Considering: a. that in order to reduce the generation of waste originating from plastic bag
waste and increase public awareness of the realization of a clean and
healthy environment, it is necessary to take comprehensive and
integrated strategic steps in efforts to prevent and handle the negative
impact of the use of shopping bags in the form of restrictions on the
use of shopping bags made from plastic bags. plastic and use of Eco-

the implementation of the provisions of Article 21 of Regional
Regulation Number 3 of 2013 concerning Waste Management, it is

to Use Environmentally Friendly Shopping Bags at Shopping Centers,
Supermarkets and People's Markets;

GENERAL REQUIREMENTS

article 1

In this Governor Regulation what is meant by:

1. Region is the Province of the Special Capital Region of Jakarta.

2. Regional Government is the Governor and Regional Apparatus as an


element of regional government administration.

3. Governor is the Head of the Province of the Special Capital Region of


Jakarta.

4. Regional Secretary is the Regional Secretary of the Special Capital Region of Jakarta.

15. Shopping Center is a certain area consisting of one or several


buildings erected vertically or horizontally, which are sold or rented to
Business Actors or managed by themselves to carry out goods trading
activities;

16. Supermarkets are shops with a self-service system that sell various
types of goods in retail in the form of: minimarkets, supermarkets,
department stores, hypermarkets or wholesalers in the form of
wholesalers.

17. People's Market is a market that is built and managed by the


Government, Regional Government, Private, State-Owned Enterprises
and Regional-Owned Enterprises including cooperation with the
private sector with business premises in the form of shops, kiosks,
booths and tents owned/managed by small traders. , medium, non-
governmental organizations or cooperatives with small- scale
businesses, small capital and with the process of buying and selling
merchandise through bargaining.

18. Minimarket is a store with a self-service system that retails various


types of consumer goods, especially food products and/or other
household products with a maximum floor area of 400 m2 (four
hundred square meters).

19. Supermarket is a self-service shop with a self-service system that


retails various types of consumer goods, especially food products and/
or other household products in the form of building materials, furniture
and electronics with a floor area of more than 400 m2 (four hundred
square meters). ) and a maximum of 5,000 m2 (five thousand square
meters).

20. Department Store is a self-service shop with a self-service system


that sells in retail various types of consumer goods, especially
clothing products and their accessories with arrangement based
on gender and/or age-level of consumers with a business floor of
more than 400 m2 (four hundred square meters) and maximum
5,000 m2 (five thousand square meters).

26. Disposable Plastic Shopping Bags are shopping bags with handrails

polyethylene, thermoplastic synthetic polymeric or other similar

27. Disposable Plastic Packaging Bags are transparent bags used as

thermoplastic synthetic polymeric or similar materials. Others are

28. Usage is the provision of Eco-Friendly Shopping Bags by the Manager


in every shopping transaction.

29. Food is anything that originates from biological sources of agricultural,


plantation, forestry, fishery, animal husbandry, water and water
products, both processed and unprocessed, which is designated as
food or drink for human consumption, including food additives, food
raw materials. and other materials used in the process of preparing,

CHAPTER II

PURPOSE, OBJECTIVES AND SCOPE

This Governor's Regulation is intended as a legal basis that regulates the


obligation to use Eco-Friendly Shopping Bags by Managers of Shopping
Centers, Supermarkets, and People's Markets.

Article 3

This Governor Regulation aims to provide legal certainty in implementing


the obligations of the Managers of Shopping Centers, Supermarkets and
People's Markets to use Eco-Friendly Shopping Bags.

Article 4

The scope of regulation in this Governor Regulation includes:

a. implementation of the obligation to Use Environmentally Friendly


Shopping Bags, and

b. fostering and supervising the provision of Shopping Bags


Environmentally friendly.

CHAPTER III

IMPLEMENTATION OF OBLIGATIONS FOR USE OF BAG


ENVIRONMENTALLY FRIENDLY SHOPPING

Part One
Use of Eco-Friendly Shopping Bags

Article 5

(1) Managers of Shopping Centers, Supermarkets, and People's


Markets are required to use Eco-friendly Shopping Bags.

(2) With respect to the obligations as referred to in paragraph (1), the


Managers of Shopping Centers, Supermarkets, and People's
Markets are prohibited from using Single-use Plastic Shopping
Bags .

The second part

Shopping Center Manager Responsibilities

Article 6

(1) Implementation of the obligation to use friendly shopping bags


The environment as referred to in Article 5 paragraph (1), is carried
out by the Shopping Center Manager through:

a. enforcement of obligations to all Business Actors conducting


business activities within the Shopping Centers they manage to
use Environmentally Friendly Shopping Bags;

b. the implementation of a ban on the use of single-use plastic


shopping bags in the shopping center it manages;

c. socialization and official notification to all Business Actors conducting


business activities within the Shopping Centers they manage on
the implementation and/or prohibition as referred to in letter a and
letter b;

d. socialization and education on the use of Eco- Friendly Shopping


Bags to Consumers in the Shopping Centers they manage through
audio, visual and/or audio-visual communication media;

e. supervision of the prohibition of the use of single-use plastic


shopping bags and the implementation of the use of environmentally
friendly shopping bags in the shopping center that they manage;
and

f. giving warning to Business Actors and/or Consumers who do not


heed the implementation of obligations and/ or prohibitions as
referred to in letters a and b.

(2) In the implementation of obligations and/or prohibitions as referred to


in paragraph (1) letters a and b, every business actor in Shopping
Centers has the obligation to:

a. does not provide Disposable Plastic Shopping Bags in


the place of business he manages;

b. providing free Eco-Friendly Shopping Bags near the cashier for


payment transactions;

c. implement procedures for socializing the use of Eco-Friendly


Shopping Bags to Consumers; and

d. implement socialization procedures for the negative impact of using


single-use plastic shopping bags.

Article 7

(1) Business Actors at Shopping Centers may provide Disposable Plastic


Packaging Bags.

(2) Provision of Disposable Plastic Packaging Bags as intended in


paragraph (1) can only be used to accommodate Food materials that
have not been wrapped in any packaging.

(3) In the event that alternative packaging bags that are more
environmentally friendly are available, the provision of Single-
use Plastic Packaging Bags as referred to in paragraph (1) is
discontinued.

Article 8

(1) In implementing the procedure for socializing the use of Eco-Friendly


Shopping Bags and/or the negative impact of the use of Single- use
Plastic Shopping Bags as referred to in Article 6 paragraph (2) letter

(2) The socialization procedure as referred to in paragraph (1) shall at


least include the following elements:

consumers regarding the negative impact of Single-use Plastic
Shopping Bags on the environment;

c. ask if consumers bring Eco- Friendly Shopping Bags;

d. offer incentives given if you bring your own Eco-Friendly Shopping


Bags; and

e. provide reasonable prices on the provided Eco-Friendly Shopping


Bags.

(3) In implementing the socialization procedure as referred to in


paragraph (1), the Business Actor may determine the method
of socialization according to creativity and market share
without reducing the elements as referred to in paragraph (2).

Part Three
Supermarket Manager Responsibilities

Article 9

(1) Implementation of the obligation to use Friendly Shopping Bags


The environment as referred to in Article 5 paragraph (1), is carried
out by the Supermarket Manager through:

a. enforcement of the use of Eco-Friendly Shopping Bags in the


business activities it manages;

b. provision of non-free Eco-Friendly Shopping Bags near the cashier


for payment transactions;

c. implement procedures for socializing the use of Eco-Friendly


Shopping Bags to Consumers;

d. implement procedures for socializing the negative impact of using


single- use plastic bags; and

e. provide incentives to consumers according to the policies of each


supermarket to encourage and reward consumers who bring their
own eco-friendly shopping bags.

(2) The supermarket manager as referred to in paragraph (1) includes a


supermarket that is independent and/or integrated with the people's
market, shopping center or other buildings/areas.

Article 10

(1) Supermarkets can provide Disposable Plastic Packaging Bags.

(2) Provision of Disposable Plastic Packaging Bags as intended in


paragraph (1), can only be used to accommodate Food materials that
have not been wrapped in any packaging.

(3) In the event that alternative packaging bags that are more
environmentally friendly are available, the provision of Single- use
Plastic Packaging Bags as referred to in paragraph (1) is discontinued.

Article 11

(1) Supermarkets must have and implement procedures for socializing


the use of Eco-Friendly Shopping Bags as referred to in Article 9
paragraph (1) letter c and letter d.

(2) The socialization procedure as referred to in paragraph (1) shall at


least include the following elements:

a. provide information in the form of audio, visual, or audio visual to


consumers related to the program of providing Environmentally
Friendly Shopping Bags that are carried out;

b. provide information in the form of audio, visual, or audio visual to


consumers regarding the negative impact of Single-use Plastic
Shopping Bags on the environment;

Article 12

(1) Implementation of the obligation to use Shopping Bags

business activities in the people's market environment which they
manage to use Eco- Friendly Shopping Bags;

b. prohibition of the use of single-use plastic shopping bags in the


people's market environment it manages;

c. socialization and official notification to all business actors conducting


business activities in the people's market environment which they
manage on the implementation and/or prohibition as referred to in
letters a and b;

d. socialization and education on the use of Eco- Friendly Shopping


Bags to consumers in the people's market environment they
manage,

e. supervision of the use of Eco- friendly Shopping Bags and the


prohibition of the use of Single-use Plastic Shopping Bags in the
people 's market environment it manages, and

f. giving warnings to business actors and/or consumers who do not


heed the enforcement of obligations and/ or prohibitions as
referred to in letters a and b.

(2) In the implementation of the obligations and/or prohibitions as referred


to in paragraph (1) letters a and b, every Business Actor in the
People's Market has the obligation to:

a. does not provide Disposable Plastic Shopping Bags in


the place of business he manages;

b. providing free Eco-Friendly Shopping Bags near the cashier for


payment transactions;

c. implement procedures for socializing the use of Eco-Friendly


Shopping Bags to Consumers; and

d. implement socialization procedures for the negative impact of using


single- use plastic shopping bags.

Article 13

(1) Business Actors in the People's Market may provide Disposable


Plastic Packaging Bags.

for socializing the use of Friendly Shopping Bags. Environment.

(2) The socialization procedure as referred to in paragraph (1) shall at


least include the following elements:

a. provide verbal information to consumers related to the program of


providing Eco-friendly Shopping Bags ;

b. provide verbal information to consumers regarding the negative


impact of single-use plastic shopping bags on the environment,
and

c. ask if consumers carry Eco- Friendly Shopping Bags.

(3) Business actors can determine the method of socialization according


to creativity and market share without reducing the elements as
referred to in paragraph (2).

Part Five
Community Rights

Article 15

(1) The public has the right to easily obtain a shopping container in the
form of an Eco-friendly Shopping Bag from the Management.

(2) The public has the right to bring their own Eco-Friendly Shopping Bags
and refuse to be given a Disposable Plastic Shopping Bag container
by Business Actors.

The public has the right to obtain information from the perpetrator (3)

Bags available and the price to be paid if you want to get Eco-Friendly

CHAPTER IV

GUIDANCE AND SUPERVISION

Article 16

(1) Regional Governments provide guidance to Managers, Business


Actors and Consumers in order to fulfill their obligations as regulated
in this Governor Regulation.

(2) The guidance as referred to in paragraph (1) is carried out continuously


to create a movement for the community to get used to bringing their
own Eco-Friendly Shopping Bags for shopping.

(3) The guidance as referred to in paragraph (1) is carried out


through :

a. coordination;

b. outreach and campaigns;

c. technical counseling and guidance;

d. supervision and consultation;

e. awarding the Manager and/or Business Actor; and/or

f. other coaching activities in the context of reducing plastic waste.

(4) The guidance as referred to in paragraph (1) is coordinated by the


Environmental Service and carried out by the Apparatus
Areas as follows:

a. Department of Communication, Information and Statistics;

b. KUKM and Trade Office;

c. Government tourism office,

d. Mayor; and

e. Regent.

Article 17

(1) Supervision of the implementation of the provision of Environmentally Friendly


Shopping Bags is carried out by the Regional Government.

(2) The supervision as referred to in paragraph (1) is carried out to


ensure that the Business Actor carries out the provision of
Environmentally Friendly Shopping Bags properly.

(3) In carrying out supervision, the KUKM and Trade Service and
Satpol PP, coordinated by the Environmental Service, carry out
field supervision and periodic monitoring of Business Actors.

(4) In carrying out the supervision, as referred to in paragraph (3), the


Environmental Service may involve elements of consumers and the
public.

Article 18

(1) Supervision by the Environmental Service is carried out by


consider :
a. results of field supervision and periodic monitoring; and

b. input/complaints from consumers and the public.

(2) The results of the supervision referred to are reported by the


Environmental Service to the Governor every 6 (six) months.

Article 19

(1) The Regional Government is authorized to carry out an inventory of


the use of Environmentally Friendly Shopping Bags by Business
Actors.

(2) The inventory as referred to in paragraph (1) is carried out to obtain


data and information regarding the use of Environmentally Friendly
Shopping Bags which may include:

a. types of shopping bags provided,

b. the size and material of the shopping bags provided;

c. the price and sale of the shopping bags provided; and

d. changes in the level of consumer demand for shopping bags


from time to time.

(3) In the event that the Regional Government conducts an inventory


as referred to in paragraphs (1) and (2), Business Actors are
obliged to facilitate the provision of data and information.

CHAPTER V

PROVISION OF REGIONAL FISCAL INCENTIVES

Article 20

(1) Managers of Shopping Centers, Supermarkets and People's


Markets who have implemented the obligations and procedures
for socializing the use of environmentally friendly shopping bags
as regulated in this Governor Regulation may obtain regional
fiscal incentives.

(2) Regional fiscal incentives as referred to in paragraph (1) are


given in the form of reduction and/or relief from regional taxes on
business activities carried out by Shopping Centers, Supermarkets
and/or People's Markets.

(3) Managers of Shopping Centers, Supermarkets and/or People's


Markets to obtain Regional fiscal incentives as referred to in
paragraph (1) must submit a letter of application to the Governor.

(4) Further provisions regarding the procedure for granting and the
amount of regional fiscal incentives as referred to in paragraph (1)
shall be regulated by a Governor Regulation.

CHAPTER VI

FINANCING

Article 21

The cost of guidance and supervision as referred to in Article 16 to Article


19 shall be charged to the Regional Revenue and Expenditure Budget
through the Budget Implementation Documents of each Regional
Apparatus.

CHAPTER VII

ADMINISTRATIVE SANCTIONS

Part One
Administrative Sanctions for Shopping Center Management,
Supermarket and People's Market

Article 22

(1) Managers of Shopping Centers, Supermarkets, and/or People's


Markets who do not carry out the obligations as referred to in Article
5 of this Governor Regulation may be subject to administrative
sanctions.

(2) The imposition of administrative sanctions as referred to in paragraph


(1) in the form of:

a. written warning;

b. forced money;

c. license suspension; and/or

d. license revocation.

(3) The administrative sanctions as referred to in paragraph (2) shall be


given based on the results of the supervision of the Environmental
Service .

(4) The administrative sanctions as referred to in paragraph (2) letter a


and letter b shall be imposed by the Environmental Service;

(5) The administrative sanction as referred to in paragraph (2) letter c


and letter d is given by the Office of Investment and One Stop
Integrated Services to the holder of the operational business
license of the Business Actor.

(6) In addition to the imposition of administrative sanctions as referred to


in paragraph (2), the perpetrators of violations can be announced in
media that can be accessed by the public.

Article 23

(1) The written warning as referred to in Article 22 paragraph (2)


letter a is carried out in stages, namely the first written warning
for 14 x 24 (fourteen times twenty four) hours, and if it is not
heeded then a second written warning is given for 7 x 24 (seven
times twenty four) hours, and if it is not heeded then a third
written warning is given for 3 x 24 (three times twenty four) hours.

(2) If the Manager has complied with the written warning as referred to
in paragraph (2), then the Manager is released from the obligation to
pay forced money.

(3) Managers who fail to heed the third written warning letter within 3 x
24 (three times twenty four) hours after the third written warning is
issued, will be subject to forced money.

Article 24

(1) The manager as referred to in Article 23 paragraph (3) shall be


imposed with an administrative sanction in the form of forced money
of a minimum of Rp.5,000,000 (five million rupiah) and a maximum
of Rp.25,000,000 (twenty-five million rupiah).

(2) Forced money in the amount of IDR 5,000,000 (five million rupiahs)
must be paid within 1 (one) week since the Manager receives the
notification of the imposition of administrative sanctions for forced
money.

(3) For delays in payment of administrative sanctions for forced money


for more than 7 (seven) days, forced money in the amount of Rp.
10,000,000 (ten million rupiahs) shall be imposed.

(4) For delays in payment of administrative sanctions for forced money


for more than 14 (fourteen) days, forced money in the amount of Rp.
15,000,000 (fifteen million rupiahs) shall be imposed.

(5) For delays in payment of administrative sanctions for forced money


for more than 21 (twenty one) days, forced money in the amount of
Rp. 20,000,000 (twenty million rupiahs) shall be imposed.

(6) For delays in payment of administrative sanctions for forced money


for more than 30 (thirty) days, forced money in the amount of Rp.
25,000,000 (twenty five million rupiahs) shall be imposed.

Article 25

(1) The administrative sanction of forced money as referred to in Article


23 shall be imposed by the Environmental Service .

(2) Payment of forced money by the Manager is deposited through


Bank DKI.

Article 26

(1) If the Manager has complied with the forced payment as referred to in
Article 24, the Manager shall be exempted from administrative sanction
of permit suspension.

(2) Fulfillment of forced payment does not relieve the Manager from the
obligation to provide Eco-Friendly Shopping Bags.

Article 27

(1) In the event that the manager has been given an administrative sanction
of forced money but does not implement it within 5 (five) weeks, it will be
subject to an administrative sanction in the form of permit suspension as
referred to in paragraph (1). Article 22 paragraph (2) letter c.

(2) The administrative sanction in the form of permit suspension as referred


to in paragraph (1) is given by the Head of the Office of Investment and
One Stop Integrated Services based on the recommendation from the
Environmental Service regarding the sanction of forced money not being
implemented.

(3) The administrative sanction in the form of permit suspension is reported


to the Governor with a copy submitted to the Environmental Service.

(4) In the event that the Manager has complied with the forced payment as
referred to in Article 26, the Manager shall be issued an exemption from
administrative sanctions in the form of permit suspension.

Article 28

(1) In the event that the Manager has been given an administrative sanction
of suspension of the permit but still does not fulfill the forced payment, it
shall be subject to an administrative sanction in the form of revocation of
the permit as referred to in Article 22 paragraph (2) letter d.

(2) The application of administrative sanctions in the form of revocation of


licenses shall be granted by the Head of the Office of Investment and
One Stop Integrated Services based on the approval of the Governor on
the proposal of the Environmental Service.

Article 29

(1) Business actors of Shopping Centers, Supermarkets and Markets

This Governor Regulation comes into force 6 (six) months from the date
of promulgation.
