TO ALL PROVINCIAL GOVERNORS, CITY MAYORS, MUNICIPAL


MAYORS, DILG REGIONAL DIRECTORS, THE ARMM
REGIONAL GOVERNOR, AND ALL OTHERS CONCERNED

SUBJECT IMPLEMENTA nON OF REPUBLIC ACT NO. 9523 (DSWD


CERTIFICATION TO DECLARE A CHILD LEGALLY AVAILABLE
FOR ADOPTION)

Republic Act No. 9523, otherwise known as, "An Act Requiring a Certification
from the Department of Social Welfare and Development to Declare a Child Legally
Available for Adoption," provides that:

Sec. 4. Procedure for the Filing of the Petition. - The


petition shall be filed at the regional office of the DSWD where the
child was found or abandoned.

The Regional Director shall examine the petition and its


supporting documents, if sufficient in form and substance and shall
authorize the posting of the notice of petition in conspicuous place
for five (5) consecutive days in the locality where the child was
found. xxx

Section 10 of the Rules and Regulations Implementing R.A. No.


9523, states that:

Posting of Petition - The Regional Director shall order the


immediate posting of a notice of petition found to be sufficient in
form and substance.

The notice of the petition with a picture of the child shall be


posted for at least five (5) consecutive days in conspicuous places
such as but not limited to provincial capitol, city/municipal hall
covering the locality where the child was found. Certificate of
posting to ensure compliance of the same. xxx

In view thereof, and in order for the DSWD to facilitate the issuance of Certification
to Declare Children as Legally Available for Adoption, within the timeline prescribed under
RA No. 9523, all Local Chief Executives and their respective Heads of Local Social Welfare
Development Offices are hereby enjoined to:

1. Facilitate the immediate posting of the NOTICE OF PETITION


within five (5) consecutive days upon receipt of the latter from the
DSWD- Field Offices, and

2. Thereafter, facilitate and expedite the issuance of the corresponding


CERTIFICATE OF POSTING immediately after the 5-day posting
period.

Likewise, all DILG Regional Directors and the ARMM Regional Governor are
directed to cause the widest dissemination of this Memorandum Circular to all local
government units within their regional jurisdictions.
