SECOND ADDENDUM AWARD

under the Party Wall etc. Act 1996,

to be served to the Appointing

Owners, under Section 10(14)

WHEREAS 123 Bayswater Road Limited, Bayswater Road (122) Limited and Alderton Park Limited of

47 Esplanade, St Helier Jersey, JE1 0PD, c/o Mishcon de Reya Solicitors, 12 Red Lion Square, London

WC1R 4QD (hereinafter referred to as the 'Building Owner') owner of the premises known as 4 & 4a

Queensway, Bayswater, London W2 3RX, 122 Bayswater Road, London W2 3JH, Land on the west side

of 123 Bayswater Road, London W2 3JH and Black Lion Public House, 123 Bayswater Road W2 3JH did

on the 24th day of April Two Thousand and Eighteen serve upon Q Park Limited of 72 Merrion Street,

Leeds LS2 8LW (hereinafter referred to as the 'Adjoining Owner') an owner within the meaning of the

Act of the adjoining premises known as Basement Car Park and vents, 6 to 28 Queensway and Consort

House, London W2 3RX notice of their intention to exercise the rights given to them under the Party

Wall etc Act 1996, Section 2 (2) (b) (c) (e) (f) (g) (h) (k) and (n) by executing the works as more

particularly defined in the Notices and the original Award dated 29th May Two Thousand and Eighteen

and the Addendum Award dated 29th May Two Thousand and Nineteen.

AND WHEREAS a dispute has arisen, within the meaning of the Act.

AND WHEREAS the Building Owner has appointed Christopher Skelt FRICS of Point 2 Surveyors

Limited, 17 Slingsby Place, London WC2E 9AB to act as their Surveyor and the Adjoining Owner has

appointed Tim Land MRICS of Avison Young, 65 Gresham Street, London, EC2V 7NQ to act as their

Surveyor.

AND WHEREAS the Appointed Surveyors did make and publish the Demolition Award dated 29th May

Two Thousand and Eighteen and the Addendum Award dated 29th May Two Thousand and Nineteen

under the provisions of the said Act and reserved the right to enter into further Awards as necessary.

NOW WE, the Appointed Surveyors, the said premises having been inspected, DO HEREBY AWARD

AND DETERMINE as follows:-

1. THAT the Demolition Award dated 29th May Two Thousand and Eighteen and the Addendum

Award dated 29th May Two Thousand and Nineteen shall remain in full force and effect and

that this Addendum Award shall be subject to all the conditions of the said Awards.

2. THAT immediately upon receiving this signed Addendum Award and notwithstanding the

Owner’s rights of appeal in accordance with section 10(17) of the Act the Building Owner shall:

- Instruct a site engineer inspect the reinforcements condition of the steel bars and

ensure they are in a suitable condition. Any damaged bars will be replaced or

straightened. A Mcgee site engineer and AKT Resident engineer will inspect

reinforcement and sign off.

- Ensure all existing concrete faces are cleaned prior to being in contact with a wire

brush. A Xypex slurry coat will then be coated on existing surfaces that will come in

contact with the new surface.

- Install a water bar to the external face of the wall and install framework in accordance

with the document attached.

- Place new concrete. Once cured the framework will be removed. The areas will be

painted to match existing once the concrete has died sufficiently. Concrete must be

dry to ensure the paint does not spall.

- Ensure all working areas are cleaned and any materials that are associated with the

remedial works are removed from the car park.

3. THAT the two signed copies of the Award shall be delivered immediately to the Appointing

Owners by their respective Surveyors.

4. THAT this Award shall be null and void if the permitted works do not commence within twelve

months from the date of this Award.

5. THAT the Building Owner shall, on the signing of this Addendum Award, pay the Adjoining

Owner’s Surveyors reasonable fee in connection with time spent agreeing and publishing this

Award.

6. THAT the Surveyors reserve the right to make and issue any further Award or Awards that

may be necessary. In the event of their being unable to agree, such dispute shall be

determined as provided in the said Act.
