MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This MEMORANDUM OF AGREEMENT is made and entered by and between:

The MALABUAN HIGH SCHOOL, with school address at Brgy. Malabuan, Makillala, Cotabato,
herein presented by MR. ROLANDO G. VALE II, Principal I, hereinafter referred to as the “FIRST
PARTY”;
-AND-

MARIANO R. CABILDO, of legal age, Filipino, married, and with residential address at Brgy.
Malabuan, Makilala, Cotabato, hereinafter referred to as the “SECOND PARTY”;
WITNESSETH:
1. That the First Party is in need of the services of the Second Party who shall perform functions
which are not part of the Job description of the existing regular personnel of the First Party;

2. That the Second Party has signified her intention to which the First Party has accepted to provide
the services needed by the latter;

3. That the Second Party hereby possesses the qualification, experience and competence required
to perform the job as described therein;

4. That the Second Party has not been previously dismissed from the government service by reason
of an administrative offense;
5. That in view hereof, the Second Party is hereby contracted as WATCHMAN (Day Shift) at
MALABUAN HIGH SCHOOL from JANUARY 01, 2022 to DECEMBER 31, 2022 in
consideration that the First Party will pay TWO THOUSAND PESOS ONLY (2,000.00) per month
to be charged against the MOOE Funds;
6. That as WATCHMAN (Day Shift), the Second Party is expected to perform the following
functions:

a. Take care of all properties of the school;

b. Render a whole day service from 6:00 AM to 6:00PM;
c. Render services in accordance with the DepEd rules and guidelines and the Government
laws;

7. That the Second Party shall perform work at a time and schedule to be agreed upon by both
parties;

8. That it is understood that the services of the Second Party are not covered by Civil Service laws
and rules, thus, not creditable as government service. The Second Party is not entitled to the
benefits enjoyed by government employees, such as leave, PERA, ACA, and bonuses;

9. That the First Party shall not be held liable as third person or employer/agency to any liability of
the Second Party that may be incurred during the performance of her duties and responsibilities
as WATCHMAN (Day Shift);

10. That this contract shall begin immediately after the signing of both parties and shall expire on
December 31, 2022.

11. That this contract may be terminated, revoked, and/or annulled only upon expiration of the
aforementioned period or upon mutual agreement of the parties. However, prior to the termination

 of this contract, the Second Party may be allowed to voluntarily resign from service based on
valid ground but can only be effective after serving a thirty (30) day notice to the First Party. Any
violation on this effect, the Second Party shall be held liable for damages and other administrative
penalties.

IN WITNESS WHEREOF, both parties have hereunto set their hands this 29 th day of December, 2021
at Malabuan, Makilala, Cotabato, Philippines.
