Discrimination Against LGBT Students in the Philippines


The incidents described in this report illustrate the vital importance of expanding and enforcing
protections for LGBT youth in schools. Despite prohibitions on bullying, for example, students across
the Philippines described patterns of bullying and mistreatment that went unchecked by school staff.
Carlos M., a 19-year-old gay student from Olongapo City, said: “When I was in high school, they’d
push me, punch me. When I’d get out of school, they’d follow me [and] push me, call me ‘gay,’
‘faggot,’ things like that.” While verbal bullying appeared to be the most prevalent problem that LGBT
students faced, physical bullying and sexualized harassment were also worryingly common—and
while students were most often the culprits, teachers ignored or participated in bullying as well.

1,700 Cases of Bullying Reported


MANILA, Philippines
The Department of Education (DepEd) documented more than 1,700
cases of child abuse and bullying in school year 2013-2014 after Republic
Act 10627, the Anti-Bullying Act, was passed last year. However, the
DepEd said 60 percent of these cases have already been resolved.

SM CITY Olongapo Downtown has joined the Special Job Fair for Senior Citizens, Persons
with Disabilities and Indigenous People in support to Public Employment Service
Office’s(PESO) “Kasama Ka Kaibigan” project, an exclusive job fair to provide employment
opportunities for PWD’s in accordance with RA 10524 (An Act Expanding the positions
reserved for PWDs, amending for the purpose Republic Act 7277, For Senior Citizens per
Section 5 of RA 9257 or the Expanded Senior Citizens Act of 2003 and for Indigenous People
in Pursuant to Section 80 of Republic Act No. 8371, otherwise known as “The Indigenous
Peoples’ Rights Act of 1997” (IPRA).

The expanded scope of reserved positions for PWDs

This provision is more than just a statement of policy. It has been cited as legal basis for
the decision in the Supreme Court case of Bernardo, et al. v. NLRC and Far East Bank and
Trust Company (July 12, 1999). In the case, the Supreme Court ruled that the Magna Carta
for Disabled Persons accords qualified PWDs the same rights, terms and conditions as
those of qualified able-bodied persons. Stated otherwise, in cases where the PWD
employee is qualified for the position that he/she holds, he/she should be accorded the
same rights, terms and conditions without distinction. Thus, it was decided that the
existence of a special accommodation or arrangement in the hiring of PWDs does not
absolve the employer of the consequences of such hiring.

Promoting equality of opportunity for – and inclusion of – people with disabilities is
central to social and economic development, emergence from the global financial and
economic crisis and achievement of the Millennium Development Goals. Despite

barriers to full participation in social, economic, political and cultural life. Of an
estimated 650 million people with disabilities, 470 million are of working age.

Status of Implementation of the DepEd Child Protection Policy


in Castillejos National High School
In 2012, the Department of Education through then Secretary Armin Luistro released
Department Order No. 40, Series of 2012 otherwise known as the Department’s Child
Protection Policy (CPP). It prescribes a zero tolerance for any act of child abuse, exploitation,
violence, discrimination, bullying and other forms of abuse. Seven years after the isuance of
the DepEd’s Child Protection Policy, this study focuses the spotlight on the status of its
implementation particularly in Castillejos National High School, Schools Division Office-
Zambales.
