Congress of the United States Washington, BE 20515 October 11, 2022 ‘The Honorable Merrick Garland Attomey General of the United States United States Department of Justice 950 Penngihania Ave. NW ‘Washington, DC 20530 We write with distinct concem in regard to an ongoing situation pertaining to the potential illegal delivery, receipt, and publication of private identities for financial donors of a registered 501 (c)(4) organization named Stand For America, Inc (SFA). As tax retum information for 501 (¢)(4) nonprofit organizations are confidential and are protected under federal law, the disclosure of this information by the New York Atomey General’s Office (NYAGO) violated 26 US.C § 6104(d)(3)(A), which requires the office to maintain the confidentiality of said organization’s donors disclosed on Form 990 Schedule B. As release of these records creates a dangerous precedent for the politcal weaponization of NYAGO, the US Department of Justice (DOJ) must investigate the malicious delivery of SFA donor information by NYAGO to an outside politically aligned organization to protect the safety and privacy of all nonprofit donor organizations registered in New York. As reported by Politico’s Alex Isenstadt on August 26, 2022 a politcal watchdog organization called Documented “obtained an unredacted copy of Stand For America’s 2019 filings, which itthen shared with Politico. The group did not share the original source of the filing, but it bears a stamp from the charity office of the New York State Attorney General.”: It is imperative that the DOJ evaluate and ascertain whether protections extended to organizations such as SEA were violated with political motivation to mitigate potential erosions of the rights to free speech afforded under the First Amendment. Furthermore, according to Title 26 US.C. §7213(a)(2) willful disclosure of a 501 (c)(4) organization's Form 990 Schedule B to any unauthorized persons is considered a felonious offense punishable by fine, imprisonment, or a combination of the penalties. As the NYAGO would be normally tasked with the investigation of such a matter and the office's potential involvement in this troubling situation, the DOJ must conduct an immediave investigation to avoid any impartiality and ensure equal justice is afforded to SFA. and any other nonprofit organization that may be impacted by similar matters in the future.
