City Counselor City of St. Louis Law Department 1200 Market St., Room 314 St. Louis, MO 63103-2864 Re: Your August 19, 2022 Letter Regarding Vehicle Thefts Dear Ms. Hamilton: ‘Thank you for your letter dated August 19, 2022 regarding the rise in thefts of Hyundai vehicles in the St. Louis area, We share your concerns about these illegal activities and the impact they have on your community. Accordingly, we write to provide you with Hyundai's response to the issues raised in your letter. First, we must respectfully disagree with your contention that any defect or failure on our part is responsible for these thefts and the wider pattern of criminal activity involving these vehicle thefts.” As you are likely aware, all of our vehicles meet and exceed the requirements of applicable Federal Motor Vehicle Safety Standards (“FMVSS”), including FMVSS 114, which ‘was specifically directed to the likelihood of a vehicle being stolen or accidentally set in motion. While criminals may be targeting certain vehicle types that lack engine immobilizers, Hyundai has since made immobilizers standard equipment for all of our vehicles. More fundamentally, rather than a vehicle issue, these thefts are unfortunately being caused by criminal acts popularized through social media. Accordingly, there is no basis for a claim of public nuisance against Hyundai, Moreover, contrary to the assertions in your letter, Hyundai has taken action to assist our customers and local governments most affected by these thefts. In St. Louis and elsewhere, we have provided steering wheel locks free of charge to local law enforcement so that these may be distributed to concemed customers. In the St. Louis area, for example, we have provided free steering wheel locks to the St. Louis Metropolitan Police Department, the North County Police Cooperative, and the University City Police Department. We plan to continue our collaboration with these agencies, all of whom have expressed their appreciation for our efforts. Sheena Hamilton, Esq. Re: Hyundai Vehicle Thefts September 8, 2022 Page 2 Additionally, we continue to monitor social media and take action to remove those posts that illustrate the manner in which these criminal acts are occurring. Hyundai has also identified a Firstech/Compustar security kit that targets the method of entry thieves are using to access these vehicles. Beginning October 1, 2022, this security kit will be available for purchase and installation at Hyundai dealerships and Compustar authorized installers across the country. We continue to explore other options to support our customers and local governments concemed about these thefts, To that end, we welcome the opportunity to have a productive discussion with your office about other practical measures that can be taken to curb this criminal activity.
