Services:
a) OAKS would assist and guide you towards filing the visa for the respective country.
b) A checklist of documents would be provided keeping in view the requirement of
respective Embassy/High Commission etc.
c) A case officer would be appointed for processing the documentation part that would
assist you with preparing a file.
d) After filing the Visa, you would be provided regular updates about the status of your
application.
e) Whilst OAKS endeavor to offer the best possible advice; immigration laws, policies &
fees are subject to frequent change without notice and no responsibility is accepted
for any errors in the guidance and information provided, typographic or otherwise.
f) OAKS cannot make any guarantees in context of approval or validity of any visa
application made by you or by OAKS on your behalf. The power to grant or refuse
visa applications vests solely with the respective immigration authorities only.
g) OAKS will just assist you in a limited manner for filing application for immigration
and will not provide taxation, business, accounting, investment or other
professional advice or services. OAKS advises clients to seek separate independent
professional advice regarding these matters.
h) For Canada application: IRCC considers only CSIC as direct/authorized agent. OAKS
therefore would not represent as any agent/consultancy to Canada. We only assists
individuals in file preparation and provide professional guidance for visa filing.

Our fee does NOT include other costs which are part of the migration process such as
government lodging fees, medical and police checks, translation of documents, and IELTS
examination fee. We bill you as part of the consultation services provided, in lieu of any
unforeseen complexities which may arise due to your personal circumstances, OAKS would
charge the client extra to accommodate the ensuing professional services. At the time of
registration INR XXXXXX of the total fee will be collected and once the client receives a JOB
offer (AIPP) additional INR XXXXXX should be deposited, the remaining INR XXXXX should
be paid once the client receives ITA. A separate fee schedule will be mailed to the client at
the time of registration.
6. Refund Policy: OAKS policies are best aimed to get the approval of visa. But in an
unlikely situation of the visa rejection, the below refund would be provided.
The refund will be made within 60 working days. Client will enclose a copy of the letter of
rejection from the Authority to support the Refund Claim. If client does not enclose a copy
of the rejection letter or rejection stamp on the client's passport, OAKS will not refund
applicable refund amount. Client will also enclose with the Service Agreement Copy, a copy
of his receipt for payment made to NEC. Failure to enclose this will also make the client
ineligible for the refund.
Clause 2: OAKS will provide NO refund if the visa is rejected for any of the following
reasons:
a) Failure of medicals by the client or his or her family members included in the
application
b) Failure to provide a genuine Police Clearance Certificate of all the family members,
which is not less than 3 months old
c) Failure to prove sufficient funds for settlement by the client or his or her family
members included in the application
d) Submission of fraudulent documents.
e) Prior violation of any immigration or Local laws by the client or any of his or her
family members included in the application
f) Late submission of any additional documents requested by the consulate at a later
stage.
Clause 3: OAKS will provide NO refund for any of the following reasons:
a) If you sign up the service & change your mind later and decide to withdraw.
b) 100% non-refundable if you do not wish to continue with our services.
c) 100% non-refundable if you fail to submit the required documents within 20
days of signup.
d) if a visa interview is requested by the Skills Assessment, Immigration or Visa
Authority and the candidate fails to attend
e) If the client fails to get the required score in IELTS to meet the eligibility criteria
and as advised by the NEC.
f) If the client abandons his/her case within 3 months from the date of registration.
(No communication with your consultant for a period of 3 months shall also be
deemed to be abandonment)
g) No Refund in case of Withdrawal/Conversion/Transfer
h) Client understands and accepts that no refund will be given if the client
withdraws / abandons his/her application or decides to drop out, due to any
reason, during the proceedings after he or she signs-up
i) Client also understands and accepts that no refund or adjustment of OAKS fee
will be done in the event he or she abandons the original service / process he or
she has
a) In the event that the immigration law changes any time after you have signed the
agreement OR anytime during the processing of your application & due to this
change of law, you have become ineligible to apply for the service you have signed
up for, and you have paid the ENTIRE amount; OAKS will refund 25% of the fee paid
by the client as specified in the agreement. The refund will be made within 60
working days after the client submits his Service Agreement, a copy of his receipt for
payment made to NEC. Failure to enclose this will also make the client ineligible for
the refund.
b) In the event that you have signed up for OAKS service under the INSTALMENT
PAYMENT OPTION or MADE A PART PAYMENT and the immigration law changes
any time after you have signed this agreement OR anytime during the processing of
your application & due to this change of law, you are now ineligible to apply for the
service you have signed up for. In this case client will not be entitled to a refund of
any fees previously paid under the first installment or any other part payment to
NEC.
Note: For all AIPP registrations, 70% will be returned to the client from the initial
registration fee in case the application is unsuccessful in the first stage itself. Once the Job
offer is released there are no refunds given, as the application from that stage purely depends
on the authenticity of the client’s documents.
7. Complaints
a) In case the user has any complaint (s) regarding our services or processes then
he/she can approach me. Complaints are handled by a team dedicated to resolve the
queries and issues of clients. This team makes sure to handle complaints in best
possible manner and provide solutions which may result in a positive outcome.
b) Only genuine complaints are dealt by our team. Complaints which are not genuine
and are result of client's own negligence, misunderstanding or fault will not be
entertained by NEC. Such in genuine complaints can be rejection of visa which can
be due to delayed submission of documents by the client, absence of client on an
interview date at immigration offices resulting in visa rejection etc. In such cases,
OAKS will not be responsible and complaints relating to these will not be adhered
to.
c) OAKS has Compliance Team which looks into the refund cases. And Client agrees
that under no circumstance would take help of media, websites (consumer court,
Social media etc) to tarnish the reputation of the company and create issue
in/outside office.

8. Pending Fee:
Client agrees to pay the balance fee of OAKS within the due date mentioned in the fee
schedule. Failure to do so, would invite additional charges/termination of services, which
ever NEC’s team would deem appropriate.
Governing Law
The agreement Terms shall be governed by the laws of India. The Courts of India shall have
exclusive jurisdiction to settle any disputes (including claims of set-off and counterclaims)
in consultation with this Agreement.
