CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This agreement made and executed by and between:

_________________________________, Filipino, of legal age, married and residing at


No.20 Road 7, Pag-asa, Quezon City, hereinafter referred to as LESSOR.

-and-

_________________________________, Filipino, of legal age, married and residing at


_________________________________, hereinafter referred to as LESSEE.

WITNESSETH:

WHEREAS, the LESSOR is one of the owners of the building to be used by therein
LESSEE as a commercial space for their Lechon Manok and Liempo business situated
at Poblacion, _________________________________ and that the latter agreed under the
following terms and conditions, to wit:

1. EFFECTIVITY: This contract of lease shall be for a period of one (1) year
counted from September 20, 2022 and until September 20, 2023 and is
renewable at the option of the LESSOR. If the LESSEE desires to renew this
lease, the latter shall say so in writing at least two (2) months before the end of
this contract.

2. RENTALS: The LESSEE’S monthly obligation shall be five thousand pesos (Php
5,000.00). The same shall be due and payable within the first ten (10) days of
every month without necessity of demand and any increase concerning rental
fees shall be done so upon renewal, if there is any. There shall be no charges for
Value Added Tax (VAT).

3. ADVANCE DEPOSIT: The LESSEE shall pay an advance rent deposit of five
thousand pesos (Php 5,000.00) upon the signing of this contract. This non-
interest bearing shall serve as guaranty for liquidated damages, arrearages and
cost of repairs chargeable to the LESSEE and may not be applied as rent during
the occupancy of the leased premises.

4. PAYMENT OF ELECTRICITY AND WATER BILLS: The LESSEE will pay


electricity and water bill subject to a submeter to be properly installed by the
LESSEE. Payment thereon shall be pursued in accordance to the arrangement
decided by the LESSEE and any third person/s (e.g. Boarder). In case of non-
payment by any third person, the LESSEE may shoulder the electric and/or
water bill in general but subject to a deduction of the LESSEE’S rental fees for
the current month or the succeeding month is such rental fee has already been
paid.

5. LESSEE’S ADHERENCE TO RULES AND PROCEDURES: The LESSEE hereby


agrees to adhere to any and all rules, guidelines and procedures to be imposed
or implemented by the LESSOR in the conduct of its activities within the Leased
Premises and the whole complex in general;
6. LESSOR’S RESPONSIBILITIES: The LESSOR shall be responsible for the
integrity and serviceability of the structure, subject of this lease but whose
upkeep and maintenance shall be for the account of the LESSEE. Refund of the
expenses shall be given by the LESSOR for extraordinary and necessary repairs
brought by fortuitous events provided that the same be attributable to the
negligence of the LESSOR and that the same be beyond the control of the
LESSEE.

7. LESSOR’S DISCLAIMER OF UNPAID FEES BY CO-LESSEES OCCUPYING


THE LEASED PREMISES: The LESSEE shall NOT be responsible for the non-
payment of third person/s of their rental fees.

8. ALTERATIONS, ADDITIONS, IMPROVEMENTS, ETC. The LESSEE may not


introduce additions to and/or install improvements upon the Leased Premises
without the prior consent of the LESSOR, which consent shall not be
unreasonably withheld. Such additions to and/or improvements shall be
exclusively at the expense and for the account of the LESSEE.

9. The LESSEE shall comply with the other conditions of the lease such as the
following:

a) The LESSEE shall at her own expense, maintain the leased premises in a
clean and sanitized condition, free from noxious substances, fumes and
odors and other nuisances. The LESSEE undertakes not to damage or
deface the Leased Premises.

b) The LESSEE shall not engage in any illegal or criminal activity within the
leased premises;

c) The installation of additional electric, water, telephone and cable facilities in


the Leased Premises shall be for the account of the LESSIE;

10.RIGHT OF FIRST REFUSAL. The LESSOR is obligated to inform first and


foremost the LESSEE should there be any proposal to buy the subject property
where the Leased Premises is located to give the LESSEE the option of
purchasing the property instead or waiving the right of first refusal and allowing
another sale to go through. The sale may be brought by the LESSEE at anytime
within the one-year contract period.

11.TERMINATION OF LEASE: The LESSEE agrees to return and surrender the


Leased Premises at the expiration of this contract in as good condition as
originally found at the beginning of the lease except for reasonable wear and
tear arising from normal use, and without any delay whatsoever, devoid of all
occupant’s furniture, articles and effects of any kind.

12.IN CASE OF BREACH OF THIS LEASE AGREEMENT: In case of breach by the


LESSEE of any of the terms of this contract, the LESSOR has the right to eject
the LESSEE from the premises and to collect and recover from him all
arrearages and damages, if there are any.

NOW THEREFORE, for and in consideration of the foregoing terms and conditions
and of the consideration, due and payable, as herein provided, the parties herein have
agreed, as they do hereby agree, commit and bind themselves to comply strictly and
faithfully with all the terms and conditions of this contract of lease.
