BACKGROUND OF THE CASE

The agricultural property, described above, was covered under the

Comprehensive Agrarian Reform Program (CARP) through Voluntary Land
Transfer/Direct Payment Scheme (VLT/DPS). Collective Certificate Land Ownership
Award (CLOA) was issued to the following Agrarian Reform Beneficiaries (ARBs):
Vicenta T. Sulatan and Edwina S. Briges

Upon ground validation of the landholding, it was found that ARB Vicenta T.
Sulatan is now a deceased person on January 4, 2017. ARB Vicenta T. Sulatan LOT 1
allocation with 2.5429 hectares is currently being tilled by JOEL SULATAN MATA, her
grandson, and now referred to as the actual occupant. While co-owner ARB Edwina S.
Briges is no longer the actual tiller of LOT 2 with an area of 1. 2376 hectares. Her
allocated area is presently cultivated by ALDEN SULATAN QUIŃA, her nephew, who is
now referred to as the actual occupant. There are no existing issues and concerns on
the subject landholding. The area of 3.7805 hectares is fully developed and is presently
planted with pineapples.

FINDINGS

Based on the validation of the FVT it was found that:

1. ARB Vicenta T. Sulatan is now a deceased person on January 4, 2017;

2. ARB Vicenta T. Sulatan LOT 1 allocation with 2.5429 hectares is currently being
tilled by JOEL SULATAN MAATA, her grandson, and now referred to as the
actual occupant;
3. Co-owner ARB Edwina S. Briges is no longer the actual tiller of LOT 2 with an
area of 1. 2376 hectares;
4. The area of ARB Edwina S. Briges is presently cultivated by ALDEN SULATAN
QUIŃA, her nephew, who is now referred to as the actual occupant;
5. There are no existing issues and concerns on the subject landholding; and

 6. The area of 3.7805 hectares is fully developed and is presently planted with
pineapples.
7. The current actual occupants JOEL SULATAN MAATA and ALDEN SULATAN
QUIŃA prayed to be replaced in the CCLOA and be given an individual title.
8. ARB Edwina S. Briges likewise prayed to be disqualified in the CCLOA as she is
longer the actual tiller of LOT 2 (1.2376 hectares) of the subject landholding. Her
voluntary waiver of right as an ARB is attached herewith (Sec. 22 of R.A. 6657).

RECOMMENDATION

1. The FVT recommends that the said landholding be in the process of substitutions
and disqualification through the basic eligibility criteria of farmers/tillers to qualify
as CARP beneficiaries as provided for in the DAR Administrative Order (AO) No.
7 series of 2011, Sec.22 of R.A. 6657, Sec. 27 and 73 of R.A. 6657. As there are
no existing issues and concerns among the present ARB and the actual
occupants and tillers of the land, the procedures for substitutions/disqualification
of ARBs are further discussed in detail in the Resettlement Policy Framework
(RPF) attached to the ESMF.
