the following

o School Head/Administrator – Chairperson


o Guidance Counselor/ Teacher –Vice Chairperson
o Representative of the Teachers as designated by the Faculty Club
o Representative of the Parents as designated by the PTA
o Representative of pupils/students as designated by the Supreme Student Council
o Representative from the Community as designated by the Punong Barangay, preferably
from the BCPC.
o Initiate information dissemination programs and organize activities for the protection of
children;
o Establish a system for identifying students who may be suffering from significant harm
based on any physical, emotional or behavioral signs;
o Monitor the implementation of positive measures and effective procedures in providing the
necessary support for the child and for those who care for the child; and
o Ensure that the children’s right to be heard are respected and upheld in all matters

B.Functions of CPC’s:

 Initiate information dissemination programs and


 organize activities for the protection of children;
 Establish a system for identifying students who
 may be suffering from significant harm based on
 any physical, emotional or behavioral signs;
 Monitor the implementation of positive measures
 and effective procedures in providing the
 necessary support for the child and for those
 who care for the child; and
 Ensure that the children’s right to be heard are
 respected and upheld in all matters and
 procedures affecting their welfare.

PART III. PREVENTIVE MEASURES:


Capacity Building of School Officials, Personnel, Parents and Students
 Strategies:

 Conducting sessions, trainings and seminars on positive peer relationships and enhancement of social and
emotional competence;

 Using training modules which include positive and non-violent discipline in classroom management and
gender sensitivity;

 Employing of means which enhance the skills and pedagogy in integrating and teaching children’s rights
in the classroom.

PART IV. PROTECTIVE AND REMEDIAL MEASURES TO ADDRESS


BULLYING AND OTHER ACTS OF ABUSE PROCEDURES:
 All bullying incidents shall be reported to the School Head.

 The School Head shall in turn inform the parents of the pupils concerned and a meeting shall be held for
that purpose.

 The student shall be referred to the CPC for counseling and other interventions.

 The School may impose Non-punitive Measures in accordance with the principles of Positive and Non-
Violent Discipline.

 Punitive measures will be a last resort.

PART V. PROCEDURES IN HANDLING CHILD ABUSE, EXPLOITATION,


VIOLENCE AND DISCRIMINATION CASES
1. Expeditious conduct of investigation and reporting of cases;
2. School Head or the Schools Division Superintendent shall forward the complaint within 48
hours to the Disciplining Authority, who shall issue an Order for the conduct of a fact-
finding investigation, not later than 72 hours from submission;
3. If the person complained of is a non-teaching personnel, the Schools Division
Superintendent shall cause the conduct of a fact-finding investigation within the same
period;
4. Criminal and civil liability shall not be a bar to the filing of an administrative case;
5. The Revised Rules of Procedure of Dep. ED in Administrative Cases shall apply in all other
aspects;
6. The identity or other information that may reasonably identify the pupil or student shall
remain confidential; and
7. The identity of a respondent-teacher shall likewise be kept confidential.

3. Vandalism
a. 1st offense – – reprimand
b. 2nd offence – warning with letter of apology
c. 3rd offence– Supervised cleaning premises
4. Staying in a place other than designated areas during flag ceremony and other assemblies
a. 1st offense – warning
b. 2nd offence – reprimand with written apology
c. 3rd offence- 3 days reporting to adviser
5. Improper behavior during flag ceremony and during class hours like eating and sleeping and other
related activities
a. 1st offense – – reprimand
b. 2nd offence – warning with letter of apology
c. 3rd offence– Supervised cleaning premises
6. Disregarding proper grooming; For boys – earring, dyed hair, nail polish, tattoo, long and funk hair.
For girls – more than one pair of earring, miniskirt, indecent outfits dyed hair
a. 1st offense – – reprimand
b. 2nd offence – warning with letter of apology
c. 3rd offence– Supervised cleaning premises
7. Failure to bring excuse letter before/after an absence.
a. 1st offense – – reprimand

8. Unauthorized use of gadgets such as cellphone, tablets, iPad and others

BULLYING POLICY AND SCHOOL CODE OF
CONDUCT

(Policy and Guidelines on Protecting Children in


School from Abuse, Violence, Exploitation,
Discrimination, Bullying and other Form of Abuse)

REFFERAL AND ASSESMENT


In all cases involving abuse, violence, exploitation, discrimination,
bullying and other acts of abuse, the teacher adviser shall record it to the pupil’s anecdotal record. The CCP
Coordinator shall accomplish the intake sheet. The School Head may refer the victim and the offender to
the DSWD in cases involving child abuse, exploitation, discrimination, bullying or peer abuse and other
acts of abuse for the assessment and determining appropriate intervention.

The School head with the aid of the assigned Guidance teacher, CCP coordinator
and in coordination with the DSWD, shall immediately remove the victim or in appropriate cases the
offender, from place of the incident, if the victim is determined to be at risk. The child’s family shall be
informed of any action taken.

The School Head may also refer to the DSWD other pupils or learners who are
victims of abuse at home, children at risk, children in especially difficult circumstances, children with
special needs or at risk, children facing difficult situations or those who are exhibiting signs of aggressive
behavior, with a view to obtaining professional assessment, appropriate interventions and assistance from
competent service providers.
