COMMUNICATIONS SYSTEMS IN THE GOVERNMENT AND THE PRIVATE SECTOR, CREATING
FOR THIS PURPOSE A NATIONAL PRIVACY COMMISSION, AND FOR OTHER PURPOSES

The case is between Juan dela Cruz versus Pedro Ramos and Anna Cruz. This case
started when Juan dela Cruz which is the customer who filed and paid for a copy of his birth
certificate. He claims that Anna Cruz, the personnel did not handle all the certificates of the
customers. He noted that the certificates are accessible to any of the other personnel of the mall.
In addition to this, upon claiming Juan dela Cruz’s birth certificate he asked for an envelope for
the privacy of his birth certificate but then Anna Cruz told him that there are no envelopes
provided. She clearly stated that PSA did not gave them envelopes for the birth certificates. With
this incident Juan dela Cruz brought the issue to the department in charge’s attention, Pedro, the
one in charge told him that there are no envelopes provided to clients to all customer service
counters but still he provided Juan dela Cruz’s birth certificate with an envelope. In line with
this, Juan dela Cruz continue to state that there is a violation of his privacy rights.

Furthermore, upon Pedro providing an envelope to Juan dela Cruz, Juan started taking
photos and videos of Anna Cruz and Pedro. He also stated that the persons handling the
documents are unfair and not capable of handling the said documents. Hence, Pedro claimed that
there is no violation of informational privacy rights or any other violation of the Data Privacy
Act.

The main issue of this case is whether Pedro and Anna or Juan committed any violation
of the Data Privacy Act, and whether the security measures implemented by the mall are
considered reasonable and appropriate.

In line with this, Pedro and Anna did not commit any violation of the Data Privacy Act
because it is not their fault that PSA did not provide any envelope on each client. As stated in the
case the documents are in one envelope prior to the request of the clients that are to be release in
a day. Meanwhile, taking photos and videos of someone without consent is a violation of a
privacy act. Even though Juan will use these photos and videos for evidence or proof, the
envelopes for the documents are not really their fault. In addition, there should not be a problem
anymore because Pedro provided him for an envelope to satisfy his needs.
As per the security measures implemented by the mall, the documents and other
certificates should be hidden and not be seen by everyone who goes to the counter. This is the
only issue that they should settle but even though Pedro stated that the physical arrangement of
furniture and equipment of the counters provide privacy to the personnel, the personnel should
be careful on handling these confidential documents.

Juan also stated that the mall and the personnel is bound to follow the rules of PSA and
the Data Privacy Act.

In conclusion to this, there are no privacy act that is violated hence, each and everyone of them is
bound to follow the rules.
