Introduction and Rules for the Maintenance Service Contract

Introduction
This maintenance service contract lists all possible repairs. It also lists the responsibilities for all the elements,
indicating the responsible person/party for each element. Below is a list explaining the symbols used.

Rules for the Maintenance Service Contract

General
Participants in the Maintenance Service Contract are (Prateek Negi), tenants of property, De Veldmaat 10-635, 7522
NM Enschede, studio 10-635, which is managed by Camelot Property Management and who have agreed with the
following rules in writing.

Article 1. Object of the agreement


1.1
The object of the Maintenance Service Contract is to offer an extra service by the free provision of work resulting from
a number of the most common activities from the Maintenance ABC, which, according to the law and the General
Rental Conditions, are for the account of the tenant: the so-called Regulation on Small Repairs (Besluit Kleine
Herstellingen).

1.2
In general, this Regulation on Small Repairs states that:
Small repairs are for the account of the tenant, major repairs and major maintenance work are for the account of the
landlord. You are responsible for the repair of damage caused by yourself.

1.3
Through this Maintenance Service Contract, a part of the small repairs falling under the Regulation, which are
normally for the account and risk of the tenant are taken over by the landlord/property manager, for a fixed
subscription fee. For all repairs that are not covered by the Service Contract, Article 7 of the Terms and Conditions in
the rental agreement continues to apply.

Article 2. Cover
2.1
The activities covered by this Maintenance Service Contract is listed in the Annex. This Annex is an integral part of
this Regulation.
2.2
The work is only carried out on parts of the property that were present at the time that the tenant moved in or which
were added at a later date by Camelot Vastgoedbeheer en Beveiliging BV
2.3
The costs covered by the Maintenance Service Contract are all costs (both wage as materials) incurred in order to
repair the parts or replace them by/using standard material.

Article 3. Excluded repairs


3.1
Excluded from the Service Contract is the execution of the necessary work or repairs of malfunctions and defects that
are a result of acts or omissions on the part of the tenant or other users/residents of the property, and which are
caused by intent, negligence or gross negligence. Deliberate destruction of and damage to property, incompetence
and inappropriate use are not covered by the Service Contract. Discolouration of materials is also not a reason to
invoke the Service Contract. This means, amongst others, that participants have to take relevant measures in the
winter to prevent freezing of water pipes and central heating pipes.
3.2
Also excluded are repairs and/or replacements of items which have been added by the participant and/or that are
owned by the municipality.
3.3
Not covered by the Service Contract are all types of maintenance not listed in the Annex, which, on the basis of the
general rental conditions of Camelot Vastgoedbeheer en Beveiliging BV remain for the account of the tenant.
3.4
Maintenance that is for the account of the landlord is not covered by the scope of the Maintenance Service Contract.
This maintenance is carried out by Camelot Vastgoedbeheer en Beveiliging BV.

Article 4. Request and implementation


4.1
The work will be carried out after receiving a request from the tenant, within 15 working days at the latest and during
regular working hours. This depends on the delivery of materials.
4.2
The starting point for the work to be carried out is the original part or the original condition. Replacement will only take
place if this is technically necessary in the opinion of Camelot Vastgoedbeheer en Beveiliging BV.
4.3
The landlord expects the tenant (or someone representing the tenant) to be at home while repairs are carried out. The
landlord will take the initiative to make the appointment to carry out the repairs and set the time of the appointment. If
the tenant (or a person representing the tenant) is not present at the agreed time, Camelot Vastgoedbeheer en
Beveiliging BV can charge call-out costs for the next appointment. The tenant must ensure that the place of the repair
is easily accessible.

Article 5. Calculation and payment of the monthly contribution and Suspension
5.1
The participant will be charged a monthly contribution, which is determined for each financial year by Camelot
Vastgoedbeheer en Beveiliging BV. Price level 2016: € 8,95 including VAT (21%).
5.2
The tenant pays a start-up fee of € 2,50 including VAT (21%). The said amount is payable in advance before the first
day of the following month.
5.3
The payment obligation of the monthly contribution starts in the calendar month following the registration date. The
participant is obliged to pay the monthly contribution for the Maintenance Service Contract in advance, at the same
time as the monthly rent. The monthly contribution is a part of the non-deductible supplementary costs.
5.4
Non-payment of the monthly contribution results in the suspension of the participation in the Maintenance Service
Contract, without notice of default being required. The obligation of the participant to payment of the arrears and to
further payment of the monthly contribution is not affected. The suspension takes effect on the first day of the time
period for which the monthly contribution is due. The participant cannot request repairs or replacement of broken parts
which have occurred in the time period during which his participation was suspended.

Article 6. Commencement Maintenance Service Contract


6.1
Registration for the Service Contract shall be affected by filling in the Annex in the rental contract, in which the tenant
signs for agreement with the provisions of this Regulation.
6.2
New tenants can take part in the Maintenance Service Contract simultaneously with the commencement of the lease
of the property.
6.3
The Maintenance contract can commence on each working day. This depends on the date of registration.

Article 7. Duration and termination
7.1
The Maintenance Service Contract will commence on 30/04/2021 and is for the duration of the rental contract.
7.2
The Maintenance Service Contract also ends on the day that the lease is terminated by the tenant or the landlord.
7.3
Termination is also possible within one month following the announcement of a change in the monthly contribution.
7.4
Termination of the Service Contract as referred to in Article 7.3 should be done in writing to Camelot Vastgoedbeheer
en Beveiliging BV or to the tenant, respectively.
