Sub: Appointment for Third party Inspector

Dear, Baidhnath,

A. With reference tour discussion, we are pleased to appoint you as a Third party Inspector
Engineer.
B. Your appointment will be on contract basis. The Management reserves the right to terminate
anytime without prior information.
C. Your starting date 23 Sept 2022 .Your basic salary compensation will be 40000/- per Month no
deduction. Basic client provide local Transportations. You should be available at site as per
client requirement, as and when required. Your represent IRCLASS on behalf of Akshar.

The appointment is subject to following terms and conditions:

1. Your place of posting will, at present is at hallol Gujarat.

2. You are liable to travel as required by the Akshar Consultancy (there in after called company)
from time to time.
3. Your resume & documents given by you will be deemed as correct and no change will be
permitted at any time.
4. You will be at your own taxes that shall be deducted from your salary and or other dues.(Income
tax Return)
5. During the tenure of service you will keep all information coming to you as an employee of
the organization as strictly confidential and other matters relating to the company will not
be divulged by you any other person other than those of the management.
6. It is agreed that any dispute of what so ever nature between you and the management will
referred to arbitration as per the provisions of Conciliation & Arbitration Act and decision
of the arbitrator shall be final and binding upon the parties.
7. Continuation of your service is subject to your being found and remaining medically
(Physically and mentally) fit.

8. You shall disclose any relationship you may have with the organization, which is subjected
to audit before undertaking the inspection.
9. You shall maintain the confidentiality of information and shall not reveal any information in
part or full about the inspection activities and about the organization where your services are
utilizes without prior permission of the organization.
10. You shall not accept any gift or any other form of inducement from any of the
representatives of the organization.

 11. You shall not act in any way prejudicial to the reputation, intent or credibility of
organization.
12. YOU SHALL CONTINUALLY strive for improvement of proficiency, effectiveness and
quality of services rendered.
13. You shall inform us in advance if you provide such services to any other organizations for
our information.
14. In the event of any non-co-operation of the organization during the audits, you shall
Bring to notice the details to our office, consult them before undertaking any decision.

15. For the services rendered, you shall be paid Fee which is in force reserves the right to revise
the Fees for any reasons and under such conditions you shall be informed in advance of the
same.
16. Personal attributes expected are: ethical, open minded, diplomatic, Observant, Perceptive,
Versatile, Tenacious, Decisive and self-reliant.

ACTIVITIES TO BE PERFORMED

Participate in the QC works in line with requirements (as a member of team), where
informed by client.
To ensure that the rules concerning its safety and security procedures are known and
respected.
Plan and carry out assigned responsibilities given by the Project
Manager/Authorized representative.

SAFETY, HEALTH AND SECURITY:

You shall at all the times conduct all operations under this agreement in a manner to avoid
risk of endangerment to health, bodily harm & damage to property. You will carry out the
activities indicated in this contract as an independent entity, own risk management and
use of own capital / resources. Safety PPE’s will be provide you by client in the plant. You here in
undertake to have accident insurance cover at your own expenses and for civil liability
deriving, by the virtue of the law or the contract, while on services on behalf of Akshar
Consultancy or our nominated client.

PUBLICITY AND ADVERTISEMENTS:

You shall not make any announcement, take any photographs or release any information
concerning this agreement, or the audit work, or any part thereof to any member of public,
press and business entity, any official body unless prior written consents obtained from
Akshar Consultancy.

INDEMNITY:

You hereby shall release and shall indemnify, defend and hold harmless Akshar Consultancy
and their subsidiaries and affiliates and the officers, agents, employees, successors and assigns
and authorized representatives of all the foregoing from and against any and all suits, actions,
legal or administrative proceedings, damages, liabilities,
Interest, attorney’s fees costs, expenses and losses of whatsoever kind or nature in
connection with or incidental to the performance of this agreement, whether arising before or
after completion of the audit work hereunder in any manner directly or indirectly caused,
occasioned or contributed to in whole or inpart,by reason of any act or omission for which the

 you are legally liable.
The foregoing shall include, but not limited to indemnity for:
a. Property damage and injury to or death of any person, including employees of client
/vendor.

b. The breach by you of any representation, covenant, of performance obligation, of this

contract.

You aforesaid release, indemnify and hold harmless obligations, or portions or applications
thereof, shall apply even in the event of the fault or negligence, whether active or passive, or
strict liability of the parties released, indemnified or held
harmlesstothefullestextentpermittedbylaw,butinnoeventshalltheyapplytoliability caused by the
willful misconduct or sole negligence of the party released, indemnified or held harmless.
SuchindemnityshallbesubjecttomitigationbyAksharConsultancyoftheirlossandthe
provisionofreasonablenoticetoyoubeforeconcludingandsettlementwithathirdparty.

Applicable Law & Jurisdiction

This agreement shall be subject to the law of their public of India & any disputes arising out of
this contract of employment would be subject to the jurisdiction of the courts in Surendranagar
–363001Gujarat.

Termination of Contract
Either Party may terminate this Service Agreement by giving the other Fifteen (15) days prior
written notice of its intention to do so.
Akshar Consultancy can terminate this service agreement without any notice on grounds of
violation of code of ethics & any clause violated this service agreement.
