INTRODUCTION

Criminal investigation is not just a set of task skills, it is equally


a set of thinking skills. To become an effective investigator, these
skills need to be consciously understood and developed to the point
where they are deliberately engaged to work through the problem-
solving process that is criminal investigation. Trained thinking and
response can be difficult to adapt into our personal repertoires
because we are all conditioned to be much less formal and less
evidence driven in our everyday thinking.

Obviously, it is not possible for someone to remain in a constant


state of vigilance where they are always critically assessing, docu-
menting, and determining the validity of every piece of information
they encounter. However, when on duty, it is frequently necessary for
a police investigator to do this. For a police investigator, this needs
to be a conscious process of being mentally engaged and “switched
on” to a more vigilant level of information collection, assessment,
and validation while on duty. Still, as human beings, we are all born
investigators of sorts.

According to the Philippine National Police Headquarters, it is


imperative that the DIDM lay out plans to address the areas that
need immediate attention. One of the areas that needs immediate
attention is the lack of competent and effective field investigators
who possess the skills and the right attitude to work on a case and
pursue it until the case is resolved by the courts. As a result, the
DIDM advises that the Criminal Investigation Course (CIC) be
converted into a sis-week course focusing primarily on basic
investigation. Course cover specific techniques in conducting
preliminary investigation.

The critical responsibilities that a police investigator face in


carrying out their duties necessitates that they learn to think and
respond in a structured and accountable manner.
HISTORY OF MALUNGON

There are three schools of thought about the origin of the word
Malungon. One says that “Malngan“ means end of tribal dispute or
feud and the event was too significant that the by-word became the
name of the place.

The second school of thought says that “Malngan” is referred to


a tree with curly form of leaves which were abundant and endemic in
the area, an identity which carried the name of the place. The third
school of thought says that “Malngan” is about the circuitous
curvature or wave-like pattern of the large river traversing the area.

Whichever is the true origin of the word “Malngan” it surely


accounts for the rich socio-cultural dynamics that captures the
thoughts, ideals and the way of life of original dwellers of the area.
Long before the waves of migrants and settlers came in 1930,
“Malngan” was occupied by Indigenous Peoples (IP) clustered and
organized according to their Tribal affiliation such as Blaan,
Kalagans, Tagakaolos and some Muslim tribal groups.

Their traditional leadership and governance anchored in clan


and/or tribal affiliation is susceptible to discontentment and the
disagreement within the clamour even among the tribes. More often
the resentment escalates to feuds or even into “Pangayaw” (clan/
tribal wars) that may end-up in generations of distrust.

This challenge did not escape the keen eyes of a Migrant from
Panay (one of the islands of Visayas, Philippines) named Guillermo
Constantino, Sr. He took turns to patch up the gaps and iron-out dis-
putes among clans and tribes for peaceful and harmonious
co-existence as clan, tribe and leaders through a “Kasfala” (a tradi-
tional consultative forum to voice out concerns).

In 1961, thru the able representation of Hon. Felipe K.


Constantino (Guillermo’s eldest son and who was then a municipal
councilor of the Municipality of Rajah Buayan, now General Santos
City), and had gained the support of the able Congressman James
Lee Chiongbian who with his enthusiasm sponsored the passage of
Republic Act No.5522. Thus on June 21, 1969 Malungon with its 16
Barangays finally became a full pledge Municipality of the Province
of South Cotabato. (namely: Poblacion, Ampon, Malandag, Tamban,
Upper Mainit, Lower Mainit, San Roque, Upper Lumabat, Malalag
Cogon, Banate, Upper Biangan, Malungon Gamay, San Miguel,
Kawayan, San Juan, and Talus). The last nine barangays mentioned
were formerly under the municipality of Malalag, Sta. Maria and
Malita all of Davao del Sur. These barangays were ceded to the
Municipality of Malungon, South Cotabato in a Supreme Court
decision dated August 5, 1981. Since then, several barangays more
were created.

With the creation of the province of Sarangani taken out of


South Cotabato on May 11, 1992 under R.A. 7228, Malungon is one
of the seven towns comprising the Province of Sarangani and is the
largest in terms of land area and total population. It is classified as
first class municipality according to the Department of Finance
based on income classification. Owing to its favorable location
between the two major-highly urbanized cities, General Santos City
and Davao City, Malungon is steadily moving towards socio-
economic progress and development.

GEOGRAPHICAL LOCATION

kilometers away from General
Santos City and 43 kilometers
from Alabel, the seat of the
provincial government. On its
northern, north-eastern and eastern sides is the Province of Davao
del Sur; and on its south lies the Municipality of Alabel and the City
of General Santos; on the south-western side is the Municipality of
Polomolok; and on the western border is the Municipality of Tupi,
both are part of the Province of South Cotabato.

CLIMATE/RAINFALL

Based from Corona Classification of Philippine Climate, the


Municipality of Malungon belongs to the Type IV climatic
classification. The municipality is characterized by rainfall that is
evenly distributed throughout the year.

DEMOGRAPHIC PROFILE

The total population of Malungon in 2020 was 105,456 or an


increase of about 1.80% from the population census five years ago
in 2015 at 103, 604.
LAND AREA
The municipality of Malungon has a total land area of
89,662.920 hectares based on the official DENR Land Classification
and the Bureau of Soil and Management Resources. Barangay
Tamban has the biggest slice of the total land area which is more or
less 18,434.7959 hectares while Barangay Malalag Cogon has the
smallest land area of 633.0198 hectares.

All 31 barangays are accessible to vehicles except barangays


San Juan, Upper Lumabat and Panamin which can hardly be
reached especially during rainy season.

The municipality is categorized as First Class in terms of


income classification based on the town’s Internal Revenue
Allocation (IRA) from the national government.

The 74% of the total populace occupied the rural areas while
the remaining 26% live in the urban areas.

ECONOMIC PROFILE

Malungon's economy is largely based on agriculture with a high


level production of dried coconut meat. Other agricultural products
are maize, sugarcane, bananas, pineapples, mangoes, pork, eggs,
beef, and fish. The economy has accelerated in the past decade
driven by advances in global communication technology and the
finishing of a modern highway that tremendously improved trade and
transport.

it has an adjacent weaving room and Blaan School of Living
Traditions which preserves the exquisite tabih weaving tradition,
considered as the crown jewel of Sarangani’s cultural resources.

As of December 2021, the station has a total strength of 66


(5 Detailed to PHQ and 2 Schooling) and an actual strength of 59
PNP personnel composed of three (3) PCO’s, fifty two (52) PNCO’s
and four (4) NUP’s covering 31 barangays consist of mountainous
rolling, slippery and rugged terrain, serving 105, 465 inhabitants.
The police to population ratio is One (1) Policeman for every 1,918
inhabitants (1: 1,918).

As of December 2021, Malungon MPS has fifteen (15) person-
nel assigned in investigation section. However, Based on Memoran-
dum Circular Number 2005-010: “Standardized Functional Set-up
and Organizational Structure for PNP Investigation and Detective
Management Unit”, Class A Municipal Police Stations are mandated
to designate five (5) PCOs and forty five (45) PNCOs in their respec-
tive investigation section.

Malungon Municipal Police Station being a Class A MPS did not


meet the said DIDM requirement due to lack of personnel in their
station.

Above-named personnel has formal training in investigation,


however, due to shortage of manpower, they were assigned to
different section so as not to affect the workflow of the station.
NEW GENERATION INVESTIGATION SOLUTION

In the world of policing, there are only two (2) basic functions:
crime prevention and crime solution. To further realize the im-
portance of investigation in solving crimes and its crucial role in the
overall anti-criminality campaign, a strategy shift to modern and
effective investigation has been anchored.

The New Generation Investigation Solution (NGIS) is an


advance technology initiated by the Directorate for Investigation and
Detection Management (DIDM) of the Philippine National Police
(PNP) which is composed of six (6) IT SOLUTIONS, which are the
Case Management and Analysis System (CMAS), Case Information
and Database Management System (CIDMS), Quantum Geograph-
ical Information System (QGIS), e-Rouge Gallery System and
e-Warrant System, and Crime Information, Reporting and Analysis
System (CIRAS).

CMAS is made to help investigators in the management and


analysis of investigative data. Meanwhile, CIDMS is used to monitor
cases primarily about the cases on "Task Force (TF) USIG." NPCS
aims to address the problem of stagnation of cold cases, especially
those who aren't served warrants of arrest. e-Rouge Gallery and
e-Warrant Arrest System are both electronics database which can
easily access the picture and warrant of arrest of someone who has
committed a crime. CIRAS, known as e-blotter before, will now serve
as an effective scientific management tool and prescription of police
intervention.
CRIME INFORMATION, REPORTING AND
ANALYSIS SYSTEM (CIRAS)
A stand-alone customized single database which was launched
on September 6, 2011 to serve as a more efficient electronic blotter
system across the country. It shall be installed into the existing desk-
top of the police units/stations utilized to enter blotter/incident reports
directly to the system. Incident Record Forms (IRF) is system gener-
ated thru the CIRS (PNP MC 2014-009).

In May 2015, a web-based CIRS has been developed and has


been pilot tested in NCRPO in June 2015. PNP Memorandum dated
May 15, 2015 Renaming CIRS to e-Blotter System and was further
developed to include Crime Analysis. The system is now known as
CIRAS.

The data uploaded into the CIRAS may be accessed and


retrieved by end users as long as they are registered into the system
which is only available to PNP personnel who are duly authorized
and endorsed by their head of office/unit.

Based on the data shown above, MALUNGON MPS has a total


of 37 crime incidents for the 4th quarter of calendar year 2020
which consists of 34 recorded cases classified under Peace and
Order Indicator (POI) and 3 cases under Public Safety Indicator
(PSI).

Out of 37 crime incidents, there were 32 solved cases, 37


cleared and 5 unsolved cases. Generally, these figure depicts a
huge accomplishment of the police station since they have only
minimal unsolved cases compared to the volume of crime incident
recorded

It is therefore recommended that a deeper investigation be


conducted to work out with the status of the unsolved cases.
Relentless conduct of preventive measures such as checkpoints,
police visibility , mobile and foot patrol to deter, prevent untoward
incident and to lessen the existence of crime in the AOR.

MALUNGON MPS has a total of 42 crime incidents for the 4th


quarter of calendar year 2021 which consists of 23 recorded cases
classified under Peace and Order Indicator (POI) and 19 cases
under Public Safety Indicator (PSI).

Out of 42 crime incidents, there were 31 solved cases, 41


cleared, 11 unsolved cases, and 1 is still under investigation. As
shown, the clearance efficiency of the station is high, however, the
table still shows the upturn of crime in the area especially traffic
incidents which increased by 533.33% compared to the previous
year’s 4th quarter .

It is therefore recommended that the police station in


coordination with the LGU must strictly implement local ordinances
related to traffic rules and regulation and further educate traffic
violators in the AOR . Further, it is also recommended to place/
install additional warning signs and safety precautions on the
national road covered by the municipality
E-WARRANT SYSTEM

The e-Warrant System is a system where all warrants of arrest


will be electronically documented so that they can be accessed
through computers. The e-Warrant eliminates the hassle bugging
snail mail system of delivering a warrant to a particular police sta-
tion. The warrants accessed by the police through the system will
facilitate the apprehension of a criminal because a warrant can be
printed out from the system and be served.

Malungon MPS has received a total of 428 warrants by mail and


court processed server, 514 was served, and 31 unserved in the
year 2016-2021. Moreover, it is observed that in the year 2018-
2021, there are more number of warrants served than they received
because some of the warrants that were issued in the earlier years
was served only during the said period.

station is the one designated to update the system.
E-ROUGE SYSTEM

E-Rouge is an electronic database of


pictures, photographs and facial composites
of criminals and suspects that can be easily
searched, viewed and retrieved for ready
identification by the Complainant. The
e-Rogue is a web base online database for
the hot mug shots and other related data
regarding arrested persons and wanted
persons with pictures.

A total of 827 arrests were made by Malungon MPS from CY


2016 to CY 2021. All case folders of those who are arrested were
encoded in the e-Rouge Gallery System, 579 of which was encoded
within 24 hours.

NUP Teresita N Alinsasaguin being the crime registrar of the


station is the one designated to update/maintain the e-Rouge Gal-
lery System.
CASE INFORMATION DATABASE
MANAGEMENT SYSTEM (CIDMS)
CIDMS is a case management system specifically designed for
Investigators in managing case files/folders

What do we need to encode in CIDMS?

Content of the entire case folder. All cases investigated, either


cleared, solved or unsolved. Either it has been referred in the
prosecutor’s office or not and either filed in a court of law or not.

A total of 1, 809 cases occurred in the Municipality of Malungon


in the year 2016 to 2021 and a total of 1, 716 case folders were
encoded on the said perios.
In the year 2016, no case folder was encoded because the
system was launched only in the regional headquarter during this
period. In 2017, CIDMS was employed in the lower units, however,
due to unstable status of the system, only 3 case folder was
encoded.
In 2019 to 2021, more number of case folders were encoded
compared to the number of cases occurred because they were
backtracking data. During these times, the case folders of previous
year’s cases were encoded into the system.
PSMS Rico A Jaleco, being the Investigation PNCO, is the main
in-charge of the system.

A total of 58 Drug Operations were conducted by the personnel/


operatives of Malungon MPS. 57 of which was referred to
prosecutor and filed in court. 1 was convicted beyond reasonable
doubt. 35 was convicted through Plea Bargaining. 22 is still on trial.

The Directorate for Investigation and Detection Management is-


sued a directive that only Police Stations with National Police Clear-
ance System can issue police clearance. In this regard, Malungon
MPS is no longer authorized to issue local police clearance starting
this year.

They can only issue if the NPCS will be employed in their office
or if they have been given permission/authority by the DIDM.
